And a lot of that has to do with women and with independence. Turned off by the entire spectacle. And by how the president handled it all of these things that happen show voters and swing voters precisely why they were going to vote against Donald Trump in the first place. Just like this event is showing people why they were going to vote against Trump in the first place. He can't be magnanimous. He can't get up there and give a speech about how we almost come together without taking a shot at his enemies. Who were just, you know, the target of these bombings, and you know, we can call it the megabomb where if we want these were attempted assassinations. Yeah. Yeah. By the way, you tweeted, which is again making a point about the the larger point about the party, you said, Hillary, Obama CNN, Maxine Waters, more of these suspicious packages were found to have been targeting those who Trump has been nasty as to what Republicans will have the guts to call on on him to tone it down and stop inciting. These crazies. I'm guessing few if any. I have any as we speak. Right. I don't think. So. I mean, Ted Cruz, right? Double down since probably Democrats that sent the ball. I mean, it's insane. Reuters is reporting this morning that the department of Justice has issued an opinion to the supreme court saying that employers can discriminate against workers. That's new great. Okay. 'cause they don't want them protected by civil rights laws. You know, a lot of the legal system was coming around on the fact that discriminating discrimination against trans people was based on gender, and that they should then be recognized under our civil rights laws, but we see that Trump is no interest in quality. He is only interested in whatever will benefit himself in the moment. And he thinks that picking on transpeople is what's going to benefit himself right now. And you know, who it's going to hurt him the most with the people who are revolting away from him. Women in the suburbs who support LGBT equality because they know it's the right thing to do. And they questioned the character. Character of anybody who doesn't support equality. Carl the other night. I got a chance to meet Sally Yates, which was really an honor. Really nice conversational along the lines of what you and I always talk about you come from Republican family. I do right. But just from my dad being unearned Berg prosecutor. And just I mean, it's interesting Jeff tweets, I just thought it really is stunning. He tweeted, no one could have predicted that the party of Nazis child. Apologists would also be the party of drains bomb sending terrorists I mean. You may think that's over the top. But not really, right. I mean, this is this is something that we've been seeing growing. Observers of our political system are saying it's only a matter of time. It's. We can't the only thing that we can do right now is pray hope and pray that nobody is injured by one of these bombs because who knows how many are out there. Yeah. Especially you know, any of the people who they're targeting any of the first responders who might have to come in contact with them. And the second thing we can do the only thing we can do proactively vote. You have to get out and vote on at is the only thing that will send a message Trump stand. What he will say everything else. But. But at the end of the day, that's all we can do you have to bring people out with you. Tom nichols. Speaking of former conservatives, he said conservatives wants value tradition intellect prudence and stoicism, but the GOP is now a party whose base cannot exercise enough self control to keep from howling like angry hyenas for just one day while the country cries to sort out and attempt at multiple assassinations. I mean, that's becoming the disturbing thing. Right. Is not becoming. But I mean, the reactions of his crowds. Right. I mean, he has made them into this angry mob that that cannot be undone. Now, right. No. I am not shocked. He's been taking this this routine on the on the road for years now. And they they have rejected all ability to reason every single look at it's gotten worse and worse over time all of the shootings at schools in different places. There have always been those nut jobs out there who have claimed that it's some false flag situation that has become more and more a staple of the response to these. Things the government doesn't respond and the right wing. Activists claim that it was a baloney that it didn't happen at all. And they are backing up by conservative media. And the only media the Donald Trump trust is conservative media. Yeah. John Brennan, obviously, former director one of the targets came out and said it yesterday. I sincerely wish that Donald Trump though, would have said these things previously and regularly. I wish that he would have encouraged people from all different backgrounds and political affiliations to come together and to try to resolve differences in a very positive matter. Unfortunately, I think Donald Trump too often has helped to incite some of these feelings of anger violence. I mean, you know, Karl it's hard to get your head around every single day like God forbid, what know one of these gone up. What if something even more horrible had or does happen? You just completely incapable of taking out for anyone. He will move on very quickly from this in a in a couple of months when people have faded into the background God, hoping nothing bad happens. He will be back to doing what he thinks helps him what he thinks hold onto his base, and he will continue to do that. And that's why we count and if the FBI happening right at the FBI comes out, right? I mean, you can you can almost imagine anything if they come out and say, yes, this is a Trump supporter. It's just oh deep state FBI's in on it. I mean, you know, people are saying I'm hearing it was set up by liberals. I mean, it's just it's you're absolutely right. They it does not matter. The people that casually just two it in they would have seen. What to them was a simple question. Asked him didn't handle. That's the thing is what dick Durbin did is. Although you say he delivered the dagger. He set off what for many people watching it thought was the the the real moment, and that was Lindsey Graham. And and to be honest. What the all that does is provide information just statements about what people have to say, they do not investigate the claim. They do not veracity. Not look for what happened. It goes to the committee for them to do their own investigation. Which is what they just did. I want to ask I want to ask a follow. It seems to me that the that the two most important witnesses one is Mark judge. Yes. And the other is the the the young lady who was a very good friend of Dr Ford said the stands by her, but she can't vouch for the story. She doesn't she had heard the story contemporary Nestle. So it seems to me those are the two witnesses that if I was in the FBI that's where I would be going, and I don't know because again to some extent Cavanaugh kind of through Mark judge under the bus by talking about his. Are they going to be able to in under cross examination or examination of a Mark judge? Are they going to be able to crack him in some way? You know, there's a lot of theatre going on with this. He these hearings, and there's no way to get around it. I almost wonder if. Play along with me here. Okay. Did the Senate make a mistake? Republicans in leading Dr Ford go first. Because this is going on it is it is lengthy it started at seven AM this morning three and a half hours in where we're at least as far as the question goes halfway through so expect some more time will people over the course of the day people the average person just start to tune this out. And by the time Kavanagh gets around to saying it wasn't me. They've heard nothing, but doctor Ford give emotional testimony come across as a credible witness. And the prosecutor Mitchell is not poking holes in her story and not calling her a liar. And you got it wrong. I wonder if there is a by the time cavenaugh gets around to testifying the holes gonna be too deep. Well, you know, what we are not attorneys. We just play them on the radio. We actually have an attorney here. And I want to get Monica Lynch firms opinion on this here in just a second. But I would push back on what you just said there Burs because how can you possibly question? The accused without hearing from the accused accuser, I because it would just seem to easy to have cavenaugh go. I let them come out. It wasn't me. It wasn't me. It wasn't me was me. I haven't seen anything that Republican senators are being swayed Jeff flake made some comments recently during the break, we're still listening. I fought hard to get this hearing. I'm glad we're having and I'm still listening. Okay. Okay. All right. I don't know votes are being changed. I'm saying the court of public opinion. Wow. It's Brett Cavanaugh has a steeper hill to climb. It is a court of public opinion. This is a Senate hearing it is not a trial in navigating that from the perspective of the sex crimes prosecutor, Rachel Mitchell. I think has been difficult at times, and and we've got KTAR legal analyst Monica Lindstrom sitting with us right here. And Monica two things one reacted the discussion that Bruce, and I just had as far as did the senators make a mistake by having Christine blase, Ford, go first, and then Secondly. Talk to us. How you think the questions from miss Mitchell have evolved over the last three hours? Well, I think absolutely Dr Ford had to go first because think about it this way under the confrontation clause of our constitution. It says that a person is allowed. They're entitled to confront their accuser right now Kavanagh is not going to be in the room confronting her. But this is his chance to be able to respond to her. So he has to know what she's going to say an order to affectively respond to it. Now, there's the whole primacy and recency argument that we learn in being attorneys and trial attorneys is people will remember the first thing they here in the last thing they hear and everything in the middle. They just kind of forget about God. We've only got two witnesses here. They're going to remember what she says because she was first and they'll remember what he says because he was last. So we'll we'll just have to see again, I think it all comes down to credibility. And this is where Rachel Mitchell's questions are coming from at the beginning. Her question seemed a little bit slower. More like lane the foundation in a courtroom as the question is going on. She's learning that she needs to be quicker and get to the point and her questions are really focused on credibility because that's all she has to go after because there's no video. There's no evidence. Right. So she's asking questions about what what Dr Florida actually members. And well what about this? And you didn't say this new didn't put this down those types of questions. Okay. So the line of questioning has evolved. And there have been some some good questions that have been asked by the by Rachel Mitchell. And and frankly, even though Democrats have been making a bunch of statements. There have been some good questions like this one from the democratic Senator from Minnesota can't tell us what you don't forget about that night. The stairwell. The living room the bedroom. The bed on the right side of the room as you walk into the room. There was a bed to the right. The bathroom in close proximity. The laughter. They uproarious laughter. And the multiple attempts to escape and the final ability to do. So that jumped out to you Monica is being a good question. Why the reason why I think that was a good question is throughout the hearing people have been focused on what what she remembers what she did or didn't write down and where the holes are. And that's one way of thinking about it. But when this Senator asked the question, what is it about that night? They you won't forget, I think that it's a different way of saying the same thing. But we think about that differently. Because what we remember is different than what we won't forget, we will not forget the things that really impacted us and made a difference for those indelible images sense. Sounds right. Exactly. The things that we just cannot get rid of. And I think that is the authenticity that people are looking for. What is it that you remember we don't care about the? Date. We don't care about whether it was day or night. Maybe. But what is it that you won't forget along with Monica Lindstrom KTAR legal analyst. I think you make a great point. Because asking the question that way, you don't have to speculate. You're not you're not guessing you're talking about the very specific things and leaving everything else out. The committee has reconvened we've got Dr Ford who is now sitting once again in the gallery flanked by her family as she's being asked questions the questions now coming from the Senator from Hawaii, and she asked an interesting question, and that is will the GOP defer to Arizona prosecutor Rachel Mitchell on every question we'll have that exchange. When I think about this idea of survivors surviving, and we think about our supreme court sexual assault is clearly one of the most dangerous aspects and one of the most heart wrenching pieces in terms of surviving. But there are other aspects of the danger around our supreme court, it's not just about sexual assault. There are people who are here who are dealing with a litany of challenges. Police brutality is a challenge in our communities. Education is a challenge in our communities. This is the thing about it is back during the Clarence Thomas and Anita hill investigation or that hearing the FBI was called to investigate. So what do you say about that? You had those you had the FBI the president ordered them. I mean. Dana come on. It proves to right there. Okay. Well, let's look at that. For a moment, shall we? Clarence thomas. At the time that he was nominated. He was a federal circuit. Judge federal being the key word. Federal, right. That means federal. And need a hill. Worked at the United States Department of education. Federal employees Clarence Thomas. Was her supervisor at the time at the United States Department of education, a federal entity a federal employees, federal employees Cain where do they get their salaries? Who pays him? Canes. Not listening taxpayers. That's right. That's where it comes from their federal employees. So where's the FBI's jurisdiction? Right. Federal. Federal government federal. And. That's that is the jurisdiction for the FBI because they were federal employees and they worked at a federal agency that fell under the jurisdiction of the FBI because they worked at a federal agency because they were federal employees that was part of the purview of the FBI. So that is why the FBI a federal agency whose jurisdiction is federal matters was called to investigate. What is considered a federal matter between two federal employees at a federal agency. What word am I saying there over and over again does anybody know today's word word of the days. That's what it is. Shut up. Steve goes it. Federal. That's right. So that is why the FBI investigated the hill and Thomas case because I'll say one more time she was a federal employee. He was a federal employees. They worked at a. That's right. Federal agency, and that fell under the purview of the FBI because the FBI deals in issues related to what federal. That's why that works that way. Your local police department does not deal with what matters federal matters. That's right. They do a state local matters and Brett Cavanaugh at the time. That this accusation was made was how old. Seventeen. Is that considered a legal adult? No, no, it's not. And when Brett Cavanaugh was seventeen years old was he or was he not a federal employee? He was not a federal employee. So the only way that comparison is even remotely accurate is if you're also suggesting that Brad Kavanagh at the age of seventeen had his parents permission to become a federal employee and worked for the federal government. Or to be even crazier about it. Let's magin that seventeen year old Brett cavenaugh or Brad Kavanagh at any point in his life had access to a time machine. Let's just say that Brad Kavanagh was a federal employees already and he had access to a time machine. And he went back in time. And somehow affected. I don't know and was able to like Benjamin button backwards with his age because that'll just say a side effect of the time machine. And he turned into seventeen year old Brett cavenaugh and engaged in this behavior. Accusingly allegedly. In which case because he went back in time when he was a federal employee and he age regressed like Benjamin button to become a seventeen year old. Then technically, he was still a federal employees. See that's how that argument then would have affect. I mean, you know, if that's what you're alleging. I mean, you might as well go ahead and throw the time machine in there too. So is that what we're doing? So that is I think that's I think that's important. Right. They so we've established that the seventeen year old cavenaugh was not a federal employee and that the sixteen year old who accused him was also not a federal employee at the time being that they were sixteen and seventeen years old. So why would this be a federal matter because if you're saying that the FBI needs to investigate it? Then what you're saying is that the accusation from of a sixteen year old to a seventeen year old is a federal matter and not a local or state matter and that it goes above police. That's just what you are. When you say that the FBI, that's what you're saying. Is that what people are saying? I mean, do you still do people still want to hold on to that argument because you have to be making the claim that these teenagers were federal employees or were involved with the federal government at that point. Is that what is that what you're doing? I'm just curious. I mean, I'm look I'm open you can make that you didn't try to substantiate that I'm gonna sit here and drink my unsweetened raspberry tea after I had some delicious black rifle coffee can just out sit here. And I'll I'll judge your claims if you want I mean, that's. But that's what it takes for that actually to make sense. I under Sandra good with that. Okay. Can we stop? Now. Can we start making the stupid this really idiotic argument because it's just it doesn't work. You have to file a police report. That's where it goes. You have to file a police report. And as I understand it, Maryland doesn't have statue limitations. We're concerned sexual assault. So she could go file one right now. I don't know. Why that why no one has advised her to do that? I mean, she surrounded by lawyers and Democrats who are lawmakers. Why? Isn't anyone advised her to do that? Because see here's the other thing about the F B I getting involved in investigating things that they can't is that there's literally a law that bars the FBI from investigating state and local matters. And all the same people that say that Trump is a tyrant and that he needs he has too much government power. Now want Trump to undermine the law and demand that the F B I investigate something that's out of their jurisdiction. So either he's a tyrant. And you think that he has too much power in the government or you want him to further expand government and grab power by using the FBI to investigate a state or local issue, which is it which I want you pick one, but you get one you can't have both you get one narrative not to concurrently one, which one is it. So how in the world? Do you have all these lawyers around this woman? All these Democrats who are lawyers and nobody advising her to go and file a police report. And we know she hasn't filed a police report ever because he's already undergone six background checks. The FBI just looks at everything if they note a crime when the FBI does a background check. If you're not a federal employee it cetera et cetera. They'll refer to the proper agency to handle it, right? But. This. Again. Local police would handle it. But the problem is. Is if you file a fraudulent police report that's a crime. That is a crime. But hey, we I mean, you really wanna find we want to get Justice you in order to investigate. We need to have a police report. So she needs to be advised to file a police report. She could do it right now. She could do it today. I think she should do it before the hearing because I would be like why haven't you filed a police report? Now, I'll say this. The police report isn't indicative of a crime existing or not existing. But if you're going to investigate a crimes existence you need to you need it. Here's the other thing. Everyone that. I have seen talking about. What's the name? I can't think of that. It's not there. They call them lighter decker tests, but that's wrong polygraph. I see all these people talking about polygraphs. They're like lie detectors lie detectors. They act. Like the polygraph is a magical machine. That detects. It's a it's somehow to magical machine that can detect lies in detect intent and can detect all this stuff means as many graphs. That's really all it. Yeah. That is don't tell the people. And they just measure different things. Right. Exactly. That's all it does it measures someone's reaction to something not whether or not. That it is true or false polygraphs are so unreliable. They're inadmissible in court and hers was was administered by her lawyer in the lawyer's office. And you and even then in order for for them to be even somewhat above hackneyed, you need to have like a professional whatever they have specific people who do that are trying to do it. And even then they're still in a missile because they're so ridiculous. But the other thing is that he actually already transcribed an interview under oath on Monday. Now is that the same thing? It's not the same thing as a testimony. But here's the thing. He and judge both the two people who are accused transcribed and interview under oath. Meaning they acknowledged that everything that they were saying in this transcribed interview was the truth under penalty of felony. They're already opened them up themselves up to massive fell felony charges. If they lied in this transcribed. Interview either of them and they both submitted them already. That has more weight legally, and is more binding and is. More influential than a quote, unquote polygraph. Note that as well. So these two are on the record. She is not she has not gone on the record. And she's fighting with congress to go on record. Why? It's not an indictment. I'm saying if you want Justice y. We have to be serious about this. We go where the truth goes, we go where evidence goes. Period.
