The Recording Academy is imploding the week before the Grammys
"Welcome to the frame John Horn Sexual Harassment Arabe and denial claims of corrupt practices. No it's not a new soap opera. It's what the recording academy is dealing with just a few you days before. It's big event the Grammy Awards last week. The academy put its president and CEO. Deborah Dugan on administrative leave yesterday she filed a sexual harassment and discrimination complaint against the Recording Academy for more on the latest developments. WE TURN TO GEM AS WAD senior music editor at variety jam. Cham- welcome back to the show. Thank you so if we believe everything that was in the complaint which was filed with the Equal Employment Opportunity Commission. Listen on behalf of Dugan one of the most remarkable allegations in well the the allegations sorta go in two directions. They're the ones against her personally. She says she was sexually harassed by a very prominent attorney who works closely with with the academy. She said that her ideas for changes were opposed by the board and top executives at the academy. And you know speaking with sources close to the situation. I'll say she didn't really fit in and it was a challenging doing situation for now having said that the complaint alleges is that there are all kinds of kind of insider deals going on inside inside the academy it alleges that people who are connected with certain artists are voting on nominating committees and financially the doesn't allege this is actually a fact the academy which has no in-house lawyer is paying millions and millions of dollars every year to outside law firms for work worked. She deemed unnecessary and sources say and her complaint alleges that she went into a meeting gave a big presentation about changes she planned to make which included stopping or at least dramatically cutting back payments to those law firms and three weeks later she was put on administrative leave. So let's look at a couple issues here. Hear the Recording Academy says that Dugan was shown the door or put on administrative leave because of the way she treated the former assistant to port. Now what does dougans defense of that issue. Her complaint says that is untrue that is inaccurate. And if you look at the academy's claims the public claims that they've made there are a lot of explosive words. Used the upshot of what they're saying is that she was mean and you know I mean. Do you remove move your top executive ten days before the big show because she was mean to somebody you know I mean it's just it strains credulity a bit especially if that executive we're not a woman and Dugan's complaint says the allegations are true. They say that the person in question was not. I'm not up to the job that she expected her and she was trying to find another place for in the organization in the EEOC complaint Dugan makes a couple of very explosive charges. One involves a rape allegation against her predecessor. Neil port now and the other describes some inappropriate behavior of not outright sexual actual harassment by Joel Katz. Who is a top lawyer that works with the recording academy what specifically she alleging for both port now and cats the allegation against port? Now this is an actual rape allegation. Apparently a foreign. That was the word they used. Female singer Songwriter on writer. WHO's in the KADEMI member who performed at Carnegie Hall you know? He admitted there was an allegation. He said it was it investigated and he was exonerated now. Presumably he was was investigated by the Academy in terms of her own claim of sexual harassment. She says that Before she had even started just a couple of weeks after she had signed a deal to become. CEO Joe Joe Cats took her out to dinner somewhere in Laguna Beach and she alleges she put the moves on her. We're talking with riders. Jim Aswa about what is going on inside. The Recording Academy so Porno said the rape allegations are outrageous terribly hurtful and untrue. A lawyer for Joel Katz said he categorically denies the sexual assault or harassment allegations. What does the Academy said? The academy has not responded and as of right now typically to the allegations. When it came out yesterday I went to them? Asked for a comment immediately. It took about an hour and all they did was basically regurgitate the accusations they had made about Dugan the day before and over the preceding couple of days they have happening addressed the other allegations and they may not. I mean that's the last question there are allegations and Dugan's EEOC complaint about how white and male leadership leadership and voting is inside the academy. But something that really caught my eye. I'm GonNa read a paragraph from the complaint is this. The board uses these committees. These are nominating committee for the grammys as an opportunity to push forward artists with whom they have relationships indeed it is not unusual for artists who have relationships with board remembers and who ranked at the bottom of the initial twenty artists to end up receiving nominations. So what that is suggesting is that the grammy nominating automating process itself is suspect that to me is the thing that should most concern the public. A lot of the rest of this stuff is inside baseball and and you no very legitimate complaints but you know that depends on how much you care about the makeup of the recording academy the fact that the nominations are skewed is something that has been suspected for a while because every year there are these kind of mysterious nominations that appear in certain categories. And you know those of us who watch is this. You know we've heard of most of these artists you know every year you'll just be like who would that and you know we might find out that a producer and engineer is on the nominating committee. The median Oh hey look there asong that album that they produced or engineered there. It is an old look also on the committee is someone who works at that label So Oh you know that sounds horrible. It doesn't necessarily have to be because the other side of it is the fact that the people who are good enough to get on the nominating committees prominent enough to be working with a lot of these artists. I'm Molly would. In the last week alone. Digital media outlets have laid off hundreds of people the publishers of USA today are fighting off a takeover attempt from a hedge fund the Washington Post actually ran a Super Bowl ad about. How important journalism is but subscriptions don't make enough money and ads are annoying data sucking and don't even work most of the time. Enter tech, Jim mckelvey is the co founder of the payments and processing giants square. He's got a start up called invisibly. That's part micro payments where you pay for individual articles and part Aztec where you the reader can earn free articles by trading more data you could choose to pay for no ads at all or strike a balance somewhere in the middle. Mckelvey told me the whole point is control. It's never been free. You've always paid for. But you've paid for it with your attention. And it's usually frustrating because you don't have any control over how your eyeballs are bought and sold and they're being sold hundreds of times a day without your permission or knowledge. So here's the deal. You don't have to do anything differently. If you want us to just manage this for you. We will. But if you wanna take control over how your tensions bought and sold will give you that control. So for instance, you're live in New York don't tell me a pickup truck because I'm in New York. I'm not gonna buy a pickup truck. I don't need one here. That piece of information is valuable and any piece of information. You give does two things for you. First of all, it increases the relevance of the products that are pitched to you because you're gonna buy some things. But more importantly, it increases the value of your eyeballs. So you are getting paid more per second of attention or I can just buy my way out of it directly. And skip the tailoring process. Absolutely. Yeah. However, you want to engage. It's interesting. It sounds like your making an argument that I should have more control of my data. But there's a version of this that also sounds like I still give over a lot of data to individual sites yet. And it's completely up to you. What you wanna do? So in our system from complete anonymity, which by the way will change the price of somebody for content. So for instance, one of our publishers will sell you an article for a. Quarter cent if they know who you are and that same article could cost three cents if they don't know because they're getting value out of your data as well. They want to know who their readers are. So it sounds like if it really was embedded into a lot of different sites. It would become a large real time experiment and trying to determine what how much people actually do value their privacy, which I think we're all trying to figure out right this moment. And there's no one answer for one person. So for instance, there times, I value my privacy a lot there times. I don't I'm about to buy a bunch of couches. If the couch manufacturers are the world knew I was about to spend several thousand bucks on couches. They would send adds to me that I would love to see right now. But the problem is in the current ecosystem have no way of signaling that and the worst cases I buy a couch, and then they find out I bought one. And then for the next three months. I get chased by couch commercials. It's really backwards and messed up right now. And we're not saying we're gonna fix it all at once. But we're saying that we're going to do this on behalf of the people whose information is the currency. Give me control of how I spend my attention. Just as I have control over. But the media and people who are afraid of change only wanna focus on the negative to those people. He says, you are wrong and society is becoming more open in accountable because of these new networks and Facebook, which is like I said very interesting because on the one hand. Yes technology marches on there was moral hand-wringing in the extreme about the democratization of language about radio about television in. Yes about the internet. But I would argue that as much as Berg may think otherwise Facebook is not the internet. Facebook does not behave the way that disruptive new networks might behave in a vacuum because Facebook is a company it's incentive is to make money. Senator. We run ads the internet is an incredibly disruptive and democratizing and polarizing force. And everything's Coburg says about Facebook that you can find a like minded community that you could keep in touch with faraway friends that you could organize protests that you could advertise a business all of that can happen on the internet with or without Facebook. I mean, I obviously one hundred percent convinced this is a game changer for. For not only the people who are imprisoned. But for these pets the ones that are the most at risk. But do you have skeptics out there to the what do they say? This is marketplace tech demystifying the digital economy. I'm Ali would. Apple released its earnings yesterday afternoon. And although it met its lowered expectations revenue from phones was down. Fifteen percent over the same quarter last year and the future trend is also down for years. Apple smartphone strategy has been to make premium devices with a premium price tag, a thousand bucks is basically the starting price for a new flagship iphone, but those prices are hard to swallow in China and India markets apple is depending on to grow. It's global market share. And even here in the US consumers just aren't upgrading their phones as much as they used to duly. Ask is principal analyst at Forrester research. I asked her if apple can keep commanding such high prices, they've relied on a very fluid base of consumers in the past that could afford to buy not only devices, but services and subscriptions within the ecosystem. And I think one of the things it's hard to tell. I think one of the things they're not gonna tell us is it inhibiting their ability to attract new consumers into the ecosystem. Yeah. It's interesting because it feels like. It was a strategy based on sort of an old economic model of ongoing recovery where you know, if you tie it to the broader economy, it was based on the idea that there'd be an economic recovery in wages would continue to go up and there'd be lots of consumer spending. And we're kind of not seeing that. Yeah. So we're not seeing that. And I think if you look at the opportunities for growth, it's either get the same people to upgrade faster or it's attract new consumers into your market. And you look at who those new consumers are and they're simply not as a flu inter as wealthy as the existing base there. Either young or they're living in markets where there's lower wages overall. I think the trouble with these large. Consumer electronics companies is is the smartphone came along at this time. And it's been like an amazing amazing ten to fifteen year right at this point. But there isn't like another it devices that's coming after it. That's going to make up for the revenue with the slower replacement cycles and the slower uptake from consumers in the market today. So what do you think comes next? I mean, some manufacturers are sort of bucking this trend. Oneplus is going with a cheaper phone is that overly simplistic as an answer or would cheaper phones. Help sell more phones if I were smartphone manufacturer, I would test the market with less expensive devices. And Molly I say that based on someone who studies consumer behavior the devices that are selling now in the market for a thousand dollars eleven hundred twelve hundred dollars are amazing for photography and playing video games and watching TV and when we see five G come out. It's going to be awesome. That said the vast majority of the activity that consumers are doing on these phones, it's still around communication instant messaging, texting my friends triaging, Email for work. And I don't need the latest greatest device to do that. And so I think it is reasonable to expect the consumers will say, hey, how do I really use this device, and do I really need something that caused the thousand twelve hundred dollars to triage, my Email, duly ask is principal analyst at poster research. Ch- according to the motley fool apple shipments were down ten percent in China in the third quarter of last year and down fifty percent in India over twenty eighteen. And now for some related links. We talk a lot about the Chinese market. But India is huge for smartphone makers shipments almost doubled between two thousand fourteen and twenty eighteen to one hundred and fifty million phones according to analysts and ZD net report out of New Delhi says that for a few years apple was selling its older models in India for low prices, which wasn't that thrilling because we're talking about the iphone five c here people. But then apple started pushing more expensive bones sometimes even selling models for more than they were selling for in the US that didn't fly either. And it happened just as Chinese manufacturers like Xiaomi and one plus came into India with super cool tricked out smartphones that were half the price of the iphone. So you could have a heck of old iphone for the same price as brand new flagship smartphone from one plus easy choice. The one plastics was released in India in twenty. Eighteen ziti net. Says its old a million units in twenty two days for comparison apple sold one point seven million units in India in all of twenty eighteen combined and on a completely different note. And what what we don't want to have happen as we don't want these things to be brushed under the rug because what happens if that if you do that is it tends to it tends to hurt you later. So or hurt somebody else later, I heard somebody else later, so if you're going through this kind of thing talk to somebody now, and let's get this handled and taken care of sooner rather than later. The other thing about statute of limitations before we leave the statute of limitations as we've said, six months for government claims you also have to file under if state claim you might have to file under department of fair employment and housing if it's a federal claim you might. Have to file with the equal opportunity, Equal Employment Opportunity commission. So these are tricky area, and you gotta have lawyers that know what they're doing. And you have to. Make a decision fairly early on. Whether you want to file a complaint with the department of fair employment and housing or with the Equal Employment Opportunity commission because that will change where the jurisdiction is which changes where your case, we'll take place if you're doing a state claim you can have it in the county where the action occurred if you are filing the the EEOC, then you're going to be in federal court, and some and you can make a decision whether you want them to investigate and make a claim with them or what I typically do is. I do my own investigation. And I just file with them. Let them know that there is a complaint, and they give us back a letter that says that we have a right to sue them for these actions, and then they'll step out so and we can conduct our own investigation. So the investigation phase of these cases is extremely important and. And what we end up with a lot of time as the he said, she said situation where you know. And I'm just gonna use male on female because that's the most common that we're seeing right now. So we have the the woman that comes in and says, well, he he's sexually abused me. And the male says, no, I didn't. And that's more. Sources says it was consensual says what she wanted it. You know, she said, yeah. And and that's a whole separate discussion that we can have a whole other show on. And that's how the law goes as it does tend to like, you know, it's like a a octopus for their many legs. And if occupy could grow more legs that'd be like the law. I want to mention too that we you may be working. You may be working. If you file one of these claims, you may be working under a mandatory arbitration clause, sometimes a lot in employment case. Yes, a lot in employment where you have either an employment agreement or you have a arbitration clause in a is in a in a in association or a union or as a situation where you've had collective bargaining. You may be bound by an arbitration agreement or if you've signed an arbitration agreement with your medical doctor. This would fall under that too. If you're suing them for professional negligence as well as sexual battery and harassment and all. All those things you may have an arbitration agreement with them that would be Kaiser. Yeah. Yeah. And you can refuse to sign those by the way. So if you're a Kaiser member, and you've signed that you may not want to do that. And you may want to resend your agreement to arbitrate. And that again is another show, but I never sign them. I want my right to be my right. And if I want to arbitrate, I want to arbitrate. And if I don't I don't want to be forced to. So we fight tooth and nail to keep it in the civil system in in the superior court system. We we we don't we don't really like arbitration hearings in the binding arbitration hearings and all that because it really takes a lot of your rights away. It takes away your lot of them yet. And the and it's often quite a biased system and usually quite biased in favor of the defense. And so typically, we are not really big fans of that system except in certain areas and in certain situations when we. We will. We'll say, yeah. That's actually a good idea for this particular case. But you want to have the right to say, so so if you are faced with an arbitration clause you can strike it out. Now, I want to emphasize the importance of an evidentiary record of the evidence. Like, Rachel said a lot of times, it's he sheds versus she said she said versus she said or he said versus he said bottom line is you wanna have and build a record. If you've if you've been a victim of this number one report it to your employer. If it's an employment situation report it to your employer. If it's a medical situation report it to the medical board and your local law enforcement, tell friends tell friends is a big thing. Right now, for example. On this Cavanaugh hearing about putting Justice Cavanaugh up to the supreme court, and this this did one of the common questions is did this lady thirty years ago. Teller friends did she consent? Did she tell your friends did it really happen? And one of the things that we always have to keep in mind is that we're supposed to be a a country where you're innocent until proven guilty. So the burden is on you. If you are the person who's accusing somebody else the burden is on you to prove that it happened. And if you don't talk about it to somebody else nobody's ever gonna know that it happened. So. As a part of the investigation part? We tried to find out what kinds of information have been put out there and social media has been a just a gem for us. It's a wonderful thing for us when we conduct our investigation. I was just going to mention that many times, the your your your evidence is based upon tax between the two people in the case of medical doctors prescriptions. Was was there any kind of emails gone back and forth, any type of you know, things like that. Social media has been great for us. So back a little bit to money damages. What can you expect? Well, as I say on the commercial. You're probably tired of hearing it by now. But each case is its own case each one is very individual. And it's going to depend on the extent of harm that has occurred to the person. Who has been victimized? And if it's like, a one time comment that is not going to be worth as much as somebody who engaged in a. Systematic predatory grooming period. And then a real harsh. Predatory course of action that went on for time whether drugs were administered to enable this to happen. And how how badly that has injured the party the victim. And a lot of people don't like being called victim because they want to empower themselves and an iron courage that, but the fact of the matter is that you are a victim. And it's the easiest way to refer it and tell we can empower you. But so if you so. In some cases. We know. There. Did you go to psychologists or psychiatrists number one? Did you seek out counseling has this affected your employment? Have you have damages where you were off work for two or three months or sometimes years, isn't sometimes forever? And sometimes maybe you had to get out of the whole career that happens. Unfortunately, more than you would know is that, you know, if you're in a man's world, and you and they shove you out basically by making your life. So unbearable you may be forced to not only quit that job. But quit that whole circle of people that are in that same profession. Restaurants, come to mind with that kind of thing that can be very difficult to get another job at another restaurant for a restaurant tour of sexual abuse. And sometimes people have to move out of the state, get different jobs. So that'll be a loss of income to you a lot of the time a loss of benefits counts loss of housing counts. All of your psychic, psychological psychiatric bills. And then the extent to which it goes on to harm you in the future. That's why doubted our law for we try to paint a picture of the severity the duration of the abuse. And was it done to ultimately harm somebody in a way that there's been longtime punitive damages? Yeah. Sometimes we can try to punish people for the behavior. If if it's a willful act if they did it on purpose with intending to hurt you. Then we may be able to punish them for for what they've done to you. And that's a very powerful tool and sometimes these come out in the news. There was a news just a few days ago about a doctor that had. I guess twelve women and one man have come out to say that this doctor was engaging and of course of conduct that was abusive. Just can't find enough people to fill all the jobs that they have open, and so some places especially smaller cities small towns rural areas are offering? Graduating college then who couldn't find anything Yeah now you'll? Get a job and you'll get money towards your, student loan debt it's incredible so who's doing what what kind of things they dangling So one of the places that we profile pretty deeply. In the story is a city at Hamilton Ohio it's about an hour from Cincinnati and this is one of these kind of. Standard rust belt, cities it was once a hub for manufacturing paper mills and, safe, manufacturers that, was once known as the safe capital of the world but you, know there, was a downturn in manufacturing and by the early two. Thousands you know all those paper mills and. Manufacturers had last and obviously you had. You, know the recession and the whole city was sort of decimated the downtown became just full of dilapidated buildings there was a two percent occupancy rate well the economy started turning the. City started really investing and trying to buy up, the buildings and trying to bring employers back to the area and they've had some pretty decent success the, problem, is that they don't have the people and this is an issue that is. Sort of. Going on all over? The midwest and the northeast where The population growth has just been really, tap it especially in the labor force people in their prime working years between twenty five and fifty, four To, try to really convince young. People come live in our. Downtown hopefully that'll dry even more young people downtown and they. Can try to you know create a? Priding urban center, sounds like a great opportunity when we say these cities are paying people to move there in what ways. Are they paying, them so in Hamilton, they, are offering young people who are willing to live downtown. Five thousand dollars towards their student loan debt in some places like in north Platte Nebraska, they're just willing to give you. Ten thousand dollars cash if you move there and you commit to living. There for a certain amount of time some places are offering you land some places are offering you money towards the. Down payment on a home the idea is to, just sort of give people an extra added incentive to come to these places who's offering land I think. Federal Housing Agency Employee Secretly Taped Director's Sexual Advances Toward Her
"Slash go. The director of national regulatory agency has been accused of sexual harassment. His name is Melvin watt, and he heads up the Federal Housing, finance agency and employee. There named Simone Grimes claims that what harassed her denied her equal pay and tried to retaliate against her. And she says, she has the tapes to prove it. Grimes has provided NPR parts of her recordings and NPR's Yuki Noguchi as the story in two thousand fifteen. Simone Grimes started working two jobs hers, plus the one she'd been promoted to, but she never got the pay increase should been promised. After nine months, she was told a raise would require sign off from the director. That's kind of one director what began his advances. So he approached me at a few functions that were at work to say. He believes there is an attraction between us. It needed to be explored Grimes who is in her early forties kept asking to have her pay match that of her predecessor. Each time she was told the decision was what's in may Grimes filed a complaint with the Equal Employment Opportunity commission.
