But an NSF spokesperson says the announcement was sent prematurely and nothing is set in stone. "The independent examiner in the Celsius bankruptcy just dropped some absolute bombs in a filing first thing this morning, so that's where we're going to start. The report is 476 pages long and comes from chaba Palais, the examiner who was appointed to be a completely independent voice. To read the reporting around it, the banner headline is that it effectively accuses Celsius of having been a Ponzi, using new customer deposits to pay for old customer withdrawals. People are just starting to dissect it, and I'm drawing from a number of those threads, including one this morning from Ramallah of lumet a wealth. So as I mentioned, one big theme is the Ponzi like dynamics of using customer funds and especially new deposits to cover older obligations. From the report, quote, Celsius recognized that it should not use customer assets to purchase the coins necessary to cover liabilities to other customers. But it justified its use of customer deposits to fill this hole in its balance sheet on the basis that it was not selling customer deposits, but instead posting them as collateral to borrow the necessary coins. Celsius also used the proceeds of these borrowings to continue to purchase cell, which editor's note is their native token. In April 2022, Celsius is coin deployment specialist described Celsius practice of quote using customer stablecoins and quote growing short and customer coins to buy sell as quote very Ponzi like. Now moving farther in the report as part of these Ponzi dynamics, it sounds like some executives were nervous about how high the rewards they were offering to the public got. From the report again, some in Celsius management sounded alarm bells over this practice and attempted to lower reward rates. Mister mashinsky, who prioritized growth in Celsius customer base over profitability, however, overrode their recommendations and refused to do so. The result was that between 2018 and June 30th, 2022, Celsius accrued reward obligations to customers of $1.36 billion more than the net revenue it generated from customer deposits.

They were drawn to Jesus and I just think about my life, I think about my family, I think about the church I'm a part of. I want to live and I want to be a part of a church where sinners feel welcome where people who are far from God feel loved and cared for and are drawn to, not because we are like the world, that's obviously not the case here. And Jesus life, he was totally different from the world in such a way that people were drawn to the grace and the mercy that was found in him. Oh, I want my life to look like that. I want my life to overflow with grace and mercy and love in such a way that people who are far from God. Through my life would be drawn to Jesus, I want to be a part of a church where people who are far from God are strangely drawn to the love and the grace and the mercy, they find in the body of Christ, so can we just pray that for our lives and for our churches that we are a part of God we pray that you would help us to live and assemble as your people and operate as your people and the churches were a part of in such a way that to use language from Mark two tax collectors and sinners find a welcome place there. And our lives and our homes and in our houses of worship as the body of Christ, God we pray you help us to love so well cares so well show such grace such mercy in our lives and in our churches that people are strangely drawn to you through us. God, please May that be so. We look around in our cities and our communities so many people in need of your grace and your love and your mercy. Even as we know, we're in need of your grace and your love and your mercy. So God help us to be active and sharing the gospel and inviting people to the gathering of your people and inviting people to see and encounter your love and God we pray that you would bless our lives and our churches to lead many people to you, Jesus, just like was happening here in Mark chapter two. And he's basically criticizing how, you know, once the message becomes more important than the entertainment, the entertainment becomes vacuous, and then he argued that the message underlying becomes less effective because it becomes so propagandist it becomes it flies so in the face of reality that the palette of the public then rebels. I think that's the phase we're in at this point, right? Albert maltz, by the way, after writing that, was browbeaten by the Hollywood Communist Party. They dragged him out at public conventions or public events and such with famous Hollywood actors. He famously wrote a speech for Catherine Hepburn, and they would bring him out. They browbeat him for hours and hours. They had him deliver humiliating speeches disowning this article that he had written, and all he did was tell the truth.

"Very interesting to me. I think my. I think my favorite part is that there are so many aspects to it so i mean that's sort of it's sort of a cop out answer but it's actually really the truth so You know we're in real estate. I you know we were. We're actually in the process of looking to acquire more land Right now Then we're farmers we have our own farming company which is really cool aspect to what to what we do because we We're sustainable across the board and that the most important piece of that is sustainability with our people are arming crew. We hire them year round. And then they workforce year round Health benefits retirement benefits But because of that they they take care of our ground and take care of our binds better than the other crew in the in the in the region So we're farmers second and we're into production and that's where you get into all the nuance of the winemaking process. Which again. I know just enough to be dangerous if you were if you give me. Some world-class grapes. I could make some perfectly average wine. But i've got great people. That actually take woke grapes and make great one. But then you're into marketing and brand development and sales and customer service and fulfillment than problem solving. And so when you put all of those things together. I mean because quarterback to the uninformed people think oh you just you just throw the ball like that's that's about five percent of what a quarterback does You know i used the illustration we all watch peyton manning at the end He won a super bowl and he couldn't throw like i know elway was sitting up on the box watching payton on the field. Think i'm sitting up here in a suit. We just the two of us shared bottle. So we're just kind of sitting there quietly veterans on the lines So what do you think she'll. I hope people buy it but if they don't i like it so we got a lot of wine to drink But yeah that that piece of it. It so people ask. How do you replace the competitiveness of football in your life where you go for that well. I love football actually gone into the most competitive industry in the world by product skew. It's the most competitive in the world or fifty thousand unique bowels align made worldwide on an annual basis and so to try to stand out as one of one in fifty thousand man. And all this stuff so i would always sneak a wall while line into the mix with these big boys from napa on his big boys from every time. I did that my hometown. Winds would win the wine tasting. What we do the big reveal at the enemy through like oh shit. The one that we liked was leeann eddie or the one that we liked. Was you know pepper. Bridge or wilbur canyon And so i think for me. That was like oh wow. You know my little hometown with the funny name that i could wait to get out of Is all of a sudden You know growing wine grapes. That are making wines that can compete with the best in the world And so that's sort of when the liable went off like okay. Maybe we could do something here We got the competitive advantage of going back to your hometown where you can hopefully get the right people to work for you. Get the right piece of dirt all that stuff. You got the marketing story of being my hometown right Which is a huge piece of. Nfl came the name double back. Yeah exactly yeah. Yeah grew up. People acid the football term radio quarterback halfback fullback dull late now. Now it's not that We wanted this. We wanted the story about. Be about returning whole yeah. 'cause there was a stigma attached. Then that's less true now Attached to you Athlete wines Where you know most of them work very good to be honest with most of them were endorsement deals in. You know you go cyber name on a bottle of somebody's you know third wine that they're trying to get rid of an and And so we didn't want the story to they were. They were gift wines. They were exactly matter of fact. I just a i doubt freddie coffee ever hear this but freddie was a guy that i got to spend time with when i was a little little kid and there's always been a hero but recently Somebody gave me some of freddy's wine As a as a gift and actually opened a bottle dude. Freddie signed one and that's the that's where it's going to be a trophy but but you know we wanted the story to be about you know small town kid that grows up fortunate enough to go. You know have a career in doubles back and comes back home and And i think that's started to resonate with people. The best complements our our. You know people that you know will reach out like had the wind really like. I had no idea that you were involved until i turned the ball around. I really liked the wine. And then i found out about okay. That's cool because you're not into this. You know because you're trying to be nice that that i got the super backhanded. Compliments from old teammates. Who would the line because they had to go support guy and then i get these taxes. Phone calls like do to have the wind. It's actually really good. So you're surprised. You thought i was gonna make some shit wine. Well yeah kinda so but it's been it's been a it's been a cool ride. It really has like you like it has nothing to do with me. It's all about the ground the soil in how they grow the great. So you're your show that you did about talking about how you have. Different patches of grapes in their close together but still they produce a different flavor. Tones ten is all that stuff that that come through the soil so absolutely less a little bit about which one is your favorite. Are you a cab guy. It's just punch in the face. Big fruit big big alcohol just wanted to produce something that had some subtlety. Some nuance imbalanced. That got more interesting over time. And and then you know as One of the coolest pieces of it and we touched on this a little bit earlier. was discovering that A lot of the things that were important in quarterbacking a good football team and being part of a good good organization carried over very directly into business in specifically into the wine business and Probably at the very top of that Was putting together the right team. you know. shoot you and our you never really good at our job but we were only really good at job if we had five bad ass dudes in front of us given us some room and some amazing dudes downfield that were open and where they're supposed to be when they were supposed to be there If that happened. Pretty good If that didn't happen we were very good and and for me. It's the same in the why business. I just have some great people around me that. Make me look it. Yeah you know. I was looking at your story a little bit. It's pretty amazing. How you built that team and then you know. Each set of grapes has their own little people that handle it and you have to find those people that want do that. That wanna be there you know and i think that's the same way like when you're building team. It's not only us on the field. There's there's the you know the people that are finding all the guys that need to be filled with us. The coaches were putting all the plays together. You know because you can't do it all and so what's your favorite part of being in this business. Like obviously drinking is know right there. But what's your favorite part is. It is it. "When i was a kid. For some periods she would just be like constantly on tylenol because of her headaches and then eventually she'll be like now. I'm too much tylenol. I need to stop and then would just than for months the like. Oh i have a headache. I feel so she'd be like no now. I can't and then be during those periods also. If i said the i had headache she wouldn't give me the tylenol because she would be like no. I'm concerned about our tylenol intake. And i'm worried. Yeah that is gonna be bad tyler That he gets in there with like our brains learn about pain management. And what i was gonna say what are acceptable trade-offs which isn't really what i'm trying to say. But it's really hard to set up in your head in addition to everything else about it. It's kind of like i know. Did some cocaine right now like that would stop it immediately. I really would. I mean. I know why doesn't exist right gas. Why would really love to see more like public discussion about. What is a huge problem. Which is that like. We don't even. We don't even have tools for thinking about this kind of stuff. I feel like late in the context where we're all getting the message all the time that we should fight through pain and like mindfulness our way through pain and that pain relief itself no matter. The context is like for weak people. Maybe i think all these messages are out there when that intersects with yard.
