This segment was inspired by but does not answer a question posed to us by serial questioner always a great source. So not gonna answer that question because I'm not gonna get into British versus internationally all sorts of confounding questions. But the general question of, what do you do when you have a trademark and how can you enforce it? Is one that is a little bit counterintuitive and really, really interesting. And one of the go to cases that I use all the time in talking about, you were trademark rights is this case called Dan Tana versus Dan Tana's. And it illustrates the difference between a copyright and a trademark. So copyrights are really, really simple. We copyright this show. If you reproduce the show anywhere, you have violated our copyright. And you're under arrest. Believe me. It does not matter. Particularly when a copyright is formally registered, it really does not matter to even show damages, right? You can get statutory damages for infringement of your copyright anywhere in the world anywhere sort of downstream as long as you prove copying. Yeah. Trademarks are different. So let's walk through the case of Dan Tana versus Dan Tana's. We'll do pretty quickly. So Dan Tana is a self described former Yugoslav soccer star. Yugoslavia being a country that no longer and should never have existed an amalgamation of Serbia Croatia, Montenegro, basically post World War II, we were like, eh, stick all the Slavs in one country and call Yugoslavia. Yeah. It broke up in the late 80s. Anyway, Dan Tana was a Yugoslav soccer star, who then opened a restaurant. He was a film producer and actor, his Italian themed restaurant, Dan, Tana's. Was opened in West Hollywood, California in 1964, and then now I'm going to just read from his own description. Since that time, the restaurant has enjoyed a storied history, attracting Hollywood celebrities and insiders to the restaurant's intimate and romantic setting. Dan Tana's serfs traditional Italian fare in it resembles an old world Italian tractoria with red and white checkered tablecloths and straw colored wine flasks hanging from the ceiling like every bad red Italian place in this country. But anyway anyway, plaintiff, who's been the sole owner of the restaurant since its inception, figures prominently into its ambiance, personally greeting and welcoming his patrons, the press is referred to Dan, Tana's as a legendary Hollywood hotspot and the ultimate LA hangout. And the restaurant has been featured in numerous newspapers magazines and books the name, Dan Tana received significant publicity in the 1970s when producer Aaron Spelling asked the plaintiff asked for the use of his name for the lead character in his television series Vegas. So that's Dan Tana. Despite the notoriety of his restaurant, however, plaintiff did not attempt to register the name, Dan, Tana's, with the U.S. patent and trademark office until June of 2005, 41 years after his restaurant's opening. Now, that's not fatal. You have, in the same way that we have not filed for a trademark on opening arguments, right? Don't tell everybody. You can nevertheless have common law rights in trademark and that's part of what we're going to talk about. So the PTO denied his application in December 2005 on the basis of the existing registration of the trademark, Dan Tana's. Apostrophe S in the same category of restaurant services sought by plaintiff. Defendants had opened the first of two Dan Tana's locations in Atlanta in 2003, applied for registered federal registration in June of 2003, had obtained federal registration of that name in March of 2005, claiming a data first use of September 30th, 2003. So wait, is this actually related? I don't know what Dan Tana's is actually. I know the name, but I don't know this intimately. Was this actually related to that guy, though? No relation. No. Okay. Entirely separate restaurant with two locations in Georgia. Just happened to be the same name. Well, without so without the space. Yeah. Yeah, without the space. So mister Tana versus. I love doing I didn't think when I was writing this up that I was going to have to explain it in an audio medium. So mister Tana, then moved to cancel the defendant's mark with the U.S. patent and trademark trial and appeal board and said, look, you are trying to mislead the public into thinking that this is the east coast branch of Dan Tana's Hollywood. And this case, which went all the way up to the 11th circuit, is the resolution of that. And the resolution looks like this. It says in evaluating the primary question is likelihood of confusion. How much would people going to Danna's in Georgia? Think they were going to mister Tana's restaurant in Hollywood. It seems like, I don't know. Here's what the court says. Our court applies the multi factor test, evaluating the following 7 factors. One, strength of the Mark alleged to have been infringed. Two similarity of the infringed and infringing marks, three similarity between the goods and services offered under the two marks. Four similarity of the actual sales methods used by the holders of the marks, such as their sales outlets and customer base, 5 similarity of advertising method, 6 intent of the alleged infringer to misappropriate the proprietor's goodwill and 7 the existence of act and extent of actual confusion in the consuming public. And if you're looking at that, you're probably thinking, well, gosh, almost all of those, probably seems to say yeah, there is some likelihood of confusing, right? The Dan tan well known. It's very similar between Dan Tana's and titanus. The services and goods are the same right there, both restaurants. They advertise in the same way, but you might suspect as I'm leading you down the primrose path that the court came out the other way. The court said, you're not thinking about geographic considerations. When the plaintiff has a common law trademark, right?.

So the so I go in and The we sit down and she comes by for like, I don't know. Two minutes talks to us and then she jumps right up, handling something at the restaurant. So let me just get to the end of the story, which is she ordered wine for all of us, And there were three bottles of wine ordered. Okay, that's gonna be pretty pricey. No kidding. And I'm thinking like you're thinking, like Jean Burns is going to get a discount thinking So what I'm doing directly. Your daughter is the daughter of the guys restaurant. You know someone, not how can she not give me a discount? Plus, she ordered the wine. I didn't order it. But you know what happened? Why you yelling because I had to pay for it. That's why I'm yelling. It was crazy. It was expensive wine, too. I remember that. So all I'm saying is some of these situations kind of goes sideways. You could do you recall how much you had to pay? I used to remember, you know, because it happened when I first left San Francisco went to L. A. It was a long, long time ago, so I don't remember it with the number of those I remember. It was sticker shock, and I looked at my lawyer and I said Said store, did you? I mean, did you see this? Then let's say that bank services, a particular client that comes under the sanctions. What did they do? We talked about this on the show before. I mean, realistically, they're goingto have to pick which regulatory regime could end up hurting them the most. Now I do think there's some cause for caution on all of this because We're potentially a year away from actually seeing any real designations under this program. If you get into the nuts and bolts of what was signed yesterday, the administration have 90 days. To identify targets worth designating. Then they have to inform Congress of any foreign banks carried out business with the aforementioned targets on and they have a year to do that. So you're talking potentially October 2021. Before you may begin to see any banking related restrictions or more serious sanctions that get rolled out. Potentially Dan the sanctions haven't been levied yet. You made a point of that. And clearly this is just amping up the arsenal that President Trump potentially could have. Can you give a sense of? Why now? Because initially, President Trump didn't have that strong of a reaction publicly to the incursions in Hong Kong autonomy, and this came according to some people, sort of suddenly. Well, I mean, it didn't It didn't let let's remember what he signed yesterday. It was a very, very bipartisan piece of legislation passed in both the House and Senate that forced the president's hand. He was essentially given no choice in the veto proof majority. To sign the legislation that came across his desk. So Congress is the one that acted and force the administration to do nothing. They signed something but haven't necessarily done anything yet, and I think the next step for the administration have to identify targets. That's the real sensitive piece here, but I don't think it was necessarily suddenly definitely was delayed for a few weeks, and I think the timing was UK announcement yesterday of excluding a certain tech company from Involvement in their five G market was, you know this has been a bad week in terms of doing in China relation to John's correct, delicate questioning of what a given bank would do. Look at the margin. This stops. Marginal Hong Kong grows for the financial system of the West. Where do they go? When they moved from stopping the marginal growth of head count over to? We've got to adjust at the margin or completely and exit Hong Kong. Where would you just suggest they go to There's no mean this is still somewhat fresh, so I don't think there is a clear answer of where you'd go to. I know there's a lot of people in Singapore that air excited of what this could potentially mean for the further growth of Singapore is a financial services hub. Which is a potentially a logical move from a regulatory standpoint, and otherwise there's no clear answer. I don't think anyone is evacuating the Hong Kong market yet. I think any moves and doing so could be beautiful from the shore, depending on the business. But this is what a lot of banks similar to those that we're looking at Bricks.
