"We're going to spend a few minutes reviewing the very long day that has just transpired many hours ago yesterday in fact the Senate the surgeon at arms of the Senate and noticed the beginning of this impeachment trial here you hear you hear me all persons are commanded to keep silent on pain of imprisonment well the son of United States is sitting for the trial of the articles of impeachment exhibited by the house of representatives against Donald John trump president of the United States well since then Senate minority minority leader Chuck Schumer has introduced a series of amendments eleven of them senators have voted on each of them one by one and rejected them one by one mostly along party lines the amendments all have aim to allow subpoenas for documents and witnesses evidence that Democrats believe is relevant to the president's withholding of aid to Ukraine that withholding of aid is central to the impeachment charge of abuse of power here's representative Val Deming's Democrat of Florida one of the house impeachment manager she speaking here on the efforts of the White House and the president himself to block evidence as a career in law enforcement officer I have never seen anyone takes that extreme steps to hide evidence allegedly proving his innocence all right that is one view here's another this is the president's attorney Jay Sekulow arguing that that Ukraine aid and the phone call between president trump and Ukraine's president the one where critics say aid was threatened J. secular saying those are red herrings why are we here only here because of a phone call are we here before this great body because since the president was sworn into office there was a desire to see him removed all right with me now as they have been for many hours and pure congressional correspondent Susan Davis and and pure political reporter Tim mac and I want to give you both the chance to offer a final thought or if to hear I would I would love to to do is just look at the substance of what unfolded today because today was a lot of procedure a lot of figuring out the rules but we heard the thrust of what the central arguments are going to be and we heard Democrats introducing evidence in the former videos in the form of witness testimony we heard them introduce video of the president himself saying things that are now and convenient to his defense team from his defense team to Davis we didn't see videos wouldn't see slides a very different approach no because the White House and one of the negative effects of never participating in the process is none of the evidence at hand really backs up any of their arguments there isn't much of the testimony that happened before the house that vindicates the White House there's some that is not as bad as other testimony certainly people testified that they did not believe the president did anything wrong or they didn't hear any first hand accounts of anything improper but the overwhelming evidence that the house investigation put forward makes it look as if the president made decisions to withhold military aid to pressure Ukraine to investigate the Biden family at that at a time when he was and still is a leading contender for the democratic nomination in the twenty twenty presidential election and I think what you see housing Democrats using that video evidence and they've made clear that this is a strategy they're going to use in this trial is they see some of their best arguments are being made by the president himself it's not just testimony that happened before the house committees it's also the things the president has said publicly time and time again that they played today and will continue to use over the course of the coming days to mac let me let you weigh and respond to that what did you hear in terms of the thrust of where the argument from each of these legal teams is going to take us in these next days well the Republican argument has remained a like she said very similar threw out which is the president did not commit any misconduct that they're not generally engaging with the fact questions they're simply saying there was no quid pro quo that Ukraine wasn't aware of this holder this pas in aid that's central to this empire impeachment process and that there is that even if the president did in fact asked for an investigation or a was behind this holding it in aid neither of those things were unethical or improper the political argument at the White House is making which I think is where most Senate Republicans are going to embrace and try to land is that while these things happen the White House is saying the president didn't do anything wrong a lot of senators don't agree with that assessment but the political argument that the White House is making is that there's an election coming up and that this isn't a job for the Congress to decide that it's up to the country to decide the fate of the president that is a comfortable place for most senators to land even if they give them a place to say I don't think this conduct was the greatest I would've done if I was the president but I'm not going to get in front of my constituents in my voters nine or ten months out of an election at timeline the pets of Bologna the White House counsel mentioned time and time again and that is the safest and easiest political space for anyone conflicted about how to vote on this and it's a very small orbit of senators that is the clearest safest path to land without feeling like you had to take two tough for her right and and that was also something that the president's lawyers touched on that that that the that the house impeachment managers in the house articles don't accuse the president of a specific criminal offense and that could leave it out if Republicans certain Republican senators are interested in taking it to say that the president may have committed some sort of misconduct may have done something wrong but it doesn't rise to the level of an impeachable offense just briefly what comes next we will what we are heard there for Mitch McConnell they will be back will all be back and do it all again starting at one o'clock eastern tomorrow because believe it or not we still have not heard the actual formal opening arguments here this was all the freeway to that is that research that's right that tomorrow begins official opening arguments and the and the White House and congressional teams have the chance to make additional motions of their own this was senators putting forward motions one of the things are "Odd K G O eight ten. Good evening. I'm Pat Thurston. John Rothman here in studio with me, so John we talked a lot about some things that were going on over the past week or two actually some of it happening. Just today just breaking today. But let's go back to this big issue. The president of the United States, Donald John Trump. He has broken the law. He has committed criminal offenses, the investigation's not over there so much that we don't now we do know that the Democrats takeover that they are going to be demanding financial records from the Trump organization. They're going to be demanding tax returns. We know that these investigations will continue, but we already know that he has committed criminal offenses. So should he at this point? Should he be held to account and by home should he be held to account? Well, pat. I want to be very clear, and I want people to understand. My feelings about this. I'm very careful, I I'm very considered about this. This is not a judgment. I make easily, but I want to refer directly to the constitution of the United States. Because I think that's what we have to do. The constitution deals with the subject of impeachment and conviction at six places. The scope of the power is set out in article two section for let me quote directly the president and vice president and all civil officers of the United States shall be removed from office on impeachment for and conviction of treason, bribery, or other high crimes and misdemeanors. Now, I'm not going to go into the rest of it. We may one day do that. But let me just in my judgment. And I'm I'm making a judgment based on my own political experience and years of being involved in this. There is no doubt in my mind that this president has committed treason, I'm going to give you two examples. Russia and Saudi. Arabia. I believe that what has happened in the show case where we have absolute definitive proof of the involvement of the crown prince, and the president is stone denial about that the president's sustaining platform with Vladimir Putin in Helsinki. There was no question in my mind that it was treason, and I don't use the term lightly he betrayed his country. That's treason and as for bribery. I think there's little doubt that this president has accepted money from a variety of sources, including the Russians and the Saudis over the years. And bribery will be proved particularly this whole thing about Trump towers now in in Moscow. A what about do you consider it bribery, the information that we're getting about the violation of the emoluments clause Trump properties you, and I talk, and it's hard, I know people tune in various times, and they tune out at various times, we did a whole night Pat on the monuments clause, I explained in great depth, a my view on that. Now, the question of high crimes and misdemeanors. That's a vaguer term. It is vague. But I think applies to this present. Absolutely. And I want to be crystal clear. About obstruction of Justice. Article one in the impeachment of Richard Nixon. Which of course, was never voted on. Because Nixon resigned, the House Judiciary committee did vote the article, but never voted on by the full house, Nixon obstructed Justice that was article one and article three of the Clinton impeachment was obstruction of Justice. I challenge anyone to pick up the phone and call four one five eight zero eight zero eight ten and tell me the vice president has not obstructed Justice. And I am absolutely confident. Although I have not seen nor has anybody seen of the report that Bob Mueller is preparing about this president will be will be certainly put on that that block I would even say indicted for obstruction of Justice, and I want to go a little further patent w but there are some people who believe a president can't be indicted. I could make the case that I'm happy to do it that I believe that's wrong that will be tested before the United States Supreme court. But one thing we do know is that a president can be listed as an unindicted co-conspirator is Richard. Nixon was by the Watergate grand jury and Donald Trump is now an unindicted co-conspirator on two counts in this situation. I just want you all to think about this. The president of the United States of America sits in the White House an unindicted co-conspirator on two counts. Felonies. And it's dismissed and I was even more shocked today. I mean, I just I every day it's something, but you all saw today that Rudy Giuliani. The president's attorney appeared on a variety of broadcasts and one of the things that Rudy Giuliani said today, which absolutely I found so appalling he said that he could produce and I quote twenty witnesses to testify that hush money payments to women ahead of the two thousand sixteen election were intended to protect then candidate trumps family, not purely to influence the outcome of the race. And this is what we have. I think we have the recording on that. Don't we he said this I can produce an enormous number witnesses. He said this on George Stephanopoulos his program on ABC this week. I can reduce twenty witnesses that can tell you what he was concerned about man. I tell you given the fact that this president and his attorney denied any payoffs. Now, they're admitting there were payoffs is there anybody here doubt that these payoffs may just days before the presidential election were designed to keep this out of the auction. Well, David pecker doesn't doubt it because he was a party to it. He was the one who facilitated facilitate pecker is he is the head of is it a I e. Which owns the National Enquirer, and he's been a longtime friend of Donald Trump's he facilitated the payment to McDougal and lied to her in essence, the the the I mean, the whole thing is so squirrelly the attorney who is supposed to be working with her was actually reporting back to Cohen. And so all of these things are so bizarre. But pecker did this he worked closely with Donald Trump? This was not the first catch and kill that. He did by way. And so he said, yeah, we did this specifically in order that this information would not come out prior to the election Rudy said a lot of weird things. We'll get to some of that. You've got the the playlist here do but before we even get to that. I wanna go backwards just a little bit. So we know we know we've been listening. We know that there is the basis for impeachment, and John you and I see this a little bit differently. And I'm not gonna put words into your mouth. So let me just start with my opinion, my opinion is that the Democrats should begin impeachment inquiries in the judiciary committee. I think they should be doing their investigation. They should be looking into the potential for Donald Trump having committed bribery, treason, high crimes and misdemeanors all of those things should be a part of their ongoing investigation because that along with the Muller report along with the investigations that are being conducted and the and the indictments out of the southern district of New York along with all of that you're going to need all of that information in order to bring a charge of indict of impeachment to the full house. And no, I don't think they should vote on it just yet. But I think the hearings should begin. They should send out subpoenas, and they should begin to amass evidence. I believe you feel differently. Well, look, I'm very logical. Remember when Nancy Pelosi when George W Bush was president when there were rounds for impeachment of George W Bush, no question and she said impeachment was off the. You know, why she said never been more angry? He said it was off the table because although the house could have voted to impeach the trial in the Senate was predetermined, the he would have been acquitted the same thing applies here. Somebody asked earlier I think was John dis who asked him the last hour, whether there's a Barry Goldwater, the answer is that the Republican party was not mobilized on the question of Richard Nixon until there was a smoking gun. I think there are many smoking guns already when it comes to Donald Trump. I'll be sitting in for you next Saturday afternoon here from four to seven Sunday rather next Sunday from four to seven I have every confidence that there will be more smoking guns between now and the time that I sit in this chair again. But I wanna be crystal clear when the Miller report comes out, I think this president is going to face real problems. And I like the Senate report today by the Senate intelligence committee that will be released later this week proving massive Russian involvement on behalf of Donald Trump and the Russians the fact that's that sixteen of Trump's closest aides have already been implicated in this. I think means that Donald Trump has a serious problem. But do you are you telling me, John Rothman that you don't think that the House Judiciary committee should begin impeachment inquiries should begin the investigations to try to subpoena? Get the information sheet investigation. Yes. But and I want add this is a big. But remember that impeachment is not a legal process. It is a political process that the impeachment by the house is basically an indictment of a president. And that when it goes to trial on the Senate, you have to be able to know that you have enough information for conviction. Otherwise, you're spending your real course. But I think that the problem here in the problem with anti Pelosi under George Bush saying impeachment is off the table that ticked me off so much because they didn't even have the increase. They didn't even have the investigation. And that's what you need to not be shy about pursuing. Because that's when you get a sufficient amount of evidence that you can then show to your Republican colleagues to get them to provide the votes, if you don't do the investigative work, if you don't amass the evidence, then of course, you can't call for an impeach, of course. I just want to point one of the things that you can't impeach somebody for being a terrible human being. Mike Mulvaney, who was tapped this week replaced General John Kelly. The president's asking. Incites once called Donald Trump, and I quote directly terrible human being. And now, this is this is what Mulvaney said he said, we have perhaps two of the most flawed human beings running for president in the history of the country. Yes, I'm supporting Donald Trump, but I'm doing so as as as enthusiastic as I can given the fact that I think he's a terrible human being, but the choice on the other side is just as back how tragic, but now I want you understand. We have a chief of staff beginning at the White House for the president of the United States. Who by the way is going to remain also as head of the office of management and budget. How will do both jobs? I have no idea. Third hat to. I can't remember what it is. But you have a man who is coming in as chief of staff who was saying that Donald Trump was a terrible human being. I mean, it's chief of staff. Unbelievable. It's incomprehensible. Do you have to take another break? I do. And so eight hundred eighty eight ten is the telephone number eighty eighty eight ten. You know, my attitude is can we impeach him? Now. And what I'm saying that I'm saying can we in bark upon in January because the Republicans aren't going to do it.
