It was sent to him on telegram, the social media platform by his girlfriend. Or a girl that he knew, a woman named Erica Flores, but guess who composed the document. Somebody associated with the U.S. government. In other words, the plot did not come from the Proud Boys. It came from a plant or agent or somebody with deep government connections.

"This is Bloomberg law with June Grasso from Bloomberg radio. Stand back and stand by. You may remember that line from former president Donald Trump during the presidential debates in 2020. Well, it's now part of the prosecution's sedition case against Proud Boys leader Enrique tarrio and four other members of the far right group accused of leading the attack on the capitol on January 6th. Prosecutors say the Proud Boys were part of every critical breach on the day of the attack from knocking down the first street barricades to smashing a window with a stolen police shield, letting the rioters into the building. And they're giving the jury plenty of visuals of the attack, showing videos shot by documentary filmmaker Nick quest Ed, who also testified at the January 6th committee hearings. For anyone that really didn't think that there was extreme violence in that day, I filmed it, I saw it. I was subject to it. The violence was real and it was exceptionally powerful. Defense attorneys argue that the defendants are being made scapegoats, and that evidence will show there was no plan by them to stop the transfer of power. Joining me is former federal prosecutor Jimmy garu, a professor at Notre-Dame law school. Jimmy tell us about the Proud Boys who are they. The Proud Boys were formed in 2016 by vice media cofounder Gavin mcinnes, who's a Canadian. The group is described as the far right neo fascist group that engages in political violence. While the actual membership number of members of the group is unknown, it's believed to be in the thousands and the group has, as many as 44 active chapters across the country. And it has a history of engaging in political violence. The first kind of prominent appearance of the Proud Boys on the national stage was the summer of 2017 during the unite the right rally in Charlottesville. One of the organizers of the event was a member of the Proud Boys. And then in June 2018, the Proud Boys attended the freedom and courage rally in Portland, Oregon, where they engaged in violent clashes with members of the Black Lives Matter group in protesters. And then of course they were involved in the January 6th attack on the U.S. capitol building. The attorney for Enrique tarrio said they're basically a drinking club. The Proud Boys aren't a sexist racist homophobic organization. Well, I think there's at least two countries who would beg to differ and one of those is Canada and the other is a New Zealand and the governments of both of those countries have designated the Proud Boys as a terrorist organization. And that designation carries substantial financial and economic consequences. The police can seize the property of the Proud Boys in their country and banks can seize their assets and they can be denied entry into the country. And then additionally, the southern poverty law center has designated them as a hate group. So they have a reputation well beyond simply being a good old boys club. The most serious charge of course is seditious conspiracy, which carries a 20 year sentence. What does the prosecution have to prove there? A couple of points in a one, it's been estimated that as many as 100 members of the Proud Boys were in Washington D.C. on January 6th and participated either in planning, directing or executing the attack on the U.S. capitol. So it's the agreement. It's the planning. It's a conspiracy. And the conspiracy charge does not require that each member of the conspiracy himself participated in acts of violence. It's enough if a member of the conspiracy, any member of the conspiracy, participated in acts of violence. Again, all the members of conspiracy agreed and they agreed to delay to prevent the counting of the electoral votes and they did that with the use of force or violence. And so again, any member of the conspiracy could have participated in the assault on the capitol using force, but it's not necessary that every member of the conspiracy participated in by using force in the attack on the capitol. I think it's probably worth highlighting that one of the defendants is Dominic pezoa and we've seen literally multiple pictures of him using the stolen police ride shield and using it to break a window into the capitol and apparently that was the first entry points where the rioters and entered into the capitol building following the solas lead. Federal prosecutors just won a conviction of four of the oath keepers on seditious conspiracy charges on Monday is the prosecution's plan here sort of similar. And it seems to me that the prosecution is following the same kind of blueprint of prosecution that they followed in the oath keepers trial. And so what we're going to see in terms of evidence being presented to the jury is going to be statements made by the various 5 members of the Proud Boys that are being prosecuted, statements that they made in text messages and other social media messages that demonstrated their intent to attack the capitol building to prevent the peaceful transfer of power. So they're going to be prosecuted based on their own words and that was the case with the oath keepers. And then there's also some members of the Proud Boys previously convicted and better to guilty plea. They agreed to cooperate with the government and they're going to testify at trial against the members of the Proud Boys. And we also saw that in the oath keepers prosecution. So that's going to be the critical evidence. It's going to be their own words used against him. It's going to be members of the Proud Boys that were on the inside that are going to testify as to what these 5 defendants intended and what they did with respect to the seditious conspiracy and then lastly is going to be photos of them at the scene, breaking into the building, knocking down police barriers, perhaps even assaulting police officers. So I think that's going to be the crux of the prosecution's case. Why do you think the judge allowed the prosecution to play that clip of former president Trump saying Proud Boys stand back and stand by? Well, it goes to the intent. What was the intent and the purpose of the conspiracy? And one could argue that this statement and this apparent relationship or connection between former president Trump and the Proud Boys demonstrates that the Proud Boys were acting on behalf of president Trump and that they were again seeking to keep them in power. And seeking to prevent the peaceful transfer of power to president elect Biden. And again, that goes to the heart and the purpose and the intent of the conspiracy. So I think this is evidence of that intent and that relationship between former president Trump and the Proud Boys. Some of the defense attorneys, including the attorney for tarrio, are trying to blame Trump, saying Trump unleashed the mob that breached the capitol. You know, I don't know that it's much of a defense, and I don't think that the defense statements are inconsistent with the prosecution's theory. So it could very well be that former president Trump and lease this violent mob to attack the capitol, but it could equally be the case that in doing so, the members of the Proud Boys participated in that assault and helped organize and plan that assault, which is the basis of the seditious conspiracy charge. Before the riot, the FBI had placed informants in the Proud Boys, and now some of those informants are being called as witnesses by the defense who say they were privy to the proud boy chats and even marched alongside them. He was an ex chairman for the Proud Boys. Has now been incarcerated for a 175 days. Of which not only me, but none of the mothers have been able to see their sons. Children have not been able to see their fathers. They have been given no bond. They have been given actually stripped of all the rights. And just to think that these men that had no arms were trying to overthrow the government is just like a ridiculous thing from any point of view. Enrique was not even in D.C. on January 6th. He had been taken on custody the day before. So he wasn't even there. You know, these guys are fathers, husbands, brothers that have missed up children's birthdays that have missed, and we could just missed his grandmother's funeral last week. So this is a very hurtful situation and again, it's a very scary and serious situation. And that's how we see it.

"No. I really did think I won by 12 million votes and that like the guy who runs the pillow empire secretly decoded the plan to send the ballots to Venezuela to get marked by antifa. And that's a real problem because if you didn't have corrupt intent, if you didn't corruptly intend to interfere with the government proceeding, the fact we all know he interfered with the government proceeding. It is proving that corrupt intent that is going to deter a prosecutor from bringing charges and is going to be a challenge for the primary challenge at trial. And so I am beyond heartened that the first thing, at least Cheney knows this too. And it's hard to explain to somebody who's not on opening arguments listener. Because if you just talk into an average person, the average person is going to be like, well, did he do the thing? And we all know he did the thing, and that's why he kind of has this sherrod mentality about it of like, well, yeah, we all know he sort of did the thing. But the question is, did he do the thing knowing that he lost? Did he do it? By the way, already all know. It's just, do we have enough depositions that might suggest he knew? Yes, that's exactly right. And so hearing number two is supposed to be about proving that the president knew that Donald Trump knew that he had lost and that he knew that the plans that contingencies he was putting into place were not legal. We're not backed even by the papers thin veneer of legitimacy. It was all outcome determinative to keep him in office. And again, we've talked about this in connection with the eastman docs. We've talked about the breadcrumbs that are left. When eastman says, well, you know, now that we've already done some light crab egg, how about some more climbing? Okay, if that document exists, probably more documents exist. I will tell you, and I don't know how anybody can say, oh, there was nothing new here when the first bit of testimony out of Liz Cheney's mouth is, here's Bill Barr. Telling the president saying, I told the president over and over again that claims of election fraud were bullshit. Then having her say we have not seen this deposition testimony yet. This was foreshadowing that his supporters in the room will testify that when Donald Trump heard the crowd chanting hang Mike Pence, Donald Trump's response was maybe our supporters have the right idea maybe Mike Pence deserves it. Imagine being the Republican Party in going up. Nothing new here. The president wanted the vice president killed. Yeah, oh, you didn't know that? We knew that. No, I didn't know that. Yeah, true. So that kind of gets to this idea of how much was new on the Thursday hearing versus how much was finally piecing it together for a larger audience. I have to type, you know, I sort of tweeted out not entirely jokingly. Okay, Liz Cheney is a show listener. A lot of what the Thursday hearing did seemed old news to OA listeners because of the work that you and I have done piecing together, not just pleadings, but the documents attached to those pleadings in connection with the eastman case, right? Because that's been our soul connection to the January 6th committee, which otherwise has not leaked nothing they've done has come out. And so one of the things that we were able to do is look at, okay, what's the minimum amount of information they put out in order to compel the production of more documents in connection with one of the chief collaborators. And as you start to look at it, you're like, oh, okay. This is what they're looking at. So let me give you a perfect example. You and I have read the Enrique tarrio Proud Boys indictment. So we know and we have talked about on this show. The Proud Boys and the oath keepers and their secret strike team 7 and their GI Joe code names and, you know, we knew that they were the militarized arm of the January 6th insurrection. We knew that they had a secret slack channel that planned things out in advance. We knew that at some level they were coordinated up through the president, probably through Roger Stone. We still don't entirely know. All of this is available if you've been reading the indictments in reading the documents, which 0.01% of the public has done. Nobody has. But even I didn't know what was put together incredibly effectively on video, which was the Proud Boys showed up and left the ellipse before Donald Trump began speaking on January 6th, went down to the capitol in advance, cleared barricades and cased the area. Interesting. That's a pretty damning piece of information to have. Is it? Devil's advocate. I know and I mean this because when we are talking criminal charges, somebody will be arguing for Trump. And they might say, well, that's evidence that Trump wasn't in charge of this wasn't the one responsible for this happening. They did this before he even made the speech where he allegedly might have goaded the crowd into doing this. So doesn't that cut the other way..

"Let's just say Joyce white Vance also said it has proven very difficult to convince a jury to convict, that makes important to remember that this very conservative Justice Department has decided it has sufficient evidence now on two militia groups. That's the start of the really big deal, right? Seditious conspiracy charges against Proud Boys and the oath keepers, right? Because that's very hard to prove. That was a big indictment to drop and it actually I think tells us something about the likely coordination between the Department of Justice and the J 6 committee. And you know, I take a slightly different view than my good friend Joyce Vance. I don't think it's all that hard to convince juries to do the right thing once you provide them with common sense, evidence that a crime has been committed and we can prove corrupt intent by the defendant. We've got that in bucket loads. But this seditious conspiracy indictment against the Proud Boys, it is really interesting for a couple of reasons. I was I was so interested in it because it came down one day. I believe day before yesterday was announced by the Department of Justice, big deal charges, seditious conspiracy for Enrique tarrio and four of his underlings. And the very next day, Steph, the J 6 committee announced we will be opening Thursdays hearings by focusing on the seditious conspiracy of the Proud Boys. That's not a coincidence step. That reinforces my belief, which I think you and I have talked about, that the team of former federal prosecutors who are investigating this these crimes for the J 6 committee are coordinating with the team of federal prosecutors at the Department of Justice who are investigating it criminally. And this is yet another indication of that. That was not a coincidence that we got Proud Boys seditious conspiracy and the very next day J 6 a by the way. That's how we're opening day after tomorrow.

No, it's not a racist organization, it's got a whole different thing. We don't even need to get into right now, but the point I'm trying to make is that this hardly proves that of the millions of Hispanics. The millions who are basically now saying, you know, we're not really at home in the Democratic Party, we might have habitually thought we were, but we're really not. We don't like these people.
