Assumed to be 81 year old Patrick Leahy of Vermont your thoughts about whether or not in fact, the Constitution doesn't require the the chief justice to preside over the impeachment trial of a former president. Well, it does say when the president of the United States has tried the chief justice shall preside. So apparently that's the interpretation they went with, because he's no longer currently the president. The United States that the chief justice won't preside. And that's of course, reflective of the broader argument that the Republicans are making, which is actually they believe that it's unconstitutional to even have an impeachment trial of a former president. Because the purpose of impeachment, according Republicans is to remove someone from office. So he's already out of office, then. Where would come the authority to have an impeachment trial. So we've seen a lot of Republican senators to making that argument. And that is interesting. In terms of President Asai, I understand it. There have been two instances in which a former Federal official has been impeached with the effort being obviously not to remove them from office as they were already out of office, but to keep them from ever holding a federal office again that that was, I think it was a Cabinet member in the 18th century and a senator in the 19th century and over the centuries there correct And neither case where they convicted. So there are those who argue that as a matter of established precedent regarding the impeachment clause, this is unsettled in that no person the president or otherwise, no former federal official has ever been impeached and convicted so that they might not hold federal office in the future. Your thoughts about that. Well, that's right on those were the two presidents that have been discussed a lot by scholars in the recent articles and just sifting through them all I've seen respected professors and scholars weigh in on both sides of the issue. I think if you look at the text of the constitution, it just doesn't Specifically to the question of crying of former president So I think that's why you've seen intelligent people make arguments on both sides. But those two examples you give you the first one was Senator William Brown. It was actually in the late 17 hundreds, and he was actually expelled from the Senate. And so then the Senate did not proceed with impeachment trial so that That could be cited as evidence that the Senate believe that it was not proper to try someone who was no longer holding office. Then you also have the example in the 18. Hundreds of Secretary of War William Bell map and hey was out of office. And there were arguments from senators that the Senate didn't have jurisdiction to try someone who was out of office. But they did proceed to vote to try and vote on his conviction and he was acquitted. So they didn't have the super majority necessary at some senator still maintained.
