What crazy times right now in the world of HR yeah? I don't think we've seen anything like this Certainly in my career man. So let's say in my lifetime. That's probably true. Overlap there I imagine so. You guys know as business owners One of the biggest expenses that every business has is their payroll and entreleadership T- entreleadership. We teach that your biggest asset that you have is your team and so we're always talking about how to build a team and how to grow team and how to how to hire But right now we're just getting a lot of questions from you guys about. If you need to exercise the option of downsizing your team to kind of make it through the storm and man that can feel really scary. And we know that and Sorry that that's so tough for so many of you guys right now. It sucks. It is not a fun thing to be facing but face it with the data. Face it with some good information. We want you to make objective informed decisions. And that's why I brought in Armando to answer Some of the legal ease and things floating around especially about the bill that came out last week the HR sixty two a one There's some implications in that for small business owners so essentially Armanda my understanding is. There's some exemptions for business owners if they if they choose to lay off their team yep absolutely so I think you and Sarah already talked about putting people first and and you've already talked about the Karen concern that we as a company take With our team members yes And so I. I don't need to go back through that but What makes these conversations. These decisions hard is that there are people involved on the other end. It's right so while the bill does address some of financial concerns I. It's still hard conversation with that. Team member And so sick. Hr Sixty two zero one pass last week on Wednesday. It only applies to small businesses so these are businesses with five hundred or less. Okay five hundred or less you members. Okay so if you're under five hundred then you qualify under this bill. Today participate a couple of special provisions for companies with less than fifty so in less than fifty have a couple of nuances. That are a little bit differently but really what? Hr Sixty two zero one says. Is that if you have less than five hundred team members and you've got to lay people off or give them time Because they're sick or they think they're sick because they have a family member impacted by the Corona virus than you have fourteen days that you can take payroll tax credit and now the question always comes up what if my payroll tax is not enough so I don't have enough that I can take a credit right now with the government is saying is that they will actually issue you a check for the surplus of. He will get money back for that. Is that when they file next year or is that I mean when they go pay their Their payroll taxes so for most of our entrepreneurs are online. Right now there would be a quarterly payment quarterly. Okay so there. There's different options when you're thinking about you know. I think a lot of business owners right now are just even calculate the pros and cons of layoffs furlough keeping people on With without as much pay or partial hours and things like that Can you just talk through? Like what kind of what are the pros and cons of? If I'm saying layoff versus furlough for example is so layoff is not enough work for the business. And you truly take off payroll Almost completely if you reinstate them then they get their vacation time in other words you bridge that gap of employment so so if it never happened A furlough is I keep you on benefits. Okay and and now if I'm a that offers benefits and we are then we would pay our employer person portion of those benefits still okay and we could even opt to pay the full mount so furlough if you did that option. You're thinking okay. This is really tough right now. We don't have enough work but in two months we will. We believe we will. And so we're not letting you go. You're actually still a team member and we're just not able to pay you your paycheck right now but you still get to review your benefits having to go do Cobra or things like that where we're helping you get through it at least with the benefit benefits yeah. I don't know how many of our entrepreneurs out there have hourly team team members and so if you've got hourly team members and you just don't have enough hours for them It's hard for them to go right now and file for employment if you haven't separated them so if you have said hey all I'm doing is I don't have enough hours to give them. And so they're not really terminated. But they're not really getting any hours and so they don't have any money coming in for some of those cases. You might be better off going a furlough or a complete severance as the relations. Let's it'd be clear they if they're doing furloughed. They're not eligible for unemployment under a furlough arrangement in some states. They are okay. So have allowed that to qualify for an unemployment. Check with your local state on that When would it makes sense to activate doing pay cut? Maybe we've got half the work that we had And we want everybody to scale back and it's a weird conversation but it's kind of like hey. Do you want to work for half of what you've been working for to do? Maybe more work right now. Actually because it's not necessarily the amount of work but it's not a revenue coming in and if we're having to make cuts as a team to get through it. How do you navigate that? So you know it's funny Dinner you know this. But I'm in all these. Hr publications and like most of you. I'm sourcing in reading and talking to people that are in. Hr that have been friends for for a long time and a lot of states have a required. If you're going to drop someone's pay you have to give them notice in in those notices range from seven days to thirty days and so this is. There's not enough time right now to do some of those things. Some companies are wanting to make this voluntary and there are some states that are kind of lifting some of those restrictions But it is so specific for that stadium and our HR publications are warning against Acting too quickly. Okay against doing some of these things now even though you have a team member that says I'm willing to work for fifty percent less. If there's nothing documented there's nothing that says they're volunteering for this You've dropped someone's pay without any notice given could be recourse later if you didn't have that documentation so if the team is is truly a team and they go. Hey leader whatever it takes if we need to work for fifty percent to get through this. We're with you. We got your back. I would say that documented and and have them right up and sign. I'm choosing to do this and that way. It's not something that might prevent something in the future right We have such great people out there and you have such great employees out there. Some great team members that that are saying hey rather than have anyone get laid off. I'd rather take less money And it is not unprecedented. These kind of economic troubles have happened before. Companies have survived them by the team railing. And saying I'm willing to take a twenty percent pay-cut or I'm willing to take no vacation or burn up vacation now early So that for companies that are accruing vacation that money's already accrued so they can pay out of that vacation fund and and not have to incur. That cost today.

Joined by Bruce Feldman for our Christmas week episode Bruce a really special guest Pleased to have the outgoing big ten commissioner Jim Delaney on this show here a little bit. He is down to his last ten days or so on the job. But I How is your house your viewing experience first weekend of Bowl Games? It was good I got to see most of the Games. It was one thing I'll say is it was three. NFL Games. That ran on Saturday in those games. Were more competitive Than some of the bowl games I gotTA admit You know hats off to Fau. They had a coaching change and even without the coaching change. I think a lot of people would have thought okay. You have a bigger group of five really good team. SMU AGAINST A smaller group of five and it turned out to be a blow out but not the way. Yeah probably a lot of us would have expected so hats off to the owls. I thought that was a real head-turner The other one that jumped out at me. I think is Kent State it considering how bad that program was Not long ago I mean Sean. Lewis has stepped up there and really made a a huge impact. They are a fun team to watch they at their first bowl win in school history On the first first day of the bowl games it was one of those reminders of what I think because they had to really scrap just to get to be bowl eligible. I think that they are a great example of Y. No there aren't too many bowls it's five hundred team that got into a bowl game. They were impressive how they handled it. And it means a ton to that program Graham and I think Those players deserve the spotlight. Yeah I got that one wrong. I picked Utah State to win by like thirty. Whoops that's bowl season for ya the SMU ONE SMU Fau? Definitely surprise me as well. I think that that. SMU's one of those teams that got a lot the hype because they were doing things they hadn't done a long time and then it just kind of unraveled You know their their signature win was TCU and then TCU doesn't end up making a ballgame So hey that crazy shootout with memphis though You know it's interesting. There was a time when everybody was lobbying for their respective team. Conference for the Group of five New Year six bowl and Michael Rescue was furious that at one point. SMU is ranked behind Appalachian State. Obviously Mountain West. People were furious. That Boise State didn't get more credit Compared to the AC and then both SMU eastbound Boise State Mountain West Champ gets blown out by Washington honestly a Washington team. That wasn't all that great this year but I felt like nick and kind of I think you had the same hunches. Well and Chris Petersen's last game that they would. They would come to play and they did. That was a Thorough domination and now we all wait to see what Jacobson do. Yeah look I mean this is now Jimmy Lakes program. There's already been a little staff shakeup. Bush Hamden the offense coordinator. WHO's there for two seasons? He is already out as well as One other offense of assistant so one thing to keep an eye on and I'm GonNa have a story on this on the athletic Later this week is there's a lot of sizeable offensive coordinator vacancies out there. So Bunch in the PAC twelve oregon is looking for an offense coordinator as his Washington. As is cal- I think there's going to be quite a few more coming There's you know look. There could be a few big ones in the south as well as the ones that already have had coaching changes. This is where they're looking for guys so it's an interesting subplot to keep an eye on over the next couple of weeks Again as we mentioned a few weeks back You you know. We both have a lot of respect for Chris. Peterson thought it was cool. To see the way he went out We'll see if he ever comes back to coaching or what he does next. He's somebody I would. "Don't you dare stop me because on this show do we only go where people expect us to of course we don't we boldly go where no financial show has gone before and therefore at about ten till we will have our state tip of the week not normally in that segment we talk about how to pass on to your greedy unwashed undeserving airs the fruits of your labor but this week we're not gonna do that we're gonna talk about what is known as a special needs trust and this is a trust that you set up for a member of your family that is incapable of making financial decisions for themselves because of either a physical or mental incapacity so these are people that are not greedy unwashed or and deserving all right I would say that they are the opposite of all of those so we'll be talking about special needs trust at about ten till so we have a great show lined up for you I think and hopefully you'll stay tuned into program only give you a quick update as you guys made no the team that my tennis team amount of time on the tennis team that is the forty and over man's for five plus is what it's called team which means that there are four five players on the team and also five oh players on the team and we're all over forty and as you guys know I'm way over forty celebrated my twenty second fortieth birthday just two weeks ago as a matter of fact but anyway so we the season started with five hundred teams of those five hundred team seventeen that made it to nationals other teams nationally in seventeen made it to nationals in Orlando Florida and we were fortunate enough to be one of those seventeen teams and then they played a debt to play like a thousand matches in the course of a couple of days and then what comes out of that is the four top qualifiers and we were one of the four so those four play on Sunday and the winner of that many tournament on Sunday B. is the national champion I wish I could report to you that we won on Sunday and where the national champions and I maybe that led you to think that's where I was going with this no it didn't happen we actually came in fourth okay so thank you we're pretty proud of that we never you know we never thought we would go beyond the city tournament we ever thought we go to sectionals we didn't think we go to nationals and we think would be on Sunday we they also said don't keep your hopes up for another one which they said the last several times a lower interest rate this is the last one kids were not doing it again and then they do it again and say this is the last one we're not doing it again so I don't know how much credibility they have with this we're not doing it again stuff but be that as it may they did a lower interest rates this week and so that's X. was kind of what was expected by the markets so not a big reaction to it but but the opposite we believe would have been true and that is that if they did not lower interest rates that would have been a big negative reaction so they're kind of forced into it and then the other thing the other player of course is the the trade war with China and sit in the the good thing about that from the standpoint of resolution is that the escalation talk has gone away for the time being and the agreeing to stuff talk has increased so from that perspective it's a good thing and so what we believe that as we look at all of this is that the fed is going to remain engaged and the there's an old expression do not fight the fed and we don't want to fight the fed because most of time you lose if you do and right now the fed is engaged lowering interest rates and that has historically been a generally good thing for equities and for bonds and then also well as we have described in previous shows the whole China thing is we believe will be resolved we see it being resolved around the elections in a in a big way meaning the terrace are removed and everybody's friends and this and that and that will then result in analysts saying that the global economy's gonna grow faster now that they're no terrace all the growth projections will be revised upwards as we see it and therefore the stock markets around the world will go up so a year from now we think that things will be higher than they are today even though right now the Dow and the S. and P. hits have hit all time highs so because of all of that we remain bullish but we always have our philosophy of by hold itself okay we never take for granted that it's going to go up okay we all know that there is no doubt we always are aware of the fact that it can change directions and go down and since our firm works primarily with people who are retired or retiring soon we believe that having a strategy to address that protect against that is very very important to what we do and in November of all seven two thousand seven we told our clients to get out of all equities and those that fall guard vice did not lose any money in equities in two thousand eight because there weren't The Mariners are going to write this ships and and to that, the Astros and the as are going to let up in any way that's going to allow them to creep back into staying in any real way. So it just feels like this kind of March for being evitable just seems like a March two, seven hundred season of not making playoff in some ways. That's almost more painful at this point than if they had just kind of hovered around like he five hundred all season and you know, and we knew they weren't gonna do it from June on, you know, I don't know. That's kinda depressing look at, but unfortunately, I just I didn't watch the game today. 'cause I woke up, I woke, I fell asleep on the couch, drop my wife off at the airport, and I woke up when they were down five, nothing they had come to bat yet and fishing. Well, I'm gonna do something else in my day because this is this is a pool there and spend three and a half hours watching thing. "You know the team that since June twenty four th and that's going back to the last time they were in Tampa before this. This last road trip. They should be handling easily, but they really struggled against them. Meanwhile, the Red Sox have been playing teams like that and have been excelling. And you know, as the Red Sox kind of extend that that gap in the American League east, they're certainly a lot of concern and the Yankees locker room. Now with, you know, they didn't have that concern in the clubhouse just going into the all star break where they were still kinda scuffling. But now it's really kind of popped up because they realize, hey, you know, we're getting closer to the end of the year. Now we're getting closer to win these games really are gonna matter on really gonna count. And right now that you know nights when they're losing the Red Sox are still winning and so they, they certainly want to make sure that they start to start going on a hot streak. Again, they had a big hot streak there in may and June, and they really kinda wanna get back to that because if they don't there. Certainly are still looking at the wild wildcard, but they don't wanna play that one game playoff like they did last year. They wanna make sure that they win the division get into the playoffs and and perhaps have a better outcome than they did last year go. There is a ton of young talent on this team.
