"Sources are telling Bloomberg that a U.S. judge has rejected the FTC's bid for a preliminary injunction to block meta's acquisition of the VR company within. And the judge is giving the FTC one week to decide whether or not to appeal. Quote, in a sealed decision early Wednesday morning, U.S. district judge Edward davila in San Jose, California denied the FTC's request for a preliminary injection to block the proposed transaction while the agency pursues a separate case in its in-house court. He separately issued a temporary restraining order pausing meta from closing the transaction for a week, while the FTC decides whether to appeal his ruling. The decision represents the first major loss for FTC chair Lena Khan, who was appointed by president Joe Biden to reinvigorate antitrust enforcement as a key tenant of his administration's economic policy. Khan has taken a more aggressive approach to mergers than her predecessors and stepped up the agency's focus on technology giants in particular because of their potential to quickly dominate budding markets. The FTC sued meta in July, arguing that its purchase of within the maker of Supernatural a popular VR fitness app with aid the social networking giant in dominating the emerging virtual reality industry, top meta executives including chief executive officer Mark Zuckerberg and VR head Andrew bosworth, testified during an 8 day hearing in December. The FTC has also challenged Microsoft's proposed $69 billion merger with gaming publisher Activision Blizzard on concerns the deal could harm competition in the nascent cloud gaming market. That case is slated for trial in August.

And we are still actually, we've got the Elizabeth Holmes sentence. Let's get straight to Scott Cohn, who's in the courthouse in San Jose Scott. She will get 11 years, 11 years and three months, Elizabeth Holmes, sentenced after being convicted on four felony counts back in January. In a lengthy, about four hour sentencing hearing here at U.S. district court in San Jose, California in the heart of Silicon Valley, judge Edward davila, who is a Silicon Valley native he pointed out talking about how he grew up here and how business used to be done with a handshake and wondering whether Elizabeth Holmes was intoxicated by the fame, whether it was the hubris that made her made her commit these counts of wire fraud that she was convicted of. But before that, a tearful appeal from Elizabeth Holmes herself, getting up on the stand, talking about how she was devastated by the failure of her company about how she, how theranos and her team meant the world to her and about how she set out to change the world and is now seeking to change herself and to learn these lessons. But what she did not do in that tearful appeal apparently was to apologize to her investors or the patients that relied on the theranos blood testing results. Of course, she is planning to appeal this almost certainly, so that may be part of the reason why. But again, judge Edward davila, in San Jose, ruling that at least a $121 million lost by investors by more than ten victims in this case, and then at that gives Elizabeth Holmes a sentence as what he says is on the low end of the federal sentencing guidelines, but just the same 11 years and three months in prison for Elizabeth Holmes. Guys? It could have been up to 20 year Scott. So one might view it as a lighter sentence. Do we know you said before that she's most likely to appeal almost certain to appeal this? Will she serve right away or will she be at home for the appeal? We're waiting to hear about that. That's another thing that the judge will have to rule on. Oftentimes in cases like this, they will let the defendant stay free on bail pending an appeal, but that's something that they'll be arguing

Roughly 5 years ago, Apple copped to intentionally slowing the performance of some of its older phones. Apple said it did that to keep units with failing batteries from going crashing, crushing. The tractors argued the real reasonable did it was to trick people in the upgrading to newer devices. Now, seriously, 5 years later, consumer rights campaigner, Justin guttman has brought suit against Apple at the competition appeals tribunal in the United Kingdom. Citing a report from the guardian and gadgets has Gutman argued that Apple didn't disclose that it was going to deliberately throttle users phone before it did so and that the company didn't give them the option to disable the setting. The piece has gotten arguing that Apple introduced the slowdown feature to disguise the fact that older batteries could no longer cope with the new OS updates. Quoting the campaigner instead of doing the honorable and legal thing by their customers and offering a free battery replacement, repair service or compensation, Apple instead misled people by concealing a tool and software updates that slowed their devices by up to 58%. It's not suing on behalf of people who replace their phones or people who paid full price to replace their batteries. Rather the piece has him suing on behalf of any one in the UK who purchased an affected iPhone. That's anyone in the country who bought an iPhone 6 through iPhone X. If it loses, Apple could end up paying as much as 750 million pounds to over 25 million people, according to the report. A case against Apple over gift card scams has been given a go ahead in court. You probably heard about these scams, somebody calls a victim, claiming to be from the IRS or some other official entity, they say there's a problem with the victim's account, something wrong with their taxes, they're behind a utility bills and the power is about to be cut. Law enforcement is on the way to arrest them for some reason. They freak the mark out, then tell them they can fix it by buying Apple gift cards, either store cards or iTunes gift cards and giving the caller the information on the card. The bad guys then use the cards, either buying goods at Apple stores if they can turn around and resell, or buying apps on the App Store in which they have an interest collecting 70% of the cost of the app once Apple pays out. The victims, of course, are left victimized, out however much money for which they were taken. Did Apple do this? No, it did not. But a piece from 9 to 5 max has plaintiffs in the case argued that Apple benefits from the scams and could do more to protect the victims. The report says Apple filed to have the case dismissed for a number of reasons, starting with the fact that cards sold clearly say no refunds. That did not wash with the judge hearing the case. According to the report, U.S. district judge Edward davila dismissed some of the claims from a class of plaintiffs that said Apple aided in the fraudulent schemes, but he did say plaintiff's plausibly alleged the company did receive some of the proceeds from the fraud and failed to appropriately reimburse the victims. The next stage in the case will be discovery according to the report where Apple will be required to hand over relevant information about how it handles such scams, no word in the piece on a timeline for the case. Apple TV plus issued a press release Thursday saying that the series swagger has been picked up for a second season. The biggest one being if you see a cat in your community and it has been spayed and neutered, it has an ear tip or you know that there's a caretaker that cares for it that confirms that the cat has been fixed. Just let it be. Just let it live in your community, let it be a part of your community. Don't take it to the shelter. So that's a little bit of what we have done and what we will continue doing is just making sure that the content that we put out be it video via social media post via flyers, door hangers, it's basic and it's very simple to understand actions that folks can take to help cats. So if you are running a grassroots organization or even just a community group, say, you know, 5 people in your community and you wanted to spread the word about TM VR, is the best thing to go hanging up flyers or door hangers. I mean, are there some best practices because there's a lot of labor involved in all of that community outreach. So what are the things that you get the biggest bang for the buck in terms of getting the word out about being able to help community cats? You know, I think community hats have worked community in it, so I think the number one most effective tool that can be deployed in terms of educating people and bringing them along in our intent to help cats is word of mouth is actually meeting people be it knocking on doors or maybe going to a community festival where you know you got a lot of folks within the community are going to be present and just engaging in conversation. Asking questions, supplying facts, data, tips that is really the most persuasive and the most impactful way to make a difference, right? Social media, digital marketing, they're great tools. They allow us to reach broad amounts of audience, but it's also a very cluttered and impersonal medium. So if you are a small grassroots organization, just make sure that you are deploying tactics where you are face to face with a community where you get an opportunity to talk to them, where you get an opportunity to listen to them as well, right? Because I think part of marketing is definitely educating folks and kind of storytelling and bringing folks along in our journey, but it's also listening to them learning to them to understand what types of messaging what types of content what type of things we can put into play to really be as effective as possible. And I think that's critical for cats because it's cats, the other thing I will say, cats as a topic that people love. People love cats and the majority of people love cats. And so if you talk to folks about cats and say, hey, I want to talk to you about tasks. Probably a barrier will come down and people are like, sure. Because cats tend to be an animal that people. People like people relish. So make sure to go to the field and talk to folks. That would be my number one advice. Can you just share a little bit about what the best Friends network is? Yeah, so we have a it's basically a collective or a gathering of shelter, rescue organization, animal welfare organizations all over the country that sign up to become best friends members, right? One other question that I, you know, we've talked about the impacts on shelters, but there are in a North Carolina Texas. I mean, there are rural areas that may not even have a shelter or a very large shelter environment, but yet there is a tremendous need to assist and support community cats in those areas. And I get the sense that best Friends still is committed to assisting and helping those cats too, even if they might not be a statistical number in the database because you're saying it's community involvement. It's getting more individuals involved. Therefore, in your opinion, are there differences between the urban community cat versus a rural community cat? I think there is a pretty big similarity across the board between urban suburban rural community members and community cats. And that is we recently completed a study that kind of went into understanding community members perceptions towards community cats, how they felt about them, what they do, what actions they take if they see them. And the biggest learning that we got from that study is that people really love cat no matter where they are in the country, no matter what type of environment rural urban suburban they live in, they want to do well by cats, which leads folks to the action of wanting to take them to the shelters so that they can find a family so that they can be adopted. And that's awesome that they have these really positive heartfelt feelings towards cats, but unfortunately what happens is, you know, if cats are taken to the shelter, shelters are overwhelmed, they may not have the capacity to handle all the intake that comes to them or like you mentioned some rural areas may not even have shelter, their shelters may be very small. But I think it is really about making sure that no matter where someone is from where they live, if they're in a big city if they were in a rural town, they understand that cats can live perfectly healthy balanced lives outside as long as they are beta neutered and they can't continue to reproduce. And the study that we did, we did interview role and urban community members and there really wasn't a big gap with regards to their relationship to community cats, their perceptions on community cats. They just wanted the cats to be okay. That's the biggest learning and the biggest takeaway from the study..

"Are there certain parts of the country that you would feel are more community cat friendly than other parts of the country? So I lived in New York City that actually my first job with best Friends was in the New York City operation. And I feel like in New York, you have the concept of bodega cat. So it was completely normal to walk into a convenience store and just see a cat. Or sleeping on top of a lobe of bread. It was common to seek hats in the alley of your building. And I feel like people in the city coexisted with the cats. There was this understanding that cats were part of the Tapestry of the city. And so most people were supportive of it, so much so that there's an Instagram page dedicated to bodega cast. Millions of followers. So I would say in my experience and having lived there in New York is probably one of the friendliest places that I have encountered. And are there areas of the country where it's more challenging for community cats? There have been some parts where there's just no or very limited access to even Spain or neuter resources even private practices, I know that best Friends does a lot of data collecting and information collecting and I didn't know if you had seen any sort of specific trends in areas where there are those shortages and maybe there are other challenges at play too in those regions. And there have been conversations sort of about the north and the south and southern parts of the United States. You may be that's more challenging for community cats on a population standpoint. I mean, the climate is better, but maybe there are some more challenges on the population side of things. I don't know what your thoughts might be on that. Yeah, so the data tells us that there's three states that are right now the top states where cats are dying and shelters. And we know that proportionally a lot of those cats can be community cats. Those three states are Texas, California, and North Carolina. Some of the challenges that those states face are as you well mentioned access to care, you know, actually post pandemic. We've seen access to care, veterinary care, spay neuter, services. That has become a challenge and is right now one of the barriers in getting us as a country to know that we can as many cats as possible. But then also in the specific case of California and Texas, there's where there's a lot of people, there's huge population, sizes, there's a lot of cats as well. So the population size also impacts the amount of pets that need to be saved. So a lot of the work that my team is doing that I'm doing is really focused on those three states, California, Texas, and North Carolina, and using a very strategic making sure that we can, from a marketing perspective, focus on specific communities within those three states. So we know within those states which are the counties, the towns that have the biggest and so making sure that we support those communities through marketing materials through like I mentioned earlier inspiring them to make a difference because this is about community involvement. And then figuring ways in which we can solve for the challenge that is access to care access to veterinary care and Spain.

It had much higher level polish than i was expecting it to when it came out and of course i was delighted because that meant that you know the they had been making really good progress in the eighteen months or so that i that i was sure they had been working on it and i hadn't been able to see any of it. I did eventually get to see. Fasd networks me been able to see one set and it was an an. It was an early version but Davila quite a bit different to you from like again i. Yeah it's really it's a total. There's initially i thought maybe it wasn't as big a change. And then later. I realized that they still Like my thinking about this is gonna change. There's a of redundant networks in there now. And i think that they they're they're just running the old one because they can't write. It's just been there next to the one that they're actually using so initially. I was looking at it and i'm just saying that works. We're like yeah. This is kind of like the other network. But then i there's so there's a set of networks where the biggest networks are the networks. They take a raw camera image and then they processed into this very high dimensional abstract space so they. They're basically doing that thing where they have had this very large crystallized block of abstract knowledge about this. Which has been generated through this back propagation process so it's not designed to be understandable right. It works but You know you can't take it apart the way you can take apart a car engine. They're black boxes and innocent. They're not total black boxes. But it's kind of a black box and then there's another network that basically takes that block that giant block of crystallized understanding from each one of the cameras and then it combines mauled together into one big block and then there's another layer that where like it basically has those blocks going back in time for the previous images right for one frame ago. It's a the cameras are thirty six per second so you know a thirty six of a second ago in two thousand six and three thirty six going back maybe sixteen frames or something like that so it has been it has a network basically looked at the history of how this unified block has evolved over time. And then that thing generates a set of outputs which are used to drive so it generates a set of outputs which are basically here all the cars here all the stops here pedestrians. And here's how fast they're moving and here's what direction they're moving in and you know..
