Didn't do anything wrong did nothing wrong presidential records act it's not even a criminal event there is no criminality here it's and ridiculous these people look they're using it as election interference they're using it to get elected they think that if they can damage somebody's reputation they could do this is like Stalinist whatever you this is the worst nobody ever thought this could happen in our country well actually a lot of people saw this coming and here are we now and of course we know that there are tandem investigations here well at least there is into Joe Biden the one that was involving Mike Pence has been cleared and we'll wait to hear what happens in the Joe Biden case from the special counsel meantime Jack Smith the special counsel investigating Donald Trump has finished his work on this one and that's why we want to talk to Dave Erenberg once again with us on Bloomberg Radio Palm County Beach State Attorney Dave have been really looking forward to comparing notes with you now that we're finally here at this day and it looks like a fairly simple one for the former president in terms of what happens procedurally today I suspect you're looking to see if he will be represented by an actual trial lawyer of record so we arraignment back with you Joe he'll be represented according to reports by Christopher eyes as the local attorney he's a very well respected former Florida Solicitor general who team Trump brought on a while ago with a 3 million dollar retainer and then Trump quickly dispatched him sent him to the sidelines because he didn't like highs advice guys apparently wanted him to be conciliatory cooperative with the Department of Justice and instead listen to Boris Epstein and extra became confrontational now you see where it got him but guys was available all along I don't understand the whole I can't find a Florida lawyer it's just that it seems like Boris Epstein who seems to be running the show did not want ties to be the face of the Trump legal team there's so many egos involved on that side you can see why there's always problems involving his lawyers speaking of his lawyers here I want to ask you about this crime fraud exception that essentially brings us to the center of the case this involves a former lawyer of Donald Trump's Evan Corcoran his testimony brought into the case after that exception was triggered here which allows them to basically do away with attorney -client privilege on the allegation that Donald Trump tried to further his crimes with his representation if you can be more eloquent in describing that please Dave take a stab at it but it seems to me that that would make life pretty difficult in hiring a new lawyer well you have attorney -client privilege and that is sacrosanct but you can't use your lawyer to facilitate a crime you can't go to your lawyer and say I want you to hide the documents I want you to lie that's obstruction and that will get your attorney -client privilege pierced and that's what the courts ruled in the DC circuit and because of that the government got a treasure trove of notes from his lawyer Evan Corcoran now what's interesting about that is that lawyers take notes but not unlike Evan Corcoran Evan Corcoran took like novels like novels like meticulous detailed notes I guess under the legal theory of A that's and why and that's why Trump is going down is because the number evidence against them comes from his own lawyer right so couple things there that's the first thing that Donald Trump legal team will attack because without it Dave it's it's not such a case this is central to making this indictment work so can could Donald Trump's legal team actually strike that down on the grounds of attorney client privilege and what happened to the case if they did there is an almost 0 % chance that he will it strike down because attorney -client privilege because the issue is already been litigated it has been decided by the court in the PC circuit now Trump's legal team will ask Judge Aileen Cannon to revisit it and if she gives what Trump he wants there will be outrage just like there was last year when she gave Trump everything he wanted because she didn't follow the law and then it will go up to the 11th circuit which will reverse her and repudiate her so the one advantage for Trump is that it gives him a chance to delay matters further he can challenge the ruling down here but he's not going to succeed but in a way he wins by losing because by losing in court he's going to have those delays that he he loves because it can push this case beyond the 2024 right so that becomes the overall strategy and maybe you would have started there if i had asked you Dave delay delay delay that's it that's been his legal strategy it's worked for him and he thinks that if he can push this beyond the 2024 election then the
