Gerstein is a senior legal affairs reporter at politico where he has been covering the arrest of trump appointing federico klein and he joins me now. Josh i saw this story and obviously this guy was like particularly high up the state department but it i read the story. I thought he had left. He was working there right like until the end of the trump term. That's right chris. I was told. He tendered his resignation on january nineteenth. So that's two weeks after the storming of the capital and it became effective a couple of days later. So i guess he was wandering around at foggy bottom knowing full well that he had taken part as the video appears to depict in this assault on the nation's capital on the congress. Tell us a little more about this individual. So he's forty two years old He served in the marine corps in iraq. According to his mother. I haven't been able to determine much in terms of a work history. He had a couple jobs on capitol hill about fifteen twenty years ago as an intern briefly working for the house. Small business committee but he seems to have sort of potted around to different Different kinds of posts before fetching up at the trump campaign in twenty sixteen. There are pictures on his facebook page showing him a working at trump tower. I believe on election night in two thousand sixteen with a couple of other young men there and then he managed to turn that into a political appointee job at the state department in this special assistant a position. Exactly what he did. There is also a little murky. I have to say. I spoke to a number of people last night. Who worked in this department at the state department office at the state department and a lot of them didn't know him or said they'd only met him briefly he seems to have ended up an office that handled brazilian and what they call the southern cone affairs. I think those are the andes countries and somebody told me he was eventually transferred a believe it or not chris to the freedom of information act office which is not usually the career trajectory. Most people in government are looking for this quote from his mother. Cecelia klein saying that fred's politics burn a little hot. She said i've never known him to violate the law. I believe is. He said he was on the mall that day. I don't have any neural. Ever ask him unless he tells me where where he was after he was on the mall.

"Welcome back to the apples and program on the short side this week because of the Vacation time I talked about earlier. Which will you know? Even though I'm not gonna be doing anything, it will be enjoyable. The first time that I stayed home. Um In like 29 years without doing anything going on a cruise or anything was during the Thanksgiving holiday and actually kind of liked. It was kind of good. There are a group of angry Republicans. I mean, what? What should be done with Eric Swalwell? I'm gonna ask you Want to ask you. You're in control. Now. He's not been proven guilty of anything yet. In the way of this this lives on he had with the Chinese spy. But We have a group of 17 House Republicans sending a nasty letter to Speaker Pelosi. Yesterday, urging here to immediately remove Eric Swallow well, a Democrat from the House Intelligence Committee. Yeah, That's the same committee that Devin Nunes sits on. Now it comes in response to those reports. You know about his past. Ties that was going to say another word. But it could've got me in trouble with the spine from China, who posed as a college student who network with the up and coming American officials to to you and allegedly slept with a pair of Middle Eastern mayor's at the same time. Her. I told you the other day the way that she operates P Is, she finds American politicians, male politicians who were telegenic, handsome their point of view on and up and comers. She's able to identify the up and comers and she starts with, um They're like mayors or there. City Councilman, Alderman supervisors, whatever you want, it's even been down. You know at that level like I'm talking about the smaller city mayors. So she she sleeps with him. She flatters them. She gets right next to them. She's Absolutely involved a zit. His significant other would be involved with these individuals. She's trying to glean information from Now because of swallow Wells position on the House Permanent Select Committee on Intelligence. He is close interactions with Chinese intelligence services, which he's made public. He's done a lot with them. Uh, And they some of them may have been unintentional. I want to be fair here. But it's unacceptable as far as I'm concerned as a nation security risk. You know, we're beginning to learn with his were always have learned the Chinese are our real enemies. It's trouble with the Chinese. And I don't know how we're ever going to get around that. Because we have so many deals going on with the Chinese. But noting that the committee that handled some of the most sensitive information our government possesses. Information critical to our defense. These senators. Excuse me. These House members are urging her Nancy to immediately remove representative swallow well from his position on the House Intelligence Committee. And it has to be her that does it. She made the assignments and the way the Devon explain that the other day she have to take it away. Now, I would assume if there was some kind of trial, a pronouncement of guilt. This would this would happen. But there's none of that yet. And she first approached him for the record when he was still a city councilman. In Dublin. Right up the road right up the road that the northern California Dublin, not the Irish Dublin. It's if you're not familiar with it. It's just outside of the Bay Area. Pretty little community. Be interested to know how they met. She reportedly, um Use some student extracurricular activities. At Cal State University in the East Bay. To network. With her her new boyfriend and befriend a lot of local officials and eventually Branched out nationally good business, allegedly having romantic encounters with two Midwestern mayors. Who were they? That for his part Assed. Far as I know, swallow well. He's not accused of any wrongdoing. You know, after the FBI gave him a defense briefing about fangs and suspected form, thanks Suspected activities in 2015. He did cut it off. Assed, far as we know. Um and Fang is not Suspected of accessing any classified information. But His father, brother, along with a handful of other local politicians remain Facebook friends with her. With her until reporting on the concerns of the connections surface last week. And that likely gave China has a dream of Danna to monitor for years. According to our Intel experts, the damage has been done. Hmm. Now, Pelosi said last week that the congressional leaders of both parties were briefed on the incident in the spring of 2015. So she's known about it that long, huh? Quote. I do not think. That is unfortunate. That Mr McCarthy is trying to make sense of this when all we have found out Excuse me when we have all found out at the same time, as Pelosi saying to referring to the House leader Kevin McCarthy. That was a statement from the other day, but yet she was briefed in 2015. So we call that a lie. Carly didn't sign the letter, but he's called swell. Well, he's called for swell wells. Regular resignation from the The intelligence committee and let's remember that I mean, he's the leader of the minority there. So what do you think? You tell me? He's not been convicted of anything. Should he stay or should he go? I would think, because Congress is a little different. Just the everyday song and dance. On when you're sitting on important committee like this The intelligence community that sucks down all this information. I would suspect that he needs to go. There are plenty of other committees he can be assigned to And it scares me a little bit that he's been able to sit through a whole ton of stuff. The whole kind of stuff. Then it involves China because it's heated up against US and China in recent years. And easy reporting back to her, even though he says he's had no contact since 2015. I would say you know, and speculation he might.
Hearing with Trump loyalist Corey Lewandowski ends after 6 hours
"If you read the early reviews of today's hearing in the House Judiciary Committee by which I mean the reviews written about four are four and a half hours into the five and a half hour hearing then you would think the hearing was a mess the daily beast headline at five fifty five pm. I'm said Corey Lewandowski testimony quickly devolves into a mess but a minute later literally a minute after that was filed everything having changed it was a half hour left in that hearing when everything changed in Corey Lewandowski change coralline Dusky ran out of ways to avoid answering questions when he faced a full half hour of concentrated cross examination by lawyer hired by the committee to question witnesses in its impede from investigation the Republicans on the committee were determined to make a mockery of the committee process from the start we have never seen a more childish and abusive the use of committee process and committee rules than what the Republicans on the House Judiciary Committee did today. This was the low point in the history of house hearings procedurally the Republicans made repeated motions to shut down the hearing to just adjourn the hearing close it down and when those motions were defeated instantly by voice vote the Republicans then called for as is their right roll call votes that they knew would take time. They knew they were going to lose and they were just trying to waste time and add to the circus atmosphere that they created corey. Lou Dusky was ready for a circus. He was was not ready for serious questioning. When Republicans took their five minute turns questioning the witness they ignored corey. Lewandowski is role in the president's attempt to shut shutdown the muller investigation as described by Corn Corey Lewandowski own testimony in the mullahs report and his own notes that are reproduced in the mall the report Republican questioning deliberately did not make any sense but the question on the democratic side also mostly didn't make sense because of Republican publican interference with that questioning and the simple fact that should be obvious by now that most members of Congress are not very good at this they did not run for the district attorney they ran for the House of Representatives and every once in a while they have to play district attorney in committee hearings and generally for most of them. It doesn't go oh very well except for the people who have actually been prosecutors and so for hours on end it was a chaotic hearing with Corey Lewandowski becoming increasingly singley emboldened in his refusal to answer any question for which the answer was not already contained in the report he was asked by several Democrats to read passages the report and he repeatedly refused to do so cars when Eric Swallow Zeroed in on page ninety one of the Mullahs report which reproduced Corey Lewandowski own connotes of a speech Donald Trump dictated to him for Attorney General Jeff sessions to deliver about the Mueller Investigation Wild Wild Jeff sessions recused from supervising or commenting on the Muller Investigation in the trump written speech jeff sessions would announce that the special special prosecutor's investigation of the president is unfair and the special prosecutor would only be allowed from this point forward to investigate the possibility of quote election meddling for future elections so that nothing can happen in future elections harassment ex well well ask Corey Lewandowski to read his notes outs of his conversation with the president as reproduced in the mall report and Lewin Dusky refused to read his words allow were you were ashamed to read them out loud and you didn't deliver those words to the person the president asks you to did. You have a conscious of guilt. I have nothing to be guilty of congressman. Thank you still feel guilty today. And that's why you can't read it out loud cars when you're welcome to read the words if you'd like when the members of the committee finally finished their questioning almost five hours after hearing began it was finally time for the thirty minutes of questioning reserved for attorney. Barry Burke who is serving as a consultant of the Committee Hybrid Chairman Nadler Adler and chaos broke out once again as the Republicans pretended there was something wrong with having council ask questions in the committee even though the committee has done that many many times before especially in investigations of a president and after another round votes trying and failing to close down the hearing completely finally finally Barry Burke closed in on Corey Lewandowski for what was the worst public half hour of Corey Lewandowski life. My question to you sir is on national television. Did you lie about your relationship with the special counsel and whether they sought your interview I I don't know prior to the Muller report being published in redacted form. Did you ever misrepresent what you did on behalf of the president. I can't think of an instance where that would have occurred. Let me show you an interview that you did on May Fourteenth Twentieth Nineteen. Excuse me a I'll show it to you from February twenty-second twenty one thousand nine. Let me show it to you. Excuse me Ma'am number twenty nine thousand nine. Thank you don't ever remember the president ever asking me to get involved with Jeff sessions or the department injustice in any way shape so did you hear that Sir that was used saying on MSNBC. You don't ever remember the president ever. We're asking you to get involved with. Jeff sessions or department of Justice in any way shape or form. That wasn't true. Was it sir. I heard that UH and that was not true was it. I've no obligation beyond to the media's because there's just as dishonest as anybody else so you're admitting sir. You're not being truthful in that clip correct my interview with remember. This can be in any way you'd like. Did you lie on national television. Sorry about the president giving you a message. It's the attorney general about the special counsel's investigation. I don't recall that particular day and my mindset at the time I couldn't answer that. Corey Lewandowski told Robert Muller's investigators that he didn't want to deliver the president's message to Jeff Sessions at the Justice Department Jeff Sessions Office because he did not want the justice this apartment logs to show that he visited the Attorney General. He didn't WANNA public record of that meeting. Barry Burke pressed Corey Lewandowski on why he didn't want a public record of of him entering the Justice Department. So is it a fact. He didn't want to public log because you knew what you doing wrong so the just as the president went to an unofficial official nongovernment employees you wanted to make sure there was not a record of it isn't that right sir. No log creates a record of your visiting with the Attorney General so I would think a log world creator record degreaser that you admitted to the special counsel. You didn't want to have a record of your visit and that's why that's one of the reasons why you didn't go to the Department of Justice because she did not want to public log of your visit correct. I've never been to the Department of Justice. I don't know what goes on the Department of Justice. I don't really want to find out what happened. Department of Justice based on what's happened to other people involving the Department of Justice to be honest with you. Barry Burke insisted that the reason Corey Lewandowski did not personally deliver the president's message to Jeff. Yes actions is that Corey Lewandowski knew that would not be legal. You said so. You never did anything other than what was completely legal when you said that circus you knew if you delivered that message that told the Attorney General to instruct the special counsel delimit the investigation to exclude the president that would not be illegal. Isn't that correct surf Mr Burke. I didn't have the privilege of going to Harvard Law School. I'm not an attorney so what I know is. I didn't think at the time that the president asked me to deliver a message that anything was illegal about it. I didn't have the privilege to go to Harvard Law. So if you're telling me that in your opinion that would have been illegal then that's your opinion too but I never assume that that never thought about at the time I haven't thought about now. Why didn't you deliver the message that the president ask you delivered unless you didn't deliver it because you knew it was improper to deliver. Mr Burglar wasn't a priority. It sure reads like a priority in the mullahs report throughout the day. Corey Lewandowski refused to answer multiple questions agents about his conversations with anyone working in the White House. Berry Burke showed that this was not exactly a sacred principle to Corey Lewandowski. I can't speak to conversations that may or may not have with senior staff members of the administration to preserve the privilege they've invoked so it's such a sacred privilege as you would not disclose private communications because that would be wrong you testimony sir now. My testimony is at the White House directed that disclosed the substance of any discussions with the president advisors to protect executive branch confidentiality and I recognize that's not my privilege but I am. I am respecting the decision of the White House. Didn't you publish a book in which you disclose these very conversations. You had with senior White House officials which book you reference. I've written to New York Times bestsellers on a year so you refresh my memory with one. I'm asking you about the bestseller lead trumpy trump leading off our discussion. Tonight is democratic. Congressman Eric Swallow of California is one of the able questioners on the House Judiciary Committee because because he is a former deputy district attorney himself also joining us Mimi Roca former assistant. US Attorney Southern District of New York an MSNBC legal legal contributor cars. I WanNa start with something you brought up to Chairman Nadler when when it was your turn already been one brief recess in the hearing and so I'm not sure whether this was I could tell us whether this was coordinated with the chairman. Not specifically said you asked the chairman to consider holding holding Corey Lewandowski in contempt of Congress for the way he was testifying in that hearing which I have to say in any previous in Congress he would have been held in contempt of Congress in the first five minutes based on what we saw what's going to happen with the question of contempt of Congress for Corey Lewandowski in Dusky. It's certainly on the table and I also think the to witness chairs next to him. empty chairs should mean empty pockets and they need to be fine. There need to be consequences and when you when you by the way I could listen to that Barry Burke Exchange all day and then he he he's just masterful and finally the truth came came out but that's not how an innocent person conducts themselves. That's how he wants to help the Congress understand. You know what the president did would present themselves. That's how a guilty person acts and so are the chairman is going to consider contempt and we're not going to stop it in Lawrence and I I saw just like you did the you know the twitter. you know hot takes on what all this meant and people said it was messy. It was frustrating and that's all true but if the opposite of of this is to do nothing and let the President get away with further obstruction. We're not GonNa do that either and we have court battles that are ongoing right now so the president may benefit in the short term from confusing people and telling people to obstruct but in the long-term there's going to be a cascade of court decisions in our favor and it's not going to be very good for the trump team. Carson there is one another alternative for the mess of it and that is letting Barry Burke to either all the questioning or let Barry Burke have the first half our and then let the mess follow that yeah and it also just depends as well on the witnesses. We should assume that most witnesses are going to be like Mister Lebowski. That's just the trump style. They haven't had to have any consequences for that as of late and yes I think you know just just like you want more cowbell. Give us more burke. He was very very good. maybe Roca one of the things that you don't have in the courtroom is the other side when in the middle of your questioning jumping up in all sorts of history on equate object to something in a courtroom you better be doing it based on the rules of evidence the Democrats

"All the status of politicians in both parties, but she talks about spirituality, she talks about sort of the universe as we just heard. How would you advise other candidates to reckon with that, do they go into her turf? They can't they can't just laugh it off and look disrespectful. But what do they do with stuff? They're not even using only talking about what I would do is, I would respectfully, listen to her, and then I would use it in a way that is long as it was in CNA apart. That would say, maybe we need more spirituality rather than the misuse that some of the right way. Wing Evangelo, coups are misusing religion. So there's a way you can discuss that going all the way zone but staying in your political zone. If you really feel that way, the question is, do you understand spirituality, and the difference between that and the distortion of some organized religion? Can you don't you need to stay out of it? Nothing in the Muller reports, said, oh, by the way, everything they did in twenty sixteen they've stopped doing or the person they helped has confronted them. That's not the case. His carry on Canadian officials had to determine if they were of a species that was allowable, and they weren't and Boehner candidate number three. So why are we having to clean this clean Utah, coal? Anyway, it's a Utah coal cleaning plant, which is seems to me wrong in the first place, because we have clean Utah coal here. We don't clean the second time, but anyway, it went out of business, probably because the coal wasn't cleave, what didn't need much cleaning, and they went out of business and left. They've left behind a trail of waste coal dust, and unpaid bills and the winner. I see number number two, the leeches one thought that do okay. Didn't do anything at all. It was between number one and number two in the winter. No our number three. I mean and the winner was number three, the Utah coal. That is the winner of round two. It'll go up against the winner of round ones voting. We'll throw them both into Boehner dome at nine twenty. That is when you will decide Boehner of the day half hour from now. So stand by for that is this. Yeah. It's cabin fever. You have Father's Day graduation, yet, pride all in the month of June. "Fellow competitor in the twenty twenty race. Congressman Eric swallow has also like you proposed in assault weapons ban. But he's proposing a buyback program where Americans who currently have those guns could sell them essentially to the government. But if they don't within a certain period of time, they would be prosecuted so subject to be thrown in jail. Perhaps are you supportive of the same measure first of all when I was mayor of the city of Newark, again, I have a record on dealing with gun violence. We did a lot of gun buyback. And even other creative ideas that I think we should have when I'm president United States. The critical thing is I think most Americans of re that these weapons of war should not be on our streets against you. Would you prosecute people do support the government buying them back, and if not potentially people could go to jail if they don't want to sell them back? Yes. Or no again, we should have a law. The bands these weapons, and we should have a reasonable period in which people can turn these weapons right now. We have a nation that allows streets and communities like mine. And these weapons of should not exist. What? Yeah, he didn't like answer. I mean, he didn't answer any of it. That's not. That's Cory Booker, by the way, he was talking about a potential maybe kind of he's running for office. But he what does he even pulling it? I don't even a one percent because I don't even think he came up when I looked at it. Anyway. Anyway, that's not the point. But I'm just I'm like why the hell is he talking why? So he and others. They are totally fine. With basically, not basically they want to jail you for owning semi automatic weapons. Can we also seriously stop with this whole weapons of war BS when I hear people say that it's almost as if they put a sandwich board over their head. That says I'm stupid on front and back. I'm stupid on the front, and I know redacted about firearm law on the back, right? Or firearms military members in service carry semiautomatic pistols to so what you're saying by what they saying weapon awards. You're you're calling for everything to be banned. And that's ultimately what they're doing. But they think that you're too stupid to catch onto it. But the problem is that they have no idea how firearms work or anything about gun law. So that it doesn't their attempts to try to out clever. You doesn't work. So well, I mean the bottom line is that these are individuals who are. Hin and Eric swale? Well, when they call for this stuff, he's using the term weapons of war, and this is an all out band. Furthermore, do you know how many law abiding gun owners there are India nited states what Cory Booker is talking about? He and Eric swallow are increasing the prison population by millions. They are celebrating their desire to increase the precipitation by millions simply by saying that owning an inanimate object that was up until heaven forbid hell freezes over on their elected the point where they would assume office was legal to own you instantly, became a felon. So they're gonna go door to door. How does this work? Exactly. I want one of these cats. Explain to me how this confiscation jailing scheme is going to work. You don't go door to door and. Confiscate everything. These are the same people during the whole immigration discussion over deportation which I don't think you're going to I guess the dome arguing I honestly I'm not one for that deportation argument because it's possible. But these individuals thought it was definitely impossible. You simply can't just go into port that many people. But what they do think is possible is to go and target more people because more people on firearms than are entering the country legally at least by the last one is it twenty sixteen statistics about all the people who've crossed over well in two thousand seventeen let the number could be changing soon, you're talking about fifteen twenty million people more than owning firearms more than that. Probably you're going to go door to door to all these people's houses. And what how are you going to do that? Are you going to take police with you are you going to because we're having a different well, having difficulty right now with regards to law enforcement and resources they they can't hire enough people because they've been demonized so much which by the way side bar on that if you think that only the cops and the government should have gone to get you think the cops are racist. Pigs in that the government is run by Nazis. Why in the hell do you only want those people to have guns? You're going to take those races to horrible police officers that systematically target minorities and go door to door, including two minority neighborhoods and to minority houses, and you're going to forcibly take our firearms. And then what happens if there's you know heaven forbid someone doesn't react to kindly to it. And there's an exchange of fire and someone is shot and the police are then blamed and writing breaks out nationwide. You're all right being responsible for that. Is it okay? To you. You're creating a problem because you want that you thought you were creating a solution to a problem that does not exist in terms of law abiding gun owners being being responsible for all of this. But seriously, I really want to hear from these individuals how they're going to accomplish that. And so far there hasn't been a reporter with the brain cell in their head accurately took took credibly ask that question are they going to go door to door? How many police officers do you think it's going to take is going to be police? Are you going to use military to go door to door millions of households because you know, that they're these people aren't going to turn their guns in, you know, in New Zealand when they were saying gun ban, and they were calling for people to turn their firearms and only twelve people did twelve and New Zealand. So how is this going to work here? No people aren't going to bide by it. So you're going to then have to make all these people felons issue warrants for their arrests. You're willing to have police that are going to be going out who's going to pay attention to the the violent crimes that are taking place because you're going to need all of these police officers to go out there and arrest all of these people who up until this point have no record have never done anything wrong until you decided to say they were felons because they owned a perfectly legal up until this point inanimate object, which they've never committed any crime or behaved NFL onea's manner. So how are you? How are you? How are you going to handle this? What is it going to cost the taxpayer and not just in money? But in terms of lives. You're going to be going door to door and doing this. This reminds me of the Lucy law in New York City that got Eric garner killed. The very far left. New York City council, which is basically you can never have a hope of getting elected to it. Very corrupt the New York City council and the mayor at the time. It was Bloomberg. They decided that they did not like the fact that they were being robbed of all of this tax revenue that was coming from all of these individuals in the street like Eric garner who were selling single cigarettes. And so they decided to crack down on it. That you're not allowed to sell single cigarettes. It's like if you it's like Cain getting a pack of cigarettes and deciding to sell one for ten cents twenty five cents whatever and being told he couldn't do that with his own property. I don't care what it is being told. You can't do that with your own property. Well, that's what they did New York City. So you're not allowed to sell single cigarette. But people kept operating and they kept doing it. Anyway. So new mayor Bill to Blasios in and he decides along with the New York City council, they need to really really amp up their enforcement of the Lucy law and police were told to be quote, more aggressive in quote that was according to the documentation that I read when we cover this after Eric garner was killed. And so what ends up happening the police don't write the laws. They bear the brunt of people who hate the law, but they don't write the law. If you don't want the police to enforce the law. It looked better people. Everyone excuses themselves in this equation. You're more responsible for these some stupid laws like this. Then the police who are have who are forced by way of their work to enforce stupid laws like this. They were the ones who told the cops get aggressive with these guys and and arrest them. So when the cops were out they were responding to a call about a fight in the street, and they say are garner on the corner selling lucys. So they call the single cigarettes. Well, they were told they have to they have to respond aggressively people were already out there. Videotaping the fight. So cops are like well crap. And then they have to hate it's with these bureaucrats in York City council in and his honor wanted. So they have to enforce and they have to be aggressive, and that's what ended up happening. Eric garner would be alive today. If New York City council in the mayor's office hadn't wanted to enforce aggressively. These this stupid ridiculous law about selling singular cigarettes. But hey, no one wants to have that conversation. At all. No one wants to have it. And it's incredibly sad because I feel like people don't want to solve the problem as a result of refusing to have that conversation. So here you have people like Booker, and you have people swallow. Well, who say, yeah, we're gonna we're gonna confiscate these. It's going to be an outright ban. This is what we're doing. It's going to happen. And Cory Booker was trying to dodge that question too. By the way, he didn't really want to say that he would jail Americans. But that's what he intimated. Well, we'll see how that goes. These individuals. They don't care how they treat law-abiding people. But so far Kamala Harris is called for it. Who is all called for this? Call a heresy swallow. Well, Cory Booker, tons of them have done this tons of them have called for this. Yeah. Jill brand. Although she kinda got quiet. I mean, it's it's really this idea that this would even be successful in the United States you'd have to repeal the second amendment, otherwise you're behaving in an unconstitutional manner. Then can you imagine the lawsuits and liability? Are your local police going to be able to handle the liability and the illegal cost that would come with people undoubtedly filing suit..

You can do it that you had the evidence of collusion. And therefore, if you have the evidence of collusion, how many times did Adam Schiff say that he has seen the evidence? Why is it Adam Schiff going to the media? And and stating that that Muller did not do his job because of Adam Schiff saw the evidence of collusion. Why didn't Robert Muller? Well, here's my question. Why does April twenty nineteen Adam Schiff have a problem with everything up until April twenty nine thousand nine Adam Schiff? This is just too easy. Aren't let's hear from. "Eric swallow, Monday became the latest person to join the incredibly crowded twenty twenty democratic presidential race his primary policy. Message of the campaign will be gun control. And he's proposing a mandatory buyback, I will be the first candidate to say that reducing gun violence has to be a top three issues. Swelled Esquire last year. I wrote a Bill calling for a buyback and ban on a salt weapons, not just a ban future manufacturing. But to just take the fifteen million that are out there and buy them back swallow stated the Bhai back is mandatory. I'm the only candidate calling for a mandatory national ban and buy back of military style semi automatic assault weapons. He told the San Francisco Chronicle and an op-ed it's bolt and will cost money. But it is constitutional. Sure about that. And rightly traits gun violence as a life or death matter. Our children deserve better than an attempt to reduce. Or contain gun violence. Our goal must be to end it. So. Yeah. Gun confiscation consistent with the second amendment. I'm not so sure he's right about that. In fact, I'm pretty sure he's wrong about that. In fact, when he proposed this legislation right around the time of the last midterm elections. He put it out there on Twitter. And so he got some blowback because people liked having their second amendment rights in this country. They don't like being told things they've bought lawfully now make them criminals, and if they don't turn them in they'll be arrested. So there was a guy out there. Let's see if I can find I was named Joe Biggs conservative commentator. So swallow wells plan was and tweeted out so basically at repertoire well wants a war because that's what you would get your out of your bleeping mind. If you think I'll give up my rights and give the government all the power. So if you're a congressman and you have somebody accuse you of being on the brink of starting a war. You might be a little upset with that. You might tell the person. Hey, calm down. It's not as bad. Bad as you think. Maybe we can find some common ground. No, no, no, no, no, Eric swallow wells tweet in response. And it would be a short war, my friend. The government has nukes to many of them. But they're legit. I'm sure if we talked we could find common ground to protect our families and communities, so it's always good to throw at the olive branch after you've threatened to nuke someone because that's when they're really going to be in the mood to compromise on an issue. Although I'm not sure where Eric's well starting from. There's a whole lot of room for compromise on the issue of the second amendment so Eric's. Well, well, he's one of these single issue candidates. And now you've got Jay Inslee running all on the environment. Eric swallows running entirely on gun control. I'm not sure these things are going to work. He's also a straight white male. So that's going to hurt him badly very badly in the democratic primary, but we will see we will see. In fact, we're going to get some debates here as early as June. We're only two and a half months away from democratic presidential debates. There's going to be a lot of them. And there's gonna. To be a lot of people on stage. In fact, if they're gonna have to do the kitchen table debates like the Republicans did a couple of years ago, but this time the Democrats are not going to do it based on your poll standings. They're just gonna pull names out of a hat. So people have no chance we'll be standing next Bernie inviting. It'd be a lot of fun for them to share the stage with people who have no chance, but hey, at least have a chance to get the people to hear their message. I guess if people are still paying attention after the first couple of these things so Democrats in Ohio, Nevada, California stand up and take about I'm Greg Columbus..

Congress for the first time today with Democrats eager to press him on interactions with the president now Whitaker's testimony was in limbo for much of Thursday after the democratic led House Judiciary committee approved a tentative subpoena to ensure that he showed up and Whitaker responded by saying he wouldn't show up unless the committee dropped the subpoena threat, which he called an act of political theater now eventually the two sides came together and agreed on the testimony today democratic congressman Eric swallow. He sits on the judiciary and intelligence committees Botha launching investigations into the Trump administration. We're here today to launch. I now that is President Trump. A here is the democrat Eric swallow. The chairman just sent over. A letter assuring acting attorney general Whitaker that if he comes forward tomorrow and answers our questions he doesn't have to worry about a subpoena. And then that's the process that we want, but Aaron what country does an executive tell elected representatives that they're above answering questions. I'll tell you what country it's China. It's Russia, it's Iran, but it's not the United States of America. And the reason we are ready to go with a subpoena is because we have sent over to the administration a number of questions, we want to ask the acting attorney general so he's getting the questions in advance and asking them if they're going to assert any privileges that would prevent him from answering, and they didn't send anything back. And so we got nervous. And when you want to waste our time. We didn't want to waste the American people's time. And so we said, well, if you're not going to answer questions, we have a process that we have to follow to compel those questions. We hope it doesn't come to that. All right. So you're waiting to hear back from him at this point, right? Okay. All right. So now again, meantime on the intelligence side, President Trump says Adam chef is quote, stealing people who work at the White House, those whereas works feeling do do, you know, congressman of of people who've gone from the White House to the committee. Well, first, Erin. White House staffers are not property that can't be stolen day can make their own decisions about who they work for and our committee, and Mr. Schiff is interested in hiring people from the intelligence community, including people who have worked in past or current administration. So I'm not going to go into the names of the people we've hired because this isn't about the staff. This is about the responsibility that we have. And as Mr. Schiff said, it says more about Donald Trump if they left him to work elsewhere than it does about us who want to do our job. And this sounds a lot like frankly, the wiretapped claim of from tower where we actually went over there and took staffers against their will to work for us. President Trump blasting the announcement of new investigations on Twitter saying I hear other committee will do the same thing even stealing people who work at the White House. So that we can do the business that we're supposed to do here on this bipartisan committee, and when we started today, the first organizational meeting, he kept that same tone as Republicans express some of their concerns about where our investigation would go, and they sort of left to conclusions about how he would lead it. He would point out to them. No, if you have evidence, I want you to bring it to me, and I want us to be able to work on it. And so I think you're going to continue to see that from our chairman interesting context as you put it both of your knowledge of him. Joining us now democratic Eric swallow from California, he's a member of the house intelligence committee, and the judiciary committee. Carson swallowed. We just heard Emily Jane FOX's reporting from Michael Collins team saying that he wants to see the congress take action to protect him against Donald Trump's threats against him and his family, particularly as father in law who don't the president threatens individually publicly a what can you in the congress do to reassure Michael Cohen, and and to encourage him to testify given that as Emily John FOX just reported. He wants to see some action taken America needs to hear from Michael Cohen. He has a story to tell he was on the inside of all of the president's personal professional and political lives, and he has turned for good. And we need to hear that story. And so good evening Lawrence. I would say. That it's not just a responsibility on congress. But it's also responsibility at the special counsel has particularly to protect a what looks like a pivotal witness in a criminal case and Lawrence as we talk about this. And of course, we're talking about the president of the United States and his lawyer. But as a former prosecutor, this is no different than talking to someone who left a street gang. And they're they're testifying against the kingpin. And I've seen this so many times where they want to do the right thing. Then they start to get the threats. They start to get the pressure. And you got to convince them that you know, I got to protect yourself do all we can to protect you. And that's going to have to happen. But that doing the right thing is the best thing that you can do for yourself and your family and not letting these individuals be rewarded with this kind of St. intimidation technique if I were working on the staff of the house oversight committee now today, I would have drafted of for the chair. Airman a house resolution rebuking the president for his witness intimidation conduct publicly citing these incidences on Fox News and elsewhere. And specifically what he said about Michael collar microphones family, and I would have brought that to the speaker right away and ask that the house representatives vote on that. I'll leave that to a chairman coming tease pro when it comes to this. He's working. I can tell you first hand he's working in a teamwork framework with chairman Nadler and chairman shift because Mr. Cohen kind of crosses into all three of those committees. "Follow me on Twitter. Some your tweets at Ethan Bearman. Well, the shutdown continues the president is apparently laying the groundwork to get ready to announce declare a national emergency, which is really interesting because the majority of people who actually study the law actually say he can't do it. And let before we get to he can or can't let's talk about why he should or shouldn't. And it's very interesting because there are many on the right who are saying. You this is not been done before where you just go. There's a political thing. It's not really an emergency. Okay. Maybe you think it is. It's not beware. When you give too much latitude to the president to declare a national emergency. And let me explain why. And I'm gonna use some of these conservatives words here for a second. Eric Ericson super right-winger conservative. It's cetera. If you're right winger, you know, who he is. And he's totally right here. He said when he tweeted out, I should clarify when the next democratic president, declares a national emergency over gun violence and takes executive actions to curtail gun purchases. You can thank the people urging Donald Trump to do the same with regards to the border. Why do I say that Eric Erickson is spot on our own local, congressman Eric swallow? Well, tweeted yesterday gun violence is a national emergency. See how that works and better yet, there's actually data to support much more strongly that gun violence is a national emergency with the number of deaths that are happening here in the United States at the hands of criminal elements. So that's a national emergency. The tens of thousands of people dying every year at the barrel end of a firearm. Okay. So Eric Erikson's, right? You don't just starting Ligo. Well, whatever I feel like as a national emergencies national emergency. Joe Scarborough former Republican congressman from Florida said Mark this down. Trump issue are ceiling your own fate. Right. And then I will get into David French is article on why this is so incredibly wrong the imperial presidency. Which again, like I've talked about many conservatives and libertarian types of said for a long time, beware. Expanding executive powers. It's not always your person who's in power. That's the key here people. It's just it's unbelievable. I've I've argued this with Democrats when President Obama have using executive action like that's dumb executive action can be reversed by the next Republican president. And that's what Trump did reversed. So much of what Obama did because he did. And that's why you don't do it that way. That's not what that was intended for was to circumvent congress. No, you got to figure out how to compromise with congress. And that's why the founding fathers set it up that way. So you get better find some compromise instead of imperial action. Four one five eighty eighty eight ten Dave in Hayward. Dave, you're on KOA ten with Ethan Bearman. Hey. Eric's wall while seriously, and we're talking adult normal on a cheap guy. There's no equivalency there. You cannot a bridge. The second amendment rights of the American people because of. So national emergency. Okay. Now, we're not talking about a national emergency as we are being attacked by Japan are called emergency powers and in one thousand nine hundred fifty four we rounded up all the aliens and deported, and whenever you say that the liberals say oh God. And they turned out three American citizens in the process. By the way, came back. But I'm sorry. But. You know, they they didn't deport those people because they hated them thank for them because they were here illegally. I'm not sure I'm understanding your logic here. So the national emergent if you're on national emergencies, there's there's statutory language around this right title, fifty the US code national emergencies act from nineteen seventy six, and if you read by the way, in addition, very specific language entitled ten that that has to do with the declaration of war or in talks about the national emergencies act. It had very specific provisions of how this works is. Why never understood I don't know who these four attorneys are that are that are telling the president. I mean, Michael Coen's, clearly not one of them anymore that this is totally okay. It will be challenged immediately. And he will likely not win in this case even with a conservative supreme court because if you read titled ten of the the US code section twenty eight oh eight any national emergency act declaration that requires the USA. That requires use of the armed forces. That's what he's talking about. Here is using the military. Without regard to any other provisions bubble that they are necessary to support such use of the armed forces. In other words, there let me put the longest shortest this is he's talking about using the military in a way that's not defined within these sections the US coat at all. So if you care about the rule of law, which Republicans always claim, then you can read this. Oh, by the way, better yet. You don't even have to take my word for it. How about a constitutional attorney David French who's a super-conservative again, by the way, who lays out and walks through the statutes is like this thing is this total bunk. Emergency rule that requires the use of the military. You would have to demonstrate that the emergency requires the use of the military. Well, we're not being attacked. So it's impossible to make the argument and actually succeed with its author Lee ridiculous. This will be challenged, and he will most likely lose all the way through the entire court system, including the supreme court of the United States of America. So and by the way. The way our laws are set up is we don't want three innocent people deported because you're doing too broad of a dragnet. You don't want people dying with our death penalty who are innocent. Oh that one guy. Oh, bad for him. While you're not him or his family in our system is actually set up to let ten people go free before we allow one person when innocent person to be locked up. And by the way, we just had a story today a couple of guys seventy years ago because they were black were convicted of raping a white woman. That was just finally pardon today. Because of racism in our country. It is that simple. Dave, thanks for calling in four one five eight hundred eighty eight ten Carlin, San Jose, Carl you're on KOA ten with Ethan Bearman. Yeah. We discussed this a little bit yesterday. You, and I I'll tell you what appears to me is that the Democrats are actually being Alber Neubert here. Yes, he could declare this. And it sure it'll be challenged, of course. But that's not gonna stop an immediate action. Maneuvering like the national guard or or the military itself was engineers. And and even even if they're called off of the task. He's still looks like a hero. She's a base because you say, look, I even had to declare Nashville urgency to get this time because they won't compromise and project our our sovereignty, and and all these people that are flooding into our country illegally. I mean, this is the kind of stuff that he's doing at is. He's gonna you made out alternately win, but he will win as far as he looks like I did everything I could the meet my campaign rhetoric so to speak. I actually a car we keep agreeing with each other. I I. I agree with you. I mean, I it's actually I don't think this is ultimately good for the Democrats either. And that's why I agreed with representatives spear the other day, I'm again, I'd like to see a deal, you know, how about Kimmy DACA, dreamer salt. Let's solve that for good in exchange for five billion dollars. Who by the way, we have seven hundred miles of fencing and wall, I don't like the idea of wall. I think that there are huge flaws in it. I think a technology solution is far superior in every way. But you're right. I mean, the the political the politics of this are not necessarily good. I just tweeted out a link, by the way to the David French article breaking down, the legal argument is just ridiculous. I don't know who these mean, you'll always find him on that always you'll generally find an attorney who can make an opposing argument. But in this case, the statutes look quite clear that he can't just. On a whim declare national emergency can't do it. You actually have to have evidence, especially if you're using the military, really important to note the difference. Okay. Carl have a great weekend by the way, four one five eight hundred eighty eight ten and speaking of all the politics. Let's get to Trump's lawyer Michael Cohen is about to testify. We've Dr drew next hour Nick Adams author of class dismissed why college isn't the answer. And I want to kick off for all we're talking about twenty twenty. I don't think she's right for twenty twenty Alexandria Cortez is on fire, and boy, I.

"We're now joined by congressman Eric swallow. Well, a frequent guest on skulduggery. So congressman welcome back. Yeah. I think that so how does it feel to be in power? Well, you You know, know it's it. liberating for the last two years, frankly, have felt quite powerless, especially in the house intelligence committee, where we just saw the shovels come out every time, you know, new evidence was discovered in the Russian investigation, and they just sought to bury it, and so it just feels like the voters gave us the ability to unearth that evidence, and, you know, bring it to light for the American people, and I'm excited about what that means for the job that we have to head. Well, look, we are very focused on those issues on skulduggery here. So let's get right to it. You're on both house Intel and judiciary two of the most important committees for investigating all matters relating to the president. Give us your sense of what the agenda is going to be right off the bat for both Intel judiciary where do you want to see the committee's begin? Where do you wanna see the investigations to unearth all that buried material? To start well with the Russian investigation. You know, we don't we don't wanna be redundant. We don't wanna do anything that Bob Mueller is doing. But there are a lot of lines of inquiry that we don't believe Muller is going to pursue particularly money laundering. So we will open up a money laundering inquiry as to whether the Russians were laundering money through the Trump organization at to use a prosecutors phrase, I think we have probable cause to do that based on the Trump's own the Trump families own admissions that they had money coming in from Russia, then we will fill in the gaps where you know, we tried to follow evidence and either the Republicans would not subpoena Bank records hotel records. Telecommunications logs, and we will subpoena those logs, and then we're witnesses came in and stood on you know, made up or invented privileges. You know, we will force their hand on those issues and be willing to litigate where the Republicans were not. So I'm again, not going to be redundant not seeking a pound of flesh. I think just filling in the color where we were not allowed to go in the past congressman, let's just flesh out this for a minute. The money laundering allegations were suspicious you're talking about. I think you're talking specifically about Deutsche Bank, which was the president's lender before he was president. So talk a little bit about that. And tell us what that probable cause is. So I think you have both sides here of the ledger. You have the lend d-, you know, the the Trump organization who has received loans from Twitter Bank. They have said that they've had money coming in from Russia. And then you have the lender Deutsche Bank who's been fine in the past for laundering Russian money. I think that was through the new York Attorney General. So there is good reason to look there knowing the eagerness and willingness that the Trump team whether it was the business side with Michael Cohen and Felix sater's trying to do a business deal in Moscow or the political side picking meetings from Russia. Who are offering to provide dirt. So I think there's reason good reason to look so what does this mean in practice? You say you want to open up a money laundering investigation starting with Deutsche Bank. So subpoenas to Deutsche Bank and the Trump organization for their finances going back because a lot of the a lot of these transactions took place ten years ago or longer so give me an idea specifically of what kind of are. We talking subpoenas exactly to who. And one more matter. Do you have chairman shifts consent on this is he on board with going in this direction right off the bat. So I I I don't want to speak for chairmanship..

"Is that you take away their ability to move forward there one agenda, which is gun pompous Gatien, the congressman Eric swallow. He explained it very well. Right. The the California congressman he explained it very very well that his plan is indeed to take your firearms from you. Now, if you never heard of the conversation of Eric swallow, the democrat and Tucker Carlson on his show. Here's some of it. I've never suggested sending troops quote. Eric Swales, your congressman California back in the spring, please. I'm just gonna go once again, and we should buy back those weapons, and I'm quoting criminally prosecute all criminally prosecute any who refuse to who. Choose to defy it by keeping their weapons. So you're going to prosecute people who don't give up their weapons that's gun confiscation? If they're caught with them. Yeah. We're not going to happen. I mean, do you think because of course, the overwhelming majority of those people are law-abiding have committed no crime, no plans to commit a crime would instantly turn them into Fallon's. Do you think that you would have a civil war? Are you worried about that? What do you think will happen? If we do nothing think more kids will be killed. I'm not I'm not more churches will arguing I'm critiquing various specific suggestion for we. And you're a well-made. So this is meaningful what you said. And I trust the American people are law abiding that their weapons could be bought back or keep them in a gun club. You don't have to give it out. What did you want to keep what good would your weapon at a gun club? When you have Avellino mystery, Al Vazquez Perez in your garage, trying to get into your kitchen and punching you in the face. It's a question for congressman swallow. It's a question for moms demand action question for all these anti gun groups, and they are anti gun. They're not in favour, the high profile parkland students are not in favor of commonsense. Gun reform. They are in favor of this kind of confiscation of the removal of the Iraqi occasion of the second amendment. My question to them is what good will your gun. Do you at a gun range? When Avellino mistrial Vazquez Perez is trying to get into your kitchen after he is availing the police and not stopping at a traffic. Stop and running his car into a home. It's the question that they should be asked. But yet somehow it never gets asked. And they never seem to have an answer. Which is a real problem. I love a good second amendment success story. You know, what I love more than a second amendment success story..

"Over one point three trillion dollars is the next step in our debt. The next increase in our debt that the treasury is going to pull us into forced into because of the Trump Tower. Tax cuts. Donald Trump doesn't want that to be a campaign issue. And that's why he's talking about birthright citizenship, we're joined again by congressman Eric swallow was back with us cars and swallow. Well, you can see as we've seen all year. But especially now in the last days of this campaign, president United States desperately trying to set the agenda for the campaign. So that the candidates out there suddenly shifts to yelling about birthright citizenship forgetting about the national debt on the same day that the president talks about birthright citizenship, the treasury announces it has to borrow one point three trillion. Forget about a health insurance policies with existing conditions of forget about cutting Medicare and social security as Mitch McConnell has promised to Donald Trump wants you to talk about either a caravan as he describes it or birthright citizenship. That's right. It's a strategy of scaring suppressing and silencing scaring families over immigration suppressing voters by calling into question. Whether there will be illegal votes and trying to silence the free press by intimidating them should the campaign to be about in these final days. Well, it's I think it should be about what we can protect for the people healthcare paychecks, and our democracy, and you see that Republicans are very very uncomfortable talking about their votes to gut the Affordable Care Act and take away the protections for pre existing conditions, and they think that they get a pass by talking about a family member who has a pre existing condition that actually makes it worse Lawrence that they voted to take away protections that would help people that they know. And then of course, when it comes to the tax cuts eighty three percent of the benefits going to ten percent of persons in corporations in our country. And then a culture of corruption that runs rampant in Washington under a president who promised to drain the swamp. It's only gotten dirtier they don't wanna talk about that. So these are hail Marys, which just a few seconds left, and they're not going to. What about the for example in Iowa where you've been campaigning for house candidates there? What about the tariffs that are hurting the agriculture sector in the mid west? I've talked to farmers there Lawrence, and they don't might being hurt by China. But they also want to see a real strategy carried out by the president. I heard from so many of them saying that they feel like this is just a scattershot approach where we should be prosecuting the case with our allies. And now they're starting to hear from their bankers, and they're not going to be able to afford these tariffs any further, and they also don't want a bailout. They don't want welfare from the president. They want to be able to work and stand on their own hard work and trade to ninety five percent of the world, which is the economy outside. The United States is the national debt having any echo on the campaign trail well in Iowa State of people who are very very fiscally Putin, and they expect that. The government will be responsible with their investments. I see that everywhere Lawrence. Of course, a debt isn't bad. If it's responsible debt that makes investments in schools in healthcare in greening, the grid through infrastructure, but that debt is accumulating because it went into the pockets of people on the top floors of every building and has it made its way down to anyone else on any other floor. In fact, people below the top floor pain for those tax cuts. So that that's not very responsible Eric's while. Well, thank you very much for joining us. And I really appreciate it. Tonight's last word is next. Time for tonight's last word. Another weird thing happened on the way to the rally. Take a look at this clip from Saturday of Trump carrying an umbrella and boarding Air Force One. Okay. So there is just about to board with his umbrella and time to close it up. The. Can just he just walks away. You can't just drop an umbrella. What you're done with it. It's not a wife..

"Quote, if someone was killed in your home while you were in it and fifteen days later, you're still trying to come up with an explanation. Forget it. We already know hashtag kashogi tweeted tonight by congressman, Eric swallow who's a member of the intelligence committee in the house. Congressman swallow joins us tonight live from his district in California, congressman, thanks very much for being here. It's nice to see you, of course, could even Rachel. So when when you say we already know when it comes to Jamal Shoghi in the Saudi government, what do you mean. I'm kind of fall back on my work as a prosecutor where if it takes this long to come up with a explanation as to what happened? Well, we kind of already know that the Saudis are responsible and now they're seeking to mitigate just who knew at the highest levels. And actually this is very similar to many of the witnesses we had in our Trump Russia investigation. And number of times we would ask a witness a question and they would take time out consult with their lawyers for five, ten minutes and then come back and we figured, you know what we already know the answer because it was a pretty simple one. And that's what's so disturbing here is that the United States is actually a part of the explanation process with the Saudis as a member of the intelligence committee and know that you take it your responsibility seriously in terms of confidential and classified information. So I'm not asking you to tell us any secrets. But one of the controversies here is that the Turkish government has been describing. Evidence that they have and reasons that they have to believe that this Saudi kill team came in kill Jamal kashogi. They may have dismembered him. They may have disposed of his body. We've had a lot of subsequent reporting on the connections between members of that supposed kill team and the leadership in Saudi Arabia. Can you tell us whether any of that actual evidence has actually been shared with the intelligence community or with US law enforcement, or are we just going on the word of the Turkish government here? That's a great question. I've spoken with our staff but away from Washington. I can't be briefed at the highest level yet, but what I can tell you, Rachel is at the FBI has not been formally tasked to work with their liaison partners. Now they have what are called legal attaches over in on camera, and it's done tonne-bolder relationships in the region. And I've actually called four and just wrote an op Ed asking for the FBI to be tasked to do this so that they can work with their counterparts over there and use our resources in why would we want our own FBI to do this? Well, it's a US resident working for a US publication who was likely murdered by US ally. So we have great reasons to want to know what happened and the person who would have to task the FBI to do this is the president. Yes, yes, that's right. And it's looking more and more thought just a couple of days ago that the president was parodying, what the Saudis wanted him to say as to what happened. But now it seems more like the Saudis are. Parroting what the president wants them to say is he is really imploring on them to use this denied denied tonigh- approach that he always used and seems to get away with as far as you can tell the what you're implying here is that President Trump and the Saudi government are working together essentially to cover up what happened here? Well, it fits the pattern of every time. Donald Trump is presented with overwhelming evidence. He thinks that he can just deny his way out of it. And now we see that the Wall Street Journal reporting tonight is that US government and Saudi officials are working to minimize what role the crown prince and the king had in the killing. And I'm afraid that will dim the moral leadership that we've always had in the world that keeps us safe here at home and keeps order across the globe, congressman, Eric, swallow member of the house intelligence committee. Really appreciate you joining us tonight. So thanks for my pleasure. All right. We'll stay with us..
