Facebook to investigate claims that Facebook has an anti conservative bias and I have had suspicions of the past few years particularly in eight twenty eighteen there's a Facebook algorithmic change that really hurt conservative sites in a serious way and it turns out that there are serious concerns that there are serious concerns with regard to face books by but it appears that Facebook I'm like a lot of the other big tech company just taking those concerns seriously and we hear on the bench appear show like to give credit to people when they do the right things even as we like to clock them when they do the wrong thing so good for Facebook to senator John Kyle the Republican from Republican senator from Arizona he's brought in with Covington Burling to do a full scale investigation into this and here is what they found he says we cast a wide net using a broad definition of conservative in order to capture for this report the concerns raised by all types of conservatives conservatives in in precise terms for our purposes includes political conservatives people of orthodox religious views libertarians pro lifers traditionalists Republicans and free speech advocates as an initial step we identify key conservative organizations individuals and lawmakers who either you study or have the potential to regulate Facebook since may twenty eighteen we've interviewed approximately a hundred and thirty three of them we presented our preliminary findings to Facebook in early August twenty eighteen and they conducted a follow up interview so here is what they found here is what the this internal study over at Facebook led by senator John Kyle found in this is a good study that is attempting to do the right thing all of big tech should take note Twitter particularly should take no because that continues to run like a garbage heap in a Facebook is actually trying to do the right thing here so here is what they found there were six categories of concerns all of these are legit a content distribution and algorithms in order to sort through the thousands of posts that Facebook users could potentially encounter on a given day Facebook to place a variety of mechanisms to prioritize the content most relevant to each individual user conservatives fear that these mechanisms prioritize content in ways that suppress their viewpoints interview is voice three general concerns on this front first and January twenty eighteen news feed algorithm change I talked about this at the time in January twenty eighteen Facebook changed its contents ranking algorithm to favor content that a given users friends and family comment on and share as well as news from quote unquote broadly trusted sources people on the right very concerned and Facebook's definition of probably trusted sources as well we should have been this is correct click bait and spam also Facebook made a concerted effort to deep prioritize click bait and spam interview is generally support the school but found Facebook policies for doing such will take again that is a correct critique of Facebook that Facebook was prioritizing as spam headlines the didn't read like a boring headline from The New York Times finally fact checking in false news interview is expressed significant concerns about Facebook's efforts to combat what the company refers to as a false news in particular interview was pointed to examples of instances when some of the third party fact checkers utilized by Facebook at various times nope split effect factcheck dot org eight people which are certified by the pointer institute entity that owns politic act has skewed to the ideological left we know that Facebook has accepted fact checkers affiliated with conservative publishers including the daily caller's fact won the weekly standard used to have one but then stopping operational and so what Facebook needs to do is either form their own independent fact checking group that includes Republicans and checking organizations left wing fact checking organizations become a club to wield against conservative media okay so those are three of the concerns other concerns or content policies hate speech designations for example interview is concerned stemmed both from the notion of having a hate speech policy in the first place and from unfair labeling of certain speech as hate speech interviews pointed out the highly subjective nature of determining what constitutes hate an assessment that may be subject to the bias sees content reviewers also Facebook prohibited the use of the platform by terrorist groups and hate organizations and it is unclear exactly how the hate organization designation is made especially considering that Facebook had had been perceived to rely on the Southern Poverty Law Center which is a garbage left wing hit group so same sort of issues the fact checking and finally there are other kinds of policies that that a lot of concern bids were worried about they believe that Facebook's community standards were just for passion disproportionately affecting conservative content particularly pro life socially conservative religious content because Facebook would constantly flag conservative content so Facebook is now responding and they're changing some of the policies they're changing some of the policies so they are changing their their contents enforcement policies again this is good for Facebook when he and we should give them credit when they're moving in the right direction they're going to specifically try to fight back against badly flagged content they're going to create the ability to appeal decisions they're going to change their political ad requirements so that is a good they're they're adding to transparencies let's talk about some of the things that Facebook is actually going to do so they're going to help users understand why they do or do not see certain content in their news feed is all you can ask from a big tech companies that they be more transparent about what they're doing Facebook introduced why am I seeing this post to help users understand why they see certain content they're going to provide explanations of the news the rankings Facebook has really not clarified its community standards in news the ranking but now the company says that they want to do so they also want to give people ways to control their news feed so that you're not going to be controlled by the great minds over at Facebook they wanna make enforcement actions against pages more transparency people know exactly why they're being flag why there why the posts are being treated as bad policy and they're going to share more details on exactly how they create their community standards so this is all transparencies good thing they're creating an oversight board for content decisions they'll issue kind of quasi judicial decisions on on how they are controlling content and they're going to include a conservative feedback in that process as well as a public comment period they're going to ensure that that oversight board has viewpoint adversity they're gonna create an appeals process if you get flagged then you can now be a let and they're going to increase staff things the publications can reach out to Facebook more directly they're also going to change their advertising house is one of the complaints is that Facebook had banned any ad that had pictures of of the fetus is more boring human babies premature they were pro life and now they're changing those content policies Facebook has historically prohibited advertisements showing medical tubes connected to the human body that policy resulted in the rejection of pro life ads they're changing that now so again is this a final answer for all of Facebook problems no but good for Facebook for taking this seriously really good for them for taking it seriously and conservatives should say that a consideration come out and they should say when Facebook does something.

"So that's not a great sign. I, yeah, I want to head off because I have seen already. I think politico is up with the story saying, oh, well, you know, Francisco has a conflict of interest. He's obviously going to recuse himself. I wouldn't explain what this conflict of interest is, and my belief that he absolutely will not recuse himself. Well, especially after all Trump does is go after by the way, if you're if you're an evil cartoon villain, as these people are Jeff Sessions is like the most productive in terms of carrying out your evil plan. And yet he's probably gonna lose his job after the midterms in my opinion, because Trump is so angry that he recused himself. So I'm sure that would be somewhere in the calculus of whether or not people want to recuse themselves fide. I completely. So here is the allege. Conflict of interest Francisco was a partner at Jones day Jones day is a Covington and Burling style firm, right? They they may even be bigger than Covington Burling. They're huge. I have friends over at Jones day, right that it's it's an enormous. They've thousands of lawyers across multiple countries, right? Another law partner is Don Mcgann. White House counsel and Jones day continues to get paid for advising the president. They were the law firm that represented the Trump campaign and they represent Trump with respect to the Muller investigation. However, so long as an attorney is walled off, it is virtually commonplace for you know, you've got one corner of the firm doing this work for Donald Trump and it it absolutely. In my view would not preclude franscisco from saying, I never did any work for the president's campaign. I have no ongoing contact with Jones day. And so there's no problem. There's no conflict and you don't have to bypass me. And in fact, Doug, this up Francisco signed an ethics agreement when he was appointed as solicitor general. And the ethics agreement specifies that basically he gets he gets a lump sum paid into his retirement account because he's a partner at the firm. He hasn't given up his partnership there, and the firm is being paid by Donald Trump. And then it says for seven years, the. Withhold a portion of his partnership shares a reserve for account reconciliations and tax payments that the firm makes on behalf of its partners until all of these payments are made. He will not. He Francisco will not participate personally and substantially. In any particular matter that to his knowledge has direct and predictable effect on the firm's ability or willingness to make these payments unless he first obtains a written waiver, pursuant to statute, and the reason that I predict that Francisco will say that this walling is sufficient is because he's already done this in February of this year for in Cisco, initially, recused himself from representing the US in the travel ban case because Jones day has provided legal advice to the president regarding the travel ban. And we're in fact representing an amicus. A petitioner in a group that filed an amicus brief on behalf of the travel ban. And then after about a week, he decided to unrig us himself in that matter. So I do not believe that knowl- Francisco is going to recuse himself. If he is the next man up, if Rosenstein is fired, he will then assume jurisdiction over the Muller investigation there. There's another bit going around that says, you can't be acting acting, which is true for succession, but the the fact that it was the acting attorney general that I issued the order appointing Muller in my view means that the acting attorney general then has ongoing supervisory authority as Francisco. I made calls this morning because I, I realize we're trying to sort of piece things together. I called French. I tried to find out everything I can about Francisco to see is this guy a hack is this guy, and I couldn't find anybody who knows him well enough to to to tell me that from the inside doesn't look good. But and again, you know, there is. I don't know. I mean, I just I had the good fortune of knowing rod Rosenstein, right? If it had been, I'm sure there are other rod Rosenstein out there. I don't offend. He recent to believe that no Francisco is one, but sure hope he is..

And I think it because he understands all too well that the delay works in the Democrats favor. And he said if they want her to come up testify, maybe maybe do it on Friday the vote but Thursday or Wednesday to the Jewish high holidays are here as well. But you know, the idea of waiting entire extra week on this. He he didn't think it was a good idea. He thought he said the process is what the process is. There is no way of getting at the truth. Thirty six years later. This is only being done for one reason. And he thought have for common say her piece, but he was very concerned about a delay in vote. I don't think they're going to lay it very long. I think they had some delay built in because they suspected something like this might happen. So I'm not concerned with the delay of a few days. And I think it Republicans have been very careful to say she deserves a fair hearing. Now, I think on the other side, you have people say, well, you better not go. You know, you better not really question. Her better, not treat her poorly, while I'm sorry, everybody has you know, the right to question somebody's credibility. When you make an accusation like that, we don't we don't believe the accuser, that's not the American way, that's not due process. That's not how we do it. So by the way, somebody had a great idea. I forget who it was yesterday. Which was let's not have the Senator. Let's let each party that was my point. That was my lawyer. Yeah, we don't we don't need any more history. And is there who's who will stand up for just the Coequal branch of government, the judicial branch here, and friend of mine said who used to work for Covington Burling, he said I'd like to chief Justice to come out at some point. And give a statement about standing up for judges accused three and a half decades later of something to just simply derail a nomination for political reasons. And you know, he won't do that. But he is the head of the judicial branch is he not? He is. You know, there's there's the old Adam Smith comment. There's a lot of ruined the country. And I have great faith in our judiciary. Yes, they're subject to partisan attack. And really it's been going back to the to the Earl Warren years, and even before that too went after you tried to pack. The court has gotten really bad now. One of the worst periods in our history. I think we have a right to criticize Sushil opinions and actions that we don't agree with it. I I agree with you that this is damaging. I don't think it will be long term. I think most judges when they get on the bench, even though obviously they they can be motivated by a particular philosophy tried to do the right thing. And so I think we'll be fine. I really do people have by the way that memory is so short term in this country. People forget, I I haven't seen any reference to it. When Merrick garland was nominated by President Obama, Jude Cavanaugh came out with an article or. Or a statement praising him. Everybody seems to have forgotten about that. I think there's also a tradition of you know, of gang above the fray and the federal judiciary. You really is our crown too. I think it'll be fine. But this certainly isn't helping it. Well, I mean, I I agree with you in theory. I it would be nice to see some judges from who are appointed by both Republicans and Democrats to stand up now and say. We have to be very careful about how we're treated as members of the judiciary. I mean, we treated we should be treated fairly to that would be nice. I mean, you got Ruth Bader Ginsburg. She said something last week. I guess critical of the process, but I again, I just go back again the verge all these this. This is not a great situation because it makes the judiciary seemed like just another political branch that you can you can throw political. Political dirt at and that's not the way it should be. Shouldn't shouldn't be that way. I think they're going to be. I think they're going to be you're right. I think one reason they're going to be very cautious here is because of the continued fall out from the whole matter and just the whole issue of. You know, harassment and the me too. And. Judiciary is usually quote self in a way on these personnel issues that some people see us having swept under the rug. So I think you're right. But I don't think you're going to see that. Yeah. "Welcome to intersections part of the brookings podcast network i'm your host adriana pita with me today arjun son donnas and fellow here brookings and visiting scholar with east asia project at the henry elston center also whitney steinman also a non resident fellow brookings and senior international advisor for africa covington burling thank you both being used to be here so when we had originally planned this we were going to talk about the now former secretary of state rex tillerson africa so i still wants to talk about his trip and maybe what affects us missile may have had on the outcomes at that trips we also wanted to particularly look at the state of us and chinese policies investment and competition on the continent of africa to dive right in rex tillerson visited djibouti kenya chad nigeria ultimately cutting short by one day so when he does his firing make his trip just to complete wash out how people reacted to any of the assurance he might have made or what that means for their assessment of the trump administration's priorities let's just say we i've not seen a trump africa policy emerge what we have seen has not been positive there's no question that president trump's alleged derogatory comments about africa were really very unfortunate whether it happened or not very unfortunate secretary tillerson's trip i think had promise secretary tillerson hosted thirty seven foreign ministers in washington last november to set the priorities this trip i guess was an extension of that in my mind sort of a listening tour but i think many of us were in a watching mode what is trump's africa policy now tillerson's gone there is no trump africa policy yet a new secretary of state has been appointed and i think for the near future we're going to continue with many of the problems that we have a lack of appointments in critical positions no embassador.

"Well in part because travis kalanick himself was a very strong leader uh he was considered the uh the face of the company he he he occupied several does rules in as ceo himself and uh and until this year when the wheels started coming off so to speak uh they didn't see a need to fill those those positions uh the the company was operating smoothly it it now is growing quickly uh revenues growing they were getting uh of new investments and uh and then things just started uh things just start snowballing callinig will remain on the board he's not totally separated from the company that is correct yeah i guess things really started to go downhill for over after a former software engineer alleged as chauvinism at the company this was in february and that's when a lot of workers in investors began questioning travis kalanick s ability to remain in charge that's right it had set all this in motion uh the the engineer uh described her experiences there uh which included the unwanted advances from a manager uh reassignments rather than a dealing with the the managers who su who she said were problematic and at it said oldest emotion a uh over uh very quickly after her blog post appeared hired a former us attorney eric holder on in his firm covington burling to investigate the company the heart another law firm to investigate the company led to firings it led to a long list of recommendations from from holder uh including things like a mandatory training sent a stronger coo role than than originally envisioned and some limited uh some limited power for the ceo so uh.
