show at 10 a.m. on WNYC This is morning edition from NPR news I'm a Martinez And I'm leyla faulted As civilian deaths mount in Ukraine some in the international community accuse Russia of war crimes Others including Ukraine's president use another word genocide But that word is specifically defined as killing or other actions committed with the intent to destroy in whole or in part a national ethnic racial or religious group Is that what we're witnessing Leila Sadat is an international law professor at Washington University in St. Louis and advises the International Criminal Court prosecutor on crimes against humanity Genocide is extremely difficult to prove before an International Criminal Court That said this does look like a pattern of ethnic cleansing or crimes against humanity So what's the difference there If it looks like ethnic cleansing do Russia's actions in Ukraine then constitute genocide That is a complicated question Leila The international community has said that sometimes ethnic cleansing can be a form of genocide and we've seen that in early decisions from the International Criminal Court in the situation involving Darfur where the prosecutor did charge genocide because there was in fact a pattern of ethnic cleansing destroying villages driving people away from their homes terrorizing a civilian population very similar pattern to what we saw in the former Yugoslavia what we saw in Darfur and we are now seeing today in Ukraine Why the international outcry here I mean Russian forces conducted themselves similarly in Syria civilians being targeted and killed we saw it in Chechnya And now a call for war crime charges and possible genocide charges We definitely have seen this before And it's a really awful movie Right now Mario pole looks like Aleppo In fairness there were calls for criminal prosecution We had two vetoes by the Russian Federation in the Security Council with respect to Syria And we did not have the international political well sufficient to overcome that through either the establishment of a no fly zone to stop the atrocities or creating a special tribunal to try those crimes because the vehicle for getting to the International Criminal Court was blocked Fortunately Ukraine had the foresight to declare that the International Criminal Court statute was applicable to its territory in 2014 and 2015 So unlike Syria's Assad who would never never accept the jurisdiction of the ICC the Ukrainian president and parliament has done that And so the ICC does have jurisdiction here and one also has to say that I think at some point the fact that the invasion was done in such a blatant fashion to a European neighbor clearly played a part You mentioned that genocide is really hard to prove but right now what we're seeing in bucha and charni of these places that have been liberated from Russian forces are these pockets of genocide or is that ethnic cleansing I think for me it's still kind of unclear to me legally what the difference is So in the former Yugoslavia the massacre at Schreiber Nietzsche for example was labeled an adjudicated a genocide even though some of the violence in other communities around the former Yugoslavia was labeled crimes against humanity The differentiation that the tribunal made was that with respect to Schreiber Nietzsche we had a specific intent that we could demonstrate and they actually use cell phone intercepts and documents and communications in order to show that And they also showed that a substantial part of the population was exterminated and that by exterminating the men and boys of Srebrenica these 8000 individuals who were slaughtered that actually made it impossible for the community to ever be constituted again Is it easy to assess based off the fact that we've seen mass graves that we've seen these burn bodies these bodies that have been stripped and people who had seemingly been executed the mock executions the sexual violence all of this stuff We are definitely seeing evidence of crimes against humanity and war crimes genocide requires this special intent So we actually have to show that they're committing all these terrible crimes in order to destroy in part or in whole the particular group And so that's why genocide is more difficult because you have to get into the mind of the perpetrator as opposed to being looking at the circumstantial evidence that we can see with our own eyes and our own ears The other thing I would say Leila is that crimes against humanity are just as serious as genocide There's no hierarchy here Crimes against humanity is what the Nazis were charged with for the Holocaust and so I know that the international community and victim groups tend to grab for this concept of genocide because we have a treaty on it and we don't yet have the treaty on crimes against humanity so it seems as if they're less important They're not less important They are absolutely horrific crimes that involve attacks on a civilian population and the dehumanization of the human spirit and human beings So it's really important to note that this idea of ethnic cleansing and crimes against humanity is a very very serious crime Now the U.S. has promised to help with any type of investigation into possible Russian war crimes But you know some people would point to the U.S. and say well this is hypocritical or politically motivated when the U.S. is not a member of the ICC and does not appear to want to be held accountable for its own alleged war crimes It is hypocritical and yet it's a really good thing The Biden administration is seriously considering dismantling some of the obstacles to cooperation with the International Criminal Court because it can see that this is exactly the kind of situation the ICC was created to address We have a prosecutor already with jurisdiction We have judges already to approve arrest warrants and hear confirmation cases We don't have to staff up and hire new people and figure out what law should be applied We have a court ready and willing to do the job And those of us who have been involved with the International Criminal Court for 20 years have been making this argument for 20 years So is the United States coming a day late to the party It absolutely is and I think it's great that it's finally getting there Layla Sadat is a Professor of Watching a lot of the NCAA tournament this year don't know why particularly. And I've noticed every uniform has multiple logos on them now. The NASCAR you got logos all over the uniform. Everybody's used to that. In the NBA, we now have one corporate sponsor, the Cleveland Cavaliers have been good year because they're nearby. A lot of teams have different sponsors. I think FedEx is on the Memphis Grizzlies uniforms. But this year in the NCAA, you've got the NCAA logo. You've got the logo of the manufacturing company, whether it's Nike or Adidas or whoever is making the uniform. And then you've got the American flag or some kind of logo on there. And one of the schools, I think, has their 75th anniversary logo. And then you've got the team conference logo. So you've got four logos right about the stirrup area and all these uniforms. And I got to wonder why. And what's next? Advertising logos on these uniforms? I understand wanting to brand a school, but I don't understand why the NCAA needs their logo on the uniform. I'm not making a lot of sense to me. The American flag logo, wonderful idea, but do we really need that?

Today, the athletics Kelsey Russo and Jason Lloyd explained why, this is a team to take seriously. For the first time, since LeBron James left town, again. And, in a potentially wide open Eastern Conference, just how big should the cap to be thinking? From wondering NB athletic, I'm on your skelter. It's Thursday, February 3rd, and this is the lead. Kelsey and Jason, welcome to the show. Yeah, thanks for having us. Thank you. Thank you so much. So guys, we wanted to pick your brain about how the Cavs have made their way toward the top of the Eastern Conference. But before we get into that, for anyone who had to avert their eyes. Can you just remind us how rough things have been in Cleveland for the last few years? Very. We saw was at forehead coaches up to this point, so forehead coaches, there was a lot of losing. I thought it will not come out of this road trip empty handed and will push Cleveland to yet another loss. Ten consecutive. And they wanted to do player development, but it still led to a lot of losses. There was locker room issues. Hey, let's talk about this story out of Cleveland, can we about Kevin Porter junior? Okay, the reports are that the cabs are ready to trade him or wave him because he had a tantrum the other night when he found out that his locker had been moved from where it had been. I think they won most like 22 games last season. The two before that, they had 19 wins in both seasons. So that's not a whole lot of wins. You know, going back to when Byron Scott was fired in 2013, Mike Brown's here for a year. He's gone. David blatz here for a year and a half. He's gone. Ty lue gets the job. Wins a championship. He's fired. And they hire John beeline to replace them. And that was a complete disaster. And the thought behind John was well who better to develop a young team than this college coach and John is a terrific basketball coach. In terms of fundamental basketball, he's great, but he's also on the wrong end of 60 and just couldn't relate to these guys. And it got off to a bad start and it didn't get any better. There was the whole incident where he called him thugs and he meant to use the word slugs, he said. Cavaliers coach John B line apologized this morning to his players after stunning them in a film session yesterday by saying that they were no longer playing quote like a bunch of thugs. Beeline says that he meant to use the word slug, not thug. And was alerted by his coaching staff after the meeting as to what his exact verbiage was. So he runs out of the building, gave all the money back just to get away from the NBA. That's how bad of a fit he was, where he said, you can keep your money, I just want out. So John leaves at the all star break for the first year. That is a terrible look for the calves. And it's just coach after coach after coach after coach and you're never going to build anything sustainable with that. And that's why I think there was a lot of doubt of whether or not they were going to get this right. And so with all that recent trauma in mind. But also considering that this team now has some really good young guys like Evan mobley and Jared Allen in the mix. What were your expectations for this team coming into the season? How did you think they would do? I expected them to take some sort of leap. It was the point in the rebuild where they needed to start winning games. You know, like they had gone through a couple seasons of allowing guys to develop, but now it needed to sort of translate into something more. They had signed Jared Allen at this point to his contract extension. They had drafted mobile. They had put these steps in place where now they were getting ready to take that step. So that was kind of my mindset going into of like, okay, now the winds matter. Like now their record matters. The last three years, not so much, but now it mattered. So I was expecting there to be a leap. I was expecting elite from their point guard Darius Garland. I was expecting an elite from iceman koro because that's kind of what they had really built this around was this young core of guys. But I wasn't expecting this kind of leap. So I kinda cranked it out before the season started of like, okay, what's realistic? What's not? And everyone was talking playing. So long story short, in order to get to the tenth seed, they're going to have to get to 36 wins. The problem with that is only 5 teams last year made that type of lead before percent leap. Warriors hawks Nick signs and nets. So really, if you boil it down, the Cavs were trying to do what the Atlanta Hawks did in terms of, you know, they've got this young nucleus and the hawks sort of exploded last year on the scene, obviously. And I didn't know how realistic that was, but that was sort of my expectation was, okay, if you want to keep your jobs, if nobody wants to get fired, you're going to have to get to around 36 wins. And obviously you see where they're at. Now, they're almost there now. It's remarkable. Well, let's get into why this team has become so good. And I thought we could break this down into three different areas. First, let's start with the backcourt. Tell us about for some of the challenges that the Cavs have had to overcome there. And why they've been able to. Yeah, there's been a lot. I mean, especially this season, you know, you start the season with Darius Garland and Colin Sexton as your backcourt, going back to the summer. You're bringing Ricky Rubio and then you lose both Colin and Ricky to season ending injuries. Down on the court, looks like he's in some pain. That jump stop white right there. You see that me? That left knee. That jump stop. It's non contact. Yes, and those are the worst. Very spin the kind of the person to hold it together. And his success this season has really allowed them to succeed because he's taken a leap in and of himself, but just as his play in his understanding of the game and how he leads the team. So, but the injuries really did wreck them, especially there and just the pieces that they had and that they early on were really a big part of that success, but they've figured out ways to hold on to it, I guess, through this stretch recently. And Jason, maybe I'll throw this next one specifically to you. Darius Garland has really emerged as a star of this season and he definitely brings an exciting edge to this team. What stands out to you about his game? What do you think he does, especially well? Terrific shooter, terrific ball handler. Garlic. Watch here by Damien Lee 50 year man and a Louis go home and a move Garland. Now you see me now you don't. Brilliant move by Garland really has a sense for the game. Great creator makes people around him better. Garland works on holiday. For a moment, shoves the move. My what a dazzling task by Garland and how about the finish by movely. Just a guy who's growing in confidence more and more and more and we've just seen him coming and coming and coming guy didn't play a whole lot in college and it's just gotten better and better and better. It has his head up looking for a teammate keeps his dribble bounces inside Allen down gorgeous. And really, I think one of the things that has really helped him is sort of separating him from Colin Sexton. And that backcourt, it just wasn't working. It's too bold on the guards. And it just didn't have a very good rhythm. And now, unfortunately, Colin had the knee injury. So he's basically for the rest of the year, but it's putting the ball in Darius's hands full time. Okay, let's move on to the front court. This team has a pretty interesting combination of young big guys, like Jared Allen, Evan mobley, and Lowery marketing. And then one now getting up there in years big man in Kevin Love. Yeah, and honestly that they start that three big lineup, you know, when Larry is healthy, which I don't think a lot of people thought was something that would work at the beginning of the season. But yeah, they start having mobley and Jared Allen and it.

There's 18 assists the other night. In a game. He's starting to hit most improved player as well. Potential all star in the exact guard line man. I was running through this with some friends the other day, that guideline in the east is really hard to crack, especially if demar Derozan is going to get voted in as a starting guard. Which may look like it happened, which it shouldn't be, because he hasn't been a guard in years, but yeah, but yeah, speaking of demar Derozan, segue, and teammate, Zach lavine, how for a little bit where they knee injury, no significant structural damage, but no timeline given yet, just it's going to be out for a little while, so let's see where this goes. You're going to be kind of cautious with Levine. It's the same knee. He had the torn ACL in. But he heard it early in a game, the other night did not play in their last game on Friday against Boston. He was in the news this past week again when his agent rich Paul made some public comments to the athletic about the situation involving Ben Simmons and Philadelphia. The sixers, of course, resumed fining Simmons last week for missing games after Simmons refused to meet with the sixers medical professionals about some of the issues he said is happening. Rich Paul came out and told the athletic quote, I truly believe the fines, the targeting, the negative publicity shined on the issue, that's very unnecessary and is furthered the mental health issues for Ben. Either you help Ben or come out and say lying, which one is it? Now Simmons, since then, has started to meet with the medical professionals in Philadelphia. He is still not back in the lineup. He is still not a full-time member of practice. So to say that Ben Simmons future is still very murky would be an understatement. So Oscar this hour, what do you make of the latest developments involving Ben Simmons? Honestly, I'm just tired of it all.
