And the jury in a kind of charged political environment goes ahead and finds her guilty. Both actually are for us to agree on second degree. Manslaughter and now Kim Potter comes up before a judge chew. This is Regina Chu for sentencing. And something really kind of remarkable happens. The prosecution is going for a 7 year sentence. In prison. Wow. 7 years sentence for an accidental shooting. And daunte Wright's family is, you know, piling on, they're like, yo, she should get the maximum sentence. She's not remorseful. And so they were there talking about how it was the worst day of their life, and of course I understand their loss. And Kim Potter does, because at the sentencing Kim Potter breaks down and she says to she says to daunte Wright, she says that the family of daunte Wright, I'm so sorry. I brought the death of your son, father, brother, uncle grandson, nephew, and then she says to the mom, Katie, I understand her mother's love. I'm sorry I broke your heart, my heart is broken for all of you. And this was so moving in the courtroom that the judge began to cry. This is judge Regina Chu and the judge basically says, come on, quote she never intended to hurt anyone, her conduct cries out for a sentence. Significantly below the guidelines. And so what does Kim Potter get? 16 months. And she's quite likely to be out in half of that.

This is a guy from the process of being arrested and Kim Potter went for her taser and unbelievably got her gun out and shot Dante right. In any event, the trial had been going on in December, the verdict came out. I think after the I went on vacation. So I wasn't able to discuss the Kim Potter case. But I'm thinking these days about the strange contrast between Kim Potter on the one hand and Alec Baldwin on the other. And let's think about these two cases for just a moment because here's Kim Potter. She's shot a violent criminal during an arrest. Here's Alec Baldwin, he shot a completely innocent woman on a movie set. Now boat shootings were accidental. Kim Potter didn't mean to do it. And Alec Baldwin didn't mean to do it. What Potter is going to prison? And by the way, I think this was an unjust verdict because I think this was a mistake, not an intentional killing. And evidently there was a hold out on the jury, the jury deliberations dragged on and on and press reports said that one jura wept uncontrollably through the reading of the verdict. And that tells me that was the holdout juror. In fact, that was the same juror that was a dura who realized listen when a policeman commits a mistake like this. It's not a criminal matter. It can be a civil matter. It could be that Kim Potter is still responsible through negligence for the loss of that man's life because whatever Dante Wright did, he actually did not deserve to be shot, and she wasn't trying to shoot him. But why is it that Baldwin is Scot free? I mean, he hasn't even been charged. And why is kimba headed to prison? That's the question I'm trying to ask. Now, one answer would be, that's because Baldwin is a big Hollywood guy. We don't go after big Hollywood guys. Could that be the explanation? Possibly, although I don't think it's the main one. Here's the second one. Alec Baldwin is rich. Alec Baldwin is able to afford all kinds of top level council Kim Potter on the other hand is middle even lower middle class, so this is a classic shoe where if you don't have the money, you can get the lawyers, you're not gonna be able to get off. I think the main factor if you ask me is the race of the victim. In other words, Alec Baldwin shot a white person and Kim Potter shot Don day Wright, who's not only black, but this is actually even important. She shot a black criminal. And ironically, it's the black criminals that get the sympathies of the left. It's the Brock black criminals that lead to the immediate cry. Go get her. And I think it was the pressure to go get her that was coming out from the public because I think the public actually saw it for what it was, but from the media, from the cultural left, this is what got the prosecutors to say, let's go after this cop. Let's make an example out of her. We realized it was an accident, but let's see if we can put her in prison, and in fact they have put her in prison, whereas Alec Baldwin, and again, people say, well, Alec Baldwin, you know, he didn't even know there was bullets in the gun. Well, he bears some responsibility for that because he was also the producer of the movie. So when you have someone who's the producer of the movie and the actor in question, they have managerial in addition to acting responsibilities. So it's very hard to argue that Alec Baldwin deserves no blame for what happened and my question is, if you're going to treat Kim Potter harshly, why not Alec Baldwin? Probably until now you took aches and pains as a normal part of life, you're like, wow, this just comes from getting older that just comes because I bump my arm on my leg, not much I can do about it. "Let's look at another case that shows a different facet of the problem Philip, in Brooklyn center, Minnesota, police stopped Dante Wright for having expired, car registration tags. Now, many listeners will be familiar with the story since the police officer involved was recently found guilty of manslaughter, but tell us what happened when the police pulled Dante over. So the senior officer who was also a training officer is trying to restrain Dante writers down to writers trying to get away. And that senior officer then calls out taser taser taser. That's what you're supposed to do when you grab the taser, let everybody know there's an energy controlled weapon, let them get clear. She does not, in fact, grab the taser. She grabs her firearm, shoots and kills Dante Wright. So I feel in the aftermath of these incidents, there are often multiple claims and counterclaims, Dante Wright's mother said he called her during the incident and said he'd been pulled over because he had air fresheners hanging from his rearview mirror. Now, that sounds like a trivial infraction, and many people concluded, it showed the police had malicious intent. But I want to play you a clip from Brooklyn center police chief Tim gannon at a news conference shortly after the shooting. It is my belief that the officer had the intention to deploy their taser, but instead shot mister Wright with a single bullet. This appears to me from what I viewed in the officer's reaction in distress immediately after that this was an accidental discharge. That resulted in a tragic death of mister Wright. So the family saying, look, who pulls over someone for hanging air fresheners in their car, its racist cops, of course, the police say, no, no, no, the cop was distressed after the shooting. This proves she could not have been racist, and almost instantly, we start arguing about what's happening inside the police officer's mind. That's exactly it. And I think one of the ways that it's important to understand the way that we do race in the United States, we've got scripts, if I tell you a story, and there is an attractive woman walking her dog, the dog pulls on the leash and she falls down and then a very attractive gentleman who probably has a British accent, goes to help her up and she's embarrassed. Where are we? We're clearly in the middle of a romantic comedy, and that was a meet cute. But we don't just have genres for movies. We have genres for the stories that play out in our society. And the story, the tragic awful killing of Dante Wright and the killing of tamir rice and the killing of Adam Toledo, we quickly put that inside of genres, where the relative question is, how sinister is the officer? How deserving of death was the victim. And those are terrible genres to help us write the narratives that get us out of here, which is why the definition of racism is so much part of the.

The only reason I believe it got this much coverage is because the suspect is black. Officer's white. verdict We've been through in the last few months And the second that's happened why we've been on the air And I got to tell you although I wasn't surprised at all with the written House of verdict criminal case It's not a criminal case I've been there You do a lot of things when you're a police officer You don't even remember afterwards You're in such a high stress situation I mean I remember responding to a domestic incident in east New York Brooklyn and one of my first days in an RMP a car but this guy George I was a young rookie and you know we responded to a domestic with this guyanese guy and his wife had called and he hits me with an ironing board Not like over my head it was the ironing board was up like they were ironing so many He grabbed the ironing board like you would kind of hug it and he swung it and buckled me at the hip and jumped on me as I fell on the couch Thank God my partner was there and got him off but I got to tell you after that thing was over I mean your heart rate's elevated It's probably beaten it I was young back then probably a 160 beats a minute You get tunnel vision I can tell you I don't remember much about that entire incident other than C in my partner at the time Get his PR 24 night stick and grab under the guy's arm to get him off me use it like a lever Like under his armpit but I don't remember much I can't do that I don't even remember what happened afterwards I know he called it ten 85 which is that officer needs assistance in New York in the NYPD But I remember anything about it.

"Com scheduled your free estimate today 1111 Opening statements delivered in the manslaughter trial of former police officer Kim Potter today she's white charged with the shooting death of a 20 year old black man last April Dante Wright Holly Bailey national correspondent for The Washington Post joined WT to talk about what went on in the courtroom We saw a lot of body camera video is very reminiscent of the George Floyd case where Derek Chauvin was with his murder earlier this spring and it was very reminiscent of that we saw body camera video from Kim Potter herself We saw body camera video from others at the scene We saw dash cam video Not only just of the shooting but of former officer powder's reaction afterwards and apparently the jurors were very very engaged in that The video seems to reveal an officer who made a mistake And I guess the defense tried to emphasize that what did the video show and again how was this used in the opening statement The video basically shows the altercation itself It shows another officer at the scene trying to arrest Dante Wright on a gun weapons warrant And he is outside the car when Dante Wright struggles against being handcuffed and jumps back into his car And you see from the perspective of Kim Potter she's shouting taser taser I'm going to tase you for several minutes But then you see her draw a gun and it's out there in an enter several seconds because she fires And then almost instantly as you saw in the body camera video that was released last spring she realizes that she's made a mistake I just shot him You saw the former officer essentially become hysterical as one of the other officers who was on the scene testified She shouted I killed him I'm going to go to prison She basically walks to a sidewalk and collapses in the ground and you can just hear her wailing And I imagine that the defense obviously as they're arguing that was innocent mistake and her attorney birds the juror to see her as a human being who can make mistakes and he said repeatedly police officers are human beings who do make mistakes I imagine that they see this video is very positive for their case but prosecutors are really leaning on the fact that she was an officer for 26 years and she had been trained repeatedly to know the difference between a taser and a gun even noting the differences in weight and where they were positioned on her belt and Aaron Eldridge who was a prosecutor in the case Basically said she failed her duty that day What can you say briefly about the emotional testimony of Katy Bryant today What was the thrust of her testimony Dante Wright's mom In this case Katie Bryant his mother was a witness because her son had called her from the car as he was being pulled over And so she testified about that call She testified about the phone abruptly going dead after she heard the officer asking her said a step from the car and then she described frantically trying to FaceTime and call and finally apparently the passenger in the car picked up and said they shot him And apparently panned the camera over to show Dante Wright as she described slumped over and dead And it was very agonizing testimony Several family members in the courtroom were teared up and obviously the jurors were very riveted during this Holly Bailey national correspondent for The Washington Post based in Minneapolis Coming up here on WTP will check out the whiz tonight with rob it's 1114 Joanna.
