"My question is, what do Republicans do about this? Are there any heroic figures in the Senate willing to stand against this? Well, Senate House, wherever last night, so the indictment gets handed down at what about 5 to 6 Eastern Time, something like that. And I start getting news alerts immediately from all sources across the board left, right, middle indifferent, et cetera. And one of the things that I was impressed by was that the immediate leadership of the Republican Party, particularly those in the house, immediately made public statements immediately went on the record immediately opposed this and started saying that there would be investigations from the house. Today I have in front of me, Manhattan district attorney Alvin Bragg's offices response in which he is trying to tell people in the House of Representatives that they can't have the documents related to this indictment because it would present unlawful political interference in an ongoing criminal case. Talk about the irony of just that statement alone. I mean, this is ongoing political interference in or this is ongoing supposed criminal interference in a political race for the president. And we've never subjected a president and there have been those that have done bad things. There have been those that likely have broken the law to a much worse degree than a campaign finance reform statute being violated. But we've never, we've never seen this happen. We've never seen an indictment brought against a former president and to do so on the most specious grounds possible.

"Kevin. I wanted to get you on if possible to talk about what happened last night, the indictment of president Donald Trump. What is your reaction to this? What do you have to tell us? Well, I think as a news story, this has been discussed at nauseum to the degree that it could be for the last three to four weeks without any knowledge of what was going to be in the indictment. And sadly, until the indictment is unsealed by judge, we still won't know what is in the indictment, so we don't know what the charges are. We don't know what Alvin Bragg is claiming. We don't know what the grand jury is claiming. We did learn one piece of new news from some source and it appears that the case doesn't involve only stormy Daniels, but also the other woman that was involved mcdougall in those payments. And at the end of the day, Trump's position hasn't moved, he said all along. He didn't make the payments, doesn't only thing about him. Didn't know anything about him. They were put in his ledger as legal expenses, which is what I would put if I had payments that I made to lawyers, so we're kind of still at square one where we were when they leaked the word that they were going to arrest him and there was going to be an indictment, but then nothing happened for weeks. We're really no further along. It's a sealed indictment and it won't be unsealed until a judge unseals

"The crypto community is extremely fond of the apocryphal Gandhi phrase, first they ignore you, then they laugh at you, then they fight you, then you win. We have a tendency to pretty much always think we've entered the then they fight you phase, but as of this quarter, I think it's pretty much official that we are now well and truly into the then they fight you face. The breakdown has had numerous shows about operation choke .2 and what seems like a coordinated effort to deplatform crypto companies from U.S. banking and in general push crypto offshore. But just in case there was any doubt, any doubt at all. Yesterday, Elizabeth Warren, the self styled emperor of the crypto antagonists, announced her formal reelection campaign for her Senate seat in Massachusetts. To do so, she released a video on a series of graphics with her looking determinedly off camera, with a big blaring headline that had been recently written about her. Some of the accomplishments highlighted included, subsidized child care, and over the counter hearing aids, great things for sure. But that wasn't all she chose to focus on. And what she did focus on would overshadow all of it. The image she chose to start that video, the headline reads Elizabeth Warren is building an anti crypto army. The headline is drawn from a February article in Politico, which covered the senator's sponsorship of the digital asset anti money laundering act last year. That act would require software providers and blockchain validation infrastructure operators to record significant personal information about protocol users and proactively generate money laundering reports without any government requests for information. Coin center called the bill unconstitutional and said it was, quote, a direct attack on technological progress, and also a direct attack on our personal privacy and autonomy. Of course, that's not Warren's only attack on crypto. Since this time last year, senator Warren has sent at least 15 letters on the topic of crypto to regulators, companies, and even the FTX bankruptcy judge. She's also sponsored at least two bills which were dramatically increased the data collection requirements within the crypto industry.

"First of all, let's remember, Trump is being indicted for campaign finance violation. He used campaign finance funds to make this hush money payment and he altered or his company altered documents in the process. And guess what I was prosecuted for, a campaign finance violation, where, in New York, and so a similarly frivolous and if I can use the term trumped up type of charge, a charge that Trump points out in his case is never normally brought against anybody. And the same was true of me. There was no single example in all of U.S. history of someone like me, first time offenders, small amount of money, $20,000, no quid pro quo, no corruption, even alleged. And yet here I was facing, again, not a misdemeanor, but a felony, same with Trump, they're trying to take this campaign finance violation, which ordinarily would be a misdemeanor and bootstrap it and elevate it to a felony. So the whole thing is illegal sham. It's a show trial. And I remember when I met Trump after my pardon, it was Debbie and me and our family, and we were having a kind of a heart to heart. And I thanked him for the part and he goes, yeah, I didn't actually was the right thing to do, but then he said something else. He goes, well, gee, he goes, it wasn't that hard for me to grasp, they're trying to do to me what they did to you. And at that time, this was actually 20 19, I believe, yes. We were I'm sorry. It was 20 2019. We were talking about the we were talking about the impeachments. So Trump at that point was facing the possibility of a second impeachment of which, of course, came after January 6th. And but impeachment is, although it's based upon the idea of a quote high crime or misdemeanor, an impeachment you don't go to jail. You just lose your job. You're just tainted. It's almost a political type of black mark. But now Trump is facing a criminal charge with a left wing judge and a left wing jury. So if the January 6th defended snow what they're up against in D.C., Trump, I think, knows what he's up against in New York. So this is a very bad situation. It's unprecedented, think about it. You got a two year statute of limitations on this, the state case, and the federal case again has been pushed aside by federal authorities as not valid or not sufficient to get a conviction. Again, Trump didn't even get fined. Hillary Clinton got fine, she didn't get prosecuted, but she got fined for almost the exact same thing that Trump is being prosecuted for. And yet the mainstream media is going Gaga over how great this is. The nitwits on the view are just kind of cataclysmic in their joy and orgasmic in their love of the fact that Trump's been indicted. Again there are going to be a lot of motions. The state court doesn't have jurisdiction. In Tennessee, for example, where we're broadcasting from Memphis, the district attorney in Memphis can't file a case prosecuting the violation of a law in Montana. Different jurisdictions. Same thing is true with state and federal, city, and federal, city, and state laws. And you've got this DA who ran as a source funded candidate, pushing forward to prosecute Donald Trump.

And so it wasn't hard for me to say that, yes, I'm running a defeat Donald Trump in this election. But what happened to him was wrong. It is a national disaster. I woke up this morning. I'm not being I'm not trying to be hyperbolic here. I literally felt like I woke up to a country that is not the country that I learned to pledge allegiance to as a kid. We are not a nation that allows the party in power to use police force to arrest its political opponents. That's exactly what's happening here. This is the stuff of banana republics. And I don't care if you're on the left or the right or you're running against Trump or not. We're running. I'm running to lead a country that safeguards certain values. And if those values are going to be gutted, what really matters is protecting that more than some electoral outcome. And so is it more convenient for some of us if Trump is in this race or is compromised? Sure, but put that to one side. I think that this politicized prosecution needs to end Alvin Bragg needs to put this case back on the shelf where it belongs. If this were anyone else other than Trump, it would have been charged as a misdemeanor at most. And I think that's wrong.

But on the most obvious one is people may want to vote for him for president of the United States. Now this does not eliminate him from running for president of the United States. What it definitely puts up speed bump in his path. If anyone could turn lemons into lemonade, there's no one better at it than Donald Trump. He'll figure out as you just said, some way to make this mug shot into something positive for his reelection. But it's just not how the system is supposed to work, Mike. And that's the bummer of this hope.

"Crazy, crazy news out of New York. And crazy news for this country. They've now officially indicted former president Donald Trump for hush money paid in the stormy Daniels case. This is one thing that I think is very, very bizarre about this and it's crazy it's two left shoes and an 8 legged man. We're talking about a payment to a prostitute slash porn star that was made through his lawyer and he reimbursed his lawyer, but didn't no take that on campaign funds. And so they are going through all of this process to try to indict him because I'm assuming that the payment wasn't the problem. We don't know what the charges are, but was the payment the problem? I'm going to go and tell if you don't give me this money. You settle with them, you sign on disclosure, they don't tell, you paid in the money that's it. Is the crime and I have to see the charges. Is the crime that he didn't disclose them on campaign spending? Or is the crime paying somebody hush money? Right now I don't really know because we don't know what his indictment charges or at least from the articles that I've read. But let me just tell you this, man. It's two sides to this on how I feel. One side is a witch hunt. They doing everything they can to get Donald Trump embroiled in some type of controversy. Some type of conflict, indictment does not mean conviction, you're innocent, it's a proven guilty. So just because he's indicted, don't mean that it's going to go anywhere. But if they drag you into court in a tarnish your name, that's enough damage done. You don't have to go to jail. Then there's another side of it. Is that I would say that Trump should have done this. I don't know what other part to add to this.

And we're going to talk about releases and waivers. And you know what's what's the biggest takeaway? Um uh, What's the what's the biggest takeaway on this situation? Because a lot of people believe they can't do anything about it. Uh, this stuff, right, you know, and, uh, that it worries me because we've done shows on this before and talked about where your rights are and where they are and what you have available to you in which you don't have available to you. And what you might be able to do in which might not be able to do and it, uh, we're repeating it to this week because I think that when people see it on the news, it's been on the news quite a bit, And they kind of get the idea. There's nothing they can do. Um, uh, about what's happening with with regard to their their cases and with regard to, um if they get hurt an amusement ride or if they get hurt in a in some type of amusement venture We have a lot of recreational ventures in Colorado, and we do have laws that state that they can publish these general liability waivers in the general liability waivers get signed, And as he gets signed, you get bound by him, and but that's not the end of the story. There's certain requirements that the general liability waivers have to include. They have to include certain language, for instance, that they don't have the word negligence in them. They're going to have a tough time saying, you wave specifically the word negligence. How they're written is going to be questioned because there's a lot of questions about Whether or not you you it's in what right kind of legalese that allows somebody know what's going on and understand what's being said, when they're presented and who signs them and how they in under what circumstances. In what the knowledge is of both the persons supplying the recreation and the person who is signing the waiver. So you know, in this particular case, I I'm not going to make a statement is to Weather and Glenwood Caverns. There's lawsuit available or or some kind of compensation available. Those parents who lost their child, It's a tragic event. Um, And the question is was. There's something this with respect Glenwood Caverns? Did they do something who was negligent and inappropriate? And if they did then It has to be addressed. And whether or not the liability waiver will hold up is another question. And I'm not so sure you just give up on it. Right. Exactly, And that's the issue. You know, That's the message. We did a show in this as well. Another show on amusement rides and releases on recreational type matters like one, you know, rafting. Snowmobiles skiing that sort of thing. So we went over the common lawn, which is the court made lives. You know, we inherited it from England. We've covered that many, many times on the show. There's also a statutory loss and you know the big picture in Colorado. That kicks kicks it off is this amusement park ride an incident that recently happened involving the death of a six year old girl? Uh, Brad said very tragic. In Colorado. The common law still applies. Uh so there's a couple of exceptions. Think about this. You have the General common long Then along comes the Legislature passes a statute specifically for the skin industry. Specifically for the scan industry. So if you're skiing and and there's an incident, so they say, Well, you have a release on your back of your ski ticket. That's that's one thing. And then there's a statute that covers and limits their liability. But that doesn't mean the end of the story. Also, then, along comes a Legislature when Colorado wanted to get major League baseball here 25 26 years ago. And they passed the statute because Major league Baseball wasn't gonna come. Let's get past the statute specifically exempting liability and protecting against liability for certain baseball. Batch flying in the air ball being hit balls being foul balls, etcetera, so That's the That's the general picture, but you get back to the amusement. Right? Bad. Uh, these? Yes, they say there's a release. Yes, they say there's a waiver sometimes you sign it. Sometimes you don't. Because it's just gonna ticket. Sometimes it's going to computer, they say, you know, you agree to the terms and conditions. So this is all based on contract lost the Bradleys cover that, you know, we have such things as adhesion contracts. We have such things as assumption of the risk of such thing as waiver, and you can't just automatically assume there's nothing you can do about this many times. There's something you can do legally about These so called Releases and so called waivers, but, yeah, there there are And you know, the first thing that has to be remembered as when we're dealing with this kind of stuff is, um, you know what's somebody's got to look at the circumstances under which things occurred. And the and I Do not think you can ever just go on or take a case and have somebody said they got here to hurt the amusement park. They got hurt in the recreational activity and just say, Well, you don't have a claim. The, uh you've got to see this specific waiver and you've got to see the circumstances under which it occurred. Uh, there is a lot of lot of, uh, of Belief and indications and there's cases out there that is stated that you've got to have the word negligence. If you're going to wait as somebody to wave your negligence. You've got to have the word negligence within the waiver. Um then you got to talk about circumstances under which the ticket was purchased. Under which the ticket got into the hands of this little girl or the parents for this little girl, you've got to talk about circumstances under which the whether or not they, uh there was gross negligence or something that exceeds just regular negligence and whether or not there was a waiver of those risks, whether or not there was an understanding of those risks and whether or not that information was provided. There's a lot of questions that come up. And in this case, I think there will be a lot of questions. Um, I'm sure they're going to get a hold of, uh, an attorney to take a look at it. And I hope the attorney does it looks into it. You've got to talk about whether or not The event was in existence or the existence of the vet was a duty to the public. In this case, it probably wasn't the but you look at the nature of the services performed. And whether the contract was fairly entered into. You want to know when the intention of the parties expressed or whether it's expressed in in the clearing it unambiguous language, and so are all those things being met. They are they being met? Such you understand what's happening, and and where are these tickets that they purchased a month in advance or weeks in advance, So they had a chance to review them, or they take it. They didn't have its history view. Exactly right. So we got a break coming up after the break. We're going to talk about the fact that this young girl, obviously six years old, was a minor. And what's that? What is the long Colorado with regard to minors and releases? Uh, because it's all important, but you know, uh, we weren't going to get on the area and do the show today, but we saw Some interviews with attorneys said. I've never been able to win one of these. And, uh and yeah, sometimes you can't you can. Sometimes the court dismissed them. It depends on the language right of the release. It depends on the circumstances, so each case has to be analyzed on its own. There's no general, all clad, bomb broad rule that you can't prevail at all. After all, who started this whole process. Yeah. That was a key area of defense that Mr Blinken used. He said that? Yes, there was a deal in place that essentially tied the hands of President Biden. Mr. Trump had reached an agreement with the Taliban without the Afghan government being party to it and that if he had attempted, Mr Biden has attempted to go back on it. It would have only led to more mayhem. He said US troops would have been attacked if that deadline had shifted, and he said that Biden administration really inherited a deadline. And not a plan. Republicans argue that the withdrawal could perhaps should have gone ahead. But with better planning to guarantee the safety of American citizens, the US allies in Afghanistan and to get out of the country a lot of the expensive military hardware that was left behind. Nevertheless them uncomfortable questions for Mr Blinken, not least about people still trapped inside Afghanistan. Yes, and he said there were about 100 American citizens. Still there, he said. "Were not in that position during the election you took office in January. Um, but you certainly have, uh, made it a point to bring yourself up to speed on exactly what happened. You wrote a 37 page treatise on This election and you state rather bluntly and unqualified and I quote This election wasn't stolen. How do you know that's correct Because I'm an empiricist and I looked at the data and I looked at the available research and I looked at the methodology. And there's not one shred of data. That suggests that the election is stone, and there's lots of data to say that everything checked out so Before this Senate led audit. It's not like the county had done nothing we have done all the statutorily required tests and more. And when I say we again I mean the county and then when I took office in January, me and of course, you have a political leadership by you and your team. But 95 98% something like that of the office. Our civil service holdovers correct And a lot of these people are seasoned professionals who have been with the office for over 20 years and Guided over many Republican victory. And I, my dad. If if somebody wants to make party, you know, inference on that That office has been held by a Republican, except for the last four years as long as anybody can remember. Right, And that's another curious point that you brought up now twice as that look I ran against the previous officeholder. I didn't hold him in the highest esteem ever. But the truth is the truth. And while I have no incentive to lie In fact, perhaps it would be to my benefit to go out and say, you know, well, the former recorder, you know he did all this and that, But the election wasn't stolen, and I'm not going to lie about that. And like I said, all the data says it's not stolen. Um and I've really spent the last eight months digging into this and learning everything I possibly can and like I said Facts and logic. Drive my study and stop. The steal movement has no facts and logic and the county officials did everything properly. So let's let's go to one thing that prevents since not many people talk about and that's that the county Oversaw a hand count audit of the ballots after the immediately after the November 3rd elections, so the way that this is done, and this is statutorily required is they get designees from the major political parties. They sit in groups of three those designees, not county employees. But Republicans, Democrats, independents. Liberal Republicans, Democrats. Libertarians sit in groups of three and they counted over 47,000 votes, and those votes matched 100% with what the machines tabulated them. So when you talk about stuff like, Oh, the Dominion machines were switching votes. Well, here, you have a statistically significant number of votes, and they match 100%. So that's this abuse that notion, Then we did additional test when I took office because, as I have consistently stated I was not opposed to the idea of doing further tests. I think that could be potentially good hygiene for the system, and I was certainly aware that lots of Republicans had reasonably or not lost confidence in the system. So together with the board of Supervisors, we enlisted two seasoned professional, longstanding reputable elections technology companies to come in and independently assess whether the machines could have been hacked whether they could have been manipulated whether they could have been connected to the Internet, whether they could have switched votes or anything else. Nefarious and the answers were no, no, no and no and so again, and that's built into all the inherent checks and tests that we have. Which eye detail at some length in that letter, so You know, at some point, put up or shut up. And there's no put up and you know they tried and there were eight court cases in the immediate aftermath, challenging Maricopa County's elections, and I believe in our court systems. I'm a huge believer in our court system. And in each case, you know plaintiffs lost, and in some of those cases, they lost spectacularly. The cracking case which was filed in the federal District Court. Didn't even survive a motion to dismiss. Which means, you know, on the 10 B six standard means it didn't even rise to the level of plausible. Sorry I'm running off here. No, I just as a layman with some understanding the law. I want to make sure we don't lose people. On that point. My layman's understanding of that is If you if a case is brought in, and it simply lacks any credibility whatsoever. It's just not remotely plausible. A judge can throw it out early. And you don't go through the entire is that? Is that a fair statement clearly And that is a hard thing to achieve as a defendant because because the default position is hold the whole trial and see The default position is perceived to discovery absolutely, and proceed to the case. It is, you know, plaintiff friendly at that point, you just have to allege something that is the least plausible. And yet we've seen throughout the entire country. That these cases have been dismissed on motions to dismiss and not only that, but a lot of the attorneys bringing these cases have been sanctioned. They've been disbarred. Rudy Giuliani, My former presidential aspirant and leader, has been disbarred from both New York State and Washington, D. C. For making bald faced lying statements that have no validity and that any good faith a lawyer would not allege in a court of law. And I've noticed there were a number of our attorneys who argued really frivolous things right up until the moment when they had to go in court, and then we're smart enough to back off of that. They knew that there would be sanctions. You can you can lie on the street just can't like for the Court of Twitter is very different from the federal District Court or the Maricopa County Superior Court. And I would encourage people to look to the ladder rather than the former for truthful statements, and Sidney Powell herself who is the progenitor of so many of these claims of fraud, has completely reversed her position now that Dominion is suing her for defamation. And so you know that that that's why and there's no, there's no evidence of fraud. In fact, everything is to the contrary. The signatures were.

Were he the prosecutor in the case, and there was, in fact going to be a prosecution pleads to conclude your thoughts. Well, Jim, I would say, you know that if you're going to look for criminal case, and I don't think there will be any, let me hasten that that but I would try something, and I'm sure they have degrees assault in New York. But an assault is any unwanted touching or uh or so forth. Uh, any unwanted intrusion on your bodily space. You can assault without touching someone. So it seems to me that if he comes up and you know, kisses someone that It's not wanting him to kiss him. Uh, you know that sort of thing If he's putting his hand where he shouldn't put it, which would offend normal behavior. If it's normal for someone to put a hand on a shoulder, then that's okay. But on the other hand, coming up to somebody and putting a hand on a woman's, uh, behind, that's something else. I think that's probably technically an assault. Transformation is much greater and the any graham specifically provides a map for your individualized growth path. Which i found is unlike any of the other tools out there. it's also really great team sessions So let me give an example. For instance with myers briggs. I can't remember all the acronyms are sixteen. Different ones Much less what. My team members are like your e i n t p. so how. how do i relate to you. And oh you're in the n. T. j. So how'd you feedback. I've just found in working with teams that It's much harder for leaders to really apply that in their team setting how they interact with each other but the any graham is much different. It has very memorable archetypes. There are nine but it also has the granularity because each type has three subtypes but you only need to remember the main type working with. So how does it help. You grow your leadership. The any graham diagram itself can serve as a powerful growth. Map by providing customized very meaningful has development reach personality type. How how does it do that. So each type is connected to four other types. There are two on either side of the diagram referred to as your wing points an to airline points that are connected to the main tight through these internal airlines with the diagram. So be four types. Offer very specific development stretches the wing points provide more gentle development steps and the airline provide more radical development movements to really create sustainable shifts. You wanna work on the airline directed toward your any graham type. Because as we have you know variable renewables coming onto the grid we need to schedule our grids more frequently in order to accommodate that uncertainty and we have to solve them at increasing scale as you have more devices coming onto the grid and already these existing power system optimization problems are really large and the really slow to solve so the question is how can we actually speed up how these power system optimization problems run in order to make it tractable manage higher renewable power grids.
