"Once. We finally got permission from joe wilkes to speak with sam. Pegg joe's best friend from high school. The floodgates opened. Sam told us that she loves joe and doesn't believe he killed yvonne lane march thirty first nineteen ninety nine but regardless she also said he told her months after the murder that he did it and he told her that before. The murder even happened. That david thorne yvonne's boyfriend wanted joe to get rid of her. I know david wanted him to okay. And i was under the impression that they've was gonna pay him to. Did he tell you that david wanted him to do that. He did he tell you that multiple times. Okay okay before. It happened or like months before we had never heard this before. This was never in any of her statements to the police or grand jury and we consider she was making it up but for what purpose sam even said but i guess you gotta get david out too. So why would she implicate david. If she thinks helping joe requires david getting out. Well if she was telling us the truth for she knew and sam did tell us that she wasn't going to bring up any more information to the police or on the stand than what they told her. Joe had said and joe did not say this so if none of this was known to the police. She wasn't about to tell them. How confident are you. The joe had made mention his friend. David wanted his wife killed before it happened. Actually david had some party so they joe have been telling you for some time that david wanted him to do this. Okay and did you think that at any point in time he was actually considering doing it now. Okay or do you believe that. David masterminded it. No i do. That's my gut feeling He wanted it. And i think he would just find i. I would say as you would always looked up to date whenever day. Moving paul week. I remember driving over david's Time especially when david Divorced now started out there. Like it's interesting. Sam mentioned these details. Of course we know that. You von and david were not married and all kids were not david's but sam didn't sam didn't care one way or another. None of this meant anything to her and to us. This just shows how little sam was actually involved or has paid attention to the case. She even told she has other shake going on and doesn't read the news or watch. Tv so the fact that she remembers these details although not accurate does tell us. She's telling the truth about what she remembers. You know david. And he's just telling you buddy miles. And i look up to once killed his wife and let them assiduously would never do anything. He would never live but did he. We were baffled. Of course we considered the possibility. David was involved but we had never come across any evidence other than what was presented at trial until now and this was new something even the police did not know. So what was going on. We had one more person to talk to you before. We confronted joe a few years back. A woman reached out to sue on facebook. She wrote her a message saying that she had information about the night of the murder. That could help. She had seen something about david. And joe either on social media or tv and it sparked her memory so we tracked her down to hear from her ourselves. We're now but my boyfriend has time we saw in there that night. We know at night time. This is jill. I'll leave her last name. Out for privacy sake. Jill told sue the night of the murder. She was at the mall with her husband. And they bumped into joe. Outside of the comfort in jill new joe from school. They were actually good friends. We just saw him and he's like yeah. I'm saying at this hotel room the night you know and so you'll bumped into him at the mall. Okay staying the night. There and his friend was picking the morning. Does he say what he was doing their pay mark. Good though gel. That's it. that's it birthday. Party swing party or something. He asks one in command. There was pizza. I'm like no. We're good like he was like. Hey you know. My friends kid is having a power birthday party. Do you guys want to bring you know on the island because we had a baby nine. Yeah the right there as he was starting to was a party like no like no good so he said it was a friend of his kid. Okay i think it's interesting. We were looking for a high school. Kager party we never put it together that it could have been a friend's child or they party now one of joe's previous statements about what he was doing at the mall that night. He said he was actually attending a party. That was the purpose of him being there. And now we have jill telling us the same thing. In fact joe even tried to call jill from prison to get her to be an alibi for him. And i mean i never but give me thinking like you know maybe and tell somebody some at the mall but then it's like it's not really that big of a deal so i saw somebody mall one nightmare right so i'm sure it's just a coincidence and whatever but the so what is now we have corroboration that one of the stories joe told us about being the mall for party might be true and now we're more confused than ever. If joe was at the mall for a party. Was he going to leave. Poff a hit and come back. I would think not but then. How do you explain rose and chris who are backed up by sam. I don't know it was so confusing and so it was finally time to talk to joe wilkes. Y'all i am so excited to tell you once again that pretty litter is a sponsor of murder in alliance. And i'm excited about that because everything i do for. My cats is rooted in love. Like letting my cat sleep on my head every single night waking up choking and hairballs but that's love and that's why i use pretty litter pretty litter house hands down. Been my favorite cat litter. I have ever had in my life. I've tried every kind of litter expensive cheap bodega litter. This is the best one. It's lightweight dust free and it's ultra absorbing crystals trap odor instantly and up to a month. I have three cats. So when i say this.

"At this point. I've been in touch with david thorne for nearly two years. David has been in prison for twenty two years for allegedly murdering his ex girlfriend yvonne lane on march thirty first nineteen ninety nine since then david has adamantly proclaimed his innocence and the bizarre murder case and conviction has been featured on multiple news tv e programs and so for the past two years. They said he told them he was in town for a job and they said that job was to kill a girl. The card joe allegedly wrote his phone number on for. Chris was presented at trial to prove that joe was there with them the native the murder and at this point. We don't really question that they were all there together but what happened while they were there is what we wonder about by trial three months after the murder some details of what they remembered changed from what they'd set in their initial statements and then a bit more change between those statements. The time they took the stand six months after that rose initially said joe was in white pants and a white track jacket by trial. The pants were black. Rose also said that. The knife that joe showed them was definitely not a pocket knife. She said it was an eight inch knife in a sheath by trial it was a pocket knife. We tried to find rose on our first trip because we had many questions about her statement. We wanted to know why it changed and also about something. She told police in her tape statement. "'cause he was like oh fuck if there is drugs and stuff in here we ought to get rid of it because it's coming back to us you know it's like all everything is possible. I think what i see here. Look there again. There's no smoking gun that tells me that david is one hundred percent innocent. I strongly questioned the investigation. I even more so question. Joseph wilkes i do see plenty of scenarios where joe could be guilty. David just collateral damage. I also see scenarios where we have other suspects that i have to believe. I've not reviewed the trial transcripts but one thing. The point out here is joe. Had no trial he confessed. And then he testified against david thorne and not over overly whelming lee convincing in his testimony against david thorne. Either i think you pointed out that he on your show that he says. I don't know it seems to be the most common answer that he gives while on the stand. I don't know i. I see i see a case where we have other possibilities. We have other good suspects. And i can't believe the defense even made reference to these people. The whole thing here is. I've always said that you're homicide or the the the victim if your family member of a victim your cases only as good as the desk of the officer that it your case file lands on and that's the unfortunate truth of these scenarios and obviously there are some better police forces than others. That will always be the truth but one thing that gets lost in a lot of these true crime cases especially the ones that are solved. Is you know we've presented some cases here in the garage where you get these guys that just get bomb. Frequent lawyers did they. They're happy to take your money but they ain't going to do. Any work for referencing may paid a lot of money. This was a private attorney that they hired david's family they again. They were broke. They used they had money to hire this private attorney. And the defendant is usually blinded by the idea. Oh this guy cost a lot of money. He must know what he's doing. Well i don't know if this guy knew what he was doing or not but he didn't act that way or conduct himself that way. He called three witnesses. The guys on could be facing the death penalty. Were reminds me a lot of the ryan ferguson trial because you have yeah one guy confessing to the crime. The other guy. Saying i wasn't one..

"So if he wasn't there with the purpose of being paid to commit homicide why in those statements is he there he at all one statement. He went to invite her to a hotel party in one statement. That's why he's at the hotel. Yes in another statement. He's there to have sex with her. Jim she could have rejected and he flies into a rage does something that he almost immediately regrets and now lucky him see. That's one thing that the other issue that. I have with getting away from the possibility joe wilkes as the actual murder. Because you know you said well. He didn't have much of a record or didn't have a record in and he didn't do drugs yet by his own admission in that confession regardless of how they got to that statement it is still his sworn statement at the time he says i did. I did some drugs at night Before going over there to kill her and then later his own words again to save my own ass. I said you know. I had to tell them that. David thorne hire me. And so it's like. Is this guy smart enough. And you said he's no dummy. Is he smart enough to creating ways to save his own. I think i was. I was so high on these drugs when i killed her. I didn't know what i was doing. I was out of my mind man. Oh if that doesn't work. And i need somebody else to to save my but i can blame some of this on david thorne and may maybe i called him the next day for for no reason other than because we were friends and i know that maybe they might be able to be called to confess called him to confess things and we see if in fact all the things that everybody says about david. Thorne and joe wilkes relationship is true other than this murder part given joe's background and how he was raised in the horrible environments that he was raised in and then david being a little older. It looks like david kind of takes him under his his wing. He you know we know david's a car guy. He gives them some kind of junk car. That that somebody like david could fix up and he would. He would actually have a vehicle so he could get to and from a job and david says you know like look. I'm not doing. I do favors for this kid. Because because i hired him to kill my ex girlfriend. I did favors for the kid because wanted to help them out. But to i would help him out and it would create inconveniences for me now. Now this guy's always reaching out to me. Can you drive me here. Can you drive me to my..

"Garage today. We have maggie freeling. Some of you may know her from the disappearance of mara. Murray documentary series. That was on oxygen a couple years ago and i believe right now the people they want to watch it. It is currently streaming on peacock. Maggie is also the host of the unjust and unsolved podcast in. She is conducting an in-depth investigation into the murder of twenty six-year-old yvonne. Lane a case that some say is unsolved because they have convicted the wrong man in this case l. o. maggie before we get into the meat and potatoes of this case in your investigation all of these years later. How are you doing. And how did you find. This case. also is so great to be back with his eyes. I'm doing alright recovering from covert actually so. My voice is kind of gone in this case very long time ago i guess at this point working on it for a year maybe almost like two years ago. I found this case. I was in touch with david. I don't remember exactly if i came to sue his wife or if she came to me but it was brought to my attention. As you know this case twenty two years this guy who a lot of people say has been wrongfully convicted for all that time and hasn't had anybody. When i first talked to david he told me his case was dead in the water and he was right. It was used up. All of his appeals. And it's an incredibly complicated cases. We'll get into so. It was really to find people who were willing to take it on pro bono and so i decided to look at it. I didn't episode four on justin unsolved. And afterwards i was just like i can stop thinking about it because there's so much here on it kind of drove me little crazy and i just said you know what i i need to do. An entire series on this david thorne is one of the men that have been convicted in this case and he was an ex boyfriend and the father to one of your vons children and he's been locked up for over twenty years in this case. Now this is in ohio so at alliance ohio and it was a case that actually received. I was a little surprised at received more media attention than i had speculated on going into it but and there was a book written on the cases. Well i couldn't find the the title of the book. do you recall it. The author of the book. If we're thinking about the same it wasn't on the case it was brent turvy. He's a forensic expert. He looked into the case and he actually has two books. One is on what not to do it. A crime scene features this case and another one murray similar so they are actually to forensic textbooks now if you could go ahead and tell us a little bit about our victim here you von lane. She's a mother of five children. Is that correct. Five kids twenty six years old. The oldest kid at the time was ten. She had her first cave when she was sixteen shoes. Jehovah's witness from you know what family has said in. An friends said at the time she was trying to get back on track trying to become a devout jehovah's again but she also had five little kids and had to make ends meet. And you know what we know. She wasn't really working. She was on welfare and she was kind of struggling to take care of all the kids. One of the children's fathers different dads he. His parents were taking care of one of the kids who is disabled. The oldest kid lived with his grandparents to. She was taking care of three of the kids on her own. Three of the children living with her at the time of the murder. Yes and actually. There was the fourth child with her at the time because she was trying to get custody back of him. The vinnie the disabled boy who actually becomes kind of a big part of the story as he was there when the murder took place. He was in the home as well. Brandon preston vinnie and trenton rural. Home and david thorne. One of the men have been convicted. In this case of her murder he knew her from high school and then they reconnected. Years after high school is that correct. Yeah so they met at a vocational school. She wanted to go to school for cosmetology and he was going for decal making david's really big into cars so they wanted the same vocational school either. Junior senior year of high school and saw each other in the hall didn't have classes together. They were taking different classes by. He saw her in the hall and was really struck by her. Everything we've heard is that. She's absolutely stunning. Knockout babe. I guess a couple years later he they were at a car parts shop. She needed to fix her car and bumped into him and he was like. Oh al sircar for you. And that's kinda how it how it started and david is the father of brandon so where does brand and fall in the order of children and from my understanding. He finds out about having a son with you. Von after brandon is already brought into this. Yes it's really complicated as we get into later in the season the children in her pregnancy is but brandon is the second youngest her. David were together somewhere around about a year. They broke up she because the father of a couple of the other kids. None of them were confirmed. The only confirmation we have is brandon from a dna test with david but so the alleged father of a couple of the other kids hearn. Him were on and off for about ten years so they had a very complicated From what we understand actually abusive relationship so her david broke up because of him. You know he's the father of a bunch of the kids. there was just. He was always going to be in her life things tumultuous in her david. Kenny went separate ways. She calls him. You know a couple months later. Maybe nine months later. Saying i had a baby. It's yours that's kind of how that happened. David was dating another girl at the time. Who was kind of like the hell. You're ex-girlfriends calling you and you. Now have a kid une things out pretty complicated for the two of them from what we know they were trying to. Maybe get back together. David says that they were talking about that. We have heard from other family members that you know there were talks of engagement rings. So david von were carrying on behind the scenes relationship while they were both seeing other people after brandon was born and they found out they had a kid together. Saw gets really complicated. Well and i love the way that you describe it in your series murder in alliance. Because i think it really sums it up very nicely in a nice in the package where you say eric. The other guy who fathered multiple of the children as far as we know that's always been the the belief or understanding. He's the bad guy. He's he's somebody that she just can't seem to quit for whatever reason maybe it is because they had such a long relationship or they had so many children together. He's always going to be around and david and her just didn't work out mainly because of this other guy because of eric always being there and you said that you know david seemed to be kind of the the more stable individual that she would kind of turn to when things weren't going right with eric or when she had had enough of this guy. Yeah i mean that's kind of what it seems like to me. I mean her. And eric from what we know. They would beat the crap out of each other like really physically abusive. I talked to her son. Preston in the interview. Eric's allegedly in the podcast. Eric is allegedly his father. He thinks eric says father many says yeah they were pretty freely frigging violent to each other. So you know david every account we know. Is this kind man who would take her back. He loved her and take care of her. During those off times with eric and you know we bring up the fact that we don't know who the dad. Nah we don't you know for certain know who. The dads are the other four children. Not in any way to shame her anything but it does get complicated. When you're talking about. Who could have done this. There are many multiple men out there who could have fathered her children who we've heard rumor that she had been pregnant with their children. So there was a lot of people that needed.

"When i first learned about david thorne's conviction i'd really only heard the basics about the woman at the heart of the story a new yvonne lane had five kids. I knew she was gorgeous. But i didn't know a lot about her life or personality. David in fact spoke of her in glowing terms at first but as i dug deeper my understanding of this twenty six year old woman started to evolve. She was complicated. Of course we all are but she was more than that. She loved her children yet by their own accounts. She did mistreat them sometimes. She allegedly sold her body for money and yet wanted to be a good jehovah's witness in the eyes of her parents so confused. I circled back to david a few months into my investigation. He agreed yeah. He hadn't told the full truth about yvonne when i first asked because he didn't want to quote be smarter. It's tricky to talk about someone when they're dead nothing. Yvonne did could have justified nearly decapitating her and so david didn't talk much about the qualities in her. That people might judge but to understand a murder of this type. One in which i believe is personal. You have to understand the victim police. No this of course. That's why one of the first questions they try to answer in a homicide is. Is there anyone who would want the victim dead. Most homicides are at the hands of someone. The victim knows so. It's an obvious starting point yet. According to the case file and yvonne's murder investigators in this case didn't bother interviewing a lot of the people closest to her. There are no records of interviews with her sisters or her father. We only know of her mother. Tanya speaking to the police as well as a young woman who as far as tanya new was yvonne's closest friend..

"This truly could be the rest of david's life. Because as i mentioned david doesn't have a lawyer anymore and he ran out of money and all of his first appeals and he's had a difficult time finding someone pro bono to take his case and that's been a battle in itself because nobody wants to do anything without money. You know russian. That i've learned the hard way outta sight outta mind but he hasn't lost all hope and that's because he's had sue on his side. Davis dog caja. You'd be here. You know russian. That i've learned the hard way outta sight outta mind but he hasn't lost all hope and that's because he's had sue on his side. Davis dog caja. You'd be here. The motive child support thorne was ordered to pay to the untrained listener. This seems like a pretty clear cut case someone confessing in a good motive but when you start digging and talking to people and going through documents the more complicated things get and it seems like everyone around. A yvonne had a motive to kill her. I i came across the case on the website injustice anywhere which has since become a staple for my research into lesser known conviction cases for my other podcast unjust unsolved. I covered an episode a week telling the stories of people who believed were wrongfully convicted. David was one of them. One of the incredible things to me about. David's case is that it actually unknown there had been other media coverage before the attack grabbed headlines as police hunt for a killer. Dwayne poelman who you just heard in. The previous clips is an investigative journalist. Who looked into the case for three years and at the center of his investigation. Very serious question. Did the system convict the wrong man. However that was over a decade ago. "Other artists use the lockdown to unlock creative pathways. Finally getting to that project they'd always wanted to explore. We've seen terrific work along these lines from saxophonist Tim Byrne and his regular collaborator, guitarist and producer David Thorne. Each made a solo album this spring. One created by tourney is a deep lesson, an immersive texture, using little more than his guitar, an amplifier and some basic pedal effects. For saxophonist Chris Potter, the musical equivalent of a new sour dough starter was something even more laborious. He startled the Jazz world with an album called There is a Tie on which he plays all the instruments, not just saxophones and clarinets but also bass, keyboards, guitars and drums. That's a deeply impressive feat, but of course, also still solitary. More and more artists have also discovered ways to connect across the ether collaborating from their respective bubbles. Trumpeter Dave Douglas made a digital album this way called Overcome with singer songwriters Fay Victor and Camilla Mesa and a few other partners. They created the music in pieces, passing files back and forth, but the sound of their communion makes it seem as if they're all in a room together. That's precisely the image they're seeking to evoke and the hope that they're holding onto in the meantime, together. Way, like, Never So sweet for NPR news. I'm nature then. "Dez Ron Douglas from their apartment in Harlem Quarantine Lockdown. How's everyone doing? I mean, if you haven't lost your mind yet, God is good. You know, if you have lost your mind that's cool to Douglas and younger turned those sessions into an album they call it force majeure after the common clause in contracts that usually only gets invoked after a catastrophic event. But the spirit in their album doesn't suggest despair. It's full of sustaining life and connection. Other artists use the lockdown to unlock creative pathways.
