"So the other obvious thing here is that deshaun Watson is going to play in the NFL for the next decade plus, probably ten to 15 years. And that will start on Sunday. And we will now discuss what to expect on the field. It's going to be about 700 days from his last start in the NFL. He's going out there against the Texans team that isn't very good. With a brown supporting cast that is pretty good, new system, new supporting cast. What do you expect on Sunday? So I wrote this and I was thinking about this. This will be published tomorrow. So when you guys, you can find it on that side dot com. But I kind of wrote a version of sure it's negatively slanted, but what if this doesn't work out? And I say it with full acknowledgment that it will probably work out. Deshawn is really good at football. He was probably, I mean, he's probably like the fourth or 5th best quarterback in the NFL before all this stuff happened. Right. I mean, yeah. Is that fair? Somewhere around there? I agree. Yep. So my questions are, the NFL has changed dramatically in the last 700 days. I think it rewards much less quarterbacks who can extend plays and then make big throws downfield. I don't think that happens anymore. You know, too high shell has really sort of, unless there's coverage bus, which they're always are. And there's always going to be big plays, but the idea that you're Ben Roethlisberger or your Russell Wilson and you're just shaking dudes off in the backfield until someone gets open downfield doesn't really happen anymore. You put a hard cap on that and you want teams to beat you via paper cut because they'll make more mistakes that way. I don't know if we've seen deshaun play a ton of that style of football. I think and we used to go bananas when Bill O'Brien overused him in the running game. And sometimes he had to. Especially after deshaun Watson towards ACL, I think he's going to have to be more involved in the running game as a quarterback than he ever was because we're seeing Jalen hurts in order to make some of the stuff that used to work work now. There has to be such a pronounced run fake element at the line of scrimmage and there has to be the threat that the quarterback is going to leave. That's true in Buffalo, that's true in Philadelphia. That's even true to some degree in Kansas City, where sometimes we'll see Patrick Mahomes just rip off 70 yards and then teams are like, oh crap, we forgot that he can do that. Let's readjust. So I do think that Deshawn is going to have to be more involved in the running game that he's ever been. I am interested to see what they run offensively because again, in Houston, it was a lot of Clemson stuff. At least that's how I understood it. How coaches described it to me, right? They borrowed a lot from Clemson. They took a lot of what he liked to do there to make it comfortable for him. In 700 days, a lot of Clemson players have come to the NFL. A lot of that stuff, Tony Elliott, all that stuff has been baked into offenses.

"It's good versus evil. It's right versus wrong. This is the kind of thing that we've been doing with sports for the last since 2016, right? It's either you're for police or you're for the NFL. You're for Colin Kaepernick, you know, this is kind of the same version of what we've been trying to we've accidentally been doing with sports, right? It's like we've been molding it into this kind of like cudgel to sort of like bang stuff with, you know? And. It's a larger societal problem that the NFL has so much sway over the way we think about things in larger society and all of that. But it's also the reality of it. And again, just to bring it back to Watson and his public comments in August, the NFL, they very much, they're very earnest in their role in sort of being a leader in society. And again, it's a little bit absurd. It's more than a little bit absurd, but it's also a reality. And they wanted to come out of this saying, we are, we are going to educate people about sexual violence and we are going to make the world better in part through this not only punitive action against deshaun Watson, but also the rehabilitation we're going to do with him. And that's the way it's going to go. And they donated a certain amount of money to organizations who support survivors of sexual violence and educate people about it, et cetera, et cetera. Deshaun Watson coming out and defiantly saying I've done nothing wrong basically outweighs all of that. And that was the biggest issue there. There are so many people who will a rationally support him. And probably would not really have a super strong feeling about yo, women are lying. They're all out to get money and all that stuff. Some people are just going to lean that way, and that's what he's going to go. But there are a lot of people who would not lean that way who then hear the star quarterback for their favorite team say this sort of thing, not verbatim, but implied the sort of thing. And they are going to end up going in that direction, which is incredibly unfortunate, and that's the biggest issue. That's why not only does he have to show some sort of public contrition both to number one, just the women who have who have shared accounts of his sexual assault or sexual harassment, not only to help them, but just to help women everywhere who have survived this sort of thing. But also, he's just it's an opportunity for him. I think there is a belief in his camp that they can get back to the Sean Watson that everyone kind of loved back in 2020 and earlier. That's not going to happen. You can't get back to that place after you've done this sort of thing to this many people. So what they can do is kind of say, okay, he recognizes. I Desean Watson recognize what I did wrong. And I'm going to have to be a better person.

"Hello and welcome to a special edition of the MMP NFL podcast. I'm Gary bramley, and I'm Conrad. And Connor, we have gathered here to talk about the resolution. Perhaps final resolution. In the Desean Watson suspension saga, still an outstanding civil case, so that has to be taken care of. But as far as football is concerned, this seems to be settled or maybe not. We'll get to that in just a moment here. But let me lay out the terms first and then we'll open up the discussion here. So Watson has settled with the NFL Watson sort of represented by both the Players Association and his own camp, his own legal team and his agency. The terms are 11 games for the suspension, which would bring him back for a week 13 game against Houston. A $5 million fine, he is also to undergo mandatory counseling. Now, things got a little bit, I don't know, push back into a gray area because part of this was clearly based on the NFL's language in their press release based on Watson showing contrition. He had given an apology or what could loosely be termed an apology before their first preseason game. Last week, and as soon as word of settlement came out, he and his camp just sort of did the opposite of an apology, said he was innocent, said that the NFL was investigation was flawed and that judge Sue Robinson made a mistake and et cetera, et cetera. So what kind of door might this crack open as far as the terms of the settlement go? So, yeah, when you had mentioned that maybe we had reached a resolution, I wanted to jump in, had this not been serious subject matter, I might have jumped in with like a Lee corso, not so fast, my friend, right? Because I think if you read the language and just from talking to people yesterday, the NFL is appointing a behavioral expert to oversee this case. And the behavioral expert now is going to be charged with determining whether deshaun Watson has been rehabilitated in this time period. Over the next 11 weeks plus however much time. Now, I don't know. He has said he had said a couple of weeks ago that he was doing counseling through the browns. I don't know if that time is going to be included. I don't know if that, whatever he'd been doing in those counseling sessions, is going to be included in this new third party. It would seem whatever counseling he has already received with the browns has emboldened his stance that he did nothing wrong, so I don't know if the NFL wants to try a different person or a different avenue here.

"Aside the football standpoint after 11 games, Jimmy, deshaun Watson is going to come back to this football team and candidly, I do think it might be a bit awkward if Jimmy Garoppolo plays good football with them for the first 11 games this season, which I think is perfectly capable of, especially given everything surrounding Watson right now. You don't mean I think they just sit tight. Sit right there, Jacoby, bras. We've never seen Jacoby with this type of football team. That roster is probably one of the top three or four rosters top to bottom in the National Football League. We've never seen Jacob who said in this position. They can run the football, they got Amari Cooper on the perimeter. They got some young talented receiver position. We know what the defense looks like. There's no need to go get Jimmy Garoppolo. You go and you acquire Jimmy Garoppolo, what does that do? What type of confidence would that show in Jacoby brisset? On top of that, will he stay healthy the entire time? He's like a tin can at times, man. You know, that's one of the reasons that's one of the reasons San Francisco forty-niners have made a decision to move on from. I mean, outside of Trey Lance, he never stays healthy. So in the end, I think Jacoby Brissette is more than capable of holding things down into such due time that deshaun Watson comes back. Sounds like they're going to stand with Jacoby brisset. And I think that they knew that this lengthy suspension was coming. But do you want to make that run for Jimmy Garoppolo? You've already traded all those picks to go get deshaun Watson. The issue that I wonder about is what would happen if something were to happen to Jacoby for set? Josh Dobbs is Josh Rosen, what are they doing there? I think the cash should be noted here as well. I know NFL owners are largely billionaires, but you're paying stuff for us comes up like $75 million this season if you acquire Jimmy Garoppolo to have. He and deshaun Watson and Jacoby Brissette and none of them may be a guarantee for all 17 alive returns tomorrow.

But this is collectively bargained, so the NFL PA agreed to this new process too. How would you say it's all going out from their perspective? Well, I mean, I've talked to a lot of people this week who maybe weren't that familiar with this part of the CDA who are wondering why the NFLPA would agree to this particular appeals process because through Sue Robinson's finding, you know, both sides were operating on equal ground to a degree. You know, the NFLPA was able to make its case before a disciplinary officer that it say an appointing. The NFL likewise was able to make its case before a disciplinary officer that had to say in appointing. But that's where the NFLPA loses a lot of its power in this process. And for whatever reason, the Players Association agreed to this process where basically if there's any violation found, the NFL can really take over. They have the right to appeal. And then they get to choose who hears the appeal. You know, you wonder next time a CBA is negotiated that this will be a point of contention, but for the time being, this is the way this process is going to go. And it gives the NFL a lot of leverage once a personal conduct policy violation is found. So how is the NFL PA respondent to all of this?

"Trotter, you are our Cleveland Browns beat reporter. It's been one week now since the Deshawn Watson ruling came down. Judge Sue L Robinson handed down a 6 game suspension to Watson, and the NFL issued their appeal on Wednesday. So first of all, what does this mean? What is the NFL's asking for that's different? Yeah, it's been a very long week and Cleveland. As you mentioned Robinson came down with the 6 game suspension in her report on Monday, two days later on Wednesday, the NFL appealed that. And that's well within its right within the collective bargaining agreement with the NFLPA. The NFLPA is the right to the appeal, the NFL has the right to appeal as well. The only difference is the NFL can appeal to commissioner Roger Goodell, who then can hear the appeal himself or appoint a designee. In this case, he's appointed a designee, essentially what the NFL felt is that Sue Robinson's decision while they agreed with her findings in that deshaun Watson violated the personal conduct policy, the NFL has been pushing for a much tougher penalty than the 6 game suspension. The NFL has been asking for a season long suspension and that's what it will be hoping to get during this appeal. Jake, what do we know about the NFL's dispute with Robinson's reasoning in her ruling? So we have not read the NFL's appeal. We don't know what those documents include. We can guess we can make an educated guess that the NFL wants to essentially set a new precedent on these types of friend fractions or allegations with regard to the personal conduct policy. So Sue Robinson and her report basically sided with the NFL on all three counts. In terms of personal conduct policy violations. Sexual assault as the NFL defines it endangering another person as the NFL defined it defines it and then undermining the credibility of the league. But Sue Robinson because she found that sexual assault in this particular situation was not violent in her opinion, it lowered the threshold of what she felt like she was able to adjudicate. So in other words, had she found that the sexual assault had been violent, the baseline would have been a 6 game suspension, presumably Robinson's penalty would have been much tougher than 6 games, but because it was nonviolent sexual assault in her opinion, the threshold went all the way down to three games. That is the largest suspension in NFL history with regard to a personal conduct policy violation for nonviolent sexual assault. So she doubled it. This was the biggest penalty that had ever been handed out for this type of violation, so 6 games might not seem like a lot, but according to past president, it actually is. The NFL, it really feels like is wanting to set a new precedent for this type of stuff going forward. And that's, I think, going to be the case that they're going to try to make that, yeah, okay. So in the past, we've had these suspensions, but we feel like going forward, it really needs to be this.

"And now we'll see if the NFL PA then takes the NFL to court to challenge his decision, which I think would be expected, which means that we're looking at a long drawn out protracted battle with the two sides, the NFL and the NFL PA, sparring again. It's going to be messy. It's going to be ugly. It's going to be really something that goes on all see the long potentially, and that's where this is at right now field. Perhaps an interesting battle ahead. I mean, I know that when we were discussing the 6 game suspension, Sue L Robinson is largely following precedent and the system that is in place, but we were discussing this in the first block of the show. How this is much more than just a precedent and system story. It's a human story. And one thing that I want to ask your perspective on is what or how has the lack of remorse from deshaun Watson in his side and frankly, in some ways, the lack of remorse, I think the brown's ownership failed to share when they released their statement on Monday afternoon, perhaps played into this story. Maybe the league isn't making their judgments based off of those facts, but I do think this is a much bigger story than just the league into Sean Watson. It is about the football following public. Yeah, well, you know, judge Robinson did say Watson's lack of remorse was an aggravating factor. She called this, by the way, while she cited precedent, more egregious than anything they had considered before. So when the browns came out with a statement from the haddam saying that deshaun Watson had expressed remorse, I think a lot of people, myself included, asked, where and to whom. And you asked about the public and the public backlash. And I think that's where this kind of gets a little bit complicated. We know that the NFL presented four cases, ten B 5, the 5th woman, was not interviewed. As the public, we have more knowledge than that, because of all of the reporting on this story, from The New York Times, which came out, you remember what the story is saying that actually Watson had had 66 appointments for more than he himself claimed, by the way. And we know also that more than two dozen women sued him. So we know the immense volume of allegations that player, which isn't to minimize the fact that four allegations is a lot. And I think that is influencing how many people feel hearing 6 games knowing the incredible volume of allegations. I mean, the NFL PA has a fiduciary responsibility to serve in its players best interest. We were talking about the possibility of them countersuing if this suspension is expanded for deshaun Watson, which would be the presumption given that Roger Goodell and the league has decided to appeal it. Is there a message being sent if the NFL PA tries to push this further when there has been so much public support suggesting that 6 games was far too little?

"Time now for us to bring in NFL lives own meeting times. Meaning what was your reaction when you saw the news at the NFL had appealed the 6 game ban? You know, I wasn't terribly surprised field. I think we can start by saying, I don't think Roger Goodell wanted to be in this position. He created this new process as part of this use CBA because he had gotten dinged so many times for being judge jury and executioner. However, this was collectively bargained, the NFL PA did agree to this new process where ultimately he did retain that right. Now why am I not surprised? Well, frankly, if you read judge Sue Robinson's report and her findings on the deshaun Watson case, she largely agreed with the NFL's conclusions in the report in the section labeled findings. She says that the NFL did meet the civil standard first establishing that sexual assault took place that she believed there was set unwanted touching that Watson went into these sessions with a sexual tent. She said all of this, but ultimately decided on 6 games for two reasons. One, press it. Now, as we talked about yesterday, that precedent was largely under the old system, which many people criticized when it came to cases involving sexual assault, and domestic violence. And then the other reason was her interpretation of what the term nonviolence means basically she felt that this was an example of a case where violence did not occur. I disagree with that. Again, as we discussed yesterday, I don't believe that is a correct interpretation of sexual violence. And again, Roger Goodell is being put in a difficult position where he has to face, I think, two largely competing impulses. One is, do you want to start off this new system by going back to that old that old process where you are the judge, right? Some might say, well, you're undermining her decision, even though it was agreed upon that he could play this role. And I think reckoning with his own history when it comes to these cases in the public black backlash that's taken place. We think back to 2014 when ray rice was suspended for just two games after a domestic violence incident that was later expanded. That's probably one of the, I would say most damaging moments of Roger Goodell's career, now he's in a position again dealing with a very public case involving in this case sexual assault

"If and when this case makes its way through the courts, I can promise you that there are going to be other people and other organizations brought into this and it's going to involve other owners from other NFL teams and the NFL PA is going to want to know why some of them were not held to the same standard of conduct that's expected the players when in the NFL's bylaws and constitution, it says that owners must be held to an even higher standard of conduct. Again, neither right nor wrong. It's just a preview of what's to come here in this long protracted process that's going to be acrimonious between the two sides as they fight to decide what's right and wrong for deshaun Watson and the length of his suspension that the NFL will want to be indefinite. I hear why the NFL PA would like to point to how owners have not faced the same penalties or have been held up to the same standards as players. That sort of strikes me as like two wrongs don't make right. Just because we screwed up with how we handled the owner's punishments, doesn't mean that we should be justified and screwing up how we handles how we handle player punishment. Then I think one thing that's been apparent and not just sitting next to you for the past few days, but also just seeing the public reaction is that the NFL PA and judge suel Robinson and the NFL, sometimes this has become a matter that no longer feels personal when there's a deeply personal story we are talking about a man who had 24 civil lawsuits. We're talking about, as it was described, predatory behavior, and it feels like now we're just basting our conversations our reactions just off of precedent. Here's what happened in the past. We should just keep doing it going forward. You call this the new NFL and it feels like this could be turning over a new leaf. If this appeal results in a much more substantial punishment for deshaun Watson. And I think the big thing is it's not us thinking it's predator predatory behavior. The judge said it was. Yeah. And she only heard the evidence from four women, correct? And this is why, listen, I've been on television when some of the situations that had players involvement with women before. And I've been critical of the league going. That's not enough. I don't care what other leagues do. You are the NFL.

When you look at, then you read about the things that took place, it wasn't close at all. So the NFL doing this is the proper thing to do. It's the right thing to do. So now moving forward, me personally, I wanted them to be gone the whole year. And maybe more. So they're putting that in place. I don't know the procedures next and how the next thing works out with this, but again, 6 games was definitely not enough. And then you look at other players in different things that have happened in the past. And a four game suspension for something that isn't even close to how bad that is. So you look at the punishment, it didn't match. It needs to be a lot longer. So now they're going to now they're going to go and take the proper steps to make sure that the right thing is done. Let's consider the two sides of this again and tie some of it together. Okay, the judge in her decision wrote that deshaun Watson's behavior was egregious, and it was predatory. Deshaun Watson, on the other hand, continues to insist that he's done nothing wrong and is not shown remorse during this process and doesn't believe he has to because he still doesn't think that he did anything wrong and you've heard him talk on multiple occasions how he wouldn't mistreat women that's not the way that he was raised. Now I think where the public is having a hard time squaring all this and the NFL is especially bothered by the appeal as evidence of that is the fact that we look at the league's history. We look at some of the players who are suspended. And yes, this was the justice who made this decision, not the NFL, not the NFL PA, just as sewell Robinson handed down the 6 game suspension, but the fact of the matter is the 6 games still was the same amount of time as Deandre Hopkins got for a failed PED test. Right. It was less than what Calvin Ridley got for betting on his team gambling online. Now again, those are policies, the league had in place. So it seems that many consistent, but what you can say is the NFL's policies treated gambling and PEDs in steroids more seriously than acts like this over time.

What more can you tell us about this league's decision? Well, this is a huge and significant step for the National Football League field. And Roger Goodell now will determine whether he or one of his designees will hear this appeal. The NFL PA is likely to take this decision to court and sue the NFL over it and so what looked like a story that could be coming to a close when justice Sue L Robinson issued her 6 game suspension and written opinion on Monday now may just be beginning. This could be the start of a very long, legal, drawn out process, but deshaun Watson is not going to play at the start of the season. His 6 game suspension stands, the NFL is looking to add onto it and add onto it by a lot. I would imagine because the league wanted an indefinite suspension with Desean Watson having to apply for reinstatement. The NFL had until 9 a.m. on Thursday to make a decision about whether or not to appeal the justices decision, considering that it would undermine her in her very first decision and that is exactly what the league decided. It decided to take a stand against the judge's decision to stand up for what it believes is right. And the judge wrote that the NFL proved that deshaun Watson was guilty of sexual assault that he posed a threat to the women around him and that he compromised the integrity of the National Football League in 6 games is not enough in the NFL eyes. The NFL PA will have plenty to say about this as well. It has two days to respond to the NFL's appeal of this decision. And again, this now is just beginning. You take a look at the appeal process. There on the board, as we just mentioned, the NFL PA having two days to respond three outside experts make recommendations to commissioner Goodell or his designate, Gödel or his designate makes the final decision on the length of the suspension and I want to reiterate in the NFL's eyes, 6 games was not enough.

"The ruling or not. So I would just want to read the quote that you referenced because there is a needle or rhetorical needle being threaded here. Jake, because what the haslam's the owners of the team said, quote, was we notice on is remorseful that this situation has caused much heartache to many. And that does feel like a distinction, right? A verbal distinction between him being sorry for what he did and him feeling sorry that people feel this way about him, but all of this raises questions about like, are we going to hear from deshaun Watson about this? Or is this just something that you're no longer expecting until when exactly? Yeah, it could be this week, but I would be surprised if it were not before Thursday when the team has some finality on how many games Watson will, in fact, be suspended. But I can tell you Pablo during mini camp in June. You know, I asked deshaun Watson, you know, point blank. He said his introductory press conference that he had, quote, no regrets about his actions. I don't have any regrets. Like I said before, the things that are off the field right now that came up, you know, caught me by surprise because I never did anything that these people are a legend. And I asked him, you know, there were more lawsuits that were filed, more information that came out, particularly from The New York Times story. And asked him if he stood by that, that he that he still had no regrets about anything that he did during this process. And he said to me, yes, but he did regret the position in this situation, had put the browns fan basin, you know, people within the team, the organization, his friends and family, but he still stood by his words in March that he had no regrets about anything that he has been alleged to have done. And so now we have the 16 page ruling from a retired federal judge, which establishes that yes, he did commit at least four acts of sexual assault as defined by the NFL. And that raises the next question, Jake, which is, what's your sense of how deshaun Watson's teammates feel about his presence on the team about him being the new star quarterback the face of the franchise now? Well, I can tell you Pablo, I've spoken to people about what it's been like having him in the building as the quarterback of the team. And they have collectively said that they could not have been more pleased with the leadership that he's brought with the work ethic he's brought the way he conducts himself in the building, he took the entire offense on a team building trip to The Bahamas earlier this off season. And if you ask players about the allegations that have been made against them, the replies usually the same. You know, it's none of our business. We don't know what happened. We're going to stay away from that. So, you know, you watch practice on Monday and you wouldn't have known just by watching the players on the field or the coaches that any of this stuff was going on. And so that reality, Jake, the blunt reality that you can go to camp on the day that this unprecedented ruling gets delivered and you don't even know based on the surroundings that something jarring has even occurred. It brings to mind the feelings of fans who are not in Cleveland. Like the fans who are around the country, the female fans who I imagine have to factor into the NFL's thinking as the message that this suspension is sending them to. I think this is something the NFL is really going to have to consider as it decides whether to appeal. You know, what message does this send to our female fan base, which is a huge part of the NFL's fan base. And reading some of the comments from other coaches, other general managers around the league, even if they're not on the record, I think the collective response is this suspension is way too low given the allegations that have been made. You look at what John Harbaugh, the coach of the Baltimore Ravens said, after their practice on Monday, you know, he said, basically, we have zero tolerance for this kind of stuff. And we have stayed away from that particular situation. I'm glad we have that policy. That's John Harbaugh. And he said he has a lot of opinions about what's happening with deshaun Watson, but would not disclose those on the record. So I think that he probably reflects the opinion of a lot of people around the league about the contract that the browns gave to Sean Watson and the allegations that have made against a player before they traded for him. And so at the end here, Jake, I want you to look through your windshield here at week 7, right? When the browns are going to welcome if the suspension holds up if roderick Goodell does not appeal this ruling. When the Cleveland Browns are going to welcome back their star quarterback. What is that scene going to look like? Do you think? How would you describe it as you understand it, sitting here today? Yeah, I'm curious to see what that scene is going to be like. I'm sure, you know, Baltimore Ravens fans are not going to let him forget about the allegations that have been made against him. And keep in mind, Pablo, under the CBA, deshaun Watson can continue to practice during training camp he can play in the preseason games, and he can return to the team during the second half of the suspension. So he's only going to be away three weeks if it remains at 6 games. He won't be gone that long, and this story is going to continue to be a big one with the browns because he's going to be on the field practicing getting ready for that return. October

"In real life going to be. Correct. And the NFL is in a tough spot because on the one hand, this is the very first case under the new CBA. The very first case that a disciplinary officer has overseen and ruled on first case that judge Robinson has ruled on. And so because it's the first case, if the NFL comes back and essentially overrules it and implements its own penalty, its own discipline and the league was arguing for initially a season long suspension, 12 game suspension was the lowest that it was arguing. If they come back and basically throw out her decision and implement its own, could they be viewed as undermining their own collectively bargained procedure. Now, on the other hand, you read the report, you read the evidence that was presented, you read judge Robinson's ruling and 6 games does not seem to match what she wrote in her report. Right. And so the NFL is going to face pressure on the other side. I think from people around the league to act accordingly and to appeal it. So the NFL is in a very tough spot. And I think these are the discussions. They're going to be having over the next couple of days. What do we do? Right. I mean, judge Robinson, again, I'll quote from her report here again. Jake, she said, quote, while it may be entirely appropriate to more severely disciplined players for nonviolent sexual conduct, I do not believe it is appropriate to do so without notice of the extraordinary change this position portends for the NFL and its players. And quote, and what you're saying here is that if Roger Goodell wants to increase the punishment here, that's the sort of sentence he would circle and say, look, I understand there's a procedural change that he has unilaterally imposing now, but the basis for it, the logic for it, seems to be established also by the judge herself. No question. And here's the bottom line. This was collectively bargained as well. Into the CBA. Goodell does have final say if he wants to take it. And I think that is what's going to be interesting in this first case. So high profile so contentious, does he act or does he let Robinson's ruling stand? It says the NFL file an appeal or do they let Robinson's ruling Stan that we don't know, but I think it's going to be fascinating and is going to set a precedent and of its own going forward for future personal conduct policy cases. Yeah, absolutely. A seminal moment in the punishment of athletes as a matter of sports jurisprudence goes, Jake. But have we heard from deshaun Watson or his representatives about the verdict that Chad Robinson delivered? We haven't heard anything on the record, you know, deshaun Watson was at practice today on Monday the day the ruling came down. He has not spoken to reporters since many camp back in June, and he's only spoken twice since the browns traded for him. His introductory press conference back in March after the browns traded for him and then mini camp, rusty Hardin, deshaun Watson attorney, did not issue a statement today. He indicated that he might, but so far we've not heard from him. And all we've heard from the NFLPA was the statement they put out before the ruling that they would not appeal the decision no matter what it turned out to be. At some point, we will hear from deshaun Watson from training camp, but it was not Monday. It might not be until after this process is concluded, which would be at the very earliest 9 a.m. Eastern Time Thursday. That's the deadline, the NFL has to file its appeal. It does seem, though, Jake, like deshaun Watson and his camp and the browns also, that they kind of built this suspension in terms of the length that they ended up getting, they built the possibility of a suspension like this into the contract that they had just recently signed, right? I mean, the financial penalty here to deshaun Watson walk us through that. Yeah, so Dan Graziano our colleague reported over the weekend before the ruling came out that the NFL wanted to impose a $8 million fine. And that comes in part because the way that finds work now under the personal conduct policy during a suspension, it comes from your base contract pay. And deshaun Watson is making a little over out of a $230 million contract, by the way, fully guaranteed, only a $1 million in base salary pay for 2022. That means if he is suspended 6 games, he will pay a total of $345,000 total, not per game total for the suspension. So yeah, it's interesting that the contract was structured that way. I actually asked Andrew berry brown's general manager about that aspect of the contract during his Internet degree press conference. And he said that it was a coincidence and that they structure a lot of their big money contracts back loaded when it comes to base salary. But that doesn't change the fact that deshaun Watson from a financial perspective will basically be paying no money and fines relative the rest of his contract. If the 6 game suspension holds. Right, right, right. And look, you know, the number 6, Jake, at the risk of getting just sort of stuck on it, you mentioned how judge Robinson referred to other precedents in NFL history as punishment is concerned. And I think a lot of fans out there, they're wondering, okay, wait a minute, hold on. Talk about precedent. Calvin Ridley, right? The receiver with the falcons just suspended an entire season for betting on games, betting on his own team while he was away from the team. Deandre Hopkins, of course, the receiver just got a 6 game suspension for violating the NFL substance policy. And I understand that Ridley and Hopkins that those decisions, those punishments came directly from the NFL, but how do you think this fits into the future forecast for how players suspensions and future discipline is going to look? Yeah, and you come back thinking about the flake gate too, which was actually mentioned referenced in Robinson's report, Tom Brady was suspended four games for deflating a football. You compare that to what Watson is accused of doing and it's tough to square that to reconcile that for sure. The difference between Calvin Ridley though and deshaun Watson's situation is that Watson falls under the NFL's personal code of conduct policy, which is different than Ridley's situation, which did not violate that, but violated a different NFL rule that Roger Goodell has jurisdiction over. And that's why he was able to implement the league was able to implement the punishment it wanted for that. There was no third party. That's the difference in the two. And so, yeah, it looks strange when you put it that way, but the way the NFL has structured its disciplined policies, they're in different categories. I want to return here, Jake to the women who started this whole case in the first place, right? Because we've been covering this story since March of 2021, basically, when deshaun Watson was first accused of sexual misconduct by Ashley Solis, this Houston area massage therapist, and we saw subsequently a total of 30 women in all make claims against deshaun Watson 24 of them filing civil lawsuits. So just remind us here, where do those cases stand now and what does the ruling here today from the NFL, what does that mean for

"A lot of us, you know, over the last year and a half here have kind of wondered, well, what did the Texans know, did they play any role in sort of enabling this in any way? There has also been obviously people who have engaged in just wild just completely outlandish speculation and conspiracy theories about it. But this is, I believe, your piece is the first time anyone has actually actually reported on what the Texans knew. And then what kind of role they played in this entire ordeal with deshaun Watson? Yeah, Gary, our reporting found that the Texans, whether knowingly or not, enabled some of the conduct. So we're not saying that they knew the full extent. They did not respond to questions about what they knew. In fact, in their statement, they said they first learned of the allegations in March 2021 when the first lawsuit was filed. However, in November 2020, the end of the last season that Watson would start a quarterback for the Texans. One of the women who is now suing him, she was not suing him at the time, but she had given him three massages in her the lawsuit she would later file. She says he built up to different requests, including oral sex and sexual intercourse. But at the time, she had stopped working for this spa where now four of the plaintiffs worked. And she posted some of their message exchanges and cash app exchanges on Instagram. And one of the messages she posted was I could really expose you. So Watson told the Texans head of security Brent nakara, former Secret Service agent about these posts. And nakara gave him a non disclosure agreement. And then that same week, like days later, the posts were on November 3rd, I believe. On November 6th, he took the non disclosure agreement to an appointment with a massage therapist. And in fact, sort of use the existence of the non disclosure agreement to reassure her as they were booking the appointment. Most definitely always professional. I even have a non disclosure agreement. I have therapist assigned to. So I think what was left on set in that exchange is how she would benefit from an NDA that was meant to protect him. And why that meant that the massage was professional, but he began bringing this to massages, and he admitted all of this in a deposition. And he said that he only used this NDA form massage appointments because other business that he was involved. And he had agents and lawyers for. And the other way in which the Texans enabled the behavior. Again, knowingly or not, was that several of the appointments, I believe, four in the criminal complaints and civil complaints together. Said that the incidents happened at the houstonian hotel. It is an upscale hotel in club in the Houston area, George H. W. Bush once had an apartment there. So it's kind of this country club type atmosphere with a fitness club with restaurants on site and there's also a hotel. The team secured Watson a membership there in the summer of 2020. Now again, they haven't gone into specific details about why they got them the membership. And it's possible they got it for him in the middle of the pandemic, so he had access to the fitness facilities there. But he then began booking massage appointments at the hotel. And he says the team wasn't aware that he was using the hotel for massage appointments. But one of the women who met him for a massage there said that the room was not under Watson's name, she was told that it was under the name of a member of the Texans training staff. So I think when we look at the story, one of the important elements is the systems and people that helped enable this behavior. And I think we often see this with high profile people. Whether it's athletes or movie stars or whatever the case may be that there are a lot of times people or structures in place that allow behavior to go unchecked and, you know, I think in this case, him having access to this exclusive hotel venue. The way he put it in a deposition was the Texans got him a place there. And the membership wasn't under his name. And then the use of a non disclosure agreement. I think there's a lot of questions about why a team security director would give a player a nondisclosure agreement. And the team didn't say what nakara knew when he gave Watson the NDA, but the posts say I could really expose you and it's from a person that had given him massages, you know, do you look into that? Should you have looked into that? And I think that's where the liability issue can come up. Just to follow up on that, I mean, somewhat stunning, I mean, do we think that and again, I mean, this is just us wondering, and so much of this is, I guess, just us wondering if we could be a fly on the wall of everybody's brains, we would have an easier time parsing out the wise in the house, but to me it blows my mind that someone said, okay, this scares me enough that you should probably carry this document around with you. When you go places. And at no point did that sort of make its way up any sort of, or maybe it did, and we just don't know, but at no point did it sort of make its way up to ring any bells, either in the Texans organization or even Deshawn, where it's like, okay, hey, this is messed up enough that they're telling me to give these women something to sign that says they can't say anything. So maybe what I'm doing is not correct. You know? And I think, you know, Tony busby's statement where he says that he plans to add the Texans to the lawsuit goes even a little step farther. He says that the Texans provided rooms for him at the hotel, which again indicates that they may have paid for those rooms, though he doesn't specify that. And then they also provided massage tables and other support for his proclivities. So I think from that we can sort of get this picture of a team that sort of knew he was booking some massage appointments away from the team. Again, Watson says he, they didn't know that he was booking them at the houstonian, but he had seen so many different therapists, separate and apart from the massage group that was contracted with the team, right? So I think there's a lot of different pieces there that you can put together. And I think that is why they are now adding the Texans as a defendant in the lawsuit. And what's the number now for the total number of massage therapists he used over this sort of year and a half period? So from fall of 2019 to spring of 2021, I was able to confirm 66. I do not think that that is the full number, for instance, you know, we all hear about the 18 therapists, right? Who supported him. I only counted 15 of those because one woman was giving a statement of support and just owned a building that he would sometimes have massage appointments in according to her statement. Two of those women, they said they met him in 2018, so I couldn't confirm that they had worked with him in that narrow time period. But so 66 is just what I can confirm in that time period. And I certainly do not believe that it is exhaustive. But it is certainly more than Watson has admitted. And in his opening press conference with the browns, you know, he was asked about using 40 massage therapists that at that time, 22 plaintiffs in the 18 supporters, and he said, well, that was over 5.

They beat the cowboys. Twenty two fourteen. We're going to talk more about how the teams looked in a football context and a bed but the most notable fact of the entire proceeding. Sarah is the fact that texans quarterback to shawn did not play was surprising to you at all now. It wasn't because right now. The texans are kind of acting for the most part that he's not really part of this team in terms of him being on a football field in playing in a game and david kelly. When he talks about the quarterbacks he's mostly talking about the other quarterbacks on the roster. I mean they really. Don't talk about shawn watson in football context so he didn't play in the first game against the packers he didn't play against the cowboys and i'd be surprised to see him in the preseason finale against the buccaneers david kelly. Of course the new head. Coach of the texans sarah and yes to shawn watson sat out against the packers. The texans had one that preseason game also for whatever that's worth twenty six to seven but watson and how the team talks about him and his absences. How would you characterize how they do that. It's very much avoiding the topic. And from the very beginning. David kelly if he heard john watson's name really kinda of deflected the question and would say not much has changed. Or there's nothing new with watson even if that wasn't really an applicable answer to the question nothing new on the sean nothing new today on and last week for the first time. He talked about watson more and elaborated on him. Johnson here Again every day. He's here to in works he does. He does what we asked him to do. And you know he's here today but it was never really in a way of okay. He's gonna play in these games. So what we talked about with you on this show back in march. Sarah is still true today. Which is that. The shawn watson faces more than twenty lawsuits filed against him for sexual misconduct and sexual assault. That is the story here. There is a separate criminal investigation. That's going on involving several of the same women in those lawsuits but just to clarify for everybody. Here shawn watson still has not been arrested on any criminal charges and so he is allowed to play into practice. Is that how all of this works. Basically at right and for training camp the nfl came out with a statement. Basically saying we done some investigating into this but we haven't completed our investigation and deshaun watson is eligible to take part in all team activities and the texans first of all didn't really know if he was going to report training camp. They weren't sure the night before. They weren't really sure that saturday night and when he did report they still thought maybe the nfl with them. Put them on. The commissioner's exempt list before training camp practices. Actually start in. That didn't happen yet from a four sarah. All of this looks not just awkward but deeply uncomfortable for everyone involved shawn watson included his employers included. And i'm just watching from afar. But it's hard to avoid the fact that this is a star quarterback who was very publicly famously wanting out of the houston texans and so the idea that this same quarterback who is now facing more than twenty lawsuits for sexual misconduct and assault is showing up reporting to training. Camp i mean what were the consequences. If he didn't do that because it sounds like he kind of had to write. How do you not reported. He would have been fined. Fifty thousand dollars per day of training camp and this is a little different under this new. Cba that fine can't be forgiven by teams so we've seen in the past where someone would hold out. There was on a new contract or the issue is resolved and those fines would be forgiven. That's not the case with watson. And so he felt the need to show up so he's not fine. So here's the shawn watson showing up to practice but doing so kinda sporadically. It seems like like he's there some days he's not there other days or maybe he is but he's somewhere that reporters like you cannot see him. Maybe sarah just walk me through a day of covering this team. What that's like for you because you show up on site. What's the scene like in terms of the media gathered here covering the story what happens so day one of training camp. It was a very large media group. I don't know how many people thought he would actually be there and be reporting but there is media to see whether he would be and since then. It's been a lot of local media. I think the attention is kind of died down even though the story has changed a lot during camp while when colley talks before practice and said he's not gonna address whether anyone is practicing it kind of avoids that question until the next morning availability so we talked to david kelley and then i usually walk over to where i can see the players entrance and we can see the players. Walk down the steps and into the practice field. Keep an eye out for shawn watson. i'll usually take video or photo as he walks by oppose that video and then i'll update twitter. Say whether he is. They're not and then i'll walk over to the other practice field in watch the quarterback's throw in the started practice. And so that's how we get a moment like the one last week. I presume sarah where he snapped at reporters because obviously the media does have this lingering curiosity about whether he's even going to be there on any given day right and i think because the story has changed so much right. It's not like he's been there every single day and there's a video of walking every single day that's not the case. We are there to see if he's practicing and so as we were recording he walks by and says. Why are you guys recording. It's the same thing every day. And he walked off into the bubble and didn't seem too happy and that was the first time he had spoken to us at all during training camp and really since the end of last season so just to be clear than it is not the same thing every single day. It's actually quite the opposite as you have experienced it. Yes absolutely and it seems that it's followed some sort of pattern because for week one. He took part in all four practices week to he didn't take part at least where we were standing for any of them the third week he was there for all four and then the fourth week which was last week. He didn't take part in any practices with his teammates. But on thursday we did see him on the side field stretching in working out with a trainer during practice. And sir what is he wearing in terms of wearing his uniform wearing the red. Don't hit me on a quarterback jersey. What is this whole thing. Look like so those two weeks weeks one in three of training camp. He has been dressed the same way as teammates although he has had that red jersey on when we saw him last thursday when he was just working out on the side field he was just workout. Clothes was not dressed to participate in practice. The one thing collie did tell us last week. Was that deshaun. Watson is getting his work done he said just. Because you're not.
