But Rupert Murdoch testified under oath that Fox News promoted election lies on air, despite plenty of evidence revealing that many hosts privately knew the claims made by then president Trump and his surrogates to be false. This is from mediaite, stunning new details emerged and more court documents released Monday in the dominion voting systems defamation lawsuit against Fox. Let me stop right here for a moment. If all of this is accurate and we have no reason to believe it is not accurate, Fox News is in a world of hurt because they are facing $1.6 billion in fines and penalties if they lose this lawsuit and it does not look good. Murdoch admitted in a deposition last month that false election claims were promoted by top host at the cable news network, quote they endorsed. I would have liked us to be stronger in denouncing it in hindsight. Northwest news radios Kim shepherd talked with ABC's and when to get the latest. Revelations are coming out on the defamation lawsuit brought by dominion voting systems against Fox News, ABC's M wins on the northwest news line, and defamation lawsuits are historically really difficult to prove, but in this case, it sounds like they might have some pretty pointed evidence. Yeah, certainly defamation cases are generally hard to win, but there are hundreds of pages in these court documents that lay out evidence to show that Fox stars were preaching conspiracy theories in favor of the former president, trying to also boost ratings without much fact checking, despite what, of course, dominion voting system says could harm their company. So this new core filing is really bombshell because it reveals the inner workings that Fox News. It's about 200 pages long. It's a part of this $1.6 billion defamation lawsuit against Fox News, and it just has dozens of examples cited in the documents. It just lists one after the other examples of both Fox News anchors and producers privately acknowledging that the former president and his allies and the allegations of the election broad were just false, despite their network promoting those claims on their shows. Do we have any specific correlations between the text messages and other behind the scenes communications and what these hosts were saying on the air? On the air, we've heard time and time again around the time of November that the dominion voting systems were rigged to possibly change votes in favor of Joe Biden changed them from Trump to Biden. And we heard that time and time again on the network, but we especially heard that from someone named Sidney Powell if you remember she's one of Trump's attorneys who were on the show continuously, very often pushing election denialism. We've heard from Tucker Carlson at least in this document saying and texting to producers that he felt she was lying. He also went on to say their quote wasn't enough fraud to change the outcome of the election, even went on January 6th later on to say that Trump was a quote destroyer. We also heard from Laura Ingraham in this document apparently telling Hannity and Carlson that Sidney Powell, again, that attorney was a bit quote nuts. Time and time again, there's just Fox News anchors and stars, and even producers behind the scenes, just continuously saying that these allegations were nonsense. So what would happen when those folks would say we should fact check this? They ignored or were they reprimanded? So we've heard of some examples in this document that some people who would speak out if they weren't large stars. They would immediately have to take down the tweet that would immediately stay quiet about what they were saying, whether or not they were fact checking. There were some producers who continuously had to fact check. And yet they were called out by some anchors as well. So there was a climate in Fox News at this time. It appears in these documents that showed that those who wanted to speak out just weren't listened to. Has Fox responded to this yet. Yeah, certainly. So we've heard from Fox a few times. They've said one, they're proud of the 2020 election coverage. They called the lawsuit baseless, and they said that the core of this lawsuit remains centered around the idea of constitutional rights of freedom of the press, freedom of speech, they've also said in another claim that they were questioning the damage amount of $1.6 billion saying that they believed dominion's value as a business can't be anywhere near $1.6 billion. So this continues the conversation from Fox News and ultimately this could be one of the most consequential First Amendment cases moving forward. We do know there's a trial set in April and as you mentioned Kim, it's going to be difficult when it comes to defamation cases. But this one is a little bit more unique. As a matter of fact, Tucker Carlson, who many of you love in these documents called president Trump a demonic force and a destroyer. So my question is, who do you stand with? Do you stand with Fox News channel or do you stand with Donald Trump? Who do you stand with? This is from mediaite on the night of January 6th, Fox News host Tucker Carlson referred to president Trump as a quote demonic force. That was in a text message to his producer after the president's supporters stormed the capitol. One of many revelations in the lawsuit filed by dominion voting systems. By the way, they're suing Fox News for $1.6 billion in damages and folks, I'm telling you based upon what I'm reading here, they may have a pretty good argument, because they're accusing Fox of defamation, and now they have all this evidence, and the evidence clearly shows that Fox really did not believe there was voter fraud, but they were not saying that on air. They were saying something very different. At issue or claims that Fox News host and guest made after the 2020 presidential election. I want to read this to you. This is from page 19 of the filing, and I've got the full document here. Fox host Tucker Carlson, Laura Ingraham and Sean Hannity immediately understood the threat to them personally. Carlson wrote his producer, Alex Pfeiffer on November 5th, quote we worked really hard to build what we have, those efforts are destroying our credibility. It enrages me.

"With the onslaught of misinformation, widespread lies have sometimes led to widespread threats against individuals and businesses now some of them are trying to fight back in court. Dominion voting systems, families of children murdered in sandy hook, a school librarian in Louisiana, all are suing purveyors of misinformation, but our defamation lawsuits are effective tool to fight misinformation, joining us now to talk about this is David Schultz. He's a Yale law school professor specializing in media law and director of Yale's media freedom and information access clinic. Thank you so much for joining us. Thank you. So one of the biggest is the case involving dominion voting systems. In the coming days Tucker Carlson, Sean Hannity, Lou Dobbs, are all scheduled to give depositions in that lawsuit against Fox News. Dominion is suing fox because of ongoing false statements about its voting machines, what kind of impact will this case have? The hope is that bringing these types of libel suits will have two impacts. One is that they'll serve to correct the record. I mean, ultimately, the trial will determine whether their statements have been true or false. And dominion is trying to establish reestablish its reputation and the falsity of these charges. But the second impact that libel litigation can have and hopefully will have is to chill others from continuing to spread lies. And it just remains to be seen how effective that is. Libel litigation is one tool, but it's certainly not going to be the ultimate resolution of the massive misinformation that we're in the middle of right now. So some have described this case with dominion voting systems as a once in a generation First Amendment case. Would you agree with that and why? What's different about this? Well, it certainly unusual. Libel law in the United States or defamation law has been very narrowly constrained by the Supreme Court and the First Amendment. It has said that because we want to have open robust vigorous political discussions in this country, the mere fact that you say something false does not necessarily give rise to a libel claim if it's an innocent mistake. But the First Amendment does not protect lies or knowing falsehoods of any sort. And so these lawsuits can proceed, but they tend to be very rare because typically, you know, major news organizations aren't in a business of spreading knowing falsehoods. So what's really unusual here is the allegation at the heart of this case is that Fox News, which is perceived to be a major mainstream news organization, has been knowingly spreading lies for months, and that's quite an unusual allegation. So knowingly spread lies, how do you prove that someone knew something was a lie? Can't they simply say they thought it was true? Sure. And that's one of the biggest hurdles that dominion will have in pursuing its case against Fox. But, you know, there are a number of ways to show it. The first issue in the case is going to be, is it, in fact, false, and I think at least according to the allegations in the complaint dominion has gone pretty far towards establishing that these claims that are being made about it are false. And in fact, there are 6 or 7 lawsuits that dominion and smartmatic have brought and all of them had survived motions to dismiss, meaning that judges have reviewed the complaints. And have concluded that the allegations, if proven would sustain a libel claim. So then once you establish falsity, then you have to show that the defendant in the case here at Fox News or some of its personalities knew had actual knowledge that it was false or had serious doubts about the truth and published it anyway. And there's a number of ways to show that. The courts have identified factors like if a statement is inherently improbable that only a reckless person would have passed it along, that can be evidence of actual malice. This notion that you should have had serious doubts. And certainly the idea that Italian satellites were somehow changing votes in the voting machines seems on its face inherently improbable. Another factor that would be an indication of actual malice, not knowledge of falsehood, is if the organization is purposefully avoiding truth. In other words, they're not talking to individuals who have obviously relevant information and passing that along. Or if they're aware of contrary facts and they just don't report them. All of those can be ways of demonstrating that they have the sufficient knowledge of falsity to justify a claim under the First Amendment. I wonder if they can use evidence from Sidney Powell's lawyers Sidney Powell's a former attorney for Donald Trump, she is actually being sued by dominion. On her own right, her lawyer said no reasonable person would conclude that her attacks on dominion were truly statements of facts. How is saying she knew she was lying a defense? Yeah, I don't believe that it is. I mean, there is certainly a defense to a libel claim if you're merely offering an opinion or if you're using hyperbolic rhetoric that people would understand to take with a grain of salt. But you can't assert something which is provably true or false and then say, well, you should have known I was lying. Except in a, you know, there could be a very rare circumstance like in a satire or a sketch on The Colbert Report where you understand that someone is lying. But when someone gives a press conference or files papers in courts and later tries to say, well, never mind, you should have known I was all a big joke.

"There's a startling article in gateway pundit that is talking about Georgia and talking about the Secretary of State Brad raffensperger. And they quote a guy from a group conservative group in Georgia that is called voter Georgia, voter GA. This is Garland fever rito. And he says with regard to Bragg, meaning raffensperger, I don't think anyone believes down here that he actually won. When I saw this, I was like, what does that mean? Well, raffensperger won his primary for Secretary of State. But surveys had shown that he was deeply unpopular in the state. So a lot of people in Georgia were like, wow, how is it that he won in one rather decisively and one even more than he was predicted to win before the primary itself. He was leading right before, but his margin was substantially even bigger. Well, this group called voter Georgia border GA has put out a report. Basically, alleging and I want to emphasize alleging that the Georgia voting system seems to have added 15% of votes to raffensperger's total. And so their voter Georgia is now filing, has has filed a challenge in all 159 counties and they are saying that these that the vote count, which is, by the way, dominion vote count for the Secretary of State is not accurate, and that he certified these unlawful results. So basically what voter Georgia wants to do is unseal the ballots so that you can count the ballots and match them up against the results that were given by the machines. I mean, this would seem to be something rather obvious and easy to do and I don't see why they haven't done it already. If anything to build confidence in the results. But this is what the article alleges and it's coming from voter Georgia that raffensperger received about 53% of the Republican day votes. Federal cybersecurity officials have verified there are software vulnerabilities and certain ballot marking devices made by dominion voting systems, discovered during a controversial Georgia court case, which could in theory allow a malicious actor to tamper with the devices according to a draft analysis reviewed by CNN. Big news, right? This is interesting. This is apparently our real vulnerabilities in the machine. This has been confirmed by cyborg experts, CNN agrees that this is a problem. Let's look at the headline of the very same article because it's intended to disguise and conceal the simple fact. Federal review says dominion software flaws haven't been exploited in elections. What? So CNN, instead of highlighting the machines of vulnerable, the subject of the article and in fact the first line of the article, instead goes on to assure its readers, will listen, this may be true. What we're about to tell you, but we want to put you on notice that there's no evidence. This is their favorite phase. There's no evidence. It doesn't mean it didn't happen. They just don't know it did. There's no evidence that it's been exploited in elections. And this is the key question. You know, here are the quotes somebody from seisa, the cybersecurity and intelligence agency, quote seisa has no evidence that these vulnerabilities have been exploited. So it's not that they have, not that they haven't. They just have no evidence one way or the

I'm always very skeptical of that particular argument. I realized that we have that rule. We have that law in place, because if Dave gets in an accident, I shouldn't be able to sue the person.
