"Um and really you know my interest in music and the internet and the law sort of all coalesced around that litigation on that i just became really interested in sort of peertopeer file sharing and copyright and how copyright was were was not a sort of productive way of working through issues in the digital environment and so uh with that i started down a pretty long road of research on digital copyright enforcement in the face of evolving technologies and probably for the last 10 years you know i have been following the copyright industries you know as they have sort of pivoted uh in change direction you know as they've tried to sort of deal with this problem of whack a mole b o uh with with massive copyright infringement you know what i'm finding as as concerns sort of shift away from copyright and toured the regulation of speech and content online were generally um that sort of lessons i've learned from following the copyright industries as they respond to these issues of content regulation are assertive pretty easily translatable into issues around other kinds of content regulation so for example hate speech uh were revenge porn um uh or terrorism incitement yeah occur there are a lot of parallels in its it's been sort of interesting if if slightly distressing i guess to see how many people you know when they start looking at these things which which i think most people quite reasonably agree are are bad kinds of things you know terrorism revenge porn hate speech you know things at that we generally don't like but it's it's been distressing how quickly people leap to this idea that well you know you know the we have this dmc a notice and takedown 'provision and they say well that seems to work let's just apply that kind of set up to everything else without recognizing how much of a disaster in some ways the dmc a notice and takedown has been right so you know at one of the nice things about notice and takedown i guess is that as of all of this solutions for regulating online content in a way that sort of allows for ain't back and forth.

"Other troubles would follow and two thousand fifteen when labels like sony music began to remove some artists work from soundcloud so apparently sony felt that the company was getting less than what it was worth to have the artist music hosted on soundcloud service also there are issues with users uploading music that you know didn't belong to them so in other words the recap you right infringement problems youtube is also experienced this sort of thing like a lot and that also falls into issues with remixes and mashups who owns the copyright to that the copyright infringement issues so quick aside i think it's a cool point here to share that i think sharing a link to an artist's work is great so if there's an artist you like and there's a link to a legitimate soundcloud file or youtube video and it leads to that music by all means share it it helps get the word out and obviously if it's an official uh soundcloud or youtube a stream then everyone's cool with it i do not think it's super cool to upload audio that doesn't belong to you and share it that way because artists put a lot of work into creating stuff and even if they don't choose to monetize it themselves it's at least respect while the point folks toward an official source rather than pirates stuff now i often will hear the argument that sharing creates exposure but exposure ultimately means nothing to an artist if they're not if they are actually trying to make a living off of their music because he cannot pay the rent with exposure you can't say dear landlord hey i'm not gonna pay rent this month but don't worry i'm going to talk this place up to everybody so you're going to get great exposure all right rant over.

"Is you know i think sometimes difficult to comprehend which is that copyright infringement is contextspecific some people assume that like okay if you see this content here it's automatically infringing everybody must know that and maybe there are some cases where that's true but there's a lot of grey where you don't know is something fair use is something parody is it protected under for other reasons or maybe it's license i mean there are a number of stories of actual license content than being taken down by google content id because contin idea has no way of recognising whether or not that content is actually license or so the most famous of all which is you know there was this big lawsuit for many many years that that really was litigating a lot of the the boundaries of of five twelve notice and takedown involving viacom suing youtube over videos and right before right on the eve of the trial of viacom had to pull out i think it was about a hundred videos they had listed as as infringing that were subject to the lawsuit because they discovered that they had applauded it themselves you have this example of like well that's licensed use right i mean that's by commonplace putting the videos on youtube for marketing purposes and then suing over it and then and that doesn't even touch on the the next factor which is you know the people who are complaining about well you know google and facebook their big enough to do this.
