"Listening to the best of the Mark Levin show, have a very Merry Christmas. Can you continue to play that music in the background as you produce? As a calming effect, as I read this, daily mail the ticking border time bone 1000 migrants in the largest caravan in history. Crosses the Rio Grande into El Paso. With huge numbers being released under the streets, just 9 days until title 42. Possibly the largest single caravan so far to cross the United States from Mexico. People from Cuba, Venezuela and Nicaragua. By the way, those are all communist regimes. Because they're so fantastic. How about we trade a thousand of these migrants for one Bernie Sanders? Would you agree with that, mister did I would? Comes just 9 days before a federal judge appointed by Clinton. Emmett Sullivan, real head case. Decided at the urging of the ACLU that the continuation of title 42 was illegal. Emmett Sullivan, shore lives in a very comfortable home, been only government dull most of his life. In the suburbs for Washington, D.C., perhaps, perhaps in D.C.. In its Sullivan would never move down to McAllen, Texas, or El Paso, Texas, where he can enjoy the fruits of his rulings, and so the Democrat party, whether they are represented on the bench in the Oval Office in Congress, they do not believe in replacement theory. No, no, no, no. When Chuck Schumer specifically said that we're not having enough births here in America. So we need to replace the workforce with immigrants. He didn't mean replace he meant replace. Yeah. They have great respect. And so that's why many of our cities and Boston, New York, LA, some of the others. They want 16 year olds to vote. They want people to vote without. Without voter IDs. Because if you don't allow 16 year olds to vote, obviously, you're against puberty, institute. And if you don't allow people to vote without identification, well, clearly, then you're a racist. I can't think of a single example where an individual can't get a voter ID, an ID card. Can you mister Madison? Not one. I can't think of any. If you're going to have a driver's license, and even people who can't drive, maybe they're too old, maybe they just don't want to drive whatever the situation is. Well, maybe they can't see. They still need an identification in the state. People who get some form of welfare benefits, people who get social security or Medicare and Medicaid. All these programs are based on the assumption that you have to identify yourself. So why shouldn't it apply to voting? We know why, because the Democrat party is corrupt. They want people to vote twice. They want illegal aliens to vote. They want previewed 12 year olds to vote. They have no problem with this. Because voting is the issue for them. Not representative government. The bigger the mob, the better the mob. That's all. And then overwhelm the system gee, I wonder who wrote about that. Cloud and pivots. Overwhelm it. And then bring your cases to Democrat judges or even some rhino judges. You don't have evidence of fraud. How are you supposed to get evidence of fraud when fraud has been legalized? We have the cleanest elections in history with the least amount. Of oversight. It's not amazing. How's that possible? Well, clearly it's not. But Bill Barr said there wasn't any evidence of anything. While he would know. Actually, he wouldn't. For reasons I've explained so many times before. Don't you sometimes wonder how they get a Merrick Garland in an Eric holder. And we get a Bill Barr. It's nothing personal with me. I'm just making an observation. Biden doesn't even have to tell Merrick Garland. But the politics are Merrick Garland knows. He knows what to do. His Deputy Attorney John knows what to do. The assistant attorneys general, the associate attorney general, the U.S. attorneys, they all know what to do. And they do it. But not us, you know. Not us. Biden's EPA prepares to crack down on home appliances. You know, those damn home appliances are really out of control, mister producer, don't you think? The way they assault people and hold the sort of things they're doing, they're going to crack down on home appliances. Crack down on home appliances. The EPA proposed new rules on Friday that would restrict the use of refrigerators, air conditioning equipment, and heat pumps, they utilize hydrofluorocarbons. They've been after these hydrofluorocarbons endlessly. And I can't tell you how many times the industry has remade these machines. And apply different chemicals in the prices are going up and up and up and up. How do I know? Because I have an HVAC guy. He's a great guy. His name's Gary And we've talked about this. And we knew prior to Biden assuming office. That they were going to pull stuff like this. The EPA's proposed rule would crack down on the manufacturing and importing of goods containing HFCs. So in other words, your recognition units. Which would restrict the use of HFCs and refrigeration

"Notice national review, I didn't say the state governments, the state legislatures, just like the framers. So three fifths of the state legislatures. Decide that the Supreme Court went too far. They have to cobble together their votes, a majority of every state legislature, or I should say three fifths of the state legislatures. Excuse me, that cholera is really acting up. I don't have a cough button, so. Damn thing's still lingering. But anyway. So what does that incorporate? First of all, it recognizes the out of constitutional power I should say, the extra constitutional authority being exercised by federal courts. All cut marbury versus Madison. Yeah, that's a Supreme Court decision that decided how they were going to rule. That's fine. For what they could rule on. I don't happen to agree with that decision. I'm in a minority, but nonetheless, it is what it is. And today it's completely out of control. Anywhere the courts want to roam the courts get to Rome. There's not a thing that goes on in our culture. That the Supreme Court hasn't ruled on. Not a thing. Because they think you're too stupid to make decisions in your own communities and states. So we need 9 justice is really 5 out of the 9 to tell us what to think and how to behave. There are certain circumstances where that might make sense, but not every single one. And every single one, if a state wants a death penalty, why does the court keep micromanaging that? Why? But there's a lot of issues. The court has a legitimate basis. I got it, but the court often roams. Like a legislative body, like a body that's constantly rewriting the constitution and all of a sudden it's a 5 to four decision, and fundamental rights are created or denied. It's really remarkable. But let's go on. So the solution I came up with which I think is the solution is at least in our system. Three fifths of the state legislatures are three fifths of all members of both houses of Congress. Vote within 24 months. That's how you deal with it. I also believe in term limits. For judges. I wrote about that in Men in Black. This guy Emmett Sullivan shouldn't be on the bench anymore. There are people currently on the bench who have demonstrated they shouldn't be on the bench either. But they have lifetime appointments, and nobody's going to be impeached. That was tried by Jefferson and it didn't work. So they're not going to be impeached for their views. No matter how outrageous they are. So why do they get lifetime appointments? They get lifetime appointments because they're supposed to call them straight. They're not supposed to be on the courts. As political enforcers. So you have an individual who firebombs a police vehicle. The summer 2020, trying to kill cops. What else would you do it? And she gets 15 months at the behest of the Biden Garland Justice Department. And they'd have some guy who steals or takes a coat rack. Out of the capitol building, and that guy's facing three years. Same Department of Justice. Same Department of Justice, different judge. But that judge is a real, well, she's not particularly good either. The Democrat judges in Washington, D.C. are the worst in the country. They're the worst in the country. Their disaster. Anyway, I thought you'd be interested in what Netanyahu is planning to do. What desantis did in Florida what Trump was trying to do in the country. And you make enemies People who want to destroy you. People want to put you in prison. People who want to ruin you. People who smear you in the media. Because you're up against the system. You're up against a corrupt system that has grown big and fat and demanding, and so forth. I'll be right back. Months, love

District of Columbia of course their nation's capital That it would be a place that would function as a star chamber for the right in courts where in other words viewer conservative you'd be convicted simply because of your politics And that would serve as a get out of jail free card for the left This is not new They have been it's going to do this for a long time You're seeing the results of it right now The sussman jury yesterday Emmett Sullivan the judge in the Mike Flynn case was not acting as a judge at all and was acting exclusively as a politician who didn't like Mike Flynn You're seeing the upper levels of the FBI FBI managers military managers going woke The marines marines of all people Not that rank and file are working door kickers out there but the management of their social media account putting out like Pride Month celebrations I thought we were celebrating unity That was the whole idea of the Marine Corps What are we doing This is the world's finest killing machine We're putting out all these social justice messages all the time Like what are we doing They wanted this This was a plan The left loved the idea of having Washington D.C. as the central repository of a place where regulations they wanted would go in the court system to be upheld Regulations they didn't like would go to die And political figures could go through the court system they were on their side and be given a free pass like Michael sussman They love this Now the evidence if you missed yesterday's show please listen to the podcast because it's important important one Where I contrast the treatment of lieutenant general Mike Flynn Who was obviously associated with the Trump administration being his national security adviser And how they never had a shred of evidence he lied to the FBI about sanctions I'm going to cover it on my Fox show this weekend too because he never mentioned sanctions The FBI's own notes say it You're like wait wait wait How could this guy possibly been prosecuted for lying about sanctions if he didn't talk about him But that's my point I contrasted yesterday's show The treatment of Mike Flynn versus the treatment by this D.C. court system of Michael sussman this Democrat connected lawyer who despite overwhelming evidence that he was engaged in misdirection with the FBI texting them that he wasn't there on behalf of Hillary Clinton Misses coincidence it's a remnant of my Secret Service day Oh he wasn't there on behalf of Hillary Clinton Even though he was getting paid by the campaign gets off even after just 6 hours of deliberation They love this They've always wanted D.C. to be a place to punish their enemies and reward their friends Through corrupting law enforcement corrupting juries corrupting judges and corrupting the court system This is not new Yeah look at this guy This guy again I said in my podcast earlier Peter again I don't know why this guy's famous on the left I really don't This isn't one of those Mariah Carey J.Lo moments I don't know her If you've seen the meme you know what I mean I don't know her Greatest to me of course she knew her She was like I'm Mariah Carey I'm just gonna pretend that I don't know her right I really don't know why this guy is but the left loves him He's got a huge following on Twitter Same as like Ron flipper rusky or something like that He's at Ron Philip cope or something Of course he's got the current thing up The UK Jim Karen you were going for it You were ready Where's the bug Come on we gotta hit this part of the shelf Here we go Thank you Jimmy I always got a cheer to the current thing Ron flippers he's got the current thing up always He has to switch that though Jim the current thing today is the pride flag Don't you think He's got to flip that He definitely He's a day behind on the current thing So flipper ruskie people love this guy And he tweeted out after Michael sussman got off Keep in mind this is a Democrat connected lawyer.

"Mike Flynn associated with a Republican administration notably Donald Trump Mike Flynn goes to court in a heavily Democrat area and what happened Despite the fact that he's accused of lying and is actually forced to plea under threat Right And it is pardoned later by Donald Trump They still go after him no matter what even to this day I challenge any Democrat Listen to me Any Democrat to produce to me evidence that he lied to the FBI about sanctions Sanctions Your witnessing jury nullification here in lifetime What's jury nullification Here's how it's described by Cornell They're legal information institute It's a jury's knowing and deliberate rejection of the evidence or refusal to apply the law either because the jury wants to send a message about some social issue that's larger than the case itself or because the result dictated by law is contrary to the jury's sense of justice morality or fairness Let me simplify it for you The evidence doesn't matter We're going to let this guy off no matter what That is what jury nullification is Folks that's a real problem That's an enormous problem because let me tell you something I don't want to see jury nullification happening If even Republicans who are guilty of some crime and overwhelming evidence is presented in court I don't want it out there that you could appeal in a political way to a bunch of jurors like you're running for office and get off Because then you don't have a country of laws You have a country where the people with the most connections and the biggest megaphones the law doesn't apply to them This is not a good thing I said this was going to happen I told you this was going to happen I said to you do not hang your hats on assessment conviction even though the evidence is overwhelming because I was quite sure that given the jury the way the jury pool was selected there was no way there was going to be a free and fair trial Now they're not even hiding it Here's just the news article Moral of the assessment trial The jury for woman the jury for a woman actually said this after the trial and after the acquittal She said I don't think it should have been prosecuted the four woman said according to an account in the Washington times there were bigger things that affect the nation than a possible lie to the FBI That was your one job Your one job as a jury was to go in and look at the evidence and not consider bigger things affecting the nation And if you couldn't do that and put your horse blinkers on here right And focus on the actual trial then why did you agree to be a juror if you're distracted by bigger things The answer is because you wanted to nullify the trial That's why They're not even hiding it You would think the four woman would say something simple like hey we considered the evidence We didn't think it was strong enough We didn't think the lie was material Okay fine That's not what she said She's like nah we don't care They're bigger things going on right now Quote there are bigger things that affect the nation than a possible lie to the FBI Not for you there are this was your one job Am I right Jim am I reading this wrong This was literally your one job Is the jurors And as the four woman Jury nullification folks we're getting to the point right now where I'm telling you if you are a public figure as a conservative and you are put on trial in one of these far far left blue areas You have almost no chance of getting a fair trial anymore Look at the judges and Emmett Sullivan in the Flynn case Couldn't let it go Hated Mike Flynn so much He came with an accused him of treason or something like that I said could not stop They could not stop going after him even though to this day There is not a shred of evidence that he lied to Trump or the FBI or anyone else about sanctions I'll prove it to you next Doesn't matter.

"I want to talk about the Republican Party and January 6th. I've said before how disheartening it is that so few Republicans would they just exception of a handful in the house to my knowledge, not even a single senator has prominently stepped forward. To speak out about the outrages against the January 6th defendants. I mean, you have people who are held in confinement now well over a year since those events and they haven't been convicted of anything. So judges just hold them under the presumption that there are some kind of a danger to society to release them. Why? Because they would mount future insurrections. I mean, the sheer foolishness of this. The maliciousness of it is outrageous. And here we are, we've thrown a lot in with the Republican Party. We do a lot for the party, we are activists for the party. And what does the party do for us when it's when it shows this kind of blind willingness to leave its own troops bleeding on the battlefield, so to speak on the political battlefield? Now, I noticed that in some of these cases that are coming up, there are left wing judges that are quoting Republicans. In trying to make a quote bipartisan argument that January 6th was some kind of threat to national security, terrorist plot against the government, again, this is nonsensical stuff. But these judges, by the way, blatant left wingers, I'm talking about people like Tanya, I believe Obama appointee. And also. Emmett Sullivan, another guy who has been these people are just torturing these January 6th defendants. In the manner that you would expect for more authoritarian or even totalitarian states, I'm not saying we are living in a totalitarian regime, but I'm saying these judges are acting like we are. There are the same, they have the same kind of apparatchik mindset that you find in those regimes. So here is M Sullivan and this is a recent case involving a guy named Robert guy swine, who is apparently.

Julie Kelly: ACLU, Government Doesn't Care About Awful Treatment of January 6th Detainees
"What Julie's doing and asking questions is doing the nation to service that the media used to do Julie but they don't seem to care And even worse they don't seem to care about the treatment of the January 6th prisoners either all these prison reform advocates are prison reform We've got too many people in jail We get when you talk about January 6th They're like throw them in the cell feed them dead rodents I mean what a bunch of frauds And let's keep in mind the people who are detained right now as I explained in my book in this D.C. gulag which has been opened just for January 6th defendants and they have not been convicted of any crime They are there denied bail at the request of Joe Biden's Justice Department With the consent of D.C. district court judges and we're talking everyone some wake and appointees Obama all the way to Trump appointees Signing off on pre trial detention orders to keep these men behind bars their trials keep getting moved I just listened to a trial this week a man who is turned himself in over a year ago his trial was supposed to start February 24th It now has been moved to April 20th Judge Emmett Sullivan yes that judge didn't even consider flatly rejected the idea of allowing him out of prison Awaiting a trial did he just moved back another two months

"27th sleep magazine story by Mark Joseph stern. Along with his efforts to help diversify the federal judiciary, Ben said he'll continue his leadership roles on several nonprofit and corporate boards once he retires. So I was on the board for many years of the legal counsel for legal diversity headed by Robert gray, former ABA president. And here we have general counsel, managing partners who are pushing for change. We've had close to 10,000 lawyers, go through that program. And so we think that's been a great change in all credit to our board and to Robert for what they had done in our various members. I'm leaving that board. Active with a minority corporate counsel association and their terrific leader, Jean Lee. But there are three things I hope to continue. I am going to stay with the environmental law institute where I've been the chair for 5 years now. And we're bringing diversity to environmental law and we want to bring the rule of law to environmental issues across around the world. We want to address climate change. We want to address climate justice and environmental justice. And so I'm invested time there. Again, working with others, we teach environmental law, environmental justice, at the Howard law school, and 7 of our students are going to be working for the environmental law institute. And we found funding for those Howard law students. So they'll have that exposure in that opportunity and they are doing amazing work. I also work with others on the D.C. bar foundation, in addition to the generosity of lawyers, the District of Columbia government, historically, has given us about $11 million. This year, mayor Bowser and our council up that the $22 million. And that money is going to go to legal groups who serve the poor. Who serve the indigent. And now, coming out of this very difficult time of the pandemic, people need those legal services. And so that's important. And I'm also on a judicial nomination commission. So we choose our judges for the D.C. superior court and D.C. Court of Appeals and I have 6 wonderful colleagues on the board where it's led by judge Emmett Sullivan, who's been the judge of about just everything in the District of Columbia. And we've found some amazing people willing to serve as judges and, you know, juris make all the difference. And because they're the ones that establish the respect of the law, the integrity of the process is in their hands. And then in terms of my for profit board service, I'm the lead director for the Northwestern Mutual life insurance company, the quiet company. Very proud of Northwestern Mutual..
