I'm christopher gothard writer and host of the l. a. times podcasts. Dirty john and detective trap. I'm inviting you to follow and listen to my new podcast. That trials of frank carson. This eight episodes series is a story of power politics and the law. In california's central valley new episodes of the trials of frank carson are available to find them search for the trials of frank carson. Wherever you get your podcasts thank you. Don gentry is chairman of the klamath tribes earlier this year. He and other leaders successfully defended their tribal rights to water in an oregon circuit court. Don welcome to the times or queasy. That's greetings in the climate language. Can you give us the lay of the land and the relationship that your tribes have with upper klamath. Lake lake is in our traditional aboriginal home. Land it's actually Prehistoric klamath area. And it's a part of where we have our rights to exercise fishing hunting trapping all reserve to the treaty of eighteen sixty four so we have a treaty rights that we reserved it were to be ours forever and if you know our history. Tragic history The federal termination act terminated the climate tribes in nineteen fifty four eventually lost our homeland but our rights to hunt fish trap and gather free state and federal regulations survived the courts and we also have water rights from adair case flowing from that treaty. Basically the whole principle is to have rights. That are worthwhile. You need to have the resources to exercise. Those rights on the fish wildlife plants in the courts of affirmative. We have enough right to maintain water in stream in klamath lake in marshes rivers provide for our fisheries and other treaty resources. So that's where we're at right now the. Us bureau reclamation announced in may that over a thousand farmers the klamath basin wouldn't get any reserved water at all from upper klamath lake because of this drought and a lot of them are saying. Hey this is going to ruin our livelihoods. We need some water. We can't exist with no water at all. Would be your response to farmers concern. It is unfortunate that we're in this serious situation you know it affects folks finances way of life and affects the economy recently here and So i mean. I can feel for that loss. I mean we've suffered a lot of loss in the past and you know what that's like having your feature down from in some respects but this is an ongoing problem. The drought is surface again. There hasn't been enough water for act to operate sustainably for a number of years especially when you consider the needs of the fish obscene downstream. It's unfortunate that we're here but hopefully know there will be a real focus on looking at the real problems. I think we've crossed the threshold of. What's been sustainable. Especially if we continue dry period resulted climate change. We need to really hip. That head on is unfortunately Folks want to continue doing business as usual so to speak to do that. You know that's the thing that's really difficult for me in tribes is worthy problem. You know where look. That's a problem. And the solution the tribes would just quit making a call him or water rights. And just give up on endangered fish could continue doing what we're doing and it's just to a point where that stop also. There are farmers who try to say that the klamath river tribes only care about the water in so much that it takes care of these fish the swamp but as you told my colleague anita shaab the schwab is important to the tribes. Yes but that non-membership also care about its fate as well. Oh yes it's been the exercise of folks to try to marginalize the importance of the fish in importance of the climate tribes in our treaty rights. Because we're at odds since somehow are perceived as the enemy. All the we're trying to do is protect the water in the stream that provides for the health of the ecosystem sustainability. The fish you know were at odds with those folks so what they do is try to make it sound. Like the fish aren't important or The climate tries in order at least as important as us irrigated agriculture. So we're definitely at odds and you describe the sh mom as a canary in the coal. Mine if they're not taking care of and if they start disappearing then there's not much time left for the rest of us. Yeah that's Indication is hardy and strong as the fish are in even to live and klamath lake which has been shallow and warms up every year if they're basically on the blink of extinction. It indicates that things are seriously wrong. In the watershed and we know that the things that men have done in terms of developing nike and draining the everglades the west and then on the tributaries to the lake the streams of unraveled and eroded and contributed nutrients into the klamath lake. The caused the poor water quality problems. We have more than a quantity of water quality of water. Also yeah the klamath tribes have had to fight against people who want their water for like one hundred sixty years at this point but the last big fight was in the early two thousands. Here's of a farmer from back. Then we figure on doing it until we get our water back and we are doing it. Peacefully. we are hoping very much that somebody doesn't come in from the other side and cause trouble to make us stop but a lot of the people who wanted water weren't peaceful. Climate tribes members were spat upon school was shot with shotguns there bumper stickers ridiculing the schwab. Don how're the tensions right now. I mean it's just ugly feeling driving by and seeing signs out there obviously one sided. You know even invitation. Alan bundy was gonna come. It's been put in the paper that they're friends of his and had in -cations with them and yeah feel ugly. You know hoping that it would really escalate to a point to where it did in two thousand one and it hasn't thankful for that younger members of your tribes have been more outspoken about the racism that goes into these water fights and say maybe previous generations. They say they're inspired by black. Lives matter and other social justice movements. How are you seeing them. Taking up the fight for water rights different from say your generation. I think it's the breath of fresh air. I think is long needed. We just have this terrible history where we've been marginalized in our own homeland for so long with non native contact or reservation area oppressive indian agents and a boarding schools and we haven't felt safe to have an opinion that's contrary to significant portions of the community. So what we're doing. We're trying to hold on the remnant of what should be here the creative place here for all mankind..

And maybe in addition to that you have those additional unemployment benefits. You know that has gone away. Still be interesting to see where the economic data goes from here. If it takes a while to get a stimulus package into the works in something in great upon and passed, then then who knows? Maybe we see some of this data start to backslide. A local band measures all kinds of stuff involved were, of course, talking about the judge Gentry. Ah fiasco in northern Kentucky. Yeah, well, we haven't talked about it. I know Willie is. You know this has got him all aroused, but you know you and I haven't touched it to this point, and I thought because it's kind of it is wrapped up. It's in the judicial panels. Hands right now is the way I understand it. Let's talk to a guy who's covered it extensively for the Enquirer. Scott work a Wortmann welcome back to the program. Well, thank you for having me. Yeah. Yeah, You think so? Am I wrong there? This is now in the hands of Ah judicial panel. You are correct. It's not a criminal trial, so it didn't work like a jury. Where they they come out with a verdict is going to come out the panel, which is called judges, they're actually the dentist on there. They're going to come out with a written decision basically whether Judge don gentry violated any any judicial codes and precepts Announced and Scott You did a great job of summarize in this whole thing in the Enquirer because it's there's many moving parts and it's hard to understand. But now me, obviously, I've followed it and I read your whole piece and I've talked to some people over northern Kentucky and Everyone said Judge. You know, don gentry is a great judge does a great job and all that sort of thing. But, you know, maybe you might have been going through. Ah, bad partner marriage and things like that wand up, you know, having affair all these sorts of things, But so the question comes down to is this you know, by the letter of the law, something that should get her kicked off the bench or just something that has looked as Look, this is kind of beneath the position and she needs to kind of resigned herself or or go go somewhere. Well, it wasn't what I would say It was a consensus as faras her ability as a judge, because Which is why the case was brought. She has her critics, people that said that she played favoritism and politics with these judicial panel that are designed to help Children that are abused. And that's where faras the actual violation that wore a lot of the the the the heart of the violations and accusations against her that could get her in trouble. Preside. But as her defense attorney said that the case infected by sex, which is the has a ring to it, Yeah, that's a headliner. All there. My friend is goingto there's going to be on Dateline with that guy. Dogs like That was one Rose came into the case. Reported by the New York Post over the weekend, So it's well on its way to Dave. I've explained, explained Scott, Stephen Penrose in your and the pace you You alluded into like a Rasputin kind of figure. He's a pastor. He was a member of the band with her, and I guess sound had the hot for her and she didn't really have the hot for him. But kind of was very influential person. Ah, dear friend kind of thing, explained his role. Wow what I began and yet a defense pretty much blame. Most of The transgression than the wild behavior in her office on him. Instead of the sort of we don't know. He didn't show up the court On Wednesday, the the prosecutor said that they served him a subpoena. He didn't show up. His attorney says that The the Judicial Conduct Commission never left a message for Mom when he should show up. So who knows what exactly happened there, But we didn't get to hear his side of the story, which Not a great ad for the mystery, but basically ah She was a he was Don Gentili family court judges specialists, but she knew him because he went to church Did Heywood pastor the church in Bromley? In Kentucky in northern Kentucky. They were bandmates. They were in this cover band called South of Cincy. And courthouse employees testified that there were rumors going around that they were having an affair that there were three involved. Judge Dent Gentry denied that, saying that there was no sexual relationship, but she did admit Hey, I said, Hey, center nude photos that she kept on her phone. And she seemed to have a tough time explaining that to the commission there, the commission kind of grilled her on that it did raise some questions why her pastor was sending her nude photos. Well, what about approaching the secretary about involving and herself in some A recent movie. That was another interesting thing because the secretary also deny that there was any sexual relationship, but he quaint The courthouse employees there were maybe three or 45. Several courthouse employees that testified hearing heavy breathing moaning to female voices coming from Penrose is office. And the secretary Laura Aubrey, who was Judge Gentry secretary. In. Gentry also backed up. This version said there was a praying they said that there were rumors going around about the sexual shenanigans. That they were up to, and they go well. It all began When she was sitting. I found the judge sitting on a bathroom floor with a profuse it ve nose bleed, so I've been over to try To help her with her nose blade. She grabbed me and kissed me, which I cooperated with. And then we stood up and had a glance in a moment. I ask you a question you've been with. "You'll get a confirmation, text and info, standard data and mistreat supply in this nationwide contest that thanks to 202 100 Let's you and I get after so many issues really, so little time we have the gentry trial is underway with Ted McKay in northern Kentucky. Judge Gentry. Who I've known many female judges in my time. In fact, I have slept with one for for decades. And the idea of liquor bottles and beer cans. In a party atmosphere in a courtroom. Exchanging sexual favors. With male and female employees in exchange for campaign contributions and rulings despicable. And this is unique. It's happened one time, I think in the whole country, Judge Gentry And why she's putting her family by the way, her Her husband is also a judge. Judge Judge Don Gentry's got issues serious issues. And ah According the hearing. That has to be a hearing. And she denies. There were sexual quid pro clothes. But she does say that maybe her at times her courtroom got out of control. She took the stand Monday morning to defend herself against the 12 judicial misconduct charges. And she said that her, Gentry said she brought her acoustic bass guitar into the office one time On a question she did admit there were beer cans and liquor bottles in her chambers. Bringing bringing in the guitar. This is something totally alien to anything Don't anticipate. This is like regular behavior. She was asked whether That created sort of a party atmosphere, and judge Don Gentry said quote it could reasonably be perceived as that. She admits violating campaign laws and asking employees and people. She appointed two boards to campaign for her, but she denies some of the more salacious allegations. Including trading. Sex, sex and more sex for favorable rulings. And this judge is 39 years old female. Appointed and I think in Kentucky once you get appointed, that basically is it and away we go. But we have so many issues in so little time. And I want to go to Tom and then J. Adam, we got so many great callers coming up. I'm going to be with you to at least two o'clock today. After two o'clock. The White House indicates that someone may call in after two o'clock, and if that happens, we'll take a call from the White House. Other than that many issues very little time. Tom in northern Kentucky, home of Rob Sanders and Tom Give me a full report. Bill. This happened to me Friday. But I agree with everything you said, But I think your business is a very good point. Because people don't like you. Death by almost got hit. By that car. Hi, Tessa. Mile After what? Before he killed those people at the moment, So I just stopped at the light. I won't pay the employees or I was working for you might not want me to, but it was a courtesy car. So I would have been the bad diet, his eyes. But I've been a hero in law enforcement being a former law enforcement officer. So my point is this here's to it as the people sitting in a restaurant eating and they get killed by this. You know what? Also, as my concern grew after reading the audience inquire, I thought, Well, maybe the police would like to know what happened to me. As a material witness and you being a lawyer. You would understand that. So who do I call? I call the Newport Place. They switched me over to Cincinnati. And then I went through the bureaucracy of trying to get ahold of the person that's investigating. And after being on the phone for 15 minutes, I said, Here's my number. Call me on as of yet they have not called me back. So I understand where citizens are upset with the police depart because of that. Well, the other issue, Tom, I have a great many officers Tell me they will not engage in high speed pursuits. Maybe if you're chasing a presidential assassin. Something character, but you have to weigh the risk to the public against the value of arresting somebody. And I'm being told someone's whispered in my ear a few hours ago that the person involved in this is one on international drug trading charges that there are indictments pending against them that this was a person who was trafficking methamphetamine in northern Kentucky and Cincinnati. And that when the police began this thing, they also believed he had semiautomatic rifles, AK 40 seven's in the car. And when I start hearing about the international drug trade career criminal, I can't say Okay, you may be. You got to chase him. But when it becomes obvious you're going 80 to 90 miles an hour. In Newport and Covington and Price Hill. It's time to stop because there's a good chance There's about 600 civilians who die every year on high speed police chase is that have nothing to do with the criminal being pursued, and those two Americans sitting there outside of a bar restaurant having a coffee? I should not have been killed by this drug deal or that the police were chasing. You can catch him later on. So on one side of the one side of the table, I can see why they should have been chasing him. Then I hear about a 47 drug dealer. Multiple investigations importing death in our community. I kind of say maybe they should have done it. Maybe they shouldn't have done it. I know what the end of the day there's two people that are dead. They got the death penalty from this guy. And whether it's Hamilton County or Camel County. I think I think Michelle Snodgrass is the prosecutor in Campbell County and that they have toe there is going to be a meeting held in the middle of this week between law enforcement in Cincinnati, Campbell County, Newport and and Hamilton County in Cincinnati to decide what happened didn't have to occur. And then this guy driving the car is going to face near murder charges because he started a process that resulted in the death of those two people. That scumbag is going to go to prison for the rest of his life. But people are dead. One other point, Willy, don't quote me on this, but I heard by the Police. Network that this Joker already killed somebody in a vehicular accident. I don't know his name. I don't know if that's true or not, but So you know our justice that you used on they'll have to decide whether to try him in Hamilton County. There's jurisdiction in Hamilton County and in Campbell County. And so Snodgrass is going to get with Jody eaters and say, and really committed crimes in both areas. Different crimes. And so probably they're going to do both. But the most serious crime is the Newport. So Toby, That's where it should be held Your lawyer he killed two people in Newport should be held in a state of great acting. Absolutely does that Does Campbell County have a good Good result On these cases, I would think so. I don't think Joe deters has ever lost a murder case that he tried himself, but on the other hand, But there were crimes committed. A serious crime was committed in Campbell County. But you can also try Ham in Hamilton County because it was a long process that began but they could try him and Campbell County get a lengthy sentence. And then try him again in Hamilton County on different offenses and stack him, which means he's never coming out. In relation to the police pursuit. When I got back to the facility eyes I told the guy what happened, not knowing this was going to happen. I said, you know, Baba block so I said it had to be a serious crime because they please not being retired for 28 years, But anyway, the police would not have pursued him across that river and left. It was really, really serious. China. The original reporting was it was like a traffic violation, and that is not the case.
