Texas Judge Grants Restraining Order Protecting Some Abortion Clinics

"The supreme court allowed texas's new abortion law go into effect the the first of september and almost immediately thereafter texas judge issued a temporary restraining order protecting some abortion clinics from private popper property private party. Excuse me private party lawsuits that the new law seems to encourage joining us this morning to take a look at what it all means is constitutional law expert david cole. Good morning david morning air. You guys do. Thanks for getting up on this labor day. Early for us Tell us about this temporary restraining order and what it means well. So we've we've through with the federal system. The smell supreme court said the federal courts. Have nothing more to say for now up the statute that goes back to stay court but before anyone filed a lawsuit under the statute planned. Parenthood austin sued specific group. They believe is likely to sue for an injunction saying. Hey you can't sue us and it's cute set up in that lawsuit not the issue of whether the laws constitutional or not all that certainly in there but what's called the irreparable injury the hassle factor of them having to defend that and potentially other cases under the statute. That's kind of what has been about all along is that these cases are going to be very difficult for large providers to defend. That's the issue in front of the court there. The basis this urgency injunction and then a couple of weeks it will receive more evidence decide whether to keep it in place. So what does this basically mean that places like planned. Parenthood can continue to perform abortions even after a heartbeat is detected. I doubt that this is a procedural maneuver to try to stop some of the litigation under this particular statute for everybody else Out there that could potentially sue planned. Parenthood they're good to go. And i doubt planned. Parenthood has got to change. Its business practices because of one case.

"They're going to see a judge who listens they're going to see a judge who's smart enough to understand the issues that they're going to see a judge who's willing to find the right results in the case to know what the facts are to listen to the song and to apply it fairly and that's that's what I want. I want to want to show Integrity. I don't want people to think that Justice is is off. Just figured out on the Fly. There is a process there and I want to be a good example to the iso right are there things that you've identified that you'd like to do a selected that would improve the court system or there's some things that you could discuss. Yes right. Now as we all know with covid-19. I can get tried sooner those that need more time. We'll get those on there. But I'd like to add more jury weeks add more trial weeks so that we can facilitate the lawyers and getting these cases run out. Would you explain that? I know when we spoke before you said that each judge has two weeks. Would you explain how it works? Cuz I thought they'd be a lot more weeks of cases, but I know that judges do a lot more than just have jury trials. There's a lot that goes on but could you explain how it works? We are in the system. So the fact that I'm running for it's a a court of General jurisdiction. So what is on that judge's docket throughout the entire year includes felony trials felony pre-trials Misdemeanor Court, Probation revocation sometimes Bond reduction hearings. Those are all areas. Plus you have a full civil docket, which is lawsuits that are filed when a law suit is progressing. They then file motions so you have to have rule days where you're hearing nothing but motions there's a lot of different things that this judge is going to hear. So what they have done is taken the trial calendar and the calendar for 2021 is already out. So I've already seen what's coming. They'll have one week of took a month of felony jury trials. They will have one week per month of nothing but Misdemeanor Court, they may do a week and Acadia wage because this seat also covers Acadia and Vermilion. So when you take a year of a court system and you divide it up week-by-week, it doesn't leave much wage. Rinsing for them to have the trial all the time. So picture like Perry Mason, you know the drama and the courtroom, but that's really a piece of a bigger Russell. Yeah, Yes. So when they set cases, they'll set multiple cases, but often a lot of those cases settle out..

"It back with six talk. God gets you in there. Too now is called in from Medford Oregon with a question or comment. I'm not sure which. Hey to now. Thanks Golan Oh thank you well. It's a question so I was always under the impression that Aiyar stood good for automatic rifle or semi automatic rifle man. It was the mainstream media that changed it to assault rifle. So okay well. I was listening to the commercial today. for the Second Amendment Foundation. And the guy that was doing commercial was explaining how we don't want the government. I met telling us what kind of guns we can own and right but when he said we don't want the government telling us we can't. Oh an assault rifles. I I actually to get to change that. Because would it help if I went over. Kinda kind of the whole would isn't a are the kinds of rifles. We're talking about kind of gave you the base with it. Yes I correct people when they start calling calling them assault rifles and I said no no. No they're not assault rifles that are semi automatic or automatic and. I wonder if I'm wrong. No you're you're right. Okay here's the deal first of all. Let's start off with the designation for the rifle. Ar Fifteen the does not mean assault rifle does not mean automatic rifle. It stands ends for armalite rifle. which was the company that created the firearm so stands for armalite rifle the company that created this particular rifle originally so we could put that aside now semi automatic full automatic assault rifle weapon military style Blah Blah Blah Semi automatic that. That is just a gun. Goes off one time I am with each pull the trigger. You pull the trigger and goes bang one time. Full automatic will keep firing as long as you hold the trigger back until it runs is out of Ammo that is also known as a machine gun. That's fully automatic at about thirty five years ago where the people people in the gun control movement said Hey. Most people don't know the difference between semi auto and enfold auto and we could take advantage of that by the confusion and we can convince the public that these semiautomatic rifles that people. We'll have been using for one hundred years. Literally Hundred Years our military Gonzalez fall out of their machine guns and they set out to do that in with the help of media. WHO fakes video? I've caught CNN twice speaking video on this and trying to convince people that the guns that are banned under the so-called assault weapon bans are full auto. Then and I'll tell you. Do you probably have run into this. I'm sure her and she'll say well. Those assault weapons and they are. They're thinking machine gun truth. It's actually just a regular oil auto loading rifle that actually functions exactly the same way that President Teddy Roosevelt's did we've been using this for literally one hundred years special or terrible about them but the media has really helped convince the public that these are military guns that are not that at their machine guns. They're not even that they're used a lot of crimes which they're not more. People are actually killed with fists and feet than people killed with these rifles. So okay. It's you know it's frustrating to try to start explaining this stuff right. It is and that's why I got confused when I listened to that commercial today and I was thinking. Why is he using the term? All right. You mentioned that I'm going to pull that Kebir. It's a public service spot. I'm going to bet until we can get a reader we didn't record that and every time I hear it I just kinda cringe you you know. So we're GONNA pull that spot until we can get re recorded and recorded correctly. It's just one of those that and put put it on me. I should have taken care of that and I didn't but in jail because you didn't shrug your true squad member and said okay. I'm got got to put up with this anymore. I'M GONNA call Tom on it. Okay well can I thank you because I started getting confused myself. I was like Oh wait a minute. Tom Doesn't come yeah. No you're exactly right. You're salad on it and we screwed up on that and I just kept meaning to do something about and I haven't and it's like okay get off your rear end Gresham and get something done here so thank you. I just want to thank you for making me do what I needed to do. Okay problem thank you. I appreciate that. Let's see here tell you what Kirk don't go anywhere. We're going to have to take a break here when we come back. You'RE GONNA be first in line. Okay Kirby Arkansas. We'll do that in the meantime thought for you here. Have you run into problems trying to explain what semi automatic Nick Rifles our whole a are semi auto full auto and then we get to some of the gun control. People go a fully semiautomatic gun. You're going the of course there are the same ones that tell you. We have to Joe Biden. Says he was the one that limited. How many magazines Agassi's could go into a gun going? What are you done but I already know the answer to that question? Okay okay we already know that. He just doesn't have brands head. County the second largest county. It's right on. I thirty five straight north of Oklahoma City. All right now I started off by put you on the spot right off the bat. 'cause my attitude is and of course I am not train attorney. I'm not a judge but my when when I look at the Second Amendment I don't see it as a granting of anything rather more of a restriction on the government. Keep your cotton picking hands off this area. What do you think well you know? I think we've got a really important in case it's going to be coming up with this. New York's rifle and Pistol Association and the Supreme Court. We're anxiously awaiting to see how that goes after argument. I think it's pretty pretty clear that when you read the US Supreme Court opinions and Heller and and the others McDonald's that it's an individual right and what I believe most interpret that Second Amendment and of course the state constitutional amendments to is basically recognition of that right it does not create the right but it received recognizes it and restraints the government from infringing on interesting. Of course you being AH gun guy. A serious competitor fires instructor but also sitting on the bench and Harry people talk it times. It must be frustrating for.
