"They are treason, bribery. And the third one. Is high crimes and misdemeanors. That sort of seems like a pretty archaic term. So do we know what is covered by high crimes and misdemeanors? I think I do high crimes are obvious that is they are violations of the criminal law that deal with matters of state that are very high and Madison and Hamilton, both talked about the criteria involving abuse of office, abusive government. So that Bill Clinton who committed a low crime, not a high crime was improperly impeached. Then you get to the term misdemeanor. That's where I think much of the controversy lies misdemeanors at common law could be serious crimes under Blackstone. 's a treatise. You could even have a capital misdemeanor. You could execute somebody for committing a misdemeanor, a misdemeanor was genre of crime. It carried kind of different consequences than felonies. Now over the years, we've ab-. Polish, the distinction largely between misdemeanors and crimes, but we've not abolish them by making misdemeanors non crimes. We've abolished it by making misdemeanors crimes by putting the misdemeanor category into the crime category. So the changing circumstances have actually strengthened my physician. Okay. So give me a couple of examples of what kind of actions would fall under high crimes and misdemeanors. Okay. I'll give you an example of mystery. Alexander Hamilton notoriously was seduced by a woman to have an affair. And the reason for the seduction was the man husband wanted to extort him and he paid the extortion money, and he was caught and he was accused of paying the money from the treasury. If he had paid the money from the treasury, it would be a high crime. But if he merely paid the tr- the money from his own pocket, it would not be a high crime. It would just be paying off somebody of to cover up an affair Hamilton understood that that distinction when he helped write the provisions regarding impeachment. And I think he had that kind of situation in mind. So a high crime and misdemeanor is something that involves kind of corruption of government. If President Trump were to really obstruct Justice, the way president Nixon did by bribing witnesses, paying hush money of destroying evidence, telling his subordinates, the light, the FBI, those would be high crimes. That's the only example I can think of in modern times of high crimes that would justify impeachment of a president. And those were the crimes that were in fact alleged it was not alleged that it was a high crime to fire Archibald Cox was a terrible terrible thing to do. Archie Cox was a close friend of mine. It was a boring thing to do, but it was not a crime. And so that was not included among the high crimes and misdemeanors asserted by congress in their Bill of impeachment. So then by this standard Trump having Michael Cohen pay off his mistress's would not. An impeachable offense. Then right now not even close. First of all, it has to occur while you're president. Maybe conceivably, it could occur in the run-up if it helps you get elected, but that wouldn't even be close case paying. Somebody offers lost, not even crime you're entitled to do it. People settle cases all the time. I don't understand actually why this woman who was recently arrested is hero among some people. I mean, she had a voluntary consensual sexual affair and then wanted money and for her silence that's not a particularly commendable act, but it's not a crime to pay for somebody silence as long as they're not a potential witnesses in a Ohka case will then I do want to ask you about theory that's being batted around about that. Third payoff that Michael Cohen made to playmate named sheriff chard who supposedly was impregnated by the former RNC finance chair, Elliott Brady. There are some who speculate that Brady may of. Paid that one point, six million payoff on behalf of Donald Trump, and indeed the agreement uses the same pseudonym David Denison that he used in the Trump agreements with stormy Daniels if it comes out eventually. And perhaps if Michael Cohen going to flip, maybe we'll see this if it comes out that Trump had a major campaign donor, pay a million and a half to his lover to aboard a lovechild and keep quiet about it in December twenty seventeen during his presidency..

"The legal battle between president trump and the porn star known as stormy daniels is heating up daniels whose real name is stephanie clifford suit trump this week alleging he had signed a nondisclosure agreement that would have prevented her from discussing their alleged affair in two thousand six then we learned the white house had filed a restraining order against clifford last month to stop her from speaking out for more on this rejoined by dylann matthews a staff writer for vox dillon does it matter if trump never sign that agreement i'm not a lawyer so i can't give a precise advice on this but gouge her name argument in the sued trump used the alias david denison throughout this and neither donald trump nor david denison uh find the nondisclosure agreement that's at issue there are certain cases were lawyers are allowed to find things like that on their client's behalf and sogard you memphis trump and his team are going to make is that michael cohen his personal attorney i'll was acting in trump's statin have you through do that and so the argument that the ms clifford is going to make in her train is going to make is that a nondisclosure agreements the significant enough agreement that it needed trump's signature to be binding the press secretary at the white house sarah huckabee sanders was asked about all this yesterday and she introduced a new wrinkle in the story lets us into a bit of her exchange with a reporter at the white house the president has address these directly and may very well clear that none of these allegations are true uh these cases already been won in arbitration in anything beyond that i would refer you to the president's out cat outside counsel and then later a stormy daniels lawyer michael of a naughty responded to that claim of having already won in arbitration from sanders calling it bogus and baseless here he is speaking to cnn's anderson cooper last night anderson at this point you know about as much about this arbitration as we do because nobody bothered to tell us about it before it happened nobody bothered to invite my client to the party if you will.

"Oh on that note here to talk more about all of it peter baker chief white house correspondent for the new york times and msnbc political analyst shannon petty peace white house correspondent for bloomberg and danny savalas a veteran criminal defense attorney and msnbc legal analyst dna i'm going to start with you gingerly be very tender with those of us who are lay members of the audience especially the slow among us when i ask you to describe what this arbitration process is that sarah huckabee sanders is saying the president one the arbitration process is a form of alternative dispute resolution and what it means is companies love these big companies rich folks because they offer a private a secret way of resolving disputes in a way to hire and right exactly retired judges of will often become arbitrators it's a private court date you can resolve your claimed there usually you can define the parameters of this secret tribunal in your contract you can say there is no appeal if you read this agreement in everyone has access to this complete and this agreement the terms are so in favor of dd david denison whoever that may be david denison can pick the arbitrator david denison can pick this state that the law the laws of the state that he once david denison can decide that there is no appeal david denisot has all the power as to the arbitrator so that win sarah sanders said they won in arbitration they didn't really win the contract allowed them to walk over to an arbitrator of their choice and say give us a tro give us a temporary restraining order and you can see in the in the arbitrators order that she looked at it decided that she really didn't have a choice but to issue a tro and that was done without any due process why because the contract allowed for it that's why stormy daniels and her team hacked to invalidate this contract because it.

"Thousand sixteen and the same day inc a new entity essential consultants l l c the journal says cohen used that company to make the payoff using a series of elaborate pseudonyms and legal contracts the company was registered to disagree rests in dover delaware an office that helps people outside of delaware create companies here why would cohen choose delaware experts say the state has few disclosure requirements it gives you a way of moving uh moving money to wherever you want to move it without necessarily having to uh a say that a particular person um sent the money experts say that fits with this part of an alleged draft settlement agreement slate magazines editor says daniels text it to him in two thousand sixteen in it daniels would be called peggy peterson and trump would apparently be known as david denison cohen the white house and daniels deny any affair ever happened and daniels denies getting hush money in a statement sent by koa cohen however has never denied making the payment today the full transcript of a two thousand eleven interview with her was published by the gaza magazine in touch in which she spells out details of an alleged sexual encounter with trump at a resort in nevada in two thousand six she claims trump kept in touch afterwards and said he hoped she could be on his show the apprentice and at one time quote he told me he was going to give me a condo there because they were building a trump tower there in tampa experts say there's nothing illegal with establishing secret companies or even paying hush money as long as the case doesn't involve straight out black male there is nothing illegal about trying to enter into a nondisclosure agreement in exchange for payment of hush money but if daniel story and her possible payoff had been reported in october of two thousand sixteen could it have changed the election the first impression that the of course this would have an impact but we know how many things did not have an impact in this election particularly the release.
