"Ledger That essentially records the transactions fewer to boil it down even further. It's an asset with evidence of ownership So put it into real world concept so we all think about when you go and buy a car you get the car but you're proof of ownership comes through the title which is recorded with the dmv. You can think of the nfc and the smart contract behind it which is recorded on the blockchain. Which is that ledger. that i mentioned As the the title And approves your ownership of the car now just like with the car having the title doesn't actually You know it's not the car itself you can't go and drive it but if anybody questions should if you own it you have. That document approve it. When you're buying an ns t that's really what you're getting and like anything else on a blockchain. I it's there. It's supposed to be permanent record of your ownership. But unlike things like bitcoins or other cryptocurrencies. Nfc is non fungible. Meaning that it's not freely exchangeable for something else so one Big corner for one of theory is the same thing as any other. Bitcoin earthier with an nf t were really focusing on. Its unique this and while of a sudden david Have nfc's become front and center. What what's happening in society. You know it. That's funny because nf really aren't that new. They've really been around since about twenty fifteen but they entered the public consciousness. A lot. Earlier this year With some really eye-popping sales of some artwork I think the first one that really caught my attention Besides a general awareness event of teas into other earlier forms was the sale of a sixty-nine million dollar piece of digital artwork that was actually comprised of fourteen years worth of daily illustrations by an artist named people. So they've really caught everybody's attention now because you're seeing sales of the digital art through an asset that most people hadn't heard about and the numbers are up there with some of the highest sales for artwork or any other collectibles out there so it's really caught a lot of people's attention here ultimately they're important because the market says so just like the paper dollar bill you know we believe that it has value so it has value but nf represent a little bit more than just expensive collectibles. There's a lot of opportunity behind them and how they can be used So you know a lot of the attention that these early high sales artwork generated actually started creating Some thoughts and other brand owners and how they could exploit an f. T. so you're seeing things like some of the earlier uses included Use in video games for unique luke boxes or character skins or you know weapons even I think in twenty seventeen. There was a game called crypto. Kitties where you could buy and trade. A unique digital cats The nba picked up on it for Tradable collectible trading cards of sorts their moments from nba games from the prior season Through the nba. Top shots so this has been picked up by a lot of different Owners of content owners of valuable resources that wanted to find a new way to reach their market. And the the eye-popping prices really drove a lot of interest drove a lot of creators to get out into that market. And it really just spurred a lot of the New ideas around what an nfc could be and given that each of these as you need you know. They are really valuable because they're rare so effectively. You're the only one that owns what you're buying now. These can change a lot of different ways but you know this is just important now because it represents a new toy that content creators have to get out there and provide something of value to their fans around the world. So let's say. I go out tomorrow and i wanna buy an nf. T- what would i be getting in my hands or in my email box. What can i expect to see to show that. I own this. Nfc yeah so you go out. And you buy an f. t. through a variety of marketplace's user linked to various blockchain's that are out there the the most common one for nf tease the theory of blockchain But there's there's a number of marketplace's out there and when you buy the nf t- You do that by exchanging some Crypto currency for it typically And you do that. Through your crypto wallet and when you buy the nf nfc you get a registration in your wallet. Says you own this. And that's basically it so the nfc. As i mentioned earlier you have the asset which let's say this is a piece of digital art that is linked through a smart contract and it lives separate from that contract. It's not something that's embedded but you can access that through your wallet You don't necessarily get a physical copy but there are You know there are different content. Creators that are exploring ways to bring an end of real world. So for the most part you just have proof of ownership and nothing else and the interesting thing for a lot of buyers That they may or may not know depending on how closely they read the contracts. They're just getting ownership over the right to say that they have the ability to display that one and f. t. it's essentially a license It's you know similar to a seat license and sports or You know it's i p Licensor is you know anything using the ip. That's in a contract there. But you don't get the most of the time she don't get the copyright so you have very limited rights and what you can do with this other than you know. Showing it privately for the most part holding it in their Digital wallet reselling it and then essentially having bragging rights that you own a multi million dollar asset what about the ip issues intellectual property with respect to content creators. How does that sit into the analysis to content. Creators really have a lot of Leverage and a lot of risk in ip market space This is an opportunity for people who had created things on the internet. That largely were circulated without you know necessarily getting value There's you know for people creating new art it's a way to reach a different market and sell things and you know really get exposure In a way that and get value from that they maybe not They maybe weren't able to get before so if you're a content creator going out there you wanna find a marketplace that will you allow you to sell the work the way that you want to You know you're considering housi- marketplace advertises the nf t to the public and you know what it describes that they're getting with their purchase. So you know fair implying that they own the artwork and they can do whatever they want with it. Maybe they're leading a buyer to believe that they're getting the copyright You know the content creators also want to make sure that when they are licensing their ip either for someone else to create An ft's or if they're minting an tease themselves which the term for their creation processes minting If they're admitting it themselves they wanna make sure that the smart contracts behind the nf us are carefully regulating. What the buyer is allowed to do it so you. You wanna make sure that it's a license an t. Not an assignment of ownership of the copyright assuming they want to retain it You know there. There's also you know that's part of the process of going out and selling the nf t but there are all sorts of you know with any other As with any other kind of intellectual property there's risks of bad actors going out there and minting and fte's of our creators own works so if you're a content creator out there there's new arena where you actually have to go out and be proactive and making sure that somebody else isn't misappropriating. Your copyrighted work or you're if you're a major brand that has trademarks trademarks or anything like that. So it creates a new wrinkle for content creators to go out there and make sure that what they have created is in being counterfeited by third. And for the most part the Marketplace's do try to verify that the sellers are who they say they are and that they own the rights that they have but some of the early ways of verifying identities was through checking. You know somebody social media usage to make sure that you know they represented you know who they say. They are now just like any other identities out there. It's not that difficult to spoof an identity of social media account or somebody else and trick one of these marketplaces so there's all sorts of unauthorized Reproductions of copyrighted works out there There's also people that may have believed they had rights to do things that they don't have There's an early anecdote of Dc comics going after a well seeing that one of their former illustrators had made one point eight five million dollars off of selling and fte's featuring dc characters and dc headed then go around and inform their creative teams and they're freelancers that going off in creating an fte's with their characters was a definite. No now so you know. Even if you're the company employing the creators you have concerns here going out and monitoring making sure that people aren't doing things that they're not supposed to do and you know for the most part because these are really novel marketplace's some of the traditional tools that Ip lawyers and brand content owners have used to monitor their ip rights don't necessarily cover An f. t. marketplace's news. You're using something like a watch service that may not get to the level of an nfc marketplace to a lot of this is really manual. It's hard to find and if you're not somebody who's thinking about selling it Selling an f. t. directly you may still experience all of those risks There's also there's interesting news that comes out Just this week. I think Where damon dash. Who's the co founder of rockefeller records wanted to sell an nf t- that included the copyright for jay z's Debut album but he is a co founder of the company and the company believes that it owned the asset which was the copyright. So there's even a dispute doing the company and the co founder over what they can do. There's a lot of ambiguity here. it's kind of an interesting space that hits on a lot of the interesting things that got us all into intellectual property But you know it's new and we have so much that's yet to be seen in how Ip rights will be affected and the consideration set content. Creators will have an how they can even go. Back and enforcer rights or claw things back if you know in unauthorized work was sold as an f. t. before the creator was aware of it. What about from the perspective of marketplaces in buyers. What are some of the issues that are being talked about these days. Sure yeah so the the marketplaces themselves definitely want to ensure that the content that's available for sale is something that is reliable They want to know that the person selling it has the rights to do so but just like a lot of commercial contracts you know when you sign up to join the marketplace and what you're minting. Nfc's you're making representations and warranties that you have the rights that you say you have so ultimately the marketplace is going to kick it back to the person minting nf to you know if there's any sort of copyright infringement or trademark infringement from a pr perspective you know. Of course it's bad for the marketplace. Not only to be infringing creator's rights or you know aiding somebody to Infringe those rights. And it's it's going to become a complicated issue where an nfc gets sold and it's purchased through you know using crypto currency It may be through a user. Who's under a pseudonym. We don't necessarily know who they are And you know the person. Sorry the person minting it may be under a pseudonym We may not know who they are. And so if this is sold as a counterfeit somebody is the buyers out a lot of money. Potentially the marketplace is going to want to refund that because it wasn't their fault and they may not be able to go out and find the person who minted the actual. Nf t. so there's gonna be some interesting issues And frankly. I can't wait to see some of this future litigation. Yeah definitely be fascinating. I was thinking about that as you were talking about. You know things that are happening. There's many opportunities. I think that are will be reading about a where. Parties may Litigate over ownership and other things So it stuffing something to to watch out for what about from the perspective content creators. if you're a content creator a what can you do today to protect yourself and there's something like that a content creator should be looking at to get involved in the space as things develop You know as with any ip. The first step is to be vigilant. You know no white ip right you have and try to monitor those as much as possible This is easier said than done if you're a small creator if you're you know big corporation like the dc comics. That i mentioned they have more resources they can put staff on reviewing the marketplaces for new drops. You know they're going to see what new. Nf teas are coming out You know they have more of an ability but if you're a content creator you definitely want to look at all the different avenues. You have to protect your intellectual property and that's where this is actually not that different from you know any other. Ip rights that are out there so if this were physical work versus digital You know through blockchain. This doesn't really make a difference anymore. So you have a lot of ways of trying to protect yourself. Vigilance is the first making sure that you know. Unwanted sales don't happen and if you notice that you have our work on a marketplace that's up for auction For an nfc you can actually send a dmca notice to the marketplace and it seems that a lot of them are honoring those right now. They don't want to be involved in selling something where you know the person minting and he didn't have a right chore. So that's your first step. Get that content. Taken down There's other proactive things that you can do as well You know registering your copyrights always a good idea. it allows you to go and you know sue if somebody is infringing. The copyrights in federal court You know but you can also consider the other forms of ip protection if you have a you know particularly novel way of the nf t for example the nfl the nba top shots uses a almost a cube frame for their Highlight an f. tease. And that's different. From how anybody else presents it so that might be something that could be protected through. A design pat You know if you are if you know you're going to be entering into the market and selling an tease. You can obtain trademark protection for those in fte's so you know there's all sorts of brand owners out there that are engaging in this I did a search not too long ago and saw that fender guitars has trademark applications related to an tease for their stratocaster trademark or for the fender trademark There's also applications out there for people that you may not consider May be more obvious than others but saks fifth avenue is putting out trademarks or nf. Tease kiss. The band has trademarks. Urs has applications even the andy warhol foundation. Maybe a little more obvious in that sense but you know. These are all strategies that content creators can pursue. And it's just one more avenue to protect your rights. If you're going out and selling the nf nfc's maybe you missed the initial copyright ground. But you know you weren't able to stop it with dmc a notice but if you need to pursue somebody who's infringing rights you know any. I think any attorney would advise you wanna have as strong of A case as possible and it's not just necessarily limited to your copyright can also fall under the infringement of design patent maybe a utility pad and if you have unique ways of presenting marketplace for example or the trademarks. As well david were getting near the end of our interview. I have a question that is what other applications might be out there for. Nf tease beyond collectibles. What's next for an nf t. In other words you know. Nfp's or something that has been a challenge to wrap my head around. Because every time time. I think i have it. I hear of a new idea so you know. Nfc's can really using a lot of different places is not just collectibles. Not just artwork. It's you know digital trading cards. It can be things like video footage. songs you could you know even sell individual tracks t- Just to almost a digital rights management software to record who actually owns it You can you know. Pursue things like event tickets to verify that somebody's actually holders that can be rewards exclusive access to different things There's even creative people that are using. Nf teases digital tokens. That can be exchanged for real world things. So there's a san francisco street artists. I liked called finch who is using the nfc as a token that can be exchanged for physical copy of the exact same piece of art. And then if you don't want the you don't wanna be possessing a physical copy anymore. You can turn that back and get the digital token again I even have seen things of one of the betting companies creating digital dna for racehorses for digital horse races and gambling It seems that the ideas behind teas are limitless at this point. So anywhere any place where you have an asset where you want to track ownership and you want it through this immutable ledger. That is blockchain. that's all ripe To be an nfc. "Twenty sixteen season by winning the national league's most valuable player in his second year in the bigs. He also became the first way to win. A golden spikes a baseball america. Minor league player of the year a rookie of the year award any most valuable player in consecutive seasons. He literally one the best player of his caliber every year except for his rookie year when he was a rookie and won the rookie of the year award and then won the mvp and his second year. That's pretty amazing. But ever since then he's pretty much been an arbitration and been making his first year made a million dollars in two thousand seventeen a and then in two thousand eighteen made a bunch of money at ten point eight five million dollars in arbitration and then in twenty nine hundred eighty s low starting after hitting his first home. Run against the rangers is bad was kind of average just through april. Twenty fifth at two thirty two brian's performance substantially improved though heading into mid may and then at the end of the year he finished with a two eighty two batting average a three eighty two on base percentage and slugged. Over five hundred all although on defense he had the lowest fielding percentage of all third baseman of a nine forty seven and twenty twenty. He struggled but this year he's also moving around a whole bunch And he's definitely probably the biggest prospect in all of baseball right or not prospect. "You guys tuning in. We've got a fantastic show lined up for you here today. A lot to talk about a lot to discuss. Of course this week started the implementation of the new sticky substance rule. We also had wander franco. Make his debut so we're going to get into conversation about baseball's number one overall prospect who was called earlier. This week will then talk Major league baseball draft get into some updates in the mock drafts. What's we're hearing out there. Talk about the college world series. Let guys know what's going on out there in omaha and then wrap things up with some more major league baseball conversation around. What's going on and the diamond. So starting off of course. Let's talk wander franko. What's going on here. He was called up the number one overall prospect by the tampa bay. Rays made his debut and boy. Oh boy was it a good one but taken a half a step back here and diving into who is wander franko. And how did we get here. Well he was signed back in two thousand and seventeen from the international pool as the number one international prospect the tampa bay rays out of the dominican republic to a minor league contract worth three point. Eight five million dollars and this was a high price to pay back then for the race for franco and but it didn't come with some controversy. Because if you look into it. Francke was apparently ready to sign with the new york. Yankees the yankees had everything lined up. They were gonna give him a six million dollar deal. But apparently that fell through due to an update in an agreement in the collective bargaining agreements which effectively capped the yankee spending amount internationally enforced them to basically stop a deal. That was done with franco. I mean people basically have said that all the t's were crossed in the eyes were dotted. It was just a matter of getting him. To sign on the dotted line. When ultimately major league baseball and the pa again agreed to the new cba international rules and thus they had to rip up this six million dollar contracts so new york yankees fans have to be a little bit upset after learning that he ultimately ended up with the raise. Because this was not huge news back when it happened this one was kind of swept under the rug but ultimately him now being with the tampa bay rays and ultimately being the number one overall prospect in his future certainly looks extremely bright man. It's got to be frustrating for those yankee fans listening out there. So who is wander franko. He's the nephew of current major league. Infielder eric eibar and former major league. Infielder willy eibar. So he's a nephew or the eibar family. He also had two older brothers playing in the minor leagues wander. Havi air franco a third baseman in the royals organization and wander alexander franko. He is a corner infielder in the astro system. His dad also played minor league baseball. So baseball runs in this guy's family and exactly what you think he's he's one of the top prospects but diving into franko. He's of course a five tool talent now on baseball scouting scale. So when you're a prospect. They have a scale from twenty to eighty. Those are the scores. You can get and basically every different tool and they have five tools. Well every one of its tools is fifty or above so basically average or better than average. His power tool received a sixty grade. His arm in speed both came in at fifty five his fielding tool was actually his lowest graded at fifty and his hit tool or hitting tool checked in at the highest level of eighty. Which of course is very rare feat so basically the scout said. Hey this guy can match right. He can hit anything. He's going to hit for average. He's got an eighty hit tool he also has some decent amount pop to them with a sixty power tool. Meaning this guy's gonna live gap the gap. He's gonna pop ones outta here. He's an offensive excellent player now defensively he could use some work with the fielding tool at fifty but they still have him projected to be an average defender so not a liability defensively and his arm strength and speed both slightly above average at fifty five so essentially saying hey offensively. This kid is extremely gifted defensively. He's just about average but with those offensive grades. It makes him obviously a huge huge advantage there and a huge prospect so back in twenty nineteen he stole eighteen bases over the course of one hundred and fourteen games split between single-a and high a ball so that goes to show how his speed tool obviously projected also as a seventeen year old rookie ball. He launched eleven home runs in sixty one games. He followed that up with nine home runs in as an eighteen year. Old in twenty nine thousand nine hundred and then this year at aaa. He had seven in thirty eight games. So the power tool had eighty certainly seems to be very very active but his eleven point six strikeout rate that he had a triple a. was the highest of his career. It was also the first time. His rate had reached double digits or exceeded his walk rate so another component of the hit rate is having a great eye at the plate and only chasing pitches in the zone so he doesn't strike out a lot.
