"Heard a noise. And looked in my mirror, and by the time I turned my head from straight to the right mirror to see what it was one of those new Corvettes past me. Doing well. Over 100. I was doing 70 In the 65 that car had to been doing every bit of 120 130 miles an hour. It came roaring by sounding like a Ferrari. Yeah, looking always is. It looked? It looked awesome. I'll say that I mean it just blasted by everybody there on the right lane. And then the thing that also surprised me. Get hammered on the brakes to make an exit, and it stopped instantly. I mean, that card. Is it smoothly, No diving. No, we've enough and it was down and off. It went I thought Turning into a big town. I just saw you get me one of those. Lets talk to Cory. Cory here on the end of the road show. What can we do for you? Well, I got AH just bought Saturday at 2014 Chevy Cruze Diesel. And Periodic when they come up to a stop sign and sit there for 30 seconds or so start released in off the brake pedal to touch the gas or the throttle. And it like neutral drops, it jumps. I am impressed. Planet Year. I'm impressed so quickly. You adapted and caught yourself a saying. Gas pedal the model. That was impressive. I noticed. Yeah. Oh, I know that Russ has had One of these vehicles that we headin for other problems that are really about that one really did not make friends with it at all. It's selling that now we've got that. That wasn't me. That was an emissions thing with the end because they Tend to be pretty good cars. But when they start having problems with that emission system in the deaf system, Oh, boy there they can get very expensive, so be prepared. But the problem you're having is just a typical old General Motors transmission that model transmission issue, which could be caused by something simple as Fluid. That's a little bit low on that could be low because the transmission lines they're comin to leak. They see just a little bit. You might not even see it on the ground, but they seep and there's so little fluid there. That it Khun get down low enough, you or he might just need some fluid in it. That could be one thing. Valve body problems could be another that can be addressed in the car with solemn Lloyd's and Val body. Ah! Worst case could be a transmission. The internal seals could be leaking, so it's It's slipping when you come to a stop the pump pressure just can't keep up with the Leaking inside and you have no lights on or anything, or else your pride brought that up. I mean, it's just Mondays engine service, like, come on, and then I know it's fallen. Remote start. Didn't go on. And then when I got in the car in service, like, come on. And I dealership. I bought it from a certified vehicle. They're goingto take a look at it. That's good. That's good and only owned it for three days. You know, there's a lot of there's a lot of times where that check engine light comes on. And then you're Your remote start will be disabled because it's not going to let your remote start if there might be a problem that could be detrimental to the vehicle. Glad mine doesn't do that. Thie, but let them have their shot, and hopefully it's something simple. You know that with that with that package it's on there. There could be some other sensor. But if there is a light on its gonna point him to a system, they're going to able to look at it. See what's going on in that system. And if you could do if it's doing it all the time, and they could duplicate it. That's even better yet, too, because then they can actually like Russ says, Watch It happen in real time with the with the computer hooked to it, and that'll help pin it down. Pretty quick that helped you out there, Corey Yeah. Thanks very much for the call that is buying it on a Saturday check engine Light on a Monday sad That's got to be a But it happens. It does happen, and at some point at some point that check engine light's gonna come on, and some would swear that people would predict that it's going to come on when they did, and they just got you. Ha ha ha. Sometimes it just comes on. There's a day that it's going to come on. It's like the warranty. You know, when they give you a 36,000.

That really introduced me it. and was like the spot to go when you're a college kid to have like Brunch and breakfasts, because it was like it was family, mom and pop enough where it's like you can bring your family feel fine, but if you're a college kid, you wanted to just get a bonds mimosas. This place was like off the chain baby I was like Oh my God like. That was a spot. Sponsor me off. Next. For me, I WANNA. Give I want to shadow to. A very. Place that I've found recently and it has been a visiting my buddy show up. Impasse aromas a little bit beyond that as Templeton or South, that Templeton It's a really quaint little spot called kitchenette. and they have. a pretty ECLECTIC meaning to have like Korean stuff in there I've seen. "So many people that are being affected by this in one way or another whether you have it family member a friend or if you've been forced to work from home or your business has been closed down what there's been so many people that have been affected by this wide reaching corona virus pandemic and we're just scratching the surface it's only the tip of the iceberg but now I've wondered to well what if you're pregnant in the uncertainties around that I remember a few years ago Camille was pregnant when we had the Zico virus and that was incredibly scary you know because it's like well could the Zika virus be here and we actually had a trip planned before she we know we're pregnant but we get a plan with with my family my parents and and my sister and brother in law and it was we're gonna go we're gonna go to the the carribean and we had this trip planned for a couple years Camille got pregnant and she could have gone because she was probably about six months pregnant not not I mean not ideal but you got a gun but then the Zico virus and it's like we can't we can't risk it as we we just we don't know and then I remember having to get tested before and after just to make sure mmhm and now I can't imagine being being pregnant during this time having to deal with the stress of everything about unemployment health safety in fact I don't that's on the Star Tribune there's an article and it talks about well how it means less visits to the doctor of course I actually I'm I tried to to find someone who's pregnant or or maybe their wife is pregnant and couldn't do it I want to hear what it's been like for the for them but we couldn't find anybody who's going through that a Corey yeah well what do you mean we I've what what my wife is pregnant were set to give birth in two weeks oh is that right I feel like a graduation I feel like at least you should have known that congradulations and I didn't know that but congratulations so do you think of a week's time yes two weeks from today in fact it's a scheduled C. section but I feel like again you should have known that for a while now well how how is your I know you're married what's your name and how she's feeling it's you're right everything you just said it alluded to about pregnancy it's it's it's not maybe frightening isn't the right word but it's unnerving absolutely my wife is like I said two weeks away from giving birth to her second child she works as a physical therapist and a hospital here locally she's already been told by your doctor her boss or working at a previously but told by our doctor last week you're done you're done so luckily she's staying at home now we mail might be missing paychecks in that way but you know we'll get we'll get over that as long as everyone stays healthy but there's a lot to deal with she had an OB appointment just last week that was initially she got a phone call to say okay come in this door of the clinic will meet you right here escort you back you'll be fine and then the day before they said actually we're just gonna do this over the phone so that was a certain certainly a change she's got another point in that she does have to go in for next week which is a little bit you know when you get used to start to think about things you worry a little bit and then what the actual hospital stay is gonna be like you know we're worried if I was going to be able to be there or not bill with no visitors allowed in our our daughter now is going to be able to see her brand new baby brother or sister for a while the grandparents will be able to see their a new grand child for a while and we're you know we think about okay having them in quarantine who can see the baby you know you see videos now of people you're bringing their babies to be grandparents family friends but staying outside the house you know should we be doing that there's a lot going it has it meant less ultrasounds I'm I think we've been further along where it has it really in fact impacted us she does have an ultrasound just the final one like I said next week that will happen but first setting for some it might just as far as you know you know this is the sum of those your checkups with the ultrasound we don't actually get to watch the video but they just check heart beats and things like that mmhm you know they might just yeah I could see doing a phone call like my wife had last week with it is that he does everything feel fine you feel the baby kicking bubble by you having any problems so yeah I think it's any way you can keep you know a a pregnant woman out of the clinic or hospital setting right now is probably a good thing if you can ensure that everything else is going well and smoothly yeah well man blessings to you and and your wife and on this pregnancy well congratulations yeah thank you and it's you know every day I come back all rights I quite literally I walk in the house and stripped my clothes wash my hands wash my face wash as much as I can just you know to be as cautious and careful as humanly possible yeah and then you're gonna you're gonna take some time off right yes yes I'll be a couple two three four weeks somewhere in there okay I know you're gonna miss me it sounds like terribly what's your name again that's cute UP next UP next wow we you know the coronavirus has really taken over and kind of forgotten about this other crisis the climate crisis we'll explain.

"The end of C. used by the way during a freakin love it but yeah so my point is like your weakest quarter thus far is not really a weak quarter it's just been a product of who cares and you have arguably what atop the reeve fourth quarter quarterback in the NFL yeah one of those touchdowns top five at work okay I I yeah one of the touchdown that was scored in the fourth quarter shouldn't have been thank you your your defense messed up a little bit that's what happened and now in which the man that's been the story of couple of men but that's what you're that's what your your offense is doing and that's that's never been this team's mindset that instead of and that's given we talked about the closer it and like the sixth inning we talk about the clothes or maybe the selling their closing out games in the third quarter by saying we're not going to even. allow you to get back into this game mentally we're going to take your soul in the third quarter and then in the fourth that's whatever will just run the ball out that's when you're supposed to do it you don't do it in the third quarter in the third quarter you make them say okay we give and that's what they're doing by office of the coming out and thrown it and throw the ball over the field is this a fair statement the cardiac cowboys have literally had zero games where the game was in doubt the fourth quarter this year right. yeah in in yes one is because the opponents are good enough that's fine but you're also doing it that's what's happening yes awesome yes okay I'm sorry I know we got to go but you're so right about that how many times have you seen this team play against teams that were good enough and they weren't running them off the field yeah long. I just miss man they make adjustments now what a world they change the KC masterpiece right here on one oh five through the fan coming up next tennis player Nick curios has us wondering is a hot chick ever distracted you from your job or something really important you needed to do. yeah I know Corey yes Sir I hear the fan. coming up tomorrow on the Ben skin show still talking cowboys with our buddy David Hellmann at eleven o'clock and then our good friend teddy Emmerich joins us in studio at noon because he has something really special to tell you about the cowboys saints game to get your grub on their local homegrown Homeboys Richards and it's been in scanned tended to on one oh five three the fan..

"Cool again, if you have terrible branding. Maybe. That's cool. Cool Corey, yes. And so mission products is the company that that distributes cool core. Dr cool. This is their business and technologies argument is that they can yank that away. But of course, temp -nology, you know, if you play this out what their what their goal is is almost certainly to go back to the table. And 'cause mission products to pay them more renegotiate the deal. 'cause they they had granted them the right to use this, and then they're taking away. And then they can I mean, they could you get if you could do this. You would get to get paid twice. Or however, many times you were willing to file for bankruptcy. It turns out some people now are willing. Why why would bankruptcy long want to make that a thing? Why would it want to give you the power to take away? Something you've already given to another party just because you're bankrupt. That's the curious thing. I mean, the baseline rule in bankruptcy is that if you have rights under state law. Bankruptcy can't change them. Those private law rights stay in place, it might reduce them to damages or somehow exceleron them, but it's not going to change the underlying property rights trademark license creation of state law or federal trademarks or federal federal, but the licenses are staying calm. Okay. That's confused. You know, the briefing even gets ethic problem of. Whether they are property rights or contract rights, guys. I love this case unlike every front, I'm sure every single one of my students is like no this ladies talking about the property contract line again. But I really liked an analogy that was in the brief Ajay Westbrook. Ted Jiang or a handful of other law professors. They said you can understand this case. Really? Well, if you imagine that you that you purchase a laptop and that laptop comes with a service agreement or warranty and imagine that the manufacturer of the manufacturer of the laptop goes bankrupt. They certainly can cancel the warranty. They don't have to continue performing on that contract. If they decide that there, you have a breach of contract claim against them. But then you might get your claim is going to be whatever the present value of the warranty is and your you'll get the pennies you're not gonna be able to say gimme back, my laptop. Well, so that's just it. If you get to rescind the wholesale contract. Do then attend like. Think to bring house that would that doesn't make any sense. And then and then sell it back to you for another fifty bucks or something like. The same analogy with a toaster. You know, where the toaster company, sells, you toaster. And then offers you a warranty and they go bankrupt. And the point is we'll just because they stop performing their obligations under the contract doesn't mean the other party, you'll automatically lose all their rights under the contract, including two toaster that they have. So a lot of people in this case having fun with does and examples things that the brief has this thing about like a franchise agreement and a company called burger town. The implications for franchise for franchise are perhaps some of the most devastating because of course, a lot of these fast food chains are struggling or maybe they would describe themselves as not meeting their performance targets. And you know, these franchise agreements are, you know, they're borderline predatory. They are heavily regulated under state law. And it is it is where when they happen renegotiated they've become very tough for the franchisees. And so for free. Which is or could go to bankruptcy in decide that they were going to reject all of the licenses rejected their franchise agreements in van 'cause everybody to have to come back or lose their life's work. You imagine like seven eleven is historically been like the shop that you open up. If you're like new to American you're trying to make it that is going to have significant economic implications that I can imagine a lot of states don't want to see happen commute in a lot of communities. Don't see happen. So, you know, this is one of those cases where the split is not very deep. It's certainly been out there for a while. There's a giant vehicle problem which will get into in a minute. So I sorta surprised at got granted except that like the economic implications of are so severe it makes sense that needed attention right away. Yeah. Before we get to that Justice. Shabila problem is wanted to flag. You know, you mentioned Danielson Elliot's on the case and full disclosure. I also worked at Wilmer. And you know, so. So feel free to take what I'm about to say as just a complete Homer, her reply breeze. Replied, recent she is on tend to be some of my absolute favorite. So when I agree legal research and writing I taught a reply brief yum from case that she argued, and this one is no exception. So, you know, the opening to her brief I think she is just so good at characterizing the other side's arguments in both affair and Avakian of way, that is also very dismissive, and you know, just kind of colorfully. So so three example, you know, she after the kind of frame this toaster analogy, she says an agency she say like the team, which is a part says all this is set out in missions opening brief technology has little to offer response lacking any textual foothold in the statute. It relies on a snippet of out of context language from this case that has no bearing on the question here it then attempts to draw a negative inference regarding Congress's intent and is just so she's so. Good at characterizing the other's position in other sites position in a way that makes it seem obviously wrong, but also the characterization is not fair, and I just wanted to fly. So I also think that she is particularly good at taking complicated issues in explaining them. Simply particularly in the middle of argument. And so I'm I think that having her in any of these fiddly statutory cases, a real advantage will Danielle who is very good at that as well. Believe it was your SCO dislodged proce that Ross Guberman rated one of the bathroom, better Skoda's blog posts as far as writing clarity. And it was on that incredibly complicated not judicial for closure questions. So you know, what I don't know what it is with Danielle's complicated issues of bankruptcy. But you know, just you keep doing whatever Danielle's do. To non complicated issues in bankruptcy. They're a little redundant. Okay. So let's talk about ability as well. So what's the problem? So here in this case there were two issues in petition for social Rory. One of the questions presented the first circuit said that it it wasn't a retained. And so the the pre court didn't grant that wasn't what wasn't preserved sorry preserved retained. I dunno where I go a Dan obtained managed mentioned. So in that issue was specifically about the exclusivity rights. So which is trade, right? Exactly. Right. Not quite and so, you know, mission products, they're the they're they've got varies exclusive rights under their contract. And and these are distribution rights. There wasn't issue about whether the their exclusive right? Could be changed by or they're right. Could be main Don exclusive by the bankruptcy court it it wasn't properly preserved. And so the supreme court only grants are Rory on this three sixty five issue. And just explain explain that issued in Winson. It's they only grants are Sharara on this issue about whether rejecting a contract is breaching it or recinding at and so. Suddenly were in the moutainous were in argument, and the mutinous arguments are the way that the respondents are presenting it has three part. It's that by granting the first question in not the second question. So by granting the recision question and not exclusively question. Sco dismayed this case moot. So they're conceding that the distribution rights and some of these other questions are still alive, but they're not under review, and they're saying that the trademark issues, which are they're saying are the only thing that's under review here are moot. Because there's no damages now mission products contest this they say the damage the say the damage claims for damages can't become moot. But the gist of the argument that the respondent is making is that look the petitioner didn't come in in prevent us from distributing all of the money out of the estate to various other parties in this bankruptcy, which means that whatever claim for damages they might have now even were they to win. They can't be paid. And so this didn't file the right thing. Well, it's not so much about them filing because stopping these distributions or you. You there diff- it's difficult to get a bankruptcy court to say, look, I'm going to keep this company in limbo until we wait to see if you get one gets her Cherie. And then we wait for an opinion. If you do particularly because there's this whole melting ice cube idea. Bankruptcy that the faster you rehabilitate, a company in get the case closed less waste you create. Because everyday in bankruptcy court. You're you know, spending the money of an insolvent company. You wanna get this closed up quickly? So bankruptcies ended up with this doctrine of moutainous where basically went once the money is distributed out of the state all of the pending appeals seem to die because there's no more money. There can be there's no remedy anymore. And so course, disuse this to get rid of them. Of course, this creates really bad incentives because you could say that you can preserve your win in intermediate core or in the trial court by pushing all. The money out of the estate, and this is this actual minister, this is what is called equitable because. Yes. So that's that's the thing in Ragab. See that's kind of equitable as a signal that it means that we're making it up. It's. Yeah. Have actually started questioning the grounds of equitable moutainous because an is essentially like a doctrine within bankruptcy. That says the cases informally move. But like for the reasons you were alluding to Danielle which is like for new bankruptcy, policy reasons. It would be like fish into how this wrapped up sooner. We're going to say it is move because we don't want to prolong the period in which we are extracting new damages are having this company or entity under spun. Spun court has never said that's a thing. Right. That's like there's there's some concern that like if they ever get this in front of them. They might be like, the, that's that's just not a thing thing at all. So it was a bold move. Right.

"Well hey there in welcome to episode number five hundred and seventy three of six pixels of separation the mirror podcast my name is mitch joel it sunday july the second two thousand seventeen let's get on with the show so who are you in what do you do so i am corey pouria i a speaker i would say first and foremost and i'm an author i'm going to say second and then it would side of that i guess i'm a person who loves living with passion so i love living my wi my purpose i really just love being able to get up every morning and go to bed every night and knowing between i spent most of my time doing what i love and you've been able to make a career out of this corey yeah i'll say maybe somewhat surprisingly because going into it i didn't really know that it would be possible in fact when i got into the speaking world i didn't even know that people got paid to speak i thought it was just your tony robbins was speaking it was because he had products he wanted to sell so i didn't even know a person could get paid to do this so yes apprising lii and thankfully i have been able to make a living at it for the last fifteen years tony was selling products initially that's what he was doing that's probably why i took it that that's what was going on and and then but one day i was like he actually getting paid to do this as well because if he is i want more of that or i want some of that and yeah so i mean he's obviously leveraged it and been able to both and i learned that speaking allows you to do both but yeah i didn't realize that speakers would actually get paid much like i didn't know even that stand up comics we're getting paid as well i thought it was mostly actors who wanted to promote a movie they were in what are you five years old you don't know the people get paid for their work what's going on corey well and i say that the speaking on minutely i was probably in my late teens early twenties and i didn't realize people are getting paid to speak the stand up comedy thing i yeah you're right i'm going back to probably when i was seven or eight if i'm being full disclosure but i actually didn't know at least that points in my life that people got paid to do those things so when you say you're you're paid speaker i mean i get paid to speak as well and it's a bit of a different model in terms of how i think about don't think of myself at all is a professional speaker i what is that okay shen looked like for those who don't know because i think a lot of people are always like i'd love to speak for a living or they see what i did that must be easy where you add in your trajectory how many years have you been doing how many years you've been paid to speak so i've been paid to speak now this is going to be kind of surprising perhaps for fifteen years and i've been speaking for fifteen years so my very first talk i got paid it wasn't obviously it wasn't something to write home about but it was i guess i'll say it was quite important to me when i started out because i was looking at this as a career as a speaker i and so i certainly got paid for my first talk and i'm not gonna say every talk in between because i definitely understand the importance of doing no fee talks but i was getting paid really early on and so what what it's like for me is i was in a corporate sales career with two sheba canada so the company that makes the well made the tv's it makes laptops and i went to konica minolta so i spent ten years in corporate sales selling photocopiers door to door something i don't.
