"Two six and good to have you with us. This evening as we're talking about rather compelling case that occurred in the state of Michigan, and I note that fifth amendment that I I guess cited earlier no person shall be deprived of accepting here, the fifth Amendment No purse deprived of property without due process of law in in Rico cases, it is possible for some admittedly, probably pretty bad people to have property seized. But when you haven't been convicted in the court of law. That's always bothered me. Yeah. There are probably the scum of the earth. But gee, whiz probably shouldn't be the standard for our Justice system. Should. Sure. So and and these cases where you know, we're used to hearing about them drug education, where they're take these property the government, you know, the police will seize ton of money or a car or how they're all of it. Because even though somebody's not been convicted of a crime. I agree. There's a lot of real issues with that. And historically, we you know, we used to see forfeitures like this a couple of hundred years ago hundreds of years ago with pirate ships than with. You know with with both those and property that could easily be taken off shore in the owner lived, you know, on the other side of the ocean. So it made some sense in that context and probably filled that, but when you're talking about immobile things like houses and land that literally can't leave the country. I don't see how they can justify that based on the historical practice was far afield from what happened, you know, a couple of hundred years ago to John who calls in from Grand Forks, North Dakota on the Jim Bohannon show with our guest, Christina Martin of the Pacific legal foundation. There is a nursing home. But and it worked out. Okay. They spent five hundred fifty thousand. But they paid toward. But what I was getting at was nineteen sixty four. Dave Buster's house for thirteen thousand five hundred dollars. This is sixty four. Last six years, I've been paying the property tax of their funds, and it's been about thirteen hundred a year. And I know it must have been less years ago. But when you get in the situation Windass county for the state say you've done enough here. Okay. You know, and it didn't happen to us. We know there's assets left, but you know, thirteen thousand five hundred dollar house and last. The last ten years. I guess it was they paid the amount. Paid for the house initially, which is kind of like, you know, when do you pay enough his all, right? Is that clear to you Christina? Yeah. You know, I it. I know exactly what you're getting at the property tax is probably the least popular form of taxation there in people have always had problems with it, especially when you start dealing with people who are on fixed. Incomes have medical condition. The thing that's always bugged me is that you're sort of punished for improving your house and really everybody in the neighborhood benefits. If you improve your house your community benefits, but the you know that you improve the assessed value of your house, and that causes your taxes to go up. That's always to be a little bit. So there's an unpopular tax. Unfortunately, there's not a point where the government says that we got enough of your money. It just doesn't happen that way the only way that we're going to get to a place like that is is really through legislative change. And that's something that you know, you can talk to your legislature about and say the government should be collecting taxes. A better way. I don't know that we're gonna see a change because it's it's been around a long time. So it'll probably be around. Along the public. Let's face. It can be pretty unrealistic in some ways, you're the public wants to lose weight. Mahogany Dazs diet. We want drive through nickel beer night. I mean, we want a beautiful schools, and and arenas for football and basketball and zero taxes. Well, I'm sorry. But the real world you got to make choices. And boy, do we hate making choices, particularly after uncle sugar has sent us. The example, you don't have to make choices all you have to do is put everything on the gross national credit card and let your kids and grandkids worry about it. And of course, localities and states can't do that. Neither should of course suckle sugar, but Douglas sugar does it. And of course, we're talking about voters are either too young to vote or aren't even born yet. And the public is complicit in this because we keep electing people who do that. So I see I see what our caller is saying, but I see what you're saying too. You're absolutely right. When our cake and eat it. Anyway, John we wish you the best in your circumstances. And I guess there's no no real good answer in that regard, eight six six five zero JIMBO one eight six six five zero five four six two six what will be the basis for this appeal that goes to the Michigan supreme court. Well, that Michigan supreme court agreed to hear our takings claim under both the fifth amendment to the US constitution requires the government pay you when it take your property here. They took all that extra equity that exceeded the debt and also under the Michigan constitution equivalent provisions and Michigan like most state has their own. The provision. It says the government has to pay you if it takes your property and Michigan's is even more protective than the federal constitution. So the the court will be looking at both questions say they could just decide the state constitution issue where they could justify federal constitutional issue. But we are happy that they're willing to hear the case because that's a step in the right direction. You know, really the only way we're going to see a change in Michigan is either with a win and the Michigan supreme court or we can appeal up to the US. I was gonna say, hey, what's at stake? Here isn't an appeal to the US supreme court almost inevitable by the losing party. Well, no, in fact, if we win under the Michigan constitution theory, then as long as they don't rely on the federal constitution and their decision, but they rely. Well, actually, they could also go on the federal constitutional issue. But as long as they will that it it, violates the Michigan constitution supreme court couldn't change that that there would be no ground for the county to appeal to surpreme court because even if they're right on the federal question US sorry. The supreme court is going to be interpreting the Michigan supreme court takings club.
