One team in Milwaukee they have the best record in the NBA and they are destroying teams winning by an average margin of victory of more than twelve points per game now of the eleven teams that have had a double digit margin of victory over the course of a season. Eight have gone on to win it. All Doris. Is there something that stands between Milwaukee and the NBA Finals? Yeah this is a great question. So in their eight losses the one thread that is consistent throughout those are teams are averaging sixteen point nine threes and philosophically. Their priority is protect. The paint. First and foremost they are so elite. At that that we have not seen this kind of rim protection in the modern NBA. With the possible exception of Spurs team that had both Tim Duncan and David Robinson but the fact of the matter if a team gets hot and really can create shot opportunities then. I think that they can be beat. The other thing that happens is your and you saw in the All Star game. I'm anxious to see how he changes the dynamic the Miami Heat. You know this. They're going to play hard defensively every single night. They're going to mix in one of the most effective zones we see in today's NBA and Eric's bolster is outstanding coach. So right now sitting in that fourth spot how far Jimmy Butler can take them. That'll be interesting. Those young guys. Right Duncan Robinson Tyler Hero Kendrick Nunn all those guys who have performed so well in the regular season when the calendar switches. "It's if you look at the social science, we have there's definitely some racial bias in arrests. There's bias that every step charging decisions to someone gets arrested. Are we going to advocate against them? There's bias there. There's bias in how courts react to people of different races. There's no question that the thing were predicting if we're predicting arrest. The thing we're predicting is bias to some extent, and that means that if we pretend that those numbers are really crime numbers instead of arrest numbers, then we're going to take this bias and sort of wash it clean and end up with these numbers where we're saying that it's neutral receiving that its objective. We're saying that it's fair, but really, it's a reflection in part of bias through mathematical object TV and scientific city number washing the. Numbers are kind of moral anesthetic. There is another fascinating example, that you talk about in your research about the inherent flaw of using history data and that's the one of stop and frisk policy, New York, these policy that directed officers to stop search and arrest people industry, can you just explain what happens and why was problematic? Well, it's, it's still happening in fact, so New York is currently developing a new risk assessment tool. There's a nonprofit in the city called the criminal Justice agency CJ that does the risk assessment and they are developing a tool to assess the likelihood that people will be rearrested, if they're went out before their trial, and what they have announced is they're going to base these predictions on data from two thousand nine to twenty fifteen now for people who follow New York closely bell know that, that period. And includes the height of stop and frisk. Twenty eleven was the year that had the most stops a court held that that was unconstitutional and forced the police to stop. And what that means is that the data had a pattern of people being arrested, who if the police were obeying the constitution would not have been arrested because they wouldn't have been stopped, and so you have extra arrests in your database. So then if you're thinking about what, what about someone we released tomorrow? What's the risk of them being arrested? The problem is that the old data is not supposed to be a guide to their likelihood now because the police activities of the arresting patterns supposedly hopefully have changed, there may be watts of injustice. But in that rare case we actually have a court finding officially that it was unconstitutional and unusually crisp case of this problem and I'm eager to see what they'll do. Talking about blind trust earlier. I just want to get back to that idea seems to thousand twelve and I quote here from your research. You say that there were at least twenty laws in fourteen states that either created or standardized? The use of pretrial risk assessment tools. The tools received broad and who's Yass tick support. Is that part of the problem, also these blind trust, and are you up to mystic about society coming to terms with it? I think we've got a long way to go. And I think you're exactly right, that this is a cultural problem you can think of it in terms of you have imagine a city council meeting, and some vendor says, I have the power of AI for you that will solve your problem. Dr crime down or will make social services more efficient, or whatever it may be people who are in positions of thority those political leaders. They don't feel bold. To ask questions when they don't understand what's being sent to them, and they don't they don't wanna look foolish. So are we still too trusting of a are we slowly realizing that these blunt, trust is an issue, or I think it's, I mean, we're waking up to our habit of pretending that numbers are morally neutral, and this isn't just a I these aren't just brand new technology. Some of these ways of using numbers have been around for many years. But hey, I is a shiny, new term. We're marketing the same stuff, so risk assessment, for example, has been happening in courtroom since the nineteen twenties. But we're now using it more and adopting it widely under the theory that we have some magical new technology, now it is true that the new techniques that those are really helpful for some things, and improving the performance of some systems. But the problem. Problem that we have with numbers in our politics with the way that they blind people to the moral stakes things that goes much deeper than brand new technology. Is it also? Because maybe the people who design, these algorithms are engineers, mathematicians, people that are not asked to think of the ethics behind the technology and on a trained in it. That, that's exactly right. And we're not making ethical deliberation. And we're not making political questions, even occur to people in engineering roles it's not part of their training. It's not the case that we doesn't necessarily would need an engineer to also be an emphasis, we need people to have their intent out. We need people to have their eyes open and be looking for possible problems, so that those problems can become part of a broader conversation. So are you flat out opposed to these tools? I know some argue. News stations, like Human Rights, Watch are they are I have not taken a public position on, whether they should be used or not, certainly, I helped to create this recent statement, this summer from one hundred or more civil rights groups one hundred twenty groups that says that these tools, ideally, should not be used. And then if they are used, here's how to mitigate the harm that they can cause. And so I certainly agree with much of what is there? It's also worth pointing out that part of my work is that I'm advising jurisdictions that are working on bail reform through MacArthur foundation project and part of our role there is to provide neutral, objective, information about some these risks including these risks to civil rights now. Let's talk about the big picture for minute decision. Making algorithms that are used in the public sector, more generally not just in the courtroom and. And what can we do to make sure they are not projecting bias, owning -taining inequality in what can we do to make sure there are ethical fair? I think we need public understanding in a lot of these context. We need people to be able to understand question how these systems work. I think the idea that technology is something that this other group of people do that we, we've engineering to engineers, and they'll figure out how to do everything is really dangerous. Because what ends up happening is they make the moral choices for us, for example, with risk. How much risk is high risk where we put that cutoff, at what point do we but the person in the red box that says you're risky? That's a political question. Not an engineering question. But today engineers are often involved in deciding that and other people who have a lot of concern about it or who's. Are at stake like members of the community might have a strong opinion about how many people should go to jail or not, they're not having a voice in these discussions. And so, I think what we need is a culture of has been harder questions about how these tools are built, and we need a culture of greater inclusion in setting up the tools, turning the dials and also deciding in some of these cases whether to use a new out horrific or not should we have them open source is that some aim to that's one way to make sure that we have the ability to check on systems. There are other ways as well, for example, if a company built something that the government is using we could have outside experts come in, and take a look at that code and check it, even if the code is in public, the part that I think, is really important is that we not allow the code to be a secret either a government secret or a company secret of the company that built the tool. All to you the fact that private companies are building some of these tools for the government is not any shoe per se. Right. It can work as long as we have a way to check on them. That's right. The problem is when these companies say that their code is a trade secret, but they're code is also helping decide who goes to prisoner jail. I don't think those things should be possible at the same time if you want to be a company where the code that you make is a trade secret, then you shouldn't be in the business of making code that is making government decisions that alter people's lives. There is a lot of talk these days about algorithm, accountability and bias, take giants are building their own tools to detect bias to correct. The algorithms IBM has Google has or you look to mystic that we're grappling with the understanding that ethical thinking should be a part of the design as well as part of the development of these tools. So. I like the idea of both thinking about how do we design ethics in from the beginning at the same time, also looking at what we've built in trying to check what its impacts are, but I worry about the current crop of company conversations about ethics and people saying, we have these, these tools that we've created that will assure fairness because there's something a little bit slippery. That's happening with the language that I think is very important and very worrying, which is that when you have technical people trying to design a system, and they're asking very detailed, very specific questions about the rate of false positives, or false negatives. So how often does the system make mistakes for this group versus that group, they'll decide that having the mistakes be equalized or something like that? Some very specific thing. We're going to call that fairness, and then we can just prove that it's fair because we've decided that fair, just means this mathematical proper. Eighty but I think the reality is that fairness and Justice are much richer. I'm glad they're checking. I'm not. I don't want them not to check. But when I'm afraid of, is the will thing that by solving one of these small problems that we've solved the larger problem. So are you up to mystic Kenny, I can digital technology enhanced human rights, because your research, really is at the intersection of technology and human rights? Right. So our people like you gonna win the battle. Well, the battle never ends. I'm a Buddhist. I believe change is always happening. There's no one resolution. I think that we pay more attention to the things that go wrong. And that's a good thing for us to do. That's how we make the world better. I do think it's possible to lose sight of the benefits of technology in the midst of our work. I heard something once someone said, you know, I was promised a jet pack in the future. And all I got was the sum of human knowledge in my pocket. So even thinking about something. Like the human rights to knowledge and information the extent to which Wiki pedia has expanded that around the world in many Wang, which is for people in many communities or for people like myself who have disabilities different ways that technology has opened doors. Sometimes physically literally, open doors for them. It's the same big story when we focus on the story of the problems were missing some other pieces at the same time. I think when we all look at something like black mirror, these other imagine distortion futures. It is true. We could end up in a bad place like that. And so I think it's up to each of us to make the world be the way that we think it ought to be.
