"Convicted murderer Daniel Lee was executed at the federal prison in Terror. Hoat, Indiana yesterday after the Supreme Court. Allowed the resumption of federal executions this week for the first time in 17 years. A second inmate was scheduled be executed today, but a judge put a stay on his sentence. Joining us now is Emily Basil on a fellow at Yale Law School in a staff writer for The New York Times Magazine, Emily Why did the Justice Department decided to bring back federal executions right now? Well. Attorney General William Bar made a surprise announcement last summer, saying that federal executions would resume and at the time Bar said that this is the rule of law. We still have the federal death penalty in this country, and he said that the government owed it to victims and their families to carry out these executions. The reason this is controversial is that we haven't had a federal executions since 2003 and in their time there's been increasing concern about whether the death penalty is arbitrary. Whether it's racially discriminatory and whether the method of execution in United States the drugs that were using are actually a kind of form of torture and cruel and unusual punishment under the Eighth Amendment, so that's why this has been a controversial move. Well, And during that time many states have stopped using the death penalty to write. The number of executions has been trending downward. Right. So since the last federal execution in 2003 there are seven more states that have abandoned the death penalty. So we now have a country where we have 28 states that have the death penalty on the books. But of that number three have declared moratorium on actually executing anyone and 12 haven't executed anyone in a decade. So you have a country that kind of at a Gives balance where there are states that still carry out executions face like Texas that have hundreds of people on death row. And then you have states that have really backed away from this because of these increasing doubts about whether we can execute the death penalty fairly. And when it comes to the issue of lethal injection, which has been one of the major problems that people have with the death penalty that it is cruel, unusual, they believe have any of those questions about lethal injection been answered. Well, we've had problems and courts have really resisted using a previous three drug cocktail that was associated with botched executions, that we're really kind of Horrible. Now the federal government is using pentobarbital on its own. That's the sedative that was used to kill pat for euthanasia. And it has been used by five states on so that is what the federal government decided to use, saying that this method has not been proved to be a form of torture. And so the federal government is going ahead with it. I should know that in 2014 there was an execution carried out with pentobarbital into other drugs in which A person who's being killed, said that he felt his whole body burning as he was as he died. Just briefly. What does it say to you that the court the Supreme Court allowed these executions to go forward? So this was an unsigned 5 to 4 decision and it was conservatives versus liberals and I think what you see here as the Conservatives on the court are not interested in expanding.

Times, 7 45 It's morning edition from NPR News. I'm Steve Inskeep, and I'm No well King. Good morning, the Justice Department put to death a man named Daniel Lee at 807 this morning. It was the first federal execution since 2003. NPR's Carrie Johnson covers the Justice Department and she has been watching this case. Good morning, Carrie. Good morning, Noah, who was Daniel Lee. And why was he on death row? Danieli was 47 years old, and he had been on federal death row in Indiana since 1999. That's when he was convicted and sentenced to death by a jury. Danieli was found guilty for his role in the brutal murder of a couple and their young daughter. It was all part of a bigger scheme. To do some robberies to finance a white supremacist cause that Daniel Lee was involved in Of this execution really did come right down to the wire. There was as I understand it some legal chaos overnight, including at the Supreme Court. Can you explain what happened? No. Well, there was so much chaos, culminating in Supreme Court rulings early this morning around two o'clock in the morning, a divided court ruled 5 to 4. Basically brushing back claims about the constitutionality of the lethal injection protocol by Daniel Lee and other men condemned to die in federal death row. For the majority. Chief Justice John Roberts said those men were unlikely to succeed in their claim that the lethal injection process violated the ban on cruel and unusual punishment since five states using the same method is the federal government and something like 100 executions have taken place using that single drug pentobarbital in the last few years. The liberal justices took a different view, though, didn't they? Very much So Justice Stephen Breyer basically said, I have had reservations now for years about the constitutionality of capital punishment writ large. He also pointed out that Daniel Lee's co defendant, who in some ways I was considered more culpable of these murders, had received a life sentence and was not sentenced to death in Justice Sonia Sotomayor. Basically said that the Supreme Court majority had short circuited an important legal process in the lower courts that these inmates basically deserved the right to have their legal challenges fully heard by the lower courts before the Supreme Court would swoop in and now, of course, it's too late because Daniel Lee was executed this morning. Daniel Lee's was the first federal execution in 17 years. But there are more there are others scheduled for this week. What are you watching? What's likely to happen there? Yeah, there is likely to be more emergency litigation in the days to come. Wesley Perky, is scheduled to die on Wednesday and Justin honking on Friday. Both of the men have claims with respect to whether their lawyers and lower lower court proceedings were good enough. And they also have claims filed by their religious advisers by two priests who say they do not want to have to go to death row and administer last rites in the Corona virus pandemic. They're both elderly men, and they fear that the prison has basically putting them in the position of challenging their obligations to these prisoners versus risking their health and so courts have not yet ruled. On those religious freedom claims he had those rulings who come in the next 24 hours or so. NPR justice correspondent Carrie Johnson. Cary Thank you so much. Thank you. It's morning.

As they are meeting their death, and unfortunately some of these botched executions witnesses who have attended them have described very disturbing physical reactions that appear to suggest that the people who are being executed are in great pain, excruciating pain and unable to express themselves verbally while the executions being carried out, so that's why the Federal Court had been permitting hearings and testimony and evidence on the issues related to the the method of the execution.

"Deep into the popcorn vi of pop culture and despite the fact it was interesting said the was the least political decade because when i remember the remember thatcher an i remember the strike and i remember i don't remember is being leased political i remember being in manchester and it being completely the opposite so for me that decade feels very very different but they were playing with those pop culture references in a way that worked for me so i was swept along by it i liked the visual style of i like the interweaving of the real world and the online world i like the characters and the way in which they interacted with their online avatars and i know that the word to our is permanently i because i by the end joy data i know that's fine that's fun i didn't we go but the main thing was i just felt like it was really good fun but really properly good phone and i smiled and i loved and i felt up lifted and i just the first thing i thought when i came is i'm gonna find somebody who hasn't seen i'm going to take them back and say again because i really enjoyed the heck out of daniel lee age sixteen i went to see ready play one yesterday the locomotive at one of the isn't it interesting in the wake of it how much the goonies has now become the movie upon which all modern movies from that period based on some i was cautious going in having felt the trailers were a bit naff i think quite a few people were sort of not necessarily blown away by the trailers and the it's fair to say my expectations worse apaz despite starting with fifteen minutes of dreary exposition it soon picked up steven spielberg reminds us that no one doesn't chase scene quite like him the costal find with libya cook who was so good in the lime house goldman monk rylance of course being clear standouts and ben mendelsohn chilling virtual scenery he can find the constant pop culture references do become a bit distracting although sequence in a set eighties masterpiece is fantastic and worth the admission price alone the film over comes.
