Democratic committee member Jamie Raskin urged the Justice Department to consider prosecuting Trump for four offenses, obstructing Congress's certification of the 2020 election results, conspiring to defraud the United States, conspiring to submit fake slates of electors, and inciting an insurrection. Mister chairman, we understand the gravity of each and every referral we are making today. Just as we understand the magnitude of the crime against democracy that we describe in our report, but we have gone where the facts and the law lead us and inescapably they lead us here. The question now is whether this unprecedented referral will lead to an unprecedented prosecution of a former president. Joining me to discuss the referrals impact is former federal prosecutor elie honig of loewenstein Sandler. Ellie, this referral is symbolic, it doesn't require the Justice Department to do anything, and in fact special counsel Jack Smith is already leading an investigation into Trump. But does the public nature of the referral and the information that it comes with put any pressure on the Justice Department to come up with indictments against Trump? So first of all, yes, this is symbolic. But that doesn't mean it's meaningless. Things that the solid can have a serious impact doesn't increase political pressure public pressure on DoJ. Sure, the more voices, especially authoritative voices like Congress that you have calling on prosecutors to bring charges, the more public pressure. But I don't think that pressure is going to influence DoJ. It's not supposed to influence DoJ and every attorney general going back to the start of the republic. We'll say we are not influenced by public pressure, but I think with Merrick Garland, one thing that I think is very strong on is not being subject to political pressure. But here's what I think is going to make a big difference, June. And that's the actual evidence itself. It doesn't so much matter what the label is or whether it's packaged as a referral or not. But I guarantee you DoJ and federal prosecutors are going to go through that report that comes out of the committee were by work because there's going to be evidence in there that DoJ does not have. There could be evidence in there that's different or inconsistent respects with evidence that DoJ has. And by the way, Donald Trump's lawyers will do the exact same thing that they're going to look for weaknesses are going to look for holes. So I'm not so concerned from a prosecutor with the referral itself. I probably just roll my eyes at that angle. Okay, thanks for the referral Congress. But I'm very interested in the actual evidence of the substance. But does it hurt prosecutors to have all that evidence out there with the public, potential witnesses? And as you mentioned, Trump's people, going through it. Yes, and it cuts both ways. On the one hand, if your DoJ, you're grateful. Wow, all this new evidence, almost certainly some that DoJ didn't already know, and we know that the committee got to certain key witnesses before DoJ Cassidy Hutchinson being one example passive Bologna being another example, the text from Mark Meadows, the committee got those before DoJ had them as far as we know. On the other hand, as a prosecutor, you never want other people interviewing and questioning your key witnesses. You never want there to be a massive body of previous statements that witness can be attacked question cross examined on. And that's what's really unusual here, because in any criminal case, the prosecution has to turn over and the defense lawyer has an obligation to scrutinize any prior statements of the witnesses. Well, here there are reams and reams of volumes of that material that we're going to see fully when it all comes out in the next few days. And all of that is fair game for defense lawyers to pick apart. So this is part of the reason there's a cost to the fact that DoJ has been largely lagging behind Congress. Now there's going to be all this information out there, some of which may be used to undermine its case, which is outside of DoJ's control. Isn't citing an insurrection the toughest of the charges to prove? Insurrection, of course, is the most difficult to prove the others are obstruction of Congress or conspiracy to obstruct Congress conspiracy to defraud the United States. Those focus on the pressure campaign on Mike Pence, those focus on the efforts have fake electors installed. The insurrection charge, though, is much more dramatic and you'd have to prove an intent to essentially overthrow the government. That's going to be much more difficult. DoJ has charged over 900 people connected to January 6th. They've not charged a single person with insurrection. They have charged a few with seditious conspiracy, which is similar, but not identical So I think the committee threw in insurrection mostly as a symbolic measure. I don't think there's any realistic chance that DoJ charges Donald Trump with insurrection. But I think the committee was trying to make a larger point there. Trump is known for not putting things in writing, not emails, not texts, and also I understand there's no evidence that he had contact with the insurrectionists, so is it going to be hard to prove intent? Absolutely, that is going to be the crux of any case against Donald Trump. It's often the crux of any criminal case is intent. People sometimes think about the whodunit, who robbed the bank or who committed the murder, but most cases turn on intend, what was the person's state of mind and can you show that specific criminal intent that you need in a case like this and you're right, Trump is particularly elusive because he does not text these are not emails. So there's not going to be some smoking gun document that he created. There's not been a person really close to him on the inner circle who has flipped and cooperated in a way that prosecutors have wanted to fully credit and trust and go with. There's no known wire cap or audio tape of him. So it's very difficult to ascertain his intent. Now, the committee was making the argument that well, if you look at all of his conduct and his public statements, you can see his intent, but that's difficult. That's never an easy road for prosecutors. And I think that's going to be the biggest obstacle to charging. Even though attorney general Merrick Garland has said over and over that no one is above the law and they'll go wherever the evidence takes them. But in deciding whether to indict a former president, are they going to consider that would be a first in our nation's history that Trump is going to be running against the current president in 2024 and a significant part of the country still believes in him and that the election was stolen. "This, better than anyone, Doug, when you first got elected, what do you have to do the next week, start calling people for money? Start, you know, going to the incentive structure is such that you have to raise hundreds of thousands of dollars every other month or something like that. And you got to give it back to the party on the Republican side, the Republican committees, the democratic committees on my side. And you don't get into the weeds of actually governing. And building relationships. And I credit you for actually building not just relationships within the Republican caucus, but folks like cinema, and you do have relationships with a lot of folks go to Washington. They don't build relationships at all. They're not even with their neighbors in the canon, you know, Russell or whatever building you're in. And, you know, I was a big believer. I love folks like tip O'Neill on my side and stuff like that. Really relationship folks. And I think when the House and Senate calendar changed in the 90s where everybody, you know, the incentive structure was to get home as quickly as possible vote and get home. So you could go to your in person events and stuff like that. And that's important that relationship. But when all the kids of members of Congress left, the D.C. schools, Maryland schools, Virginia schools, and that they went home back to their home districts. You weren't seeing each other on the weekends. You weren't traveling together. I'm a huge proponent and believer in code L's, right? Bipartisan code deals across the world, right? Where we're united front where the water ends. And you can build those relationships. And some of it's perfunctory, but some of it is, you know, I think Hillary Clinton and John McCain actually developed a semblance of a relationship on a lot of those codes because they were both focused on the armed services committee on the Senate side.

Federal court documents show that governor Larry Hogan is on the witness list in the case against his former aide Roy McGrath. The case is based on fraud and embezzlement charges against McGrath, who led the Maryland environmental service before he was named as Hogan's chief of staff. years We always wanted judges to have more discretion But there were some judges that just especially in terms of bail bail was being used as a punitive measure for many many years So I guess the legislator tried to correct some of those wrongs And by giving the judges some more leeway and such and I think judges have a little bit we wanted to make sure judges had more discretion in terms of drug offenses in particular So I think hopefully some judges will have more discretion right now and they'll look at each case on a case by case basis He's right we got a minute left Anything else we want to tell will in the office Well I just want all new to know that and I know everybody gets aware and gets enlightened when we're talking about national elections but please it's really the folks Iowa caucus debacle verdict: Sometimes, there shouldn't be an app for that

"Here's what we know about what happened earlier this week. In the Iowa Presidential Caucus the Iowa Democratic Party hired a very new company that built an APP that clearly had not been tested well enough before it was deployed in the real world. Nevada had planned to use the APP but says it won't won't use it in its caucus later this month but long-term this is a huge problem for trust when it comes to technology elections and it raises the question. What parts of the voting process do need tech innovation? And what parts. Don't I asked Charles Stuart this question. He's a professor of political science at Mit and a member of the CAL. ALL TECH MIT voting technology project. The best use of technology in elections is to do the things that human beings are bad at doing. Human human beings are very bad at doing tedious. Things on the most tedious of those things in elections is counting the balance. The best use of tech starts with with a really well designed system that uses computers appropriately to record and tabulate votes but then has paper systems that human beings can verify vote make sure that the computer recorded their vote properly and that you can go back to the paper to verify the count if you have to in a recount entre because you're doing an audit who like how big a market is therefore what you have described and for election tech overall. Well there's a a market for voting systems and there are a like to say two and a half companies that produce these systems meaning. There's two large companies knees and then there's a number of smaller companies but it's a very small market and people in elections have been hoping to expand that market either by the making it easier for new companies to enter or to find ways to take Off The shelf. Parts and to create voting systems. uh-huh let's talk about the competition piece because it sounds like some big tech companies have actually been in this market but then gotten out right right. The best and most famous story is that. IBM was actually responsible for the proliferation of punched card. Our technology in the nineteen sixties in eternal report from IBM concluded that one day inevitably something would go wrong and big blue would be the last red in the face and so the decision was made to sell that part of the business. They were lucky they were not the company that was blamed for her hanging Chad in Florida. In two thousand these systems are in the spotlight and we know that there will be mistakes. How hard can it be to create an APP? That takes some numbers that you type in over here and push them over to a A data server server over there and technologically. It's not necessarily a big problem. The there are other issues though Having to do with you know the scrutiny is that the system is is facing and the consequences for getting things wrong and the ability to the software and to try to break it and to know basically make sure that it's bulletproof I've seen a number of instances Where people have just radically underestimated the complexity of building election system of any sort Thinking that it you know it can't be any harder or more complex than other things that they built and they're often wrong. What is when something like this happens? Then you know it sounds like on the one hand you're arguing during their we. There is a need for better standards and communication possibly more competition. But what is the cost of an event like this to voters. Trust in new technology I mean the the cost has to be pretty high because I mean first of all you. It's incumbent upon people running elections or caucuses to run them in a way. That's now it looks like it's it's it's free and fair you know most people bowl who are not involved in this business Don't recognize how chaotic really can be and say really had to do your due diligence to make sure that it looks it's like People know what they're doing and whenever it looks like people don't know what they're doing then is not going to be good.
