The judge Tracy hunter sentence in state court was okay, the trial was agreeable. The sentence was agreeable took them three years to decide this and going back in time, she was elected in twenty twelve and in two thousand thirteen twenty fourteen these stories began to arrive. Is out of the juvenile court of Hamilton county that something was amiss that there was a judge who was completely ill equipped to handle the job, and that she wasn't performing competent competently by sitting on cases for a long time. Not ruling on simple matters incapable of making a decision. But, you know, have my sadly we have some incompetent judges because you have incompetent individuals in every walk of life. But then she got into the area of criminality she was charged by Hamilton county grand jury of nine counts of felonies committed in office, and then she was indicted, brought to trial before judge Norbert NATO and a jury in Hamilton county multiracial jury, and Hamilton county convicted of one count of illegal interest in a public contract. And she was ultimately, sentenced by judge Dinka locker because judge NATO retired to six months in jail, and this matters now been pending, at least five. Years after the fact of the legal system continues to mull over what to do. Joining me now analysis, the trial, judge and the matter of Tracy hundred. That would be judge. Norbert Nadel, retired and judge NATO, welcome again to the Bill Cunningham show. Judge, how are you? I'm fine Bill and a pleasure to be with you, did I count accurately reflect what the status of the record is after they saw five or six years. Well, apparently, if there's no appeal to the sixth circuit court of appeals from the federal court's decision, and there's no stay of execution, then very soon judge Roland pose the original six months sentence that I impose of four almost five years ago. Can you explain to the American people house at possible that the legal system of what you and I've been a part for very long time has taken so long. Justice delayed is Justice denied. Why did it take five years and the actual committed six and seven years ago? That's correct. I have no idea Bill. All I know is. Is if I had done that when I was a judge the. Impeach judge. Nadel signs of the work. They impeach me. Somehow who can you reflect can, you tell the American people why the federal courts took three years to rule on the fairness of a state court trial, which is generally a rubber stamp deal, because they go back you were the trial, judge. She was convicted by a multi-racial jury. Correct. Correct. And, and then you sentenced to six months in jail, right? Six months and local jail. And actually, I was criticized by some of my colleagues saying that the sentence was too lenient. On that issue. Explain to Tony bender why the sentence was and the minds of some, it was an F four. Why did she only receive six months, you showed a lot of mercy with your Justice? What was in your mind about sentencing? Well, I did. And of course, ordinarily on something like that she would have received probation. However, she was a public official that breached the public trust. And that was the reason there had to be some type of, of committed sentence of incarceration. And that's what I did. So in your mind and somewhat worse when a judge violates the law while wearing robes. That's correct. Any public official who breaches a public trust as she did a must be, yes. Absolutely. And this is not simply incompetence. This is not making a mistake. Judges make mistakes on rulings all the time. You made mistakes even my beloved wife made mistakes judges make mistakes judges have errors judges have bad days and good days, wasn't about incompetence, or anything of that character. This is about felony. These committed while in office and you thought a sentence of six months was appropriate. Correct. Because obviously, ordinarily she would've even under today's rules, she would have probably gotten probation. But because she was a public official because she bleeds breached, a public trust of dishonesty. That's why she was sent. So back in two thousand fourteen you said, okay, I give you six months in jail. Then her lawyers, CLYDE Bennett was involved at the time who has since been disbarred, and that matter was appealed to the Ohio. I ister court of appeals that one over everything that you did everything. The jury did all the motions, and they said there was no unfairness in Toronto. And then that matter was appealed to the Ohio supreme court who looked at the record and said, we're not going to hear this case, because there's nothing there. And then her inventive lawyers that I give them credit for this that they filed a petition of habeas, corpus and other motions in US district court after concluding all the state rights, and then a judge named Timothy black I Timothy block, he's a good person. Yes, but he's a liberal, he's from Harvard, and he sat on this case, literally for three years and did nothing. Now, there was no trial in federal court. All it did was have the paperwork in front of him. And he determined yesterday afternoon. She did not receive an unfair trial. That is correct. Now. What happens at this point with judge Tracy and I can't believe we're still talking about her five years later after felony conviction by multiracial jury in Hamilton county where still talking about it. So this point, what other what other remedies to her lawyers have well, I suppose they can they can keep beating the dead horses. I would say and try to try to appeal to the federal circuit court of appeals, and if she doesn't receive a stay of execution. The case will go back and sentenced will be imposed give a stay of execution, which who knows. You can never predict that then they'll keep appealing to the six circuit. And again, as I say, keep beating the same dead horse, if that's been beaten, for the way of five years now, the background music. Of this case when I speak to my friends in the black community they tell me this is all about race. If Tracy hunter was white or male. None of these things have happened. Can you address the issue the elephant in the room, which is raised somehow there was this massive conspiracy by the way, not involving Jo Jody step aside. Correct. And it was a commonplace court judge Beth Myers appointed special prosecutors, one of whom was Merlin Chevra, doc who spent years in Henry county prosecutor's office now in private practice, Crosswell. And so during this entire implementation of Justice, and Tracy hundreds case, the background music. The black community is racism, racism, and racism, can you address yourself to that it was a multi-racial jury, there was, I believe at least two or three minority on the jury three and she received a fair trial. And actually, I was complemented by the whole legal community. For my fairness in and and patients in the trial. So, you know, I sat back and gave his fair trials I could. And a lot of the prosecutors. Merlin Shiva decker and Scott causal at the time complained that I gave too many favorable rulings to judge the judge hunter. And I did it only because he had been a colleague of mine. Bent over backwards. You've been over a lot of people said you weren't fair to the state. A lot of people said, you've been over backwards to let CLYDE Bennett. Do whatever you wanted to put on in the almost all your rulings were in favor of a colleague, judge hunter, I tried to be as fair. And as open as I could and a lot of evidence on both sides, because I felt that the jury had a right to know. And it was a search for the truth. And I let a lot of evidence in that, that other trial judges may not have let in. Well, did you see any racism that was lurking around the benches? And the courthouse that day. Not. Bennett told me personally that he felt she got a very fair trial. And I was extremely fair. As a matter of fact, originally, she was represented by attorney from Cleveland. And they told me that they inquired of many, many attorneys when the case was assigned to me, and they, they were told that, that she would receive a fair trial by me, and I would be fair and open. This is important. Clyde Bennett is an African-American defense lawyer is he still in jail know? No, I, I don't think he is. But he's been disbarred. Correct. I think he got six months suspension. So eligible to be reinstated. He's back in the profession. A second time because. Clyde, CLYDE, keep screwing up, but CLYDE benefits person. He's a good person. No question applied Bennett. Who's a proud advocate for the African we ever met American community said to you judge Norbert Nadel that you conducted a fair trial. Absolutely. He was highly satisfied, any any was telling people that were criticizing me. Hey, the judge was fair at this point five years later, I guarantee you when Pat Dinka locker has he doesn't have to sentence. All always doing is imposing your sentence, fourteen correct. Don't think locker doing his passing through, and in the next here he's going to be in July. What I understand that. I wasn't sure of, but yes, yeah. Yeah. I fully expect the judge think locker will impose the sentence that I originally imposed. It's unbelievable. What's happened in this case because of the color of our skin? She's received benefits that no other judge whatever receive because I think judge Timothy black, who's a good person federal district court bent over backwards for three years. Yes. To try to find something that he could free judge hunter under and even a liberal federal judge from Harvard said, I can't find anything but it took them three years to do it. That's correct. That is correct. And I think there's something I glanced at that I think there's something in the opinion or he wasn't. He he was a little critical of the sentence. I think so in that opinion. Well, he said something to the effect that quote, whether a six month jail sentences warned is not for this court that assault. Correct. Only the state court can impose their amend the sentence for a state court conviction. And that was your sentence. That is correct. Judge NATO do you want to see her serve every day those six months? Absolutely. I think based upon what I saw based upon what I heard during the trial. I think it was a very fair sentence. And I really think that the Justice will be served if she serves if she serves out sentence that was a sentence, a carefully considered, and I think it was the appropriate sentence considering she was a.

It was a hotel out near your LAX where we were doing like this little people's of America convention, and they show up and Gary has to get off the trike and walk around and walk into frame, and they all they had a really good double for him. The the hair was perfect. It's face was very similar. You know, a little person double, and and there were debating how to do it my? So we'll let you why don't you just have him hide behind the trike Gary will step down, and then this guy walk around, and then we'll cut too. I mean, it was just again we were sort of making it up as we went along. And there wasn't a great deal of direction going on. It was like I said pretty. Pretty crazy set. Wow. I mean, one of the things I've been curious about because I still like I haven't actually seen it. We just been obsessed with this trailer. And and I've actually played this for like I played it for Sean Anders who directed instant family. That's out right now directed daddy's home when he was like, that's not a real thing. Right. And I was like what do you mean? He's like that trailer you were playing. That's not real I go. Yeah. It's real it's a real movie. And he was like no way. I even when I showed it to him. He was like this is not a gag. And I was like, no, no, no, this is real. So we were reading trivia. And like the first trivia point. That comes up says director Matthew bright was fired after he turned in his cut. The whole film was then re edited Peter Dinka JR. Has said the original director's cut which screened in Austin was gorgeous. But the people who fired bright ruin the movie. Do you know anything about that? I do I do. I. Quite a bit. Actually. I mean, I'm sure Peter includes has his opinion. I don't remember the whole original director's cut. I certainly saw you know, the re-cut. So they brought in this well-known editor Wendy, brick Mont who worked a lot with Ivan Reitman it's done a lot of bigger budget stuff. I had worked with her on another project before. And so they brought her in to try and find the movie, but you know, and that's always the case in the. But in this case, it was really sort of, you know, there was a lot of footage that I don't think had any bearing on. You know, the pro how how the movie needed to to go? And so I remember her talking about it like, yeah. This was it was a real challenge for her. But certainly the sensibility of Matthew bright was part of why everybody got involved. I'm sure, you know, I I don't know if you're where his his most famous movie is a movie called three way, it was Reese Witherspoon first movie. Yeah. She plays. She plays. A girl hitchhiking to her grandmother's house. That's right Kiefer Sutherland plays a character. Bob wounding ten you know, it's like this red riding hood saw this movie. I saw the crazy movie. And so that was sort of where he's established his reputation as being you know, sort of a little bit out there and doing interesting sort of cult kind of movies, but but they certainly I think they got off the rails pretty badly..
