"Seven years. Well it's difficult to answer that question because there has been. Some statements made by the police department. That not everything was written down and that there are other things done. I mean if nothing else if that investigators no longer on the case someone else has to come through so either nothing's been done or there's no paper trail and it's impossible for anyone to take over the case and everything is just in the person's head that doesn't make any sense but yet there hasn't been a whole lot done it doesn't mean they haven't followed up on any leads or anything but it's difficult looking at the records that have been produced to figure out what exactly has been done which goes to our very point of why it was not an active investigation despite their frustration with the police the kassy's and their legal team say the files are rich in information on possible suspects and persons of interest. Do you feel that the person or persons involved might very well be named in these records. Paul elaborate a little more. The men candidly some of it. Very helpful and easy to understand some of it of no organizational value at all or help a great deal of redundancy and frankly a lot of what appeared to be reinventing the wheel from year to year as new investigators would come on it and so on. However since we've gotten the file michael terada who is the investigator who has been working on. The case has developed some good leads and really one of the best catalysts to lighting a fire under the case again was unexpected for me which was once the case was back in the local newspapers or at least local media again in the tampa and orlando area as witnesses started coming forward. And and you know there's a percentage of leads leads valuable. It's usually about ninety. Five percent is not of any genuine value. But there's nuggets in that five percent that you have to run down while i've been trying to focus on the legal aspect of the case. The investigative unit does sort of keep me a prize certainly keeps the cassie family apprised of what's going on in there. They are running down some valuable leads and it case continues to be very active. Despite its old age. I have reason to believe that. Many of these are genuine. Leads some of them. Frankly happened from you. Know shake in the bush is a little bit and just sort of potentially disturbing witnesses. That might not have been disturbed over a decade and reminding them of the importance this case has especially for the cassie family and so people have recollections of events. That may not have been accurately recorded for instance. I know that mr terada had spoken to a series of people that were living in the apartment complex or the condominium complex at or near the time of the disappearance several of which were reporting Regular sort of verbal abuse from some of the workers from the actual facility. People that work as we understand it were given permission to live on the premises during the construction and the add-ons renovations that were taking place there. I know that the investigator has spoken to several of them. They've given us some. If not outright suspects. Good people have interest to speak to and we've located many of those people in are currently following up on those interviews. I know it's speculative but based on everything that you know all the files that you've reviewed do you believe that one or more persons in those records knows what happened to jennifer. Do believe that. I believe that it would have taken more than one person to have created sort of the dearth or the lack of evidence that exists right now and that the lack of you know what appear to be strong leads in the formative days of the investigation. You know from six to eight. I believe that in half you know since my involvement in this that the culpable parties are most likely the evidence would suggest are people that were working at the facility at mosaic in january two thousand six in our next episode of house of broken dreams. I did not because the car you can tell. The car was steering from side to side. There was some type of struggle going on inside the car. I see so. The car was more sort of toward the intersection. And it was moving in a in a way that erotic or correct that's correct word out use erotic. You make this observation in. What did you say to your husband. Or what did you to discuss. Actually my husband said it seems like somebody's fighting in the car. He said if we had time we would call. The police. And i said to him. We don't have time because you gotta go issue. I eight radiation. That's why we did not stay a stop sign to see which by the car turn because we was rushing to get on the other side of town. We expected this to be the Kentucky Derby. We're expecting this to be a big podcast. And it's still a big podcast. Thank you to the people at Oaklawn for putting together an enormous program for the Arkansas Derby this weekend saving the weekend getting some amazing horses to run a couple races for us and these are the racists. We're going to talk about. So yeah I'm I'm the formula and I'm joined by empire maker. How's it going on your end going? Good Man I'm I'm Just wanted to give a shout out to the cove virus for just destroying the first half of the year for everybody. Thanks thanks buddy. Besides all that. We're actually getting back to work next week Things are starting to normalize slowly hopefully because little bit afraid of some resets on death tolls going back but other than that We're GONNA stay on a positive note and talk about some horse racing I wanted to mention to just a massive week at will rogers. We played three slates there. This week and slade all of them. I think we had fifty percent wire greater on all three of them. Yeah and we've we've kind of figured out a strategy on will rogers. It's been paying out and I think a lot of people been following us on that too. Yeah I've gotten a ton of good feedback and you know people people asking for other picks from different tracks based on the success. We've had their gets. It's been a great week. What did we got going on here? We are looking forward to oaklawn tomorrow. We are going through one through fourteen. But WE'RE GONNA skip to. We didn't have enough data on that race to make a competent pick and for these picks in the past. I've given you what were are one. Two three in terms of an exact try box or an exact a three horsebox We're changing it up a little bit. We're giving you our top two favorites to win and then we're also going to throw in what we consider to be a long shot so I think at the most or at the least are long. Shot to sorry are long shot to finish in the money. I think at the least. We've got maybe an eight to one horse squeezed in there but most of these are Morning Line odds of ten or more so basically a value played up to bounce into your exotic exact to try to pick three and four hours to cover the coverage basically. Yeah exactly something that we think could show could place and provide a pretty good value and and you know in these huge races. This is what we've noticed. I'm sure other people notices while there's always a that squeaks into the money when you've got twelve horses run in like that that you know it wasn't in your top three may not have been in your top four wasn't in your top five so we're trying to find any of those value. Only builds up the drama even more for the Derby and maybe I'm an idiot for not knowing that process that they went through to split those but I'm glad I'm glad they're split up because I think it allows for the drama to unfold all year better this way although I think that division to believe Nidal's division is is a much tougher division. I would say so I. I agree with that wholeheartedly. There's there's some horses that I did not put in my top three. That shocked even me. So yeah and without further ado race one. We got a six Furlong Race. Six six and a half for a long time member which it is. Let's start going are are. It's a six okay so our number one horse here timely tradition. You'll Rosario on that horse. Been extremely strong All year been extremely strong at Oaklawn all year. And that's the The morning line odds top horse as well. We've got timely tradition in there. I'm digging deep for my number two horse. My second horse as a really good chance to win is I think it's the eleven horse jackets or Jacquat died yesterday. Pronounce it Jay. Acc I'll say Zhukov. Because it sounds awesome more sophisticated ways. Let's go with it absolutely so it's it's second to last race puts it probably one of the top horses in this race Its last race was a bit of a letdown in in terms of matching up with a rating on this race. But if you remove that and you start to look down it's it's done really well Flavian Pratt on top of the horse. Not Hurting you there now. Fly does a beast man. Yeah for sure at eight to one. That's an extremely good value. And I'm not even at my value play yet when I get to my value plates the number eight Lexington Grace from Ireland. Twenty two one morning line odds it ran to ninety S in its past couple of races really strong horse had a little bit of a dip down in its third and fourth previous races. But even before that it's been running really strong And also it's Yeah. It's A it's a Horse. That's finished in the money several times. A lot of thirds a couple seconds. So I see no problem at twenty one in place in some sort of wager on Lexington gray so I got one eleven and eight. It's my two top favorites to win. And then a nice long shot in there as well. And that segues into the eight horse for the relevant metric for race one Lexington Grace Irish horse just another just another reminder how thanks again. And when he pulled my hand back over he was exposed So you know what I mean and I don't remember the exact words that are he said you know. There's been a lot of years ago. But basically from metallica couch to walk towards the door he was his solid countless almost closer to the door. So I kinda got up off the couch and uh-huh walked around. There was a coffee table there and I walked around the coffee table towards the front door and he jumped up and got over there kind of before me and apologizing like kind of apologized to apologize his way out of it. It's what he didn't mean to do that. Or whatever and you know that time I was at that point. I was a new girl so I was like you know. Forgive you or whatnot you know. No biggie no harm no foul but you know I really do need to sort him home. I told him I had something. I made up something to get out of there route and offering what came over him. Because I'm a little. I'm a little bit taller than him. And then you know even our build. I was you know. I'm a little bit bigger than he is even build but I was just almost like a superpower over him well he he grabbed me but the way he grabbed me wasn't like you know two friends wrestling random why he grabbed me in a force. That was like you would grab a suspect that that you would just caught fleeing from you. You know you get them and you can't let them go But he grabbed me in that way but you know at that point I mean. Obviously I could've could've fought with him but you know again you've got two seconds there in ten billion thoughts going through your head that I don't know what what hit me but I was thinking things like you know. I don't want to get a five year or his house. You know we've we. We both know common friends and you know just so many things but he. He overpowered me and and pushed me down to the floor. Like got me down to two onto my knees You know he had gotten our remember he'd gotten hold of my ear. Bud I am such weight pulling so hard that I literally thought he was GonNa rip my whole year off my head After leaving I'm surprised it wasn't at least bleeding but hold me in a way that I mean I. I couldn't move any other way or else you know. He had that kind of hold on me now but he You know he had a hold of my ear and he was he was still exposed in the front of his pants on just like they weren't all the way down but he the front available spalding on And well we'll to say he he he forced me he is physical force but he used force and you know it it the way he had a hold of my ear stunned me first of all I just didn't I didn't know what he was trying to do there but you know he is. I remember once he had me down to my knees. I had pride move or something but I mean he he ripped ripped up and twisted that much harder I will. I'm stuck any forced you to have seven course. No he forced all sex. And where you were you scared in that moment. Did you feel like he could. He could really physically hurt you or possibly. Even the way he the way. Yeah he had he had hold my ear You know when he grabbed because we facing each other But once he once he had pushed me he got me in order to get me down he he kind of us one of his legs to unlock one of these. You know how you do when you used to go behind through friends at school and unlocked earnings from the back but he had done that to to my leg with my knees with was legs But he had such a grip on my shoulder and his other hand on the on the other side on the ear and he was pulling so hard but the shoulder tactic tactic was what he actually pushed me out with but he was so hard that his name in the world scope But yeah he used it was it was physical physical force We'll just say that didn't last very long you know was all it was quick You know and once he finished He let go of my shoulder but still had an older my ear because he knew I was probably I was going to jump up and you know one of two things hurt him or damage some things trying to get out of there after this ordeal Darryl said officer bets shoved him out of his front door before bolting it behind him Daryl. Darrelle drove home and didn't tell anyone what had happened. He said he was so distraught. All he wanted to do was a race any memory of that night he thought it was all over until a year later when beds contacted him again he's pop back up on social media You know when it was it was a really long sincere apology. You know all that you know again. I had blocked it out that whole time. And hadn't I just thought you know just learn But you know there was he popped back up apologized there. There was a you know not long after he apologized. We'll we'll just we'll we'll say there was another incident but I was. I was fooled into you for you. Forgave him when he apologized. Yeah I was very compelled to. I believe that you know that he wouldn't do anything like that again. but he but he did unbeknownst to me in the back you know. I was too forgiving. But you know it happened again the the next time that it happened He wasn't he wasn't in uniform or anything however his his duty built it was was close by you. Know with his service weapon you know in the in the holster You know so there was obviously. I was unharmed. You know so there was a little bit more than just physical aggression. There was you know there was of a bigger threat at that point. He didn't threaten me with it per se. But you know it's it's on the room. It's very obvious it's right there. It's host to the doorway. This time. Darryl said he was invited over to help. Kenny bets get ready for an event. He asked Daryl to help him the pick out tie at which point. He rushed him forcing him to the ground much the same as he did before Darryl admits he was too forgiving. And maybe a little naive but it was too late much like he had with the teens. Innocence that's pounced on Daryl's kindness walk past his duty built. Thomas Weapon there and that's when you know he just came out of the closet and I mean it was. It was very very fast what there was no reaction time after after that had happened. Why why didn't you fight? You press charges. Does she think about it. It was never an option to you at that time. No you know. He's in law enforcement. You know he's sworn officer With a large department no less so a a lot of friends you know I mean I think it was. It was a fleeting thought but at the time again Rodham Tell Darryl chose not to pursue lawsuit but said he hopes his story will bolster those of other victims as we near the end of our investigation. Five more victims lawsuits became unsealed unsealed or detail those at length in the fourth episode of this series in the next installment in the series untangle the web of cover up and negligence that police in city leadership have spun around the scandal. When did you feel like he had crossed the line and started to become a predator? He would it was on a regular basis. He would ask for nude photos asked for me to come over all sorts of things at at this point. CFO showing signs of emotion. He's constantly tapping a foot and clearing his throat. More often than usual. It's clearly tough for him to share his stories of abuse. Did you ever go over Once when he picked me up and so he pick you up at your house. Yes Sir he picked me and and see up and what I mean what happened people so he picked you ended other plates. Yes and what happened. And so he He had called it and text best thing he needed help. Moving paperwork from his office is to his home and of course we were eager to help. He pulled up in his police car and and took us to his house from there. We helped taken paperwork boxes axes of things and we started watching TV on his couch and that's when he started. Come on to me and NC I will you do now. We were in the range between Queen. Fifteen and seventeen. They'd get out he He said the fridge was full of alcohol. And that's when he started to come onto us and I was extremely nervous. Didn't know what to do who to call call. So that's when I started drinking and from there. He took us into his bedroom and some messed up. Things happened it. He did he wait till you were. Were drunk take advantage of you know I had about two or three and I had a buzz. And that's when he pulled us back into his room started taking our clothes off and kind of pushed us onto the bed and from there it let onto to him giving us oral sex and US giving him oral sex and it led to him penetrating me and NC He took us back to our house about an hour or so after after and we kind of left us alone for a bad then after that he started back putting pressure on us. Hey do you WANNA come over. Hey can you send me more pictures. He kept on chasing. Thank us and I mean. How long did this continued to this kind of relationship continue? It continued well after I got back from the military Came back to Kentucky about a year after going through my training and all that I came back back and I was over eighteen he would still continually contact me. Ask Ask for pictures. Ask Me for favors. He would ask me to come over and mess around with him and just ignore them. You didn't tell anyone about that night at his house now. The only the only a person I did tell besides in C- was officer would thirty two year old Brandon Montas would was fired by the Louisville Metro Police Department -partment on April thirteenth. Two thousand seventeen in January of this year would pleaded guilty to a felony attempted enticement of a minor charge. According to court documents would met the teen explore camp in Kentucky where he was working as a counselor he pursued the teen over social media and attempted to coerce them into sexual activity. The charge carries a mandatory minimum sentence of ten years in prison but prosecutors and woods attorneys have agreed to a five year stint behind bars. The judge in the case agreed to a slightly longer sentence that will put brandon. Would in jail for seventy months He told me we needed to to talk with the higher ups about it and I told him I did not want to come forward I was scared of what would happen only after the lawsuits were filed would. CF come to believe that would was involved in the alleged cover up. What would you? I think what happens if we came forward I would be shamed I would lose my spot on the department. My father would pull us out of all the extra activities that we are doing I was. I guess it's just scared of the repercussions of coming forward. Did you ever did you ever fear or feel like you could be hurt because of this. Did you ever feel career violence in a way now. Kennedy was really intimidating. When did did you become aware that that this wasn't just that that would was involved? That flirty had helped covered When did you become aware of all of that? I wasn't completely aware of this situation until it was completely brought to light right about a year and a half ago when everyone started filing suit when everyone was getting interviewed and we had started started talking about what had happened with each other. Who I've discussed have told me that? The same things happen to them. He would pressure them for nude pictures and from there escalated and he's facing. He's facing criminal charges now yes deal. It's darker in there So I'm I'm going through the story of whatever I was talking about and and it was almost like situation but I had been before where he took my my hand it over and For lack of better term. He was clouded. We'll put it that way You know it was it was. I don't even know the word to describe that other than under shock So I drift away and you know just kind of made a joke about it like you know Kinda trying to laugh off and and You know ease the tension or whatever but that I had going on I made a joke or something and you know.

It's important to note that two of the officers serves involved in this case have pleaded guilty to sex abuse charges the civil litigation that brought the scandal to light is still ongoing and Louisville is still trying to heal our reporting is based on court documents and interviews with victims local politicians reporters and attorneys Fox News has reached out to all all parties central to the story some chose not to respond. Now here's more from our reporter. Andrew Kuyper our story begins with the Youth Explores Program in Louisville a mentorship opportunity for teens. WHO ASPIRE to careers in law enforcement? They're explorer chapters across the nation. But some say this Golden Opportunity at Kentucky how dark dark secret and became a nightmare of abuse intimidation and shame at the hands of Louisville Metro. Police officers he would. It was on a regular basis. He would ask ask for nude photos. Ask for me to come over all sorts of things in this first installment. Our series will detail the allegations of abuse by the officers against the youth explorer cadets. We'll hear from lawyers. Local politicians and alleged victims additionally in the final days of our investigation. Five have new explorer lawsuits were unsealed due to the complex nature of those cases were devoting a fourth episode to investing those claims at length. We'll also update you on all the the litigation surrounding the scandal and take a look at how the saga has roiled the Derby cities local politics. It's important to note some of what's discussed in this. PODCAST is graphic if it can nature to start we'll hear from the lawyer who filed the first lawsuits on behalf of the former cadets. And you take a young person who has been sexually assaulted sexually abused intimidated. Who has gone so far to till and other officer And nothing happens David. Yates is a councilman and end attorney. In Louisville in two thousand sixteen he was contacted by someone claiming to have been sexually abused by officers in the explorer program. And I'd hoped that it wasn't as large as it was but it was just a terrible secret. Yates filed the first lawsuit that contained a striking number of allegations allegations including rape destruction of evidence and intimidation by Louisville Metro. Police Department officers. We'll get into the details a little later on but I it's a story about how he learned of the abuses. It started an individual Hit spoken to me and through my law practice. Olive doc contacted Will eventually be a client in Think I filed with NC in March sixteen. NC was a youth explore cadet that filed the first lawsuit against the Louisville Metro Police Department also just to be clear. NC is not his real name due to the graphic and perverse details of the story. His identity has been concealed not long after. NC came forward more cadets disclosed graphic abuse to yates he could either take action or keep it to himself for him. It wasn't much of a choice. They had the data that the the you know. For from their social media sites the text messages and stuff from the individual abusers. I think that the their individual stories all clobbering each other pictures of the Genitalia of the abusers that they had sent them the tipping point that led him to file. Suit was what he calls calls the inaction of police leadership to hold officers accountable for their abuses. Then they're young lady. There was another case that was filed. there was another situation -Tuation in the media covered it that she had reported what was going on Base came to her home and they insured the parents that this officer would never be around. anyone in would be an officer was going to be the chiefs desk. Yates named officers. Brandon would good and Kenneth Bets the alleged primary of users in the scandal. Also named were officers. Curtis flaherty police chief Steve Conrad Mayor Greg Fischer as well as is the boy scouts of America and learning life to parent organizations of the Youth Explorers Program. I made multiple attempts to speak with beds would and their lawyers about the ongoing civil and criminal cases against them. I even ran into one of bets as attorneys in an Elevator in Louisville. Despite all of this they refused to offer comment or make themselves available for interviews additionally multiple attempts to reach the boy scouts of America and learning for life. What unanswered today? No one from either organization has respond to my emails or my calls similarly attempts to speak with flaherty Conrad and Mayor Fisher went unanswered Fisher. Staff Senator previously circulated statement about the abuse allegations saying it's imperative this administration must get to the bottom of these disturbing allegations flirty attorney the settling Did tell me. He expects the accusations of negligence leveled against his client to be dismissed. Upcoming hearing currently flirty is named As defendant in all seven civil suits filed by former explorer cadets. His attorneys said he is innocent and ran a very safe programme the lawsuit alleges that NC was raped by wooden. Bats acts the officers recorded on camera. The main inconsistency as I recall it was the mayor said during a two thousand thirteen investigation. What he learned about that he read about or saw in the media and the deputy mayor and the chief both said they had individual meetings with the mayor where he was briefed on the course of that investigation and the deputy mayor and the chief of police said that he was? He was briefed on the investigation or briefed on the allegations as early as two thousand thirteen. That's my recollection. Yes flirty alleged role in the scandal goes beyond negligence. CF is still pursuing his civil lawsuit against Officer Bets and the Louisville Metro Police Department. He's currently recovering from injuries. Sustained while in a motor vehicle accident while serving in the army. I hope that this will shed a light on the police department. Darryl retired from the police force in two thousand fourteen due to progressively worsening health conditions. He's now working part time in the Louisville area and actively seeking professional counseling as an outlet for the trauma from the abuse. He suffered by officer bets. He thinks that there's been ongoing sexual abuse in the program for years before what's been reported. The Police Department is overwhelmingly. Great people you know bought by the most level but you know you see stories like this. We're occasionally there's a bad apple that comes in in this case. I think I think it it happened before. NC's allegations of abuse now public. The News ripped through Louisville. You know the media is all over it and people are talking about it. Council members are talking about got it. Police officers are talking about it. Citizens are talking about it. You know I can't go to the grocery store that being stopped by citizens other council members are having the same thing in in in another lawsuit is filed and More of the same have council members calling me saying what are we going to do the lawsuits where the tipping point for James. He met with Mayor Greg Fischer and urged him to contact the F. B. I. to look into the allegations but the mayor's office refused James Request for outside law enforcement instead Fischer decided to hire an outside investigator former. US District Attorney Carry Harvey for one hundred forty thousand dollars. Mayor Fisher said in in a statement that is of the utmost importance to get to the bottom of the youth explores sex-abuse. James took issue with the decision to hire carry harvey. Not What the decision to have an investigation. Gatien the scandal. The private investigator has no ability to arrest. Anybody has no ability to search. Warrants has no ability to do subpoenas all those things that are necessary you to investigate a case and had the tools and resources and assets that you need to do that. James was prophetic as harvey began investigating. The police union prevented handed him from interviewing LAPD officers. Because of a clause in their collective bargaining agreement a heavily redacted version of the report was recently released after months of delays delays in it Harvey found that Louisville Metro. Police made mistakes in handling the allegations of misconduct. The report also found no evidence a cover up by Mayor Fisher and largely cleared chief. Conrad of mishandling the investigation in Tibet's misconduct however the allegations of abuse that were recently recently released. In Harvey's timeline are disturbing metro council. Recently voted to release Harvey's timeline of official knowledge of the abuse which is separate from his original report although the names of the miners redacted local Fox News Affiliate W. D. Rby reported that flirty was fully aware of sexual misconduct allegations made made against pets. Betts is now at the center of the Youth Explorer Program Sex Abuse case now charged with several counts of sexual abuse abuse. The fact that we knew there was a problem in two thousand two and that we still did not do anything about it as a police department. The children were molested. It's the most disturbing detail for Metro Council president. David James Documents released Thursday showed that two female explorers came forward in two thousand to to sing. Four years later in two thousand six betts joined the department in became involved with the explorer program. He's now accused of salting eight explorers before he resigned in two thousand fourteen. You've Conrad really knew about it. Why did you not stop the program and check on these children to make sure that no further bad things? We're going to take place the same time. Line shows Samir. Fisher wasn't made aware of any allegations until November twenty sixteen. He ended the explorer program in March. Twenty Seventeen Fisher tweeted a statement that says in part heart. I remain committed to ensuring that all questions are answered. That justice is served in that all necessary. Measures are taken to make sure. This never happens again. Harvey's timeline has bets joining the explorer program in Nineteen Ninety nine and would in two thousand and two thousand to two females accused bets of sexual misconduct conduct the allegations against pets. When he was a member of the Louisville Metro Police Department go back to two thousand and seven when Harvey reported that he took an explorer to a local park mark and demanded oral sex? The first allegations harvey found against would date back to two thousand eleven when he said the officer had sex with a seventeen year old and exchanged changed explicit e mails with a sixteen year old. Harvey's timeline and report do well to fill in some of the missing details about the allegations against bets would and flirty clarity. However the findings were questioned by some in city leadership? James said the report was not so thorough in its findings and mayoral candidate and councilwoman. Angela elite took issue with a previously undisclosed professional relationship between Harvey and deputy mayor. Allan Hessen leads said hasn't Harvey worked together. And Former Governor Steve Beshir's administration neither Hessen or harvey could be reached for comment. This report isn't enough for James and others who hoped the FBI investigation Asian. Give a clear picture of who knew what and when so Contacted a friend of mine that is retired from from the FBI and explain what was going on and said I really needed to talk to the agent in charge. And then that took place and so so the next day the FBI said that They would start looking into the case. The FBI confirmed affirmed Fox News that they began investigating. Major Curtis Flaherty the Director of the local explorers program who was also in charge of the unit that looks into criminal misconduct by police police officers. They said their investigation is being done in coordination with Departments Public Integrity Unit which is no longer headed up by flaherty so With an investigation. We're taking place about officers doing inappropriate things with explorers. Then it would have been his officers that would have been sent to do that. Investigation and he would have been in charge of directing how that investigation doc plays well. That's definite conflict of interest. The scandal prompted chief Conrad to suspend the program in November of two thousand sixteen emails obtained by Fox News. Show that flaherty successfully lobbied to have it reopened just a week later for a slate of summer activities including National Explorer Pistol Missile Competition. The regional and national explore competitions were described to me on background by multiple sources as breeding grounds for abuse. Indeed Harvey's report uncovered an alleged incident. In the Louisville Metro Police Department in the first episode we heard from two alleged victims of a former Louisville officer who detailed graphic experiences of abuse and rape in the second lawyers politicians detailed an alleged plot to cover up the misconduct. A warning that some of what's discussed in this podcast is graphic in nature and may not be suitable for young audiences. Fox News has reached out to all parties central to the scandal for a comment. Some chose not to respond. And now here's our reporter Andrew Kuyper. Hello I'm Andrew Kuyper. Thanks for joining us in this episode. We're going to hear from an academic and investigative. Let's get a journalist. Both of whom have deeply investigated. Instances of sex abuse in youth explore chapters across the nation in the first episode. We heard from two who alleged victims of a former Louisville officer with detailed graphic experiences of abuse and rape here. Cf a victim who filed a lawsuit against the officers he He said the fridge was full of alcohol. And that's when he started to come onto us and I was extremely nervous. Didn't know what to do who to call. So that's when I started drinking and from there. He took us into his bedroom and some messed up. Things happened in the second episode. We spoke with lawyers and local politicians close to the scandal. They detailed their knowledge of what they say is a cover up by police and city leadership. They helped shed light on the claims of abuse and negligence at the center of this story. Here's attorney David Gates that think that obviously The way the program was run looking back. Now I think th that level negligences. That's the standard of here but to say that they actually they they were part of that cover up. And they're part of that I think that that moves on to people in positions of authority. I think it moves all the way up named flared individually for that reason because he ran the the program. The allegations of abuse made by the victims are striking not only because of the severity of them but also because of the pattern they establish. It appears the officers would groomed groomed scouts beginning with inappropriate text messages and eventually escalating their actions to increasingly more sexual and perverse levels. They seem to have exploited. The innocence inhibition of the teenagers. Unfortunately sexual abuse in the Youth Explores Program isn't unique to Louisville. There have been hundreds of documented cases of officers exploiting their positions as mentors to prey on teen cadets. In some cases officers were prosecuted and convicted and others. They resigned or fired from the force today. We'll hear from a local investigative journalist and unacademic both of whom have written extensively on the abuse within the youth explorers programs across the nation. The first Andrew Wolfson he's a longtime investigative reporter with the Courier Journal and Louisville he compiled a database of sex abuse lawsuits against officers involved in police youth explorer programs across the nation from newspaper articles in court filings. We got a tip that A A an officer had been suspended because some allegations involving in his role as a adviser to the explorer program and We weren't able to write I too much about it. And then finally there was a Sealed lawsuit filed under a pseudonym search for the plaintiff. I think that was NC. I remember correctly and We got a a copy of the lawsuit and then went from there. NC was the first victim to file a civil lawsuit. Food Against Former Louisville officers can his bets and Brandon would the lawsuits made explosive allegations and claimed to officers raped him and also recorded boarded the acts on camera. Neither of the former officers were made available for interviews or comment. NC's Lawsuit Tore Louisville Thunder. It was the first of an eventual seven seven lawsuits filed against members of the Louisville Metro Police Department and city leadership. And that I that I reporting that you did on on NC's lawsuit over the ripple effects. I think people were disturbed that That this involved police and had apparently had gone on for a long time and One turned out that an officer who had been allowed allowed to resign from the department was one of the accused and so I think there was a suspicion of whether it was properly handled When it first came to light Wolfson spearheaded a nationwide investigation into sex abuse in the Youth Explorer Program Program? He found one hundred and sixty two victims in at least twenty eight states over the past forty years. Well I am reading about the explorers of it wasn't hard to come. Upon the fact that there were cases stretching back decades we've found that the the executives in charge of scouting in explorer program specifically did not respond respond in an effective way as these cases emerged Part of the problem was that authority was diffused fused between the the scouting organization and The police departments that actually ran these programs. Some of the details wolfson uncovered were harrowing the youngest victims he came across. We're just thirteen years old. In Oregon he found a case where five officers made a sex tape with two boys and two girls. Another instance in Rhode Island six officers had sex with just one girl in Los Angeles. A former explorer turn officer was sentenced to eleven years in prison for sodomizing teenage boys. In some cases the officers prosecuted and served jail time and others they we're allowed to resign or even remained on the force and we were there any patterns. That you that you came across. I think The one thread was a The victims like all explorer scouts were Kind of enthralled with police and wanted to at least consider instead of pursuing those career so they were kicked. The victims victims were abused by officers in positions of power who exploited the kids desire to enter their profession. This exploitation of ambition destroyed many young lives well I think it's it begins. He found over thirty cases where officers were punished for. Sex Abuse in the youth. Explorer Program got calls from people after the initial report was done people who've been and then victims are their parents and so on and And and we got a sense that there are a lot of. I'm pretty. I'm willing to bet that there are a lot of cases where The parents don't go public and there are undoubtedly a lot of cases where the girls themselves never tell their parents or anybody else. So the the the exact amount of of how often this occurs is simply unknown. I I compare it to an iceberg. The keys we counter the tip of the iceberg but as we know about icebergs you know the most of it is below the water level. This seems to hold with the incidents in Louisville where attorney said there were many more victims than those who filed lawsuits. The ones who haven't come forward or maybe even more embarrassed than Children who are abused by police Because they you know. They looked up to Police and least we're entertaining the idea of becoming one so I don't think it's going to grow to those proportions but we haven't really I mean there's obviously I think what what I wrote that story. I think there's still only two or three cases here service more come to the fore here. Walkers concerned with some of the practices and policies of departments who run explorer programs namely how they conduct ride alongs and social interactions in a number of the cases officers were found to invite cadets into their homes and give them alcohol such is the case with cf who detailed his raped by officer. Kenneth Bets in our first episode in California Walker found a two thousand and two case where an officer pled guilty to multiple sexual misconduct charges for abusing three sixteen year old often during late night. Today eight federal prosecutors have obtained guilty pleas from two officers central to the story and the FBI investigation is ongoing ongoing. We're going to focus on five recently. Unsealed lawsuits that have cast the Derby city further into tumult. The newly public lawsuit suit detail allegations against a number of current and former LAPD officers. They unveil a rash of explosive allegations. That some say show a ring ring of negligence and cover up that was established to protect officers at the center of the scandal. You've already heard reports from former cadets like cf who said he was raped at a Louisville Metro police officers home when he was just a teen his story which he shared in the first episode of this series is detailed at length in an unsealed lawsuit. You've also heard from local politicians and lawyers who have been central to the Fray Tad Thomas who represents all seven the plaintiffs in the youth explorer lawsuits talked with us in an earlier episode about the cycle of abuse. He said the officers perpetuated. What would happen is a victim? uh-huh of bets would go to would and say this is what happened so woods would say you know what we need to tell Mr Flare knee and so they would go and report it. The Mr Flaherty when woods during the same thing and then flared he would do nothing about it and and vice versa. A victim of woods as we go to bets and say. Hey this is what happened to me what should I do well. Let's go to flair and flair would not do anything. And here's Council President David James and our second episode. He was one of the first outside of the police department to hear of the shocking allegations. I received some communications from some police officers asking me if I had heard about search warrant conducted by the Police Department on an officers don't and I said no I have not and so when they did that I was told that They found videotape of officer. Bets officer would molesting One one of explorers in so it was common shocked by that and so A couple of weeks at passed passed and I had not seen anything on the Muse about Arrest being made and I thought that was awfully strange. At least eight current and former Louisville Metro police officers have been named in the youth explore lawsuits at the center of the scandal are former officers. Kenneth Bets and Brandon would both bets and would have been charged in federal court. Bets has pleaded guilty to enticement and child porn charges. Prosecutors said he met three of his four victims through the youth explore program in his plea agreement bets and his attorneys agreed to a sentence between ten and fifteen years in prison. The judge in best case said the plea agreement of fifteen years in prison was too lenient. He scheduled to be back in court in August to be resentenced. In January of two thousand nineteen would also plead guilty to a federal attempted enticement charge according to the plea agreement would met the explorer a Camp Kentucky and sexually pursued the eighteen over various social media platforms although prosecutors and woods attorneys agreed to a five year sentence. The judge did not the judge recently gave would a longer sentence sentence than what was agreed to in his plea deal. The former officer will spend seventy months in jail. Also central to the controversy is retired. Major Curtis flaherty clarity who ran both the youth explore program and the Department's Public Integrity Unit which investigates criminal wrongdoing officers. flirty has long been accused of allowing allowing the allegations against bets would and officer. Brad Shuman go under investigated and largely unpunished. We'll dissect Schuman's allegations momentarily flirt. His lawyer lease settling Told Fox News that his client maintains his innocence and is expecting to be dismissed from the civil lawsuits due to the statute of limitations. Thomas said the court will resolve that issue in an upcoming hearing. Shuman is the primary defendant in one of the recently unsealed lawsuits. The plaintiff identified only as in court documents initially accused Shuman of raping coercing and sending in soliciting indecent photographs when she was a minor around two thousand and eleven an an amended complaints. The woman walked back the rape claims instead accusing Shuman of groping her sending inappropriate photographs and attempting to solicit sex from her this recalibration of allegations. According to Schuman's lawyer. Carol Pettit is enough to discredit claims. She said Schuman didn't have a relationship with the team. Although she acknowledged the officer was an explorer advisor at the same time beal was a Cadet Pettit said Schuman maintains his innocence. Thomas the plaintiff's attorney said so the defense has employed a number of strategies to drag the court proceedings out for as long as possible so the next step is really to go before the court and see what what she will let us do next. I assume that we will have rulings on our motions to dismiss In the near future either before are they hearing or soon thereafter that I would think and we'll be asking the court when we go in for the status conference one way or the other for permission to proceed in Discovery Cavalry to you. Start sending out written questions to all the defendants into start taking witnessed at positions. And do you feel like this case has moved quickly. I mean and we're GONNA get an arduous process process right You know th the defendants have a right to use the civil process to defend themselves themselves. In a way that they see fit and that includes motions for this miss and procedural tactics Which is what they've done here And removing the federal the court and Fighting Tooth and nail to keep us from being able to start discovery so unfortunately It moved quite slowly slowly Hoping that this judge will give us the go-ahead to start taking discovery and really Keep the case in the high gear. Some of the allegations that it become public our heroine consider this from one of the five lawsuits filed by its against former officer. Kenneth Betz I I think You know some of them the allegations Gheysens. They had really not been discussed and the and the public around until the judge unsealed. The lawsuits are really One would be the sting operation that was conducted in one of our cases. I wear our client had gone and complained to About one of the officers officers and you know asking for nude photographs and Other sorts of harassment and things like that she reported it to some some of the CO defendants in the suit and they Essentially tried to set up a sting with her Where they invited the officer he was already at another other Catholic Picnic They tried to get him made her behind the on one of the buildings and and what I believe happened at that point is tipped off at this was going on and he you know changed his tone and and didn't show up in K. W. versus pets the lawsuit Thomas mentioned the former officer is accused of stalking and attempting to sexually assaulting on multiple occasions between two thousand eleven seven and two thousand twelve. Thomas said he and his team found no records of a sting operation on officer beds after conducting an open records request with the department he said. The lack of documentation of complaints and investigations helps establish a pattern of negligence by flirty and other officers involved in the explorer program at one point during a statewide explorer conference K. W. said bets approached her while she was sitting on a bench and forced his me between her legs making rough contact with her genitalia. Eliya during the same week on the day of her Sixteenth Birthday K. W. alleges that bet singled her out during a group exercise and humiliated her before making being the other explorers singer. Happy Birthday sometime later in two thousand and Thirteen K. W. alleges that that's trapped her in a stairwell with the intent to sexually assault her. He said it was only when someone else came in that she was able to break his grip on her wrist and fleet. The five recently unsealed lawsuits also established allegations against a number of key players in the explorer program. Chief among them is former officer Julius Schmidt. She's accused in multiple lawsuits of helping to cover over the misconduct. Alleged against officer bets and Shuman essentially the lawsuits say that Schmidt helped perpetuate the abuse by failing to report it and sometimes actively preventing appropriate action from being taken..
