months ago before we get to the update could you just quickly recap what happened initially that white castle how we get to this point where we are today right so this all went down into we hours of the morning on may first two a._m. the white castle parking lot downtown a fight broke out there weren't a lot of details at the time but the upshot was there were two clark county judges who ended up seriously wounded and rushed to the hospital both of those judges were they were shot right that they were shot yeah there was unclear how the fight started pretty clear how it ended you had to guys with gunshot wounds we both happened to be judges they were in town for judicial conference and so there was a lot of human cry a few days after that two men uncle and nephew were charged in the case but remember the way this works is the police arrests on charges they're not really charged until the prosecutor decides to charge them and a few days later when they hit their deadline to do that they said we need to look at this a little longer and that was i'm sorry go ahead notch and they let those guys go and let those guys go you can't hold them if they're not charged with anything and i was going to say right there it seemed pretty controversial at that time because regard purpose of who did what somebody who shot somebody was going back to the general public and that was a big talking point for the media and in this press conference today before we get into any specifics it sounded like terry curry had a big problem with the media he did i think easily half the news conference the first five or ten minutes were spent criticizing what if you'd as irresponsible reporting i will say for the record i don't think any of that was on w._a._b._c. if the prosecutor disagrees he has my number i believe we played this very responsibly but he said there were some in his words there were people trolling for copies of the security video trying to get people to handed over this evidence you're not supposed to do that he was not pleased and he made his displeasure known before he ever explained who had been charged with what but i'm not gonna i'm not gonna pretend like i didn't have questions i came on the air and said look you have two guys on videotape shooting the judges and i was very concerned at the time that they just let those guys go that was that i don't have any problem in meeting that i was very concerned about them sir a lot of normal folks on social media and otherwise our listeners were well i suspected at the time with turns out to be the case which is when you've got somebody in the police say we're holding them here's the preliminary charge and the prosecutor says not we're dropping the charges but we need more time let him go for the time being that smelled like self defense or at least a self defense claim that needed to be investigated just what in the world went down here that ends up being what they called not one the two grand juries to decipher and hers videotape and that was a question that i asked the prosecutor today because a lot of people reacted the way you did look got this on video and his point is look it's using analogy that terry curry did not when t y hilton catches a pass in the end zone and it takes ten minutes to figure out if he had both feet in sometimes videos them sometimes it isn't Understood. there was no audio and that could have changed interpretations so going back to may fifth these two guys brandon keizer and christopher vasquez they were arrested in connection with this case they will alternately let go and that brings us to today what happened today what charges are being filed and take us through the entire process here so both of those gentlemen have indeed been charged they are both charged with battery and disorderly conduct one of the judges andrew adams is also charged with battery into early conduct he and mr vasquez facing identical set of charges six counts of battery one kind of disorderly conduct there are seven additional charges against brandon kaiser because he is the one who's accused of doing the actual shooting and there was a fight and then there was gunfire because he's accused of doing the shooting i off the police allege that the gun was not licensed so he's charged with that second there's two things that make a battery charge more serious in india danna one is the seriousness of the injury obviously the guy who shot somebody has caused more serious injury than the guy who punch somebody so that's one reason he's facing additional and more serious charges the other is the fact that gun that's a separate version of what's called aggravated battery who who punch to do do we know any of these details why is one of the judges now being charged with battery he is accused of punching and or kicking that's a direct quote from the indictment punching and kicking the other guys the second judge is not charged but one of them is basically what you've got here when you have a grand jury case there is not as much information that is released publicly as when the prosecutors charge somebody so all we can do is connect a few dots we know for sure is there was a fight judge adams as well as these other two gentlemen are accused of all crossing the line in punching kicking and wrestling the other verb thrown in there then brandon kaiser is the one guy is accused of shooting somebody so judge adams one of the judges downtown gets into a fight get shot and he's facing charges as well now i know you don't work in the criminal justice system per se but in all your years of covering high profile cases here w._i._b._c. is that normally the case where two guys get into a fight one guy gets shot and both of them get charged it's not unprecedented again the shooting just takes us to another level picture with what's going on here i an indictment as the your federal prosecutors always make this the last thing they say at these news conferences and indictment is just a charge of his nadi finding of guilt that's where the jury to sort out later that remains the case in this case they they've decided there's enough evidence here to take this to court against all three of these guys alternately all three of them may very well be claiming self defense when it goes to jury and that jury will have to decide okay who was the aggressor here who was legitimately defending themselves who but we don't know specifically who started the fight what was said who specifically is claiming self defense who don't know any of those details i think we can infer that all four of them may have claimed self defense but as far as who started why it started what was said we don't have any of that made public that'll wait until until the jury trial if there is a jury trial so the other judge that's not charged brad jacobs that he just stand there and watch all this go on the involved in the fight why wasn't he charged that's another one of those things we don't know we know he was involved to the extent that he got both hit and shot at a he he definitely was a victim according to visit diamond whether he did anything whether he punched anyone back with the grand jury found that whatever he did was self defense and that's why he wasn't charged those are all things that we do not know in fact i i asked that specifically and got the answer i expected which is discussed that honest with you i know fight with somebody and i wind up getting shot in i also end up getting criminal charge i'm upset about that that's a bad day there there rules which terry curry was at pains to go into detail with you're going to claim self defense there's two things that have to be true one of them is the force that you use has to be commensurate with the force being used against you he comes with a knife you come at him with a gun it makes a great line it doesn't work so well and criminal proceeding actually in that specific example would those are both deadly force but one guy punches you you shoot him that's why the grand jury filed charges against the guy with the gun so you've gotta have commensurate force the other thing is if you're the aggressor if you started it you can't then claim self defense no matter where it escalates from there chatting with eric berman from the w._i._b._c. newsroom joining No body covers the Indiana general assembly better than our Eric Berman from the WABC news, Rome, Mr Berman, let's get right to our teachers packing heat yet. Yes. It is in progress. Let we told you last week that the Senate had moved to build the floor to to allow that the house has followed suit today. So both the house and Senate could vote later this week, they go better than different ways. But what it amounts to is? If a school or a teacher wants to they could get state money to get trained in how to use the gun properly is this the same thing as the school safety Bill. The Senate version is it is part of the Senate one of the Senate school safety bills would make it one of the ways you could use those school safety grout. So you could use it for metal detectors, you could use it for school security officer at this would allow you to use it for firearms training, the house Bill which came out of committee today. This would cut the school district out of it. This would say it's up to the teachers directly if you want to have firearms training for that purpose. You can get a grant from the criminal Justice. It's two for you. How of the conversation's been going about this because I had a chance to take my son down to the general. About a week ago. He was a page and I saw guys fighting about what theater gets funding. I can only imagine when you're talking about teachers and firearms the conversation gets ramped up a little bit more. You know that the house and Senate debates actually were very similar in committee. The the argument on the pro side, of course, is look this is self defense. This is one more way to harden to target to make people think twice about bringing in a gun for for bad purposes. Have the proverbial good guy with a gun. The arguments against it are number one. Look, you're bringing in someone who doesn't have the training of both bills talk about specifically training. You would have this many hours of training with the God, the argument is, you know, there's still going to be a difference between trading a teacher on the spur of the moment. And having a police officer does this every day of his life of the job training to go through. So that's one of the arguments that comes up the other argument that comes up is you're creating a more volatile situation. You've. I've got kids who are thinking about suicide DNS high teen suicide rate you're putting God within their reach your potentially putting a gun into the reach of the folks who wanted to do a school shooting. So those are the arguments pro and con it'll go to the floor and Bill chambers. And we're a long way from the end of this. What else about this school safety? Bill is this the Senate Bill to seventy nine talks about giving judges the discretion to waive attempted murder suspects as young as twelve is that part of this to that is a separate Bill already passed the Senate that's headed over to the house. And that would of course is directly inspired by the Noblesville school shooting last year where the the shooter at that case was sent to juvenile detention, but you can't hold a juvenile past eighteen if they're charged as juvenile at because he was thirteen with this happened the way the law was written. He couldn't be charged as an adult. This Bill would change that this Bill would say, look if it's attempted murder. We already make an exception for murder if you're. Just unsuccessful. That's still could be charged as an adult. So that'll go to the house sometime next month. What kind of feeling do you have about that life from the sources that you talked to and see every day? Is there a big push to make this happen? Yeah. I think that will sail through that that's sort of viewed as a an oversight in the laws. Edgeley? I believe it passed the Senate unanimously I'd be surprised if that one didn't pass we're chatting with Eric Berman from the WABC newsroom covering the Indiana general assembly. All right. So Eric, here's what we're gonna do. We're going to kind of go down a couple of different topics. Here you tell us where we stand and what you're feeling is. Okay. It's lightning round lightning round crappy. Right. Let's start with hate crimes. Where are we at with hate crime legislation? That would still kind of a mystery of the Senate president pro rod Bray said he hopes to move that at least out of rules committee last week. Whether that meant having a here again rules or reciting it to another committee. He had left open. But in either case it didn't happen. It's. The calendar for this week. They've got one week left after this. We hear it could still be added to a calendar this week. But it's gotta happen by next Thursday. If it's going to happen. So that one is still up in the air sports gaming that is awaiting a second committee hearing. Remember, we talked about this last week that has gone through one committee already has to go through the Senate appropriations committee because of the money involves they have to sit there of calendar for this week, and it's not on there. So we would expect that hearing is going to take place next Thursday last possible day, one of the interesting things that Nigel and I have been talking about is this smoking age. There's a push to make the smoking age twenty one we had Senator Mike young on our program last week sounds like he is one of the senators that's against this. What are you hearing not hearing a whole lot with her to what about the cigarette tax, which the beginning of the session was getting the most attention. You're you're still hearing ads the station from the folks who support this. Cigarette. Tax increase able in both chambers have been saying all along look we were not closing the door. But we're not terribly enthusiastic about it. Because the smoking age does not involve a tax hike. That's a little bit less. Controversial. It's not that anybody is jumping up and down endorsing it. But it doesn't have the same level of opposition. Either. That's another one that's been through one committee already still has to get hurt in the financial committee different one this time, Texan fiscal policy. They too are going to have to hear it next week. If they're good to hear it at all because it is not of their calendar for this week. I know our pal guy Ralph has introduced some gun legislation. What else are we hearing about anything firearm related? There's the one that sort of went down last year the river. There is the Bill that would say, look if you're a church, and you have a school on your property. You operate a church school? Remember schools are gun free zones. And so that's made. The church again freeze. There is a Bill by Jack Hamlin Senator from Indianapolis. There's the counterpart in the house that would say, look, this is an exception. You can if the is okay. With the fact that there's a school there shouldn't rule that out that is closer to passage on the house side the Senate side that's another one that has to go through two committees. It's been through one that is of the calendar for this week in a second committee. So that should go to the floor next week teacher pay that literally about ten minutes ago went through the house. Remember, this is the eighty five percent of your budget has to go to the classroom. Not has to were encouraging. You were urging you to put eighty five percent in the classroom bad has passed the house that goes to the Senate next month that whole encouraging thing kinda just weirds me out a little bit because that can be very loose term. The indy. Eleven new stadium hearing on Thursday. Okay. And what are you hearing about this? Could this go either way is there momentum on one side or the other? This could go either way, I would tend to think it makes it out of committee. But even that's not necessarily a sure thing this is one of those where it's got enough moving parts that people may want more time to look at it. They're not saying no just yet. But there's a long way to go. Remember also that was wrapped up with a new deal for the capital improvement board and possibly another expansion of the convention center. Changing robbed the taxing district of the tax you pay tickets extending that awhile those, you know, the eleven could be dropped out of that. And the rest of it could advance eleven could stay in it. There's a lot that could happen without between. Now, the end of the session capital improvement board deal. Does that include the Pacers in any way, it does? That is the weather's wrapped up with in exchange for the Pacers extent promising to stay in the house for another. I believe ten years might be twenty. But for a long term extension of their lease in the field house. That's where all this other stuff comes if that is all wrapped up in one big package. And what kind of timeline are we looking at for some of these key bills. Well, we're starting to come up on deadlines at this point anything that doesn't make it out of committee by next Thursday is all but dead United as I said before it's like Princess bride. Everything is only nearly dead or mostly dad, but it's in bad shape. Is it doesn't get out of committee next Thursday, the bills probably the big one this week that has its committee hearing on Thursday, we would expect this week or next be state budget? Which of course, is the biggest Bill of the session that's going to go through committee this week or next the casino Bill probably next week. And of course, we're waiting to see what happens with eight crimes and anything marijuana related is dead. Is it tabled? It ain't over till it's over, but I've been saying all along I don't expect that to move. It hasn't been scheduled yet. I will remain surprised if that makes it onto the calendar. But budget analysts are keeping an eye on Berman states receive federal money to help administer Medicaid state budget director, Jason dude, it says if the shutdown drags on Indiana might have to juggle some accounts without that reimbursement or current on a monthly basis we are concerned that we'll have to outlay some additional state funds to maintain those administrative services while the federal government is working through its issues, which says his office is also watching for a possible drop in sales and income taxes.
