"Pause here to let our listeners know they're tuned into of consuming interest. You're listening to of consuming interest. I'm surely worker. My guest is Tom's Gordon. He's the executive director of responsive law, which is a Tom himself is a lawyer. He is a out there fighting for consumers rights in terms of giving access to the legal system and making it more affordable. Tom moving forward here we've been just talking about that ticked case, which I find fascinating. Do you think that there are ways that they may find to get around this ruling in Florida? I know that the Florida bar association is very restrictive. They don't want a bunch of retired lawyers coming down their practicing as well. And so they are pretty tight, aren't they? And they've been the ones that have brought legal cases against the paralegals, et cetera and so on. Can you put it in perspective for us? Sure. Florida has consistently over the years been one of the most aggressive in going after competitors to the traditional bar. So as you mentioned, they've the Florida bar is sued paralegals for engaging in what they considered unauthorized practice. They have as we've seen in the tick case, they've gone after a company that used lawyers to help people but consider they thought that was unauthorized practice of law. So it is certainly a problem in Florida and in other states as well. What was interesting in the tick case, one of the many things that's interesting is the opinion of the court mentioned several times that they did not think that ticked was harming anybody. And in fact, they thought that, as a matter of policy, and as a matter of improving access to the legal system, tick was probably on balance, providing a good service for people, but they said, it just wasn't their job to, as the court to make that decision about policy. Interestingly, though, the guess who makes the policy about who can practice law in Florida? Yeah, I wonder if it has anything to do with the bar association. It's actually the Florida Supreme Court is the ultimate policy maker. With the bar station having a big role in that process. But basically they said, oh, we're the Florida Supreme Court. We're not we're here to decide this case. You can't make a policy change here. That's the job of somebody else. For that, you need to see the Florida Supreme Court. So step down to the next window and we'll help you in a bit of circular thinking there. Right. There's a lot of circular thinking in a lot of excessive bureaucracy. So what's likely to happen if there were to be a situation where the Florida Supreme Court were to change its mind on this as a policy matter and change the rules that they felt they had to uphold in this case, they would have to go back to a process where the Florida bar is formally excuse me formally involved at every stage and then would have to have mandatory input from the Florida bar as members of committees that we consider this if it's somehow made it to the Florida Supreme Court. A couple of years down the road, you could potentially see a rule change through that process. But I wouldn't hold my breath waiting for that to happen. Well, now have other states have there been any other kinds of apps developed in addition to ticked that might come under scrutiny of the courts of the bar association? There are other apps out there and not just in traffic, but in other areas as well and other companies that are providing a either referrals to lawyers or a matching service that will find you a lawyer or providing service through software that doesn't provide legal advice but will help people complete forms. And so any of those companies could potentially continue to face this aggressive UPL prosecution in Florida. So ticked will have to will not be able to permit Florida users from using its app. But right now, users and other states will be able to continue using it unless those states move against it. Would that be a clear? Well, it would be except that ticked sadly because in part, this defense can be expensive and ticked actually pivoted to provide different business services, ultimately, and got out of the ticket fighting business. Oh, okay. But similar, similar apps and similar companies providing services and other states aren't directly affected by this and can continue their work. And it might continue depending on how they think the ruling might affect them. Right. Right. Interesting times, Tom, very interesting things going on out there. Especially with the innovation of technology and accessibility making things so accessible through your computer. It's very interesting. What were some of the things that came out of your research summit that you would like to just share with our listeners? Sure. Well, there's a lot of things. We bring together occasionally we bring together some policy experts from around the country to talk about these issues and how we can better get help for consumers and change the rules so that consumers can have better access to legal help. One of the things that we're looking at right now, there's a couple states that have changed their laws around, change the regulations around the business models that are allowable for legal services. So not just whether it can be used legal services provided by a lawyer or by, say, paralegal, who provide services directly to consumers, but also issues around the ownership of law firms. So for example, in most states, you're not allowed to as a lawyer you're not allowed to work for a company providing legal services unless that company is entirely owned by lawyers. So there's a reason if, for instance, if you want tax out, you can go to H and R block, which is a national company and get tax advice from a company that's not owned entirely by accountants. But there's no equivalent for lawyers because lawyers aren't allowed to work for a company like H and R block to provide services for the public. So Costco or a Walmart or Microsoft or an Amazon. None of those companies can provide legal services even through lawyers. What's happened though recently is both Utah and Arizona have changed that rule. Arizona has changed the rule entirely to allow licensure of companies that are not entirely owned by lawyers. And Utah's doing it's called a regulatory sandbox, where they're collecting data on some carefully controlled examples of this that they're letting practice with these types of business models. And so that's been a cause for optimism for us. And we're seeing other states such as California are exploring this as well, and we're hopeful that if a larger state like California can make this work, that will set an example for the rest of the country. Well, you know, there are bright spots, at least to Tom. And it's so good that we got you here to help us to share some of that. I do know that you all have been fighting to fight for a long time. Where do you see some of the areas that I mentioned small claims court earlier? Well, while I don't want to go into a very deep discussion on it, has there been any changes in small claims court? That's supposed to be the people's court. But unfortunately, it doesn't meet the needs of an awful lot of people anymore. No, and the small claims dollar limits are very low. So you can't very effectively bring a lot of everyday cases in small claims court in a lot of states. Those limits hover around 5 or $10,000 and people could easily have legal issues amounting to 15 or $20,000 for any number of things. If they're, you know, if they're a small business and they're dealing with a contractor, if they're dealing with home repair and have an issue with somebody doing that or if they're buying a car and have an issue with a lemon, they're going to have issues that would be beyond the scope beyond the financial amount for a small claims court case. We've been talking basically real estate all morning, but we let the insurance guy you know, made them feel good game a little during the bone. He probably paid himself for that anyway. So Tom McCoy was was this earlier from Triple A insurance. And we had a good conversation. And now we're taking calls and talking real estate. You ready to go back to work? We could make small talk, but let's just go back to work. Let's get to work. Let's just do it. George is in Cumming, Georgia on the home fix it show. Hey, Dave. Hey, George. Uh, yeah, I got a about some four lots of, uh, Them down the edge of the ocean anyway as a canal lots That's what he told me. The guy's H and Anna, the broker. It was his personal property. I was looking at some property and he said Well, you don't seem to find anything that you're looking forward said I've got some lots You don't sell. You didn't really trying to sell them, but You know, I know you a little bit, so I looked at him. I said, yeah, they like like, pretty good. Yes. You know about 300 ft on the canal. So this is some pretty valuable property. So anyway, I bought it. And I've cut it myself for a couple of years and got tired of it, so hired a guy that was cutting next door. I saw him cutting and got his number and he's been cutting it. But anyway Uh, When when everyone's awhile, it'll You know it doesn't rain here and be raining there. But he said, Well, I can't cut it is underwater. I said Wait, and I said, Well, how much he said. Well, at least half you know about 34. So your properties underwater. I can't cut it. I said, Well, You know this can, he said. That's not a canal. Really. That's a river. And, uh, it runs into the ocean. It's not Regular normal canal like you're thinking. And when it rains a lot. It floods. It's underwater. So I talked to the city inspector guy and he said, Well, you could you could build some houses up real high. And I could let you build three. Not for work on one lot is you got his own buildable. But he said you'd have to build them, huh? And way back in the back where it's got a little bras. And It does. I don't know if I ever got any recourse of Yeah. I mean, my first thought was you need to talk to a real estate attorney in that state and figure out you know what happened there. It sounds like maybe this broker um you know, maybe didn't disclose some things. And and as a real estate agent broker, Um you know their license law. Um, and then there's just straight up, you know, potential, and, you know, obviously, I don't know all the details, but it could be misrepresentation or fraud. So more of like a civil Matter, But I would absolutely talk with the real estate attorney if he represented that as a canal and you have some paper trail around that you might have some recourse there. So this is definitely an issue for an attorney. So do I have to disclose my property floods on occasion to I have to tell you that when absolutely any material adverse, you know, uh, anything that would impact the home's value so You know, the seller does not have to necessarily disclose things that are open and obvious. Um, but as a real estate agent, we actually have a higher duty to disclose you put those two things together. I always tell us seller better to over disclosed and under disclose we actually had a situation once in Druid Hills, where, um, the home would flood whenever it rained. Um they had taken all the appropriate actions, but it was earth and floor basement and water would get in there and part of portions of the driver would be underwater. Our seller disclosed mean wrote a two page document to disclose all this the day before closing, Of course, it rains. Floods Buyer tries to get out of the contract and get their earnest money back. But because the seller disclosed everything didn't matter how scary it looks. He disclosed it so the seller retain the earnest money in that situation. So it's just that idea that as the seller you're better just disclosing everything. And and and you know, you're you're going to have less concerned down the line. If something does go wrong at the home by properly disclosing. Is there a defense where he would say Well, you bought it. You didn't come and look at it. That's not on me. You should have come and look at it. So every every state has different rules around this. Um and so I can't speak to Florida and Georgia. It is a buyer Beware states so the buyer is responsible for doing any and all inspections and and checking. You know anything that affects the property, whether it's on the property or external Really? So that is on the buyer. But the seller still has to disclose things right? It's not like a blanket forgiveness, like Hey, you figure everything out. So, um, you know if you're buying a piece of property in another state, you know you still need to do all the right things. Disclosure. Excuse me due diligence. You need to go out to walk the property on a land purchase. Get a survey. You might even have somebody from the county come out to check and confirm. It's buildable before you acquire it. Those are all the things that should have been done in this process. Um, it does sound like this agent and broker, you know, may have been trying to pull a fast one. You know? You seem like I wasn't even trying to sell it that Yeah, that seems a little salesman Need to me on that line alone? Yeah. When I heard that I was like probably talked to in the tournament. Hell if I got a bridge in Brooklyn? Yeah, that's right. Uh, so, George, you need to go down there and find uh, what you call a real estate real estate attorney and you want to find a real estate attorney because they're sort of like real estate, closing attorneys, and sometimes they cross over. But you need to find a litigator. Somebody with litigation experience in real estate, and you can do that here, you know, just just look for referrals. The Bar association is a great place to start. So he called the Florida Bar Association explain what happened and they can help you with some referrals for that area. Surely there was a lawyer involved. In this somewhere signing something you wouldn't want to use him. You want to get fresh. I would get my own representation. Yeah. If that broker refer that attorney right then there could be. I bought my house a year and a half ago. And according to like Zillow, and all these other website It's saying my house is worth like $90,000 more. Is there going to be like Is that another like bubble situation where it's going to Market's going to crash again because that kind of happened back in Florida for me back in 2000 and seven My house was worth like 450,000. And then all of a sudden the bubble burst and People were short selling in my neighborhood for 2 25..

They're just enjoying a beautiful Wednesday out on the ocean, and they hear a little noise, and it turns out that under a tarp was a raccoon that had stowed away, now the raccoon is cute as hell, but raccoons will mess you up. So the guys keep their distance, one of them pulls out a cell phone and starts filming and they really just yell at the raccoon and kinda spooky. They didn't touch it. They didn't poke it with a stick. They didn't hurt it, but the raccoons up jumping overboard because they frightened it, and now there has been a legal complaint may to the Florida bar association because lawyers are supposed to uphold a higher code of conduct in the average citizen, which includes not being cruel to animals. So is it cruel to scare a raccoon off of your boat? Twenty miles out to sea. The lawyers have the perfect Florida lawyer defense. They say. They look until you can come up with the body for the record. You can't even prove that the raccoon is dead. Or is even harmed for all, you know, he swam twenty miles back to shore and is alive and healthy and going through people's trash right now. You know what case closed? Well, first of all I have to say you didn't press too much unless the whole because he's a bigot or racist. My question to you as a member of the Florida bar association. Could you please explain this while thousands of people out there aren't need legal authority. The file. Lawsuit against somebody malpractice lawsuits, we're only these guys these lawyers only wanted to change cases. Explain that this change what? Sorry. Amount practice lawsuits in the state of Florida. There are attorneys that practiced just in practice areas. Sure. There are. What are your purchases call up and asking you could be founded that none of them want to deal with? Hey, let's know to be honest about it that nuts. It's one of those things that as an attorney. I it's like being it's like working as a police officer in the internal affairs. Right. Yeah. Not a place to go into. If you want to actually have friends around you, right? Sometimes it's difficult to your own. No two ways about it. Like if sincere and you care about the job, you do especially in real estate and the condo situations. But this is major people who really really need help in this particular area. And they turned it back on somebody taking medicine and the loyal come up and say, oh, we can't help you. Well, let me tell you where I'm going to change it up on your little bit and make it a little more apropos for this show. So you're saying sometimes difficult to get a to find attorneys wound up going after other attorneys. I can tell you that might what I hear all day long. You know in the type of area that I practice in is a little different. I hear that it's impossible to find attorneys that actually represent unit owners because there's there's a thinking of that some firms have certainly not my firm, but there's a thinking that some firms have that they will simply never ever. Represent a unit owner because they feel potentially it's going to turn associations away from hiring them in the future. My thought process was that. No. If an if there's a unit on route there that's getting screwed over because of an out of control board or something like that. It's my obligation to help them. I really do. I think they certainly need someone to turn to as well. And if a just my two cents, my thinking is an association, you know, has has a thought that no we will only hire a firm that only and has only always just represented associations. Maybe they're not getting the view of both sides of the coin. You know, there's there's always two sides to every story, and I can tell you that. I enjoy the fact that I have represented unit owners over the years because I think it has helped me in my field as an association attorney to again, see both sides of the story. There's too sometimes too much of the thought process out there that the association's always right? Well, the board is always right. Not the case all the time who has the deeper. Have if you're thinking of who has a deeper pocket, you would think oh, well, the board would. But if your client the homeowner wins than the board has the. Get your money back. Exactly. Right. But again, if you're only locked into the way of thinking that the board is only right respectful. I think you're gonna miss something.
