"Darryl. The big news of the day today. It was pretty obvious to me Conan. You actually brought this this is as a news story. I've got the source from vice news, which I did a little digging around this afternoon, and vice was actually the only one to fully published the affidavit in this case, Cody Wilson. Who is the gentleman we've had on the show more than once. I mean, he may may still go given what happened to him apparently within the last twenty four hours or so he was arrested and bonded out. I believe for one hundred fifty thousand dollars. Arrest warrant is out for his arrest. He's in Taiwan right now really missed his flight back to the United States to be arrested. Yeah. No kidding. How did I miss that detail? I saw some one hundred okay because I saw some paperwork earlier one hundred fifty thousand dollar cash bond that he was still out. I okay, I guess that's because he's not in the United States. Interesting chief of police awesome. Chief of police came out and had a question and answer. Couple minutes ago. Ten ten fifteen minutes ago and gave out a lot of interesting information. The girls age where this guy is at whether they tried to get a hold of them before they actually wrote up the warrant how strange I wonder why they would have tipped their hand on this. So for those that don't know the the news is that Cody Wilson, the founder of defense distributed is alleged to have committed so-called sexual assault, which you know, sounds real bad until you actually hear the details in the case of sexual assault. Sounds like rape. Well, of course, it's not rape. It's consensual this particular situation. You're not saying that sexual assault is consensual. No. It depends sexual assaults a legal term. And in some cases, it's nonconsensual in other cases, it's consensual because in this case, Cody allegedly had sex with somebody who is under the age of seventeen consented to the access, but people who believe in the sexual assault laws will say that you cannot consent to the actions if you're under the age of whatever fill in the blank Blake which. Yeah. Based on various geographic lines. So that was the allegation we can get into more of the details in the story here in a moment. But now, I wanna know why it is they put out a warrant for his arrest publicly like this in a way that's going to stir up a lot of attention. When presumably if he had been allowed to come back from because it's not hard for the police to figure out of dues not here. Right. You know, shop at a shop ask ask around for him or something like that. Oh, yeah. He's not he's not there. But anyway, he's not there apparently. And he I wonder if he's made any kind of statement about this yet if the chief of police in Austin has been talking than I I'm curious to know, what has attorney have to say when asked they said they have had no contact with him. Posted anything on Twitter in quite a while. Yeah. Well, I mean, of course, generally in in circumstances. Like, this most attorneys are going to tell you not to say anything at all. According to vice dot com, and again, they do have the full five page affidavit for the arrest warrant, which I read earlier today, the self-described crypto anarchist at the center of the national debate over three D printed guns was charged with sexual assault on Wednesday. According to charging documents. The Cody Wilson who's thirty years old paid a girl under seventeen for five hundred dollars for sex at a hotel room in Austin, Texas back in August. Sexual assault of a minor is a second degree felony in Texas. Well, at least vice didn't call her a child, which is what the police have been referring to this young lady as this so-called child was on a website. Apparently, wasn't it like sugar daddies dot com sugar. Daddy, neat dot com. Yeah, they call it. A dating platform. Now, some older dudes are in that and sung Yung younger. Women are totally into that. You'd better believe they're into it. They don't actually have to have a relationship. It's just basically gimme money. I'm pretty. The big question is is that is a site. This is is this prostitution because often is illegal. They're they're gonna try to throw it through with prostitution card. Adam you'd think they're going to try to arrest her for prostitution. Oh, heck, no, okay. Because she's the one who committed the act of prostitution also. And also lied about her age because there isn't because there's an age limit on the site eighteen and up. It doesn't matter though, you as the as the so-called sexual assaulter in this case, it's your responsibility to know, how old the girl is doesn't matter. If she told a lie to get you write something in some states in the prostitution or prostitution with the minor. As part of the thing at says it. I forget the exact wording that they have in New Hampshire. But it's something about I it's not a defense that the defendant told you that they were over a certain age. Yep. So. There's a certain type even if they even if they use an accredited. Is this idea or someplace or use this dating site in that case, you just checking a box and filling in a birthday, they're not actually, you know, they're not showing your you'll have to show ID because they're telling you I have over this. That's what they're telling you. So there, you know, like, so. This is the dating site liable. No, absolutely. You can make an argument you said that the dating site can't be held liable. That's not true. According to what according to the United States of America v. Ross Albrecht where raw sober twists convicted. Because of things that happened on a website that he ran he ran the website. The dating site is not liable for a girl lying about her age on the dating site. Now, there are new laws in the United States. The to foster passed earlier this year, which says that if a woman or man or whoever posts if there are more on your website that can be construed as prostitutes. And there's usually some kind of a stencil code that the people will use that, you know, saying thing means a different thing if you can point to fight the federal government can point to five different posts on somebody's sites like a Craigslist or something that they they say we're related to prostitution, then they can charge the website owner. Owner with like facilitating. Yes. Sexual enslavement or something, you know, trafficking traffic trafficking, by the way that is the department that's involved in this case. That's what the that's not what's likely going to happen in this particular case, Cody Wilson can't get out of this charge or anything because if they if they charge the owner this website with something, right? That's not going to get Cody Wilson. Right. It'll just be a co-defendant. Right. And you know, I don't know. Maybe there are prostitution ads on this site. But I would suspect that most people on this site day are trying to approach this from a different direction of I'm pretty unique to give me money. I'm a sugar baby is they're called. And then there's the sugar daddies who apparently apparently are just loaded with cash and just hand out money. It's prostitution when you when you make a deal in advance. Right. So if you say, look, I'll give you X for why? Then if she says, yes, or in reverse, you can give me x and I'll do why. Then you get you. They definitely want to bring him in and charge him with a felony so-called sexual assault. According to Texas, penal code twenty two dot O one one. And we were reading excerpts from this earlier just going to read it all in one phrase here, so sexual assault in Texas is defined a lot of different ways in the case. As far as I'm concerned, real sexual assault is where there's a victim who is not consenting to that would be definition a one. Yeah. Key words here assault that's against your will. That's not. That's not. Right because a one here says causes the penetration of the answer sexual organ of another person by any means without that person's consent. And then under section a two. It says a person who intentionally or knowingly causes the penetration of the sexual organ of a child by any means. So they take out the line about any kind of consent because according to these politicians, and the people who support this law people who are under the age of seventeen in Texas cannot consent right is ridiculous section c one defines child as any person under the age of seventeen. Right. So you're bringing up this question of intentional and earn or knowingly and suggesting that that the age of the person in him not necessarily knowing that person. So he knowingly had sex with this woman. He intentionally had sexiest woman, but he did not know that she was a child may maybe maybe not their definition. Who knows what he knew as far as what he can disarm. Argue that he didn't know maybe he could argue, but it won't matter because the fact of the intentional or the knowingly aspect of this has nothing to do with his knowledge of her age it has to do with whether or not he knew that he penetrated her right? So if he was somehow unconscious and penetration occurred, then he could argue heated. No, right. Right. Right. So if he was asleep in the hotel room, and she got him ready while he was sleeping, and then inserted herself on top of him while he was asleep. Then maybe he could argue that he didn't knowingly her that's the only kind of way out of that. And that would be a hard one to argue anyway, because again, it's still he said versus she said, although I presumably they did they might have done some kind of rape kit testing. I don't know. I forget if that was mentioned in the the affidavit or not, but either way. Sorry. This isn't rape. If the person consents, and I do believe that a teenage person in this case absolutely can can consent and most sixteen year olds have consented. And in a lot of. They can right. So what do you know, the people who support these sexual assault rules so called protecting teenagers in this case? I'd like to hear is a sixteen year old in New Hampshire somehow more mature than a sixteen year old in Texas because having sex with a sixteen year old in New Hampshire completely legal by consent. They could they could drive a two thousand pound vehicle down the street, right? They can't buy a pack of cigarettes legally, but they can apparently, you know, consent to certain things, right. And I think the inconsistency among the law is also a problem. But it's all it's all over the map. It doesn't make any sense. Ultimately rape should be rape. When it's nonconsensual. That's what should be considered rape. That's what should be considered sexual assault. And I mean this young lady net, Cody. He drove it to the hotel. They got the valet to park the car. She walked into the hotel room with them spent a couple of hours in there with them. And then she went with him in his truck. He drove her to a water burger and dropped her off there, by the way, Italy consensual, by the way, I do think they paid. I do think that there should be an age that. You're still award of the of your parents. And then you are unable to make these types of decisions, I should be an arbitrary age as much as it should be somebody who wants to emancipate them, right? Correct. And that's why I already have my definition. And that is if you are on your own, you're if you're able to take care of yourself, then you are capable of making a decision that you want as long as you're not hurting anyone else. But if you're still living with your parents. Well, exactly, and they have a problem with it. Because they have you know, deemed you. Unin incapable of making decisions on your own. Then I think that's a whole nother argument number. Remember, of course in most states, you cannot escape from your parents. You don't have the ability to emancipate yourself in New Hampshire. You can't do it. Even though the age of consent is sixteen in New Hampshire. You cannot emancipate legally from your parents so-called ownership or or protection. Right. So even if you believe you're ready, you've got a job, you're going to work, you, you know, you you are responsible at a young age as many of us were I was working at sixteen and working. I was going to go. I I and I got out the house was quick as I could. If if you are responsible, and you wanna leave the house where let's say worse, your parents are abusive and you want to get out of that household. Sorry. The cops that they pick you up. They'll take you right back because they legally have control over you, even if you want to prove otherwise, so it's it's frustrating for a lot of young people. I know that was controversial. And when I was living in Florida. There was some discussion over the emancipation laws, which I believe in Florida, you can be sixteen to eighteen and there's a court process called emancipation that you can go through and then a judge can determine maybe based on whether or not you're working or other factors. Whether or not you can emancipate yourself from from your parents. Yeah, we even even that process is bullcrap, of course, my opinion. But I mean, but the whole thing about seventeen you're still a child till seventeen Texas, Texas, you're being dumb. That's just that is for certain. For insurance purposes. It's twenty-six some states have a difference between homosexual sex and heterosexual said, yes. But it ain't just because the law hasn't caught up yet. Well, of course, that's what it means. But yeah, the suggestion being you have to be older in order to have gay sex, then straight sex, which of course, right ridiculous. And outrageous. Regardless. I mean, it's slowly imperceptible. Builds up in this three d. printer hours using it was only part of a gun and Andy never fired it. But it was just one of a selection of blueprints posted to the internet by Cody Wilson and his company defense distributed and those collections of digital gun blueprints have been downloaded thousands of times before they were taken offline. First after the State Department's decision to settle a five-year lawsuit with Texas based nonprofit defense distributed that company was going to be legally allowed to make blueprints for three d. printed guns available online. Quickly, however, state attorneys, general stepped into object to that decision, Washington state's Bob Ferguson who led the lawsuit by eight attorney's general argued that three d. printed plastic weapons are dangerous because they're untraceable often undetectable and require no background check when Tuesday, federal judge issued an injunction in the attorneys general favor blocking the gun plans from being published before a Wilson set August first deadline. Here's what happened today. Federal judge stepped in with a temporary injunction. Okay. And that's what it sounds like this is not over, but for now, there will be no more blueprints to make three d principal weapons online. And yet according to Cody Wilson, the decision does little to change a reality that's already barreling our way the debate is over the guns are downloadable. The files are in the public domain. You cannot take them back. You can adjust your politics to this reality. And ominous vision of reality and one that seems terrifying when I predicted back in twenty twelve. And yet when no one was actually killed with a three d. printed gun and nobody's seemed to be toting these around and cities or threatening people with them. It's a good question, and he's a very well-spoken guy in has his pitch very well developed at this point. I have been in touch with Cody since he first came up with the plan for three to print a gun before you'd even printed one fired. And my impression was always that. Really, maybe despite the first amendment argument, he likes the idea of getting guns into more people's hands, making it easier for people to get access to guns. I think that he deeply opposes a lot of gun control laws and is sort of this techno anarchists who thinks that technology can sort of solve the gun debate in. He wants to be the one to do it. Nestor wrote on our Facebook page, individual gun control is over technology. Not the government has made this. So three d. printing is going up and many business sectors, not just the firearms industry. This'll be bad news for gun manufacturers to when the day comes that you can print off an AR fifteen. The firearms manufacturers will be faced with declining markets. Yeah, I think one of the key aspects of that that listeners comment that I think is especially important. There's this idea of disruption and in our research, we really began by kind of interviewing a whole host of different folks from government industry, the security sector trying to get a sense of, where's this technology going? What are the term security implications? And we actually were surprised to find that there's not a terrible amount of consensus around the potential limits of this technology and its downstream implications for security. And part of this has to do with what are the sectors. What are the industries that are going to be the most disrupted going forward? And you know, I think weapons proliferation is obviously one of the biggest threat domains that we have a right to think about, and it's it's certainly the focus of today. But there are other ways that this technology will dramatically change social, political, and economic life. Is this the kind of thing? Trevor where if it hadn't been. Cody Wilson, I should be clear. He's not here to speak for himself so we don't want to malign his intense too much because he's not here to defend himself. But if not, Mr. Wilson, someone would have done. This was this kind of thing, just inevitable. I, I would tend to agree with that, and I also think that to some extent, I don't want to derail too much, but there's a question of whether or not this is somewhat of a distraction. So I mean, we can look at extensive gun control policy studies and there's huge variation or lack of clear results about the effectiveness of those policies. So I would refer listeners to more the the ran gun policy in America initiative for some of the rigorous analysis there. But I think at the end of the day, there are real limits to three d. printing of weapons and firearms of all types. And I think it's something worth discussing depth.
