"Well, it's one of the things that you have been noted for from the very beginning is not just assuming that we know everything, but as we learn more, we create products that reflect this new knowledge. And now you're creating a line of products based on what we've learned in, say, the last ten years brought together from what you've learned before. So it's a very profound movement that you're heading up right there in your own company. And it's setting a stage. You're not a me too type of person. You get out there and do this wonderful research, create these wonderful assets for people, not only the products, but the knowledge and the books and your presentations on TV will touch upon that as well because you've been a pioneer in reaching out beyond the health food store, which is historically where people have gone like yourself. You go in and you ask questions, you're reaching out to a platform that reaches a lot of educated people who have an interest. And I want to cover that in just a bit. Before we get to that, though, I'd like to turn our attention to your program called hope. We discussed this before and I was talking to my wife yesterday. And I said, this acronym of hope, Brenda Watson has summed up in these four letters the most profound foundations of digestive health and further total health in those four words. And I always thought it was so succinct and yet so profound as many things are. So could you explain hope to us? What is that program consist of? Okay, it's kind of a funny story. You know how things are. So I'm writing a book called gut solutions. You remember that? So I'm sitting there with doctor Leonard Smith. Doctor Smith was my mentor and also a GI surgeon and unfortunately he passed last year, but we're writing a book at my house, right? We've got that solutions. It takes every digestive condition, right? And gives you what is it? Who gets it?

Why wouldn't you go and change? You went and got a sandwich. This is becoming a thing now, right? This is becoming a thing. Why can't I share this to my other? We're going to be talking about 1986. I know you guys are dying to see this. A dying to hear this interesting and now I'm just dragging it out. And I really can't figure out what's going on with the this should be able to share. It's a technical thing. Wait for Jack to come back. He's back. That was quick. Now I'm in my jammies. Friends timeline. Let's see. So Jack, what do you have? Let's talk about some albums from 1986. How's that? Yeah. A lot of good albums, a lot of good albums. Yeah, 1986 was a pretty good year. And I think that there were a couple of great records. I think, you know, for me, the most pivotal thing that occurred in 86 was the changeover from Van Halen with David Lee Roth. To with Sammy Hagar, so they put out the 51 50 album, which I thought was actually a very good record. That was a Sammy Hager fan prior to him joining Van Halen. Certainly being the big Van Halen fan that I was previously, I was disappointed that David Lee Roth had left. But we kind of got a two for one. And I'm going to give you a two for one in that. We got 51 50. And we also got David Lee Roth itam and smile with his quasi supergroup of Greg bissonette and Steve vai and Billy Sheehan on base all just premier rockstar, unbelievable musicians, so that's my first pick. Yeah, it wasn't a great album, though. Which wasn't. David Lee Roth's. Oh, there's a lot of great stuff on that first record. There's a lot of stuff on. Yankee rose, shy boy. Right? So what's the problem? Didn't he do? There was something else that came off that album. I think Yankee rose was about it though. It really. Was the album. You know what? He did, oh, it was a remake. He did another remake of tobacco road was on survival was on it. There was a lot of good stuff on it. A lot of it not necessarily on the radio. That's life. He did that to life. Yeah, but that wasn't it's on the album. That was not on that. I don't think so. I wasn't about that on the EP that he had done. That was on Ed him and smile. It was think it was the last track on the album. Yeah. It was his first one was all kind of just a gigolo and right? Listen, it was entertaining. It was definitely entertaining. It got, it got its due, the critics loved comparing it to 51 50 and the differences and it's just as good and it made it an interesting fodder. So that's life, you're right. They actually finished the record, but Yankee rose great song shy boy that Billy Sheen had brought in. I'm easy, gray tune. Ladies night in Buffalo, fantastic song. Going crazy, tobacco road, elephant gun, big trouble, bumping grind. There's a lot of great stuff. Not a lot of stuff that ended up on the radio. But comparatively speaking, if you go back and you actually look at the critics, they were a bunch of critics that actually liked the edom and smile album better than they liked the 51 50 out. Now, I don't want to turn this into a Van Halen show, but couldn't those have been the people like me that didn't really appreciate Sammy Hagar with the band until later on. Because that's when I really started to, I listened to it and I was like, you know what? I quietly like the I liked why can't this be love? I like dreams like best of both worlds. Off of 51 50 big video by songs in the Philippines. I mean, when I say a video about this wasn't on TV, these are big fucking screens with monster speak. It's like concert speakers and you go into these buzz. And it would just be deafening. But the 51 50 I came to appreciate later. I did like the David Lee Roth album, but then I kind of didn't after a while. I don't think an age. I don't think, I don't think some of it age well, just like David Lee Roth himself. Good point. Great point. Great point. Yeah. David Lee Roth can not sing anymore, has not been able to sing for probably 20 years. Yeah. Yeah. And he looks like more like doctor Smith from lost in space than he looks like. Lion maned 1980s, rock dick. Yeah. David Lee Roth. Chiseled and fast and he certainly has he certainly has an aged as gracefully as this is true. I'm better looking than him now. That I know. I saw something of him recently. Don't argue with me. How could I possibly ask teeth what kind of jacked up his teeth were kind of jacked up? What does that mean? Something's going on. No, no, no. I thought he was pretty sure he's missing a tooth. There's something you had said he's not well. This hints that out there that he's not well. He didn't actually he had actually let it be known that he wasn't well that he was, he had made some comment that he was right behind Eddie. But you never know, that David Lee Roth, you know, he probably didn't like the fact that Eddie dying got all that publicity and wanted to fire back. That's just the way that that lunatic is wired. And I love those early, you know, David Lee, I mean, those early Van Halen albums, but David Lee Roth did not age well, and he did not age gracefully. No. In body and in mind, in my opinion. Yeah. Yeah. Well, God bless him. He's still a legend. So I'm going to go with an album that I'm not, I was a fan then I kind of wasn't then I'm kind of neutral on the guy, but this album was a fucking blockbuster. Peter Gabriel was so are you fucking shit me? What? How many times have you put down Peter Gabriel? Oh, I'm not a big K pita Gabriel fan. And that's the first one that you come up with? How dare you? It's a good album. It's a great album. It's a masterpiece. Yeah. It's got red rain, sledgehammer. Don't give up featuring Kate Bush. Mercy. What's your time in Europe? What's your what's your favorite song on for that record? Yeah, I do like don't give up. I do like that. It's the slowest one on the album. But I like, you know, I like the Kate Bush. Duo. But of course, red rain is good, but in your eyes isn't that isn't that the classic off that album? Would you say? and sledgehammer. Sledgehammer. Sledgehammer got all the accolades for video. For the video, right? Yeah, yeah. Because claymation looked

I'm loved your article and I can not wait to talk about this great issue. Diversity, equity and inclusion. But before we get started, why don't you tell our listeners a little bit about who you are and what you do. Jane, we'll start with you. Well, good morning. And thank you again for having us. I'm an employment lawyer. I've been in the employment law space for over 40 years. And I've actually seen a lot of change during that time period, but there is still so much work to do. And so we found a DEI esquire as an organization that would really keep the conversation around diversity inclusion and equity going and really trying to touch some of the topics that maybe haven't been grappled with as intentionally as they needed to be. All right. Connie, thanks so much for having us Theresa. I am an in-house labor and employment attorney. And before that, I worked at a labor employment law firm for about a decade, but as Jane mentioned, sometimes people think of lawyers as the obstacle or barrier to some of our diversity, equity and inclusion efforts, but really I think as employment attorneys, we can provide a different type of perspective on how we can further those efforts in a collaborative way while also still kind of keeping the law in mind. So excited to have our conversation today. Well, let's talk about the articles. So I want to talk about what does being authentic from a diversity equity inclusion perspective mean when it comes to a workplace context. So it means being who you are, being able to be who you really are. And the reason we thought this article was important because it's because so many people don't feel that way. They engage in what has been termed covering behaviors. And those are behaviors that people from underrepresented communities engage in just to fit in. It's about modulating your identity to be accepted by the mainstream. And there's actually been some pretty good research on this space. Doctor Christie Smith from Deloitte and NYU law professor Kenji yoshino published a paper on this entitled uncovering talent and they and that paper identified a new model of inclusion, which really takes into account four areas of four types of covering that people engage in and counting. I will share what they are. The first is appearance. So that is about changing your appearance or your mannerisms, so that you look different in order to get acceptance in the workplace. So for me, that meant relaxing my hair, I have naturally curly hair as an African American, and we used to kind of joke in my community that we would relax our hair so that other people would feel relaxed. But that is an example of covering. People are feeling more free now at where their hair as it grows out of their scalps, which is great. A second example of a covering behavior is advocacy. So that's not speaking up when a slight occurs to avoid being seen as divisive or in my case, perhaps an angry black woman. So really, when you feel you really ought to say something, but a big conversation goes on in your head, should I do that? Should I not? It should be said, but am I the one who can say it? How will it be perceived? So that's an example of advocacy. So a couple of the other covering behaviors that doctor Smith and professor shino talked about were included affiliation. So that's the idea of avoiding actions that might be associated with certain groups or marginalized identities. A common one would be a working mom who doesn't talk about our kids at work because she doesn't want to appear less committed to her work or maybe an African American male who might hold back constructive criticism because he's afraid that he's going to be perceived as intimidating. Another one would be association, which would be in somewhat similar to affiliation, but association is actually avoiding contact with your own group. And I have to admit I'm somewhat guilty of this myself. I'm a Taiwanese American and my maiden name is twang, which I found at growing up. A lot of people in America, frankly, they had a hard time pronouncing and being named Connie Chung when Connie Chung was the only Asian American person on TV that anybody knew was frankly kind of annoying, right? Because I had so many times where people were like, oh, is Connie Chung your mom? Or is Maury Povich your dad spoiler alert the answer is no. He is not my dad. But it was distracting and just kind of it made me feel a little bit more like an outsider. When I married my husband, who's Caucasian American, and he had the last name almond, which is very easy to pronounce. Nobody really wonders about it. I took his last name, in part because I wanted to have an easier last name that didn't have to have a lot of explanation or conversation around. But that's an example of an association where I didn't choose the last name just because that was a choice I wanted to make, but in part because I wanted quote unquote easier last name. Provided some statistics in the article that you wrote about how common covering actually is. A bit about that. Yeah, it's actually really very common. According to the research, 83% of the LGBT community engages in covering behaviors and perhaps we can understand intuitively why that might be because there's still so much hostility. 79% of African Americans, 63% of Latinos, 60% of women, often that's around children. But what's also interesting is that about 45% of straight white men also engage in behavior. But the reason why they're engaging in this behavior is because they have some other characteristic. It's not their whiteness or their illness. It's another characteristic that they feel puts them in an out group. So for example, having a disability or maybe having grown up poor or maybe being an evangelical or whatever characteristic they have, which might not be the dominant characteristic. And so they cover up that part of themselves. Interesting. The fact that the majority of people are engaging in these covering behaviors, one impact it has. If you wonder, why does it matter? Why do we care that people have these covering behaviors? Doctor Smith and professor yoshino mentioned in their paper that there's an immense emotional toll that comes with these covering behaviors. So many of us are so used to it that you don't even identify it. You don't put a name on it because you are doing it. Like you mentioned Theresa, that kind of a battle within your own self within your own head. Should I have said that? I said that wrong and you think about it later on. There's just so much energy spent around those covering behaviors. Really, whether people are aware of it or not, those covering behaviors can result in isolation, insecurity, reducing engagement, just less productivity because it's like having a side hustle just to maintain your main hustle. You just spend so much extra energy on those things that you shouldn't really need to. And that means there's less energy on your work, your family, whatever else you want to commit yourself to. I think that so many people in the workforce have come up during a time or an environment where they felt like they had to cover. And there was just mentality that that's what's needed. That's what being professional is. I think it carries on in that they think, well, that's what I had to do. So that's what others should have to do as well. But I don't think that's really being true to inclusion. That's certainly not creating a sense of belonging. And that's not really getting the most.

"They don't have the ability to have that buddy buddy think there are certain areas where they still do. But they're losing that. And it becomes more of an organizational sale. And one of the things that I think we could take a lesson out of other industries playbooks is the coordination between sales and marketing as it relates to Doctor John Smith. We were looking at some technologies on behalf of several of our clients that will let you see, okay, what's Doctor John Smith's surgical procedure volume for what's relevant to you? What does that mean from a dollars and cent standpoint and all that? So, and those are relatively relatively new platform. I think it's really innovative and it can help a lot of companies out. So let's say that you have that and doctor Smith is worth $3 million or a $1 million. So with that, what do you do? How do you actually leverage that knowledge to then not just have Randy the rap be able to go in and call on doctor Smith and know that he needs to close the deal. But also, how do you line up the support behind that to make sure that Randy has the highest likelihood of success? I was talking to somebody the other day about this. So as we all know, I love college football and the university of Georgia bulldogs, our national champions for the first time at 41 years. Joe dogs. And I follow the recruiting process and yesterday was national signing day in case you're wondering if you guys can. But so I follow it. And all these 18 year old kids, when they make their announcements, somehow have these beautiful graphics of me tackling somebody with a Georgia Jersey on and talking about all the wonderful things that I'm going to do. So there's some graphic designer who's doing that. In large scale and I'm not saying that when you go call on Doctor John Smith that you need to have him tackling somebody in the Georgia Jersey. That's probably the wrong answer. But imagine if you would, if you knew that getting doctor Smith on board is worth a $1 million to your business. Is there a reason why you would not take the time to customize marketing materials for him? There's a reason why you wouldn't make sure that you're not coming with some generic presentation about look at how great our features and benefits are, but you're actually tailoring it towards, by the way, in your practice, you did 316 total knees last year, right? If you're probably better than the industry average, right? So you likely had X kind of outcomes that you really want to get rid of. Here's what the impact is. Do you hear how much faster you could be, here's how many more cases you could do. There's no reason that you can't take this down to what do you do for that guy that's going to be a whale or that gal that's going to be a whale. And make sure that your sales and marketing team, your true go to market team, is aligned to be effective. And the only way you're going to do that is if you actually have a CRM that people are using, not just like, hey, we got Salesforce and it's there, which is what 90% of people are. But if you actually use it as a tool to make sure that sales and marketing are partners and not like fighting against each other about the quality of leads, but you're actually saying, okay, let's get down to individual doctors. What's our plan for snap? What's our plan for doctor Brown? What's our plan for this person or that person?.
