"Been a landmark day in the investigation of the capitol riot Jury selection started for the first trial related to the attack 49 year old guy refit of Texas is the first capital breach defendant to go on trial in a case that's being called high stakes for him federal investigators and almost 300 other people who face similar charges Joining us on Skype Politico senior legal affairs correspondent Josh gerstein Josh good to have you back Thank you so much Hey good to be with you guys So yeah what is accused of exactly here Well so it's an interesting case because he is not one of the capital writers who's actually accused of going into the building He's accused of clashing with police at a line where there was tear gas and pepper spray being deployed probably on both sides by the police and by some of the demonstrators on the west terrace of the capitol But actually the most serious charges that he faced are a few One is bringing a weapon to the capitol prosecutors say that he had a Smith and Wesson pistol on him when he went onto the capitol grounds and was attempting to gain entrance into the building And he also faces a charge of essentially making threats to members of his own family to two of his own children saying that he would shoot them if they reported him to law enforcement So what are the stakes in this trial Josh Well it is really the first test in a courtroom of these cases that prosecutors have brought We've all heard about how broad this effort is that there's something on the order of 800 criminal cases Somewhere around a 160 170 people have already pleaded guilty but among those that are actually asking for trials this is the first one to actually go in front of a jury or will be the first to go in front of a jury and that really becomes a benchmark for all the cases that come after it There's not going to be 600 trials But what happens here will dictate how the plea bargains are handled What kinds of offenses people are willing to plead guilty to and what kinds of sentences they're willing to consider in exchange for a guilty plea So you can be quite sure prosecutors and defense attorneys all over town have their eyes on this case Well what about jury selection I mean everybody knows about the capitol riot to how tough is it to get a jury seated in a case like this I think we'll have a jury seated by a midday tomorrow or by early tomorrow afternoon It's been somewhat difficult because you've had a number of jurors come in and say look I know people that worked in the capitol I was on Capitol Hill that day at least one person said they walked down there from their apartment to at least to the mall to see what was happening up there at the capitol So you definitely have some people with direct knowledge most of whom are being sort of struck out of the jury pool But there are a number of people that say look I just followed the news about it when it first happened or for a few weeks after that It wasn't a hugely traumatic event for me personally And most people like that are being kept in the pool of potential jurors to be assigned to the case All right well it'll be interesting to see this all unfold Josh Thanks so much Okay my pleasure That's Politico senior legal affairs reporter Josh gerstein who joined us on Skype It's 6 14 This is Dan Danny uses navy federal credit union to save and invest Luckily for him navy federal takes the legwork out of managing his money which gives Dan time to work.

"I'll start with this Greg because based off the phone call we took from Danny and Quincy in the prior segment because he felt like today, despite the win, was kind of a regression for the Patriots both in the red zone for the offense and certainly against the run defensively. I actually, to me, what was the most important thing in this game for this patriots team was despite this almost being the Nashville sounds triple-A team that showed up in terms of their personnel. That's a tough ass team there, coach by Mike vrabel. And they don't give you a whole lot. Yeah, they play some zone defense and you're going to get some openings if you protect the quarterback well. But you know, they kept they stay close to the Patriots. They tested the Patriots and they tested their toughness and this was almost a sort of playoff type game for them. Was it a well man team? No. But still, despite all that, strip all that away, and they were tested, and by this team. And I think it was a toughness check for the Patriots, a real one, not some of these other artificial oh, you know, the Patriots show a lot of mental toughness this and that storylines that always happen when this team. I thought they were really tested. It reminded me of some of those old older ravens teams that used to come in here and battle the Patriots and not give them an inch. So I thought that the Patriots did well to answer that. And I thought that that was important for them because those are the type of games that are coming up against the colts against the bills twice, and before they get to the playoffs. So these are really good opportunities for a lot of people who are new to this in New England to get tested in those scenarios. That being said, I do not think the patriarchs played all that well today. I thought that to give up 270 yards rushing is embarrassing. It's flat out embarrassing. And if you win against a team that even had average NFL personnel, you probably lose this game just for that very reason. And also Mac Jones did not play well in spots, despite throwing for over 300 yards. He's like how are you feeling. Say well i said what i said. What did i say. I didn't listening. I said i'm feeling fine. Because i wanted to discuss how i'm actually feeling here on the air. I didn't want to blow it in the stupid enough for those of you. Don't know we broadcast just outside of charlotte and a beautiful town. We like call marshmallow. We had twenty two acres. We have horses. We have chickens. We have cats and cattle and all that stuff. Oh my and dogs. Yup can't forget. About the big fat dogs are english bulldogs in kooky and so we sit up here in eight hundred square foot studio. It's very nice. It's very comfortable and it's above are three car garage. I know big baller but myself. I'm trying to take better care of myself. I'm trying to get my blood pressure down so one of the things you have to do to get your blood pressure down this you know. Stay away from salt. Stay away from a fatty foods. Stay away from stress. Is one of them. Stay away from monster drink. Believe it or not. I might have a cup of coffee on saturday. saturday morning. Sit out on the porch and watch the sunrise and style i was. What are those they someone four. I was a twelve pack a week. Drinker those monster drinks now not in the monster drinks because the monitoring's have like two hundred milligrams of caffeine in it. I will get the. What is it bang. I think got three hundred fifty milligrams of caffeine so. I was aunt up all the time. So i've been staying away for that. My blood pressure came down. And now it's a. It's a diet change so here on the french. We have of course chickens and with chickens comes egg so we have unlimited eggs so with eggs comes bacon with bacon. Come sausage sauces comes toast or hash browns and pancakes and all. That is a big heavy breakfast to have early in the morning. And start your day. So i have been for the last two weeks. I switched my diet for just for breakfast. Now i've been eating really good at night too but for breakfast i have a whole cucumber. I skin it. I chop poker chips. And there's a. There's a dressing dressing to help the the medicine go down but unfortunately dan eating cauliflower dot cauliflower cucumbers and broccoli every morning must have something to do the justice digestive system it. I haven't had a solid movement in probably two weeks. So you're like a solid shooter and but here's the thing. I was freaking out. Because if he corn what happens you know you see. Do i know this is getting really descriptive here. If you let us eat any of these things peanuts one thing you always see know like uncle say maybe i should chew my food better type. The oh i would freak out because after having breakfast about an hour after breakfast. I'm like ooh. Dan danny again. I i gotta go. Never seen him run so fast. So and cucumbers they have the seeds the cucumber sees if you get the older cucumbers bigger cucumbers seeds and i saw the seats. And i'm like it's only been an hour. It's there's something wrong with me. I'm dying there's no my tests are gone to my stomach right my butthole out. And that's it so. This is the colon cleansing show. Yeah cleanses but i got scared so i actually looked it up. I told my wife she's like there's no way. There's no way you just had breakfast. I said i know. And so i looked at the body. It takes approximately twenty to forty minutes for an actual cucumber to to process in your body. So i was like who. How and i was thinking about skipping steps in my body wasn't getting the nutrients that that was trying to do to get my blood pressure down taking garlic pills and all that you need to have some fiber though i will. I don't know what kind of fiber to have though what should eat food. That has fiber in it. I don't take the pels. Oh okay yeah. I can take the the fiber one or whatever or do. What's the jamie lee. Curtis thing the activity and maybe eat those. I dunno. don't take pills. Just find a food that has fiber and it. What's new what you dan. Oh not too much is doing a job this week and doing some tile work and two different projects and don't forget at the bottom of the hour we have to see with technology. He probably actually helped them win. Too many games last year they were surprisingly competitive in the second half of the year given the rather sparse roster that they had so suggs at five still had come inga higher on my board. Inga is evocative of so many of the other players that they've had in their at various times and they desperately just needed someone who could be primary creator. Doubt suggs may not be ready to do that yet. but you know if jalen suggs becomes a malcolm brogdon or fred bandleader. Maybe as the upside of like a cow lowry. I mean number five. That's a pretty damn good pick raise. So i think i've not as high on suggs as some just because i don't see him as a future super duper star necessarily as the guy on an offense but certainly at five a totally good pick their fronts wagner though a little bit less high. What do you think of. I'm probably a lot less high than i think. It'd be with wagner. It's what does he do at a level that like let's say forces your opponents response. So i think he can be capable help defender. I think that he he's a good comedian. Is some of the defensive. Michigan was good. He can move the ball. But i don't think he's dynamic enough with the ball in his hands to really create reactions and he's not a good enough shooter that he's going to continue to occupy that defenders attention and so i think it's harder for wagner to make that sort of impact and to draft to draft him at number eight. It could work out. I don't expect it to Based on what. I've seen. So i i just. I didn't love the film unim- i didn't love didn't love him in some relief. We'll talk much more about that later. And i'm a little higher in the new. I had him in the same tier. Evan moberly and not in the same here with command guy. I think that there's a lot of ways that suggs can contribute to winning basketball. And like i think his fours a lot higher. I value that and i thought he delivered really well not in some early however that didn't impact my greatest much just because i thought that was the best player in in the draft and they got him at five.
