"Law, Professor John you He's got a new book called Defender in chief. But he's also very much in the news right now. For articles he's written in National Review and Newsweek that apply some of the ideas in the book. To the Supreme Court ruling last month that protected for now the DACA program that suspends deportation for young adults who were brought to this country illegally as Children but grew up here. Remember that was an Obama policy and acted without Congress that President Trump tried to undo, and the Supreme Court didn't let him because they said Trump didn't offer a real reason. Professor. Yoo argues in his articles that by protecting Obama's ability to unilaterally suspend prosecution of a particular group for these few years, the ruling thereby gives Trump the right to suspend prosecution against groups of his choice. For example, he could suspend all prosecutions under federal gun laws and declare an effect. A universal trump gun permit. Or he could unilaterally cut taxes by 50% by suspending enforcement of the tax laws or let polluting businesses get away with violating environmental laws. By suspending prosecution of those you get the idea. If you're thinking this is interesting, but academic and wonky from a college professor. Think again. Professor says he's actually been consulting with the president. And last week on Fox News Sunday, the president seemed to refer to professor use take on the powers that the doctor ruling might give him when he made this sweeping set of predictions. Was signing a healthcare plan within two weeks. A full and complete health care plan that the Supreme Court decision on DACA gave me the right to do so we're going to solve we're going to sign an immigration plan Healthcare plan and various other plans. And nobody will have done what I'm doing in the next four weeks to Supreme Court gave the president of the United States powers that nobody thought the president had by approving by doing what they did Their decision on Dr President Trump last weekend on Fox News Sunday. As for John, you, some of you will remember by way of context that he was also a controversial aide to President George W. Bush after 9 11 when he wrote what came to be known as the torture memos offering a legal war time rationale for acts of what most people consider torture that the Bush administration undertook several times. And a legal rationale for surveillance of Americans without a warrant. Push his own Justice Department later concluded that use loyalty to his own ideology clouded his view of his obligations in his job. Now you was back in the news advising Trump with me now is University of California at Berkeley Law, Professor John You His new book is called Defender in Chief Donald Trump's fight for executive power and, Professor. You Thanks for coming on Welcome back to WN. O'Brien. Thanks for having me back. So first because I'm not a lawyer or a legal scholar. Correct me if you think I need any correction on how you see President Trump's powers to stop enforcing the law as given to him by Chief Justice Roberts and the docket decision. On. Glad you're not a lawyer or legal scholar. I'm sure he had a much happier life as a result, let me I think you've basically got it right. But the main point I want to stress Is what's good for the goose should be good for the gander if President Obama was allowed to benefit from this right to not enforce the law. Then President Trump should as well and I have to say one. I actually think DACA program is a good idea, but the Constitution requires that it be passed by Congress. And so I was a critic of the DACA program in 2012 2012 2014. Some of the diaper because I have a conscience as a clause is called to take care clause that requires the president's To enforce the law. It doesn't give the president the ability to say I will just completely not enforce this law course presidents have to choose. Where they're going to devote resources to pursuing more important cases, versus less important cases more statues with a critical to national welfare than others. The president's power to enforce the law doesn't give him or her the ability to say I will just not enforce this statute that I don't like. Because otherwise that gives the president a second veto as it were one that actually can be reversed by Congress. And so President Obama and that was the point of my article is to say, I think the Supreme Court was wrong a few weeks ago. In the stock case. But if it really believes what it says then President Trump should be able to benefit. I'm the same powers president. In other words, I imagine a lot of people are sceptical this, but all I say, is take any opinion of the Supreme Court and we really want to test whether it's correct. Do a search her place. And put the people from the other party. Rather than your party so every time it says Obama instead put in Trump every time it says immigration instead, as you suggested, put in taxes or put in health care. You still think that you agree with the opinion? If President Trump can exercise the same powers that you support President Obama having that is a good rule of thumb. I agree to substitute the people you disagree with for the people. You agree with when you're talking about some kind of political or constitutional principle, But would you agree that the Trump clip we play there from Fox News Sunday was based on your interpretation of the docket decision, and he's now going to take what's in effect your advice. And do lots of things that you would consider constitutionally indefensible. Look, I talked to people in the White House about these opinions. Articles I wrote right after the opinions of shoot, I thought again. I was criticizing the opinion by showing How far let President Trump grow way They actually called and we had conversations very much like the one we're having Right now. I was just explaining well, do a search her place put Trump in for Obama. Put skills based immigration instead of Dhaka, in the opinion of the Supreme Court should be held to be accountable for its decisions. There's not any kind of constitutional law or presidential power that only applies to trump but doesn't apply to Obama. Oh, and people told me there were these news stories that said they took pictures of the president's desk and they saw printouts of my articles on his desk, which I wish I could have those photos. That's a that's amazing answer. First I ever heard about it, actually, but So that's that's why people say, Oh, President Trump, And as you said in the clip you played from his interview on Fox News Sunday. He does refer to this idea that the Supreme Court just transferred a lot of power to the presidency. I think Trump notes that he himself opposed Taka. Unopposed this power, But if the Supreme Court says the president has it And Trump should be able to use it just like Obama used..

Justice Department officials say decisions are politicized

"To justice department whistle blowers speaking in front of the house Judiciary Committee today outlining a series of allegations regarding what they see as political meddling in department affairs under president trump and Attorney General William Barr judiciary chair Jerry Nadler told those assembled it seems clear that bill bars actions are politically motivated and improper the Attorney General had simply missed judged the situation and thought that Mr Birmingham would go quietly then we might truck up this episode to simple miscommunication and incompetence but make no mistake this was not an isolated incident joining us on the komo news line is A. B. C.'s Adam Kelsey Adam let's go into what Nadler is talking about Nadler and his fellow Democrats on the house Judiciary Committee essentially accusing the Attorney General William Barr politicized apartment justice serving as something of a cheerleader attacked Dr president trump and we heard from a number of witnesses including a former deputy Attorney General under Republican president George H. W. bush said bar refusing political cronies to reverse decisions involving trump associates and the called party completed the race in his lifetime to the rule of law and we also heard some really interesting testimony from a career prosecutor in the justice department who worked on the project stones he testified that pressure from senior department officials including the Attorney General led to more lenient sentencing and anybody else would be getting solely because Roger stone was an associate of president trump that the timing of this testimony was really interesting because it comes just hours after another trump associate general Michael when he found his atheist met after ruling by and you'll score basically coming after the justice department lobbied on his behalf so we're hearing in testimony on Capitol here and we're seeing it play out in real time to dissociate the president trump being treated special are being treated differently than any other average member of the country and the president had this to say today about what he thinks about Michael Flynn saying he thinks Michael Flynn was treated horribly by a group of very bad people expired on a campaign and they should never spy on a campaign to put it mildly never happened before in the history of our country will ease basically pointing the finger back at the Obama administration saying that while he was running for president president trump was running for president back in twenty fifteen to twenty sixteen he's saying that the Obama administration's justice department was illegally looking into what was going on in his campaign and basically comes down to accusations of partisanship and politicization on both sides of the aisle I think that the Democrats really going after the justice department which has been traditionally so independent from what's happening in the White House willing to at times look into and investigate the goings on of his own party at the White House and saying that William Barkat if he's doing is constitutionally required duty just acting on the president's behalf and present health kind of playing the what about game as he looks back a few years and says he with the Obama administration's justice department I was playing politics not his own is this all coming about because of tourney General William Barr removing the district attorney Geoffrey Berman ends yeah I mean it it certainly doesn't help William Barr's case and you know although president trump has the right to dismissed any of these US attorneys at anytime you like he was the optics of the situation William Barr announcing late on a Friday night that Berman with stepping down Berman later saying I never resign showing up for work the next day on a Saturday morning and then it having to be trump who steps in to actually fire him over the weekend it seems like the trump administration there never really crossing the line when it comes to their actions always seems like there's an administrative staff but they're going about it in the wrong way in a potentially illegal waste inspired by the Supreme Court on other issues being flagged on Capitol Hill today it seems like it the governing party administrative aspect of the action that president trump and his administration you get

"AM six forty. More stimulating talk. And we're back with our final segment with Greg hunter. We'll take your calls as well. As we talk about world events market volatility, and so many other incredible stories, Greg if you had to single out one story to really watch in two thousand nineteen what would it be deutchebanks stock for for stocks? Deutsche Bank is under eight dollars a share. It was nineteen dollars a share year ago. It's now seven Donald something. If it keeps falling deutchebanks makes Lehman Brothers. Look like a kiosk. It's a huge mega bang, and the Lehman Brothers is largely credited in the last credit balloon for taking down the global system on the other side, it's all the fraud inclined ahead what happened with this coup that happened in our government. And I think there's going to be big big things a big price to pay for the people that tries to Dr President Trump with a phony document out of office with the phony dossier paid for by the Democrats. I think that's going to be a huge story. I thought about the Clinton foundation in the press the press, so they had the same way beyond the library was a fraud. This is hundreds of billions are a couple of billion dollars. Nobody in the democrat party mentioned a word about it. I thought the Clintons, you know, you know, work doing good work for the people in Haiti they were ripping them off in a time of need. Nobody on the Republican side said a word this was a huge revelation. What you mean for more than ten years the Clinton foundation the Clinton global initiative, that's totally fraud. Cherry nobody in the mainstream media, including FOX did this story. That's what I'm talking about. White people. Don't know what's going on your records. She did Jerry courses. He's a good, man. He's he's he's suing the they tried to get him to lie. And I think they Muller team bit off more than they could chew on him. But this is a huge revelation. And this is what tells me our media not you Georgia Armenia is a co completely project. I mean, the the New York the Washington Post, you a story about this twenty one trillion and that Dr Skidmore and he called me later, Monday lied. I didn't take any of that stuff. It didn't cancel each other out. Huge fraud, and this and let me tell you that had affects every American. I mean, even I mean, that's an unbelievable amount of money that went through the department of defense. Right. And if you look at the student loan thing, and this is why this is such a big problem to debt and one point five trillion dollars in student debt. There's one hundred twenty five million taxpayers. But that can thousand dollars for every taxpayer in America to pay for this style. You amplify the debt? It's un-. It's unbelievable. Frightening amount of debt, that's unfathomable. Had he gone glares on who said if you add up all the derivatives and all the debt, I miss to. It's too quadrant. Two thousand trillion, and and they just had a story out on the guardian UK that talked about how it was Ambrose Evans Pritchard. Who's a real hit a real guy financial guy talking about how the Bank of International Settlements is worried about derivatives in a credit seizure and the dribs are far worse than they were before. And they're worried about there being a quote vulnerable to failure could cause it to stabilizing feedback loop and the IS fears a waterfall effect. Well, this came out. And what what do we have next month? We have the the the the world economic a foreign in Davos, Switzerland. What else who else is Switzerland out the Bank of international the central Bank of central bankers leaking out, but not? There's something good coming down to pipe, George. Let's go to the phones for you. Now, greg. They're lining up for you. Let's go to Cindy and mount Gilead Ohio to get us started. Hi, cindy. Hi, oh, what a great show. Thank you so much great. You know? Oh, I miss some of what you were saying I into your screener is amazing. And anyway, so I've been following any big fan of charity navigator. And so they broke the story that the Clinton foundation was keeping eighty five percent and only giving fifteen percent to charity. And so it's my understanding that won't Hillary Clinton was secretary of state she diverted taxpayer funds earmarked for Haiti to the Clinton foundation. And there was footage that we never saw you had to go in you to Haiti rioting because these people in Haiti near she was doing this writing.

"Job? Okay. And and the truth is he's not wrong about being gutless. Like, if the person actually wants to take a stand against the administration publicly, quit quit and talk about how terrible it was or alternatively. If you actually want to work inside the administration and make it a better place. Shut your face. Why are you going to the New York Times to brag about how you anonymously are helping the administration from the inside except to provide yourself cover later. This is very obviously self interested. Do you really think anybody the New York Times printed an anonymous op-ed from somebody inside the Obama administration making the same claims highly highly highly doubtful because printing anonymous op EDS is kind of frowned upon is kind of frowned upon for for pretty good reason. Which is that there's no way to vet the claims that the person who's actually making those claims, but we don't know the senior official is it could be some low level person. Who's bet from once they're hundreds of people working in the White House, hundreds of them. So that is quite plausible. But President Trump then goes to Twitter, and he decides that he is going to lose it. So President Trump had a couple of tweets. He tweeted out does the so-called senior. Administration officials really exists or is it just the failing New York Times with another phony. So if the gutless anonymous person does indeed exist the times must for national security purposes. Turn him over to government at once. So no. Didn't do that. That's not a thing. The press doesn't have to turn over to the federal government for writing an op-ed that rips on the administration, that's not an actual thing. And then the president had one more tweet. All caps in question. Mark. Execute this person. We're gonna find them prescribed penalty in the constitution for treason is death. So presumably we will find this person take them out back and Trump will them he'll take his tie off. And then he will strangle him with with the oversized red tie. It'll be quite amusing. But it's also true that this op Ed does no good. It is actually deeply counterproductive. Because all it does in the end is Dr President Trump to throw out anyone who may be actually trying to curb those worst excesses. And now we get to spend months trying to. Trying to drill down on how it is drilled down on exactly how it is that this this happened in the first place coming up. The Senate Judiciary committee is having useless counterproductive hearings.

"As it put that when I get reelected in two thousand twelve hours earlier at twenty twelve years caught a lot like I'll have more flexibility basically cut deals. With so I find it. Amazing the Democrats you know thought it was cool to cut, deals with with fiber poop in two thousand twelve he was still a former KGB guy, in two thousand twelve He was still a pretty bad, guy and yet, Hillary Clinton was pushing the. Reset button Barack Obama, was worse getting caught, on hot mic saying I want to deal, with him and so look again. Going back to President Trump going back to the campaign he, has been honest and transparent about saying he wants to forge a good relationship with Russia the Obama, people wanted, to do it but they failed they didn't really get a lot done with poop I'm not saying he's a good guy but I'm saying that why was it ok for the Obama people. Don't wanna work with Putin and now, somehow it's Dr President Trump what do you make about the timing of this next meeting in. The fall we don't have an exact date for maybe it's Security Council but this. Also right near the term so you can already. See democratic ads flashing. On your TV screen saying you, know they're in cahoots together we. Told you all, this, time there's collusion between Putin and Trump or do you. See it as maybe an advantage for for the president for Republican well that's a good question. Because the time he's important but also, more importantly you. Know everybody in Washington likes to focus on the. Horse race bikes to focus on like, is this good good. Or bad politically? In what what if, it's good for the country so, my reaction was all boy why are. You going to do this in terms like you said with the timing because? It's just gonna remind Democrats oh let's run ads Do that anyway or not here's the point I think cups, of, Washington in October And says you know what I'm going to help, in Syria we're going to finally bring the, civil war to an end at guess what behind you Mr President on North Korea and, we've got, finally really clamped down at Kim Jong UN and and and on. Iran you know I'm gonna. Help, Israel make sure that gets out of. The neighborhood it becomes a good neighbor now I will admit that that's pretty optimistic I don't think Russia's really. Gonna, help us on all of those things, in the span of a few months however what if there was a, breakthrough audit there's some. Progress and President. Trump is validated somewhat saying. One hundred percent. But but gains validated that's the question The problem with the landscape today as you've got a lot of the, media as we, know that never give him the. Benefit of the doubt goes ever give him credit but you know what, Republican voters what it would be validated there, would be Republican voters some of them might be deflated about what's going what happened in, Helsinki southern, baby deflated about you know the Democrats piling on all the time. If the president has a. Strong, economy you know and it be says. Look on the foreign policy five I got North Korea headed towards Steve ation bladder report helping us on at. Syria, you could say hey you know this, guy is keeping some of the promises a lot of the promises he, dated twenty sixteen in. My point is Would it would potentially, vote Republican voters before terms to, say you know what this, guy's taking a lot of. Heat he's taking a lot of flack but he's. Actually getting stuff done yeah interesting Ed I, wanna keep, you around because I want to hear. What you're gonna do for your birthday, today and if you're listening call, in one eight six six. "Fairly confusing in like it didn't fix anything whatsoever yeah it's the i mean the tweets are just so great because there's no like rand that never says which high and there's no exclamation point there's no random prentice sees it's like it is a sign that they realized that they truly fucked this up and that someone who had practiced law in the last seventeen years had to do something to try to right the ship here like giuliani did not write those tweets he was too busy talking bob cost of the washington post at three in the morning so the question is like what happens now i guess on the legal front muller and whatever prosecutors are dealing with the coen case may or may not move forward on additional charges or certainly they got some new information last night and then i guess in the court of public opinion i mean this morning sarah huckabee sanders was asked about this why did the president lied to us for so long and now she's using the excuse i can't comment on ongoing litigation even though that was not the case two weeks ago when she said that the president knew nothing about these payments so she's a straight shooter as we always knew i mean it's just i it seems as though the white house has now been caught in some pretty huge lies over this last week in addition to lying about knowing about the payments to stormy daniels we also had the story this week about trump's dr president trump's longtime personal doctor herald bornstein this week said that trump dictated to him what to write in two thousand fifteen letter that stated he'd be quote the healthiest individual ever elected to the president which is the the letter let me tell you a lot funnier when you have in your mind that trump actually dictated the entire thing born seeing also said that trump's bodyguard raided his office and retrieve trump's medical records this is pretty serious allegations here right that we're not allegations it's the truth i guess that the letter was phony about trump's health that trump's entire medical records and that whole the clean bill of health but his doctor gave him was completely bullshit during the campaign at the same time his entire campaign was trying to tell everyone that hillary clinton was.

"So they feel that should shift the way we think about sex addiction ali fedotowsky thank you very much twenty two minutes to seven if you cast your mind back to the presidential campaign in the united states you may remember that donald trump's people released the letter in which his doctor said mr trump would be the healthiest individual ever elected to the presidency well no that doctor who said something quite remarkable peter booze is all man in the united states he didn't write it himself saying now this is dr harold bornstein he had trump trump treated dr president trump then mr trump since nineteen eighty he'd had a long relationship with him he signed this letter that at the time we believed he'd written december twenty fifteen as donald trump was vying to become the republican candidate for the white house and it says in part mr trump has had a recent complete medical examination that showed only positive results actually his blood pressure under ten over sixty five and laboratory results were astonishingly excellent his physical strength and stamina are extraordinary if elected mr trump i can say unequivocally will be the healthiest individual every elected to the presidency now he says he didn't write it and in fact mr trump dictated the letter to him rather ashamed of that well yes and what he's not addressing now is why he did not why he signed a letter that he clearly says now that he hadn't written and it actually follows another claim about his relationship with mr trump he says that shortly after mr trump became president his office was raided of mr trump's medical records and he says this was a traumatic event for him put to the white house press spokesman she said this wasn't a raid in fact it was standard operating procedure to get the medical records of a president and get them transferred to the white house and this was before he made the claim about the letter just a very very quick thought if you would peter is the doctor now saying that actually what was in that letter isn't true he wasn't the fittest man ever ever ever yeah it does seem to be well it's unusual what he's saying he's characterizing the the word healthiest as black humor he says that's my sense of humor it's like the movie fargo it takes the truth and moves it in a different direction whatever that means extraordinary thank you very much peter.
