money limits on braces or it's more also about the grassroots organizing well in this race what we need to do is we need to have a great grassroots campaign and we do we've had two thousand individual contributions we raised over years of almost three hundred fifty thousand dollars by the reporting period the end of the year we raised more at the second half of twenty nineteen the justice dalet at the same time period when she was running in twenty seventeen at the current Supreme Court justice that ran on two years ago yes it's a three years ago it was two years ago two hours that the election yeah she well she is all yours blur together recently was over she was elected in April of of twenty eighteen as I go around the state people are excited about our campaign they understand why this race is important this race has incredible consequences for Wisconsin today and Wisconsin into the future tell us about that you know this court for sure is going to hear a case and gerrymandering we're all gonna filler census forms the beginning of April legislative lines are going to be redrawn as a result of the census there's gonna be litigation about those legislative lines and that litigation is going to end up on the doorstep of the Wisconsin Supreme Court and that decision is going to impact the state at least until twenty thirty I believe the supreme court's going to your case cases about women's access to health care about what's was constant response going to be a gun violence to the climate crisis to criminal justice reform what's our democracy in the state going to look like all of that is on the line in this race because those are the decisions that this Supreme Court is going here look we're gonna have another Supreme Court election until twenty twenty three in the state of Wisconsin this is our year this is our chance to win back your seat on the Wisconsin Supreme Court let's talk a little bit more about some of the issues that you were just looking at are there any recent issues that came before the Wisconsin Supreme for that you would have you would have made a different decision then is what came out of the Supreme Court I think if you look at this Courtney look at the issue the case that they decide at the end of last term that had to do with administrative rules from the department of admin excuse me the ID PI the department of public part of the lame duck that was nice it was it was a little different than that it was okay PI case okay so in twenty sixteen there was a case om om involving the administrative roles and the court ruled one way three years later in the cash to case the court ruled a hundred and eighty degrees different they completely changed what the ruling was from three years earlier and the only thing that changed from twenty sixteen to twenty nineteen AS as justice and wash Bradley road in the descent was the make up of the court the problem is is when the court changes brought their decisions that quickly when they change their decision on a dime it a road stability and predictability in the court system and that's not good for any of us to not be able to have stability in knowing what the law is or to to take what the law is right now and they all that's okay I can get a change in a couple of years right that the court is going to change it mean if none of us know what the what if if they're gonna change on a dime like three years later just because the make up of the court has changed how do any of us know what the law is I appreciate the intensity that your brain to this I mean right this isn't for me and for many religious right is a conversation of who we gonna vote for the Supreme Court but you're reminding us that this isn't just about picking the candidate that we think aligns with our values our perspectives the most but really taking a deeper dive into do we want to protect our democracy yet careful I I thank I wouldn't be running in this race I didn't think it was important I have two teenage I'm a single mom of two teenage kids I'm I have a full time job I am in this race because of my kids and for my kids and I couldn't do it without my kids but the things that we are fighting for is the very democracy the cornerstones of our democracy nope thinking about you know we're legislative lines are drawn thinking about women's access to health care thinking about gun violence in the climate crisis all of those things are so vital to every single one of us in the state of Wisconsin I love that this conversation is about it started off the conversation of the person on the individual that when you go in there for the court it impacts your individual life when you're facing something and also that it has the impact on a larger scale as well the Supreme Court has AT and our judicial system has both of those complexities happening at the same time absolutely and and that's why it's important just to go back to the point I made earlier to have someone who's been on the frontline of the justice system on our Supreme Court because the impact that the law has an individual's a something that I see and I hear and I feel every day and I will bring that to the Supreme Court one of the questions I had written down you already predicted it in almost answered it but I'll get to it a little bit anyhow was in my day job is you know I get to I'm I'm I get to work with tenants in on civil rights issues and so many times before we ever entered the courthouse my clients are worried am is I'm I'm going to be listened to am I going to have a fair shot to have a chance at winning this is not I don't think it's that they doubt the facts that they believe is that they doubt that someone's going to listen to them talk to us about how you from the Supreme Court can help dictate the level of respect that needs to be reinstated our judicial system would think if you come into my courtroom every day any day ending county you will see a courtroom where everyone in that courtroom is treating everyone else or with respect and it starts to the judge and I and people who are in my courtroom know what if there are there's a big group that comes in and I know they haven't been in court before it's the first thing I say to them is I'm really glad you're here I'm glad you're here to see how the third branch of our government works I just I'm gonna treat everyone with respect I need to hear what everyone saying I expect everyone else in this courtroom to treat each other with respect and that's it just put it out there I think on the Supreme Court treating the lawyers and they come in with respect treating your colleagues with respect treating members of the public with respect all of those things om I answer the question about you know what what can you do do you think that the Supreme Court justices currently collectively treat the public and each other with respect I think the I think two days yes I do I think in the past that there have been some issues but yes and I think you know in my career I have a long track record of being able to build consensus with people when I was in the Dane county DA's office I worked with judges and I worked with defense attorneys both in the private bar and in the public defender's office I worked with probation agent and victims' advocates and law enforcement and elected officials members of the public to work on reforms in the criminal justice system when I was at the department of justice again I worked with the judges I worked with the public defender's office I worked with victims advocates to pass a rule so that victims names would never show up in a Supreme Court briefer decision or a court of appeals briefer decision we worked I worked on the judicial council and propose this rule and worked for years to try to get this passed but I had to build consensus to do it I would bring those same consensus building skills to the Wisconsin Supreme Court talk to me about the relationship between the different branches of government how how should the legislative executive and judicial branches interact with each other I think the judicial branch exists a large lead to make sure that the other two branches are overstepping and that they need to be dating that is a very very important role for them to play we saw that their many examples of that there have been and then on the federal judiciary and some of the reforms that Donald Trump has tried to pass we've seen that that the judiciary has come in and said no you've that's over step you can't do that so that is in on the know very very important role of the judiciary in from Vermont I feel like that's where part of the breakdown of trust all of our judicial government started is no matter who's in charge of the Wisconsin state legislature in the Wisconsin governor's office you expect all the Supreme Court to be the final decision maker when governor Doyle was governor governor Iverson governor Walker any of them all of them can overstep their boundaries every everybody does now and then and you expect the judiciary to be the final you know evaluator of the circumstances and it feels like under during the Walker administration things change and and it doesn't feel that the judiciary is independent anymore sometimes when you have members of the Supreme Court who always find for the Republicans when they always find for the right wing special interests when the always find for the corporations you're right it feels like they are not making independent decisions again it feels like they're not following the rule of law but their outcome driven they're making decisions based on what they want the outcome of those races to be is there any member current or former of the Wisconsin Supreme Court that you would say you most aligned with on your back you doubt is a is a dirt sorry justice Rebecca dalet is off a front of personal friend of mine I think that she ran a great race when she ran two years ago I think on the Supreme Court she has worked really hard to build consensus with her colleagues I think that she is someone who has written some smart decisions on.

designer at Ted Baker and he does youtube flocks and blogs and talks about all the things that he experiences in his life he's written a recent one about going back to university which is Toco and we're going to be talking about kebabs grills and wine good how have you to got on this week how meteorology stories I wanna hear well I got caught out by eggs this week in a rather unexpected way I'm not deeply allergic to eggs but I had a couple of pieces of food across a day which clearly had some egg in it but not enough that I would worry normally so the I was cross oil and they normally have a tiny bit of egg in sometimes glaze maybe a glaze made some are but I've had them before a problem that was fine couple of hours later had lunch had a cornish pasta and that had a little bit of egg way down on the list that's just a glaze that'll be fine soon as I'd have the Cornish Pasta started to feel a little bit grumbly what I've noticed with my egg allergy is whereas it used to be a vomiting action now it's just a kind of a general nausea he gets worse during the day and so for the rest of the day I just felt out of sorts yeah you didn't want to do anything and then we're all going out in evening to eat and in the car driving there I just felt sick or because I'd had a little bit of egg in two pieces of bread and pastry earlier in the day do you think of it just been one of those things that might have been okay Yep yeah I think so it would have just system but there's obviously enough just to trigger it was like you I used to vomit as a child and I wonder whether that is actually quicker recover from because you get out of your system and I noticed it was feeling as if this sickness was literally traveling through my body and so by mid afternoon it was it was a die from height later in the evening it was my stomach that was rumbling and then I just felt like I'd been ten rounds with Mike Tyson oh I just wanted to go to bed and my body was saying just got a bad just getting US get out of here so stop eating these things well I've got to be for more careful now clearly I've always been a little bit kind of cavalier with my allergies but since doing this podcast become much more aware of it now and so now I do have to make choices which are wasn't making before I was kind of this egg allergy is is not GonNa beat me but is beating me so I'm just going to have to be more careful now maybe I should go and have some protests maybe shed and see how much intolerance it might be a full allergy yeah it might be that it's beating you it just might be that you have to reframe how you feel about okay I'm going to just embrace the fact that it's there and I'm going to Miss uh-huh yeah it's confirmed or reaffirmed two or three incidents I've had of the last six months where a little bit of egg has not been a good idea so you're right have to just be careful now really annoying because it's now it's now denying me choices and that's one of the things that if you got I used to but when you get denied even more choices you get more cross about it and you already avoiding pave and I'll beating rice cakes and that'll be it soon it reminds me of that awful day in my twenties when I sat on the floor and cried with a pack of rice cakes my life now but there's so much else you can eat how about you how did you get on this week roof I had one amazing meal out which I couldn't fault I went to a restaurant called Lucy's on the plate and inside and if we're supposed to I'm John they were absolutely amazing I would love to get Lucy on the show one day she spent twenty minutes going through with me and my family about what I couldn't couldn't have smart was really really worried you must take this seriously previously in the week another restaurant actually refused served me they were like nope they phoned us back and said we've got this booking for the most alleged person in the world and we'd like to cancel it we can't take scared how did you did that I felt quite upset at first bart at rather somebody was honest and said I really don't feel comfortable feeding me yeah that's true because four usually a walk in rather than pre because newsy when you find a book someone's got time to prepare get ready for it but quite often I've had that worth walked in and said can you serve me in that like no is an interesting one because does this parallels we've talked about before between disability analogies and if you'd walked in with a wheelchair they would not be allowed refused here so enjoyable that person isn't GonNa die if they can't get wheelchair it's a different thing they potentially could be up for a lawsuit if they make a mistake and they're not sure it's a bit different it's kind of like I feel discriminated against because they can't even make me salad or planes steak because it's not that hard yeah I was telling them I was going to have the state I don't know how you can cup of staying hard is it so we just spat on the pavement outside with the big the it'll be name checked by the one way you had such a lovely nail and lemon drizzle pudding the whole walls amazing get done something specially for you it was on the menu this place is all gluten free and lots of the stuff is Vegan so obviously a good choice that's interesting because it's a gluten free ending if he is so they know where was this whereas this restaurant we'll have to we'll go down there lucy's on a plate in animal side tastic we'll get Luciano because I'd like to know how she made the decision to to turn the restaurant into gluten free yeah well I spoke to her about it she years ago and everyone told her it won't work no one's interested but she just thought well my kids had issues with gluten it strikes me that is it's a confidence isn't it for the proprietor or the the the puzzle used the restaurant if they're confident enough to know exactly what goes into that food and they know that all they will need to really do is listen into you and to make sure that putting out is not going to kill you then that's what we need help them do to instill that confidence I'm just impressed that somebody's spent that amount longtime did your list of twenty five allergies if he's tall and she was even asking me about things I wasn't alleged to all this muster in so she knew all of the unusual allergens and with news it was phony aging and was that the best experience you've had on a restaurant would use up there yeah some good experiences ten after lost in the north I think I think I think better experiences there was a gluten free fish and chip shop and it was Vegan batteries were all the time I mean I was just beside myself to emigrate shit yeah the north of the UK for anyone listening outside of the they see that's I imagine yeah so why south gutted what we're talking stereotypes gluten free fish and chip shop near me that's all gluten free all the time there's a couple that do it on the first Monday of the month before they changed the oil which is fantastic but that's never the time I think of spontaneously getting chips I have something to say about this week as well because as long as I have a really positive experience because I hosted an event and I had to be an after one hundred people I ause really very concerned that the food was going to be not just delicious because the workup in dealing with you guys like I really need to take the dietary requirements really really seriously and it's sort of like you don't really know what you're going to get and when you organizing the big event like that and you call a lot of people have to say the venue raising as well and that was the listing in London they were fantastic yeah it was really supposed to experience to actually feed that many people on how to really really good feedback as well when you've done these events before you not really hub to think about the food I have done only one big event like that before in March and it was the same thing but I just don't think I took the seriously I just got it in how does much I just kind of the venue with that whereas this time I was really like right have you got all the director requirements what are we gonNa feed them is this going to work really into it and how many guests with those about a quarter no allergies people who I was catering for located for were making specific choices and I needed to really respect them so it was super important that the food was really good well labeled yes labor we had tariff-free milks and everything so it was good there was some interesting news recently of bad grills Mr outdoors US getting stung by a bee having an anaphylactic reaction he was filming in India for a new TV series has just been going out I think you can catch it up all that somebody so icon it can be susceptible to basting you wouldn't expect it but I guess human like the rest of us I use that I I think it's ironic ironic that tiny little inset that his is the thing that says it looks awful the reaction that he had he had a really dramatic reaction and they lose kept on filming him saying how painful it was and his face is so swollen but this is the first time it's happened to him no you know there's a there's a video clip of him gene stung by bees because stupidly was going into the Ivan getting the money out without any protection tool just protection but then you see the the consequence of that and I think it just shows how allergic people can be two BS and they're occasionally stories of people who've died of non-flight shop you tend to think they're being stung by thousands of the Nautilus just WanNa do that listen to some of their grills being stung by bees we are trying to steal their honey careful of.

And frankly, the Republicans could have stood up and presented a unified front in defense of religious liberty for Brian Haggai during but they chose not to two of them two of them did David Craig and do we Strobl they stood up and defended Brian Hagedorn against the assaults on his religious faith. But nobody else did nobody else saw fit to do that. And conspicuously missing as well as Brian haggard orange. Former boss Skywalker. Brian Hagan was chief counsel for Scott Walker. Brian Haggadah Orne is a candidate for Wisconsin supreme court because of Scott Walker but former governor nowhere to be found nowhere to be found so grassroots it's on you. It's on you. On you this election. It's on you next election. Because waiting around for other groups or waiting around for I guess, the usual suspects. We've all gotten used to having these elections being done a certain way if is going to win it's going to be because people like you are willing to knock on doors are willing to actually drag friends out to the polls. Gonna be tough. 'cause Lisa Neubauer is bringing three hundred thirty five thousand dollars from Eric Holder to her campaign, she's bringing in two hundred twenty nine thousand dollars from other third party groups that was just announcing there is likely to be more before election day rolls around. Meanwhile, the realtors decided to scare everybody else out of the donation game for this particular race. So it's on you. It's on you. The future of ten. Right-to-work voter ID Wisconsin reins act the castle doctrine. A whole venue change. And a whole host of other changes are right now up for grabs. Because every single one of them is going to be litigated again in front of a brand new court at the liberals are able to control the court that same court. I should point out not hesitate to point out. We'll also be the court that will be in power. If the liberals take it over the same year, we go into redistricting that should be fun hawk. "Welcome back. Great to be here. Sure. Appreciate all of you being with us. As I mentioned earlier, we've got president CEO for I liberty. You know, how I feel about I liberty. I talk about it all the time. This is one of those organizations that when we are thinking about being on the front lines and being in the battle, and we want to get in the battle, and we want to participate in getting in the battle. You gotta go to first liberty. This is what we all should be supporting, and you know, this is a great organization. Kelly Shackelford his team on the front lines. Kelly. Welcome. I'm glad you're with us. It's a privilege to be on, Dan. Kelly one of the things that is in the news, and we're talking and hearing a lot about is the American Legion case, and it's being watched very very closely. And I know your team is arguing this case at the supreme court. I think the end of this month right February twenty seven February twenty seven tell us about the case. And how important this is to to our nation. Well, this is a case about a Veterans Memorial. That was put up almost one hundred years ago by mothers who lost their sons in World War One and the American Legion. And it was to honor these forty nine young men who died in World War One of all races and backgrounds and just people who had died in of course, back then you really couldn't fly. Most people couldn't certainly fly over to Europe to see the grave of their their son. And so they put up this memorial in Prince George's county, which is Maryland right outside of DC. And it's a it's a cross, and it says, valor and courage, and it says the American Legion on American Legion land and it sat there until forty years later. Outside of DC. So they they needed to build roads. So they by eminent domain, they took the land. But they certainly were not going to determine Veterans Memorial. And so they built the road around the land. And so it's somewhat in the median, and then another forty years or so later, the the American atheists come forward and say, hey, wait. You can't have this cross on government property, and they filed a lawsuit, and we want it to district court. Additionally, we don't tear down Veterans Memorial because they have a cross or religious symbol. We got to the court of appeals in our our judges were to Obama appointee to one Clinton appointee. And one of the Obama appointee said, you know, if we just cut the arms off of the cross won't that take care of all the problems. This was the mind we were dealing with. And not surprisingly decision came down to two one. The Clinton appointee a descendant and said, there's nothing wrong with this veterans from where we don't tear down veterans memorials because of a cross, and but he was out outvoted and so two to one it has now gone up to scream court in one of the reasons is because this would be horrible for these families their descendants. Or are there saying don't you dare care this down, but it would be bad for Veterans Memorial all over the country because every community of every state has country has religious symbols in their cemeteries with the veterans memorials in these types of things. I mean, the bulldozing and sandblasting is beyond our wildest imagination of what is going to have to happen it if this occurs, and as a great example, Dan within the jurisdiction of discord that has already ruled is another cemetery. Arlington National Cemetery, not overturn they're going to have to go into Arlington, and literally tear down the large. Freestanding crosses debtor in Arlington cemetery. The cross sacrifice the Argonne cross the too many unknown soldier says known but to God it just unfathomable. And and that sort of the obvious first step, and I can if you want I can go further into what this means for all kinds of issues because of sort of the test or the legal analysis, and the fact that many people think. Now that we have five justices on the court who were more hone following the constitution that they're actually going to maybe go back to the constitution. So these silly attack on veterans memorials on displays around Christmas. All these things maybe can be stopped and because of the bad interpretations that have occurred in the past well Kelly as I think about this. So I have eight grandchildren under the age of nine. And to think there's just a mere thought that they're not going to be able to go to Arlington. You know that it could get that far. And and I think about how important this is for our heritage is an as as Americans that I can't even imagine I shudder to think or imagine what this is going to lead to what this is going to open up that this eightieth group could could win this fight. I I know you're not here for this year here because I asked you to talk about a couple of these cases. But you know, this is why I'm just saying to our all of our listeners. This is why we this is what we have as Yvan Jellicoe Christians as American patriots. We have first liberty the others have ACLU and American atheist groups, and so on and so forth, we have first liberty. And this is why we've got to fight and one of the ways that we. We get into the fight is we support groups like this this, and I'm not I I don't even wanna sound a little bit. I'm just giving an example, but my wife, and I believe it's really important that we support I liberty and we have for years, and we always will. And this is this is supreme court argument. And I am magin Kelly that this is no easy task to prepare for to have attorneys on hand ready and fighting and preparing for this this what could be very long and drawn out. But this is the end of the line. We can't go any further than this. Every I has to be dotted. If they want it, by the way, if anybody wants to go look at the case support, the case be all the info they can just go to. I you spell it out. I liberty. I liberty dot org, and they can do that. But yeah, I mean, I look at this like this is a no brainer getting involved with because I really believe were about to be a part of changing history. And and. And that's what this case it's going to be a precedent. That's going to be in the law books. Now who knows twenty thirty four years. It might be case everybody is following. And it's important not only because of the Veterans Memorial, and what it means to our veterans memorials all over the country. But also important because why are we here we're here because of some really bad tests that were created by paths court that are leading to these absurd result that they're trying to interpret the establishment clause, and what the founders are trying to do with the establishment qualities. They didn't want to be a national church in anyone any of us supporting national church, the idea that they brought all these terms in now that aren't part of the constitutional separation of church and state and all these other things twisted them tore. Now, the government is almost hostile to religion, the founders would be appalled at that. That never what they intended by the constitution. So what we did in our brief, in fact, as we said the court the cash you run workable, they lead to just absurd results. They're certainly not what the constitution says. Let's go back to what the constitution says. And so if the government's not coercing someone with the gardener the religion. There's nothing wrong with religion in public. Founders are fine with that that's freedom. And so if we succeed in that, we can really change the culture in a major way and get back to what our country was really about from the very beginning. And that's why this is a case that is so critical to America to our heritage to constitution. And it's something that we have got to step up and get involved in. And I hope everybody listening will. And this reminds me of how you are you guys in your team are I mean, how are you working to help make sure that we get judges on federal courts? These are lifetime appointee. Tell us about that. Well, one of the things when we you know, we are mantra or our mission is is really advancing religious freedom across the United States. And so we we were preparing to do that for a president Hillary Clinton before the election and figuring out how we were going to do that under that administration, and when Trump got elected instead we were surprised, and we should all right? Let's see what opportunities there are we've seen a number..

The question now is what restrictions the White House place on the FBI CBS. Jeff gay says F B I officials knew this investigation would put them in the middle of a political firestorm. This was not a criminal probe where the FBI could just follow lease wherever they may go in this case the White House set the parameters on who to. Interview and what to look into? So Dr Ford was not interviewed nor was judge cavenaugh FBI agents relied on their public testimony from last week's hearing to track down witnesses. Ultimately about seven people were interviewed as the FBI tried to corroborate the allegations. The Wall Street Journal reports the FBI report does not corroborate. Dr Ford's claims a coalition of Christian churches is calling on Brett cavenaugh to remove himself from consideration for the supreme court. The national council of churches represents about forty million people across the United States and says that Cavanaugh disqualified himself showing extreme partisan bias during his hearing last week demonstrating that he lacks the temperament to join the high court. The group says that the judge told outright falsehoods and criticizes Kavanagh's record on voting rights, healthcare and other issues on which the group is taken liberal leaning positions. Don't fall for it warns the Louisiana secretary of state's office. "The station there to exports and then in the summer of 1993 i was just having a conversation with the guy who was doing the play by play for the indianapolis ice which was an eye gel team at the time and i hope you do a show on the ihl if you haven't because that was a great league to um and he just mentioned that he wouldn't be able to do it that fall because he had a bunch of uh basketball commitments and i said well they have they gotten anybody to replace you he said i don't know so i you know i knew the ice we covered them uh so i call up there president ray compton and suggested myself and i had no hockey experience at that time because growing up in florida i had rarely seen my experience with hockey the time had been uh dan kelly on the usa network calling the finals when the finals were on um um so so it it was was about bad it um but so i said well this will be a fun challenge um this would be fun to do to be the voice of a team for a year so yeah ninety three ninety four i was the radio voice of the indianapolis ice out had a very bad team um had a really good bunch of characters and duane sutter one of the famous six sutter brothers was the head coach so he was a lot of fun so it was a great experience um being the voice of the ice but so fast forward a couple of years i hear there's 'cause they're going to announce a soccer team of personal indoor soccer team for indianapolis i'm thinking will i you there is a chance i mean there's certainly nobody in this town who's done indoor soccer play by play including yours truly so i had was a tape of me doing hockey so why after the press conference are covered the press conferences to work at the tv station at the time i went up to the owner and i said you know i wanted to play by play for you here's a tape um and that was in february of ninety six and over the next course of the next few months eventually i guess somehow they decided that the only option they had.
