Last week, the state Department of Social Health Services filed a notice that it is appealing that verdict to the state Court of Appeals. Now, The Cox family says no, it should go straight to the state Supreme Court all about Making a change in DSHS, where they actually care about the safety of Children and do their jobs the way they should be doing them the money. Unfortunately, it's the only thing we have. We can't force him DSHS to do anything. The bottom line was that they knew that Josh Powell had killed his wife. They knew the Children of war. Potentially witnesses and the kids were talking more and more about that, and despite all of them, and despite 46 red flags They put Those Children in the sole care of Josh Powell in his house, and through it all, Chuck Cox and family and their supporters have remained steadfast and wanting to hold the state accountable. "The seventies. Right now 68 degrees in Seattle News at 11 starts now. We start with breaking news from the White House President Trump says he plans to act as soon as tomorrow to ban the popular tic tac app from the United States. The Chinese own video sharing APP is at the center of national security, privacy and censorship concerns. The president said he has the authority to ban the APP through executive order or emergency economic powers. It follows reports that Microsoft is in talks to buy tick talk. The value is just weighing in calling a ban a danger to free expression. Also breaking on our live feeds. Right now, this out of control wildfire is exploding in size. In Southern California, the apple fire went from 40 acres to 900 acres in just hours. 200 homes are being evacuated in Riverside County That's east of Los Angeles. Like Washington. That area is getting hit by a scorching heat wave. And here in our state crews are still working to get this wildfire under control near like Crescent, an Olympic national park. So far, it has burned about 65 acres. Park Service believes people started that fire, but the cause is still unknown tonight. And this is just breaking now. In south Seattle, police say a car drove into this Safeway building on south a fellow street police just ended up clearing the same. We do know that driver is in custody. An historic verdict tonight as jurors find the state negligence in the death of Charlie and Braden Powell. They were killed by their father eight years ago. Lawyers say it's the most money ever awarded in Washington. For this type of case, Thomas Joel Marino is live with the accountability. The boy's grandparent's now hope to see Joel. Aly and Steve. This award is more than $98 million the boy's grandfather says it sends a message that the state agency that oversees Children. Got to change the culture that allowed this tragedy. The day Charlie and Braden Powell died. They were taken to their father's home by the Department of Social and Health Services worker for a supervised visit. But Josh Powell locked that caseworker out killed the boys and then himself an explosive house fire. The grand parents sued the state and now one over a jury in court Question. One answer. Yes. Chuck Cox calls a $90 million award A wake up call. I'm hoping that That this will be the start of them. Looking at their program and Following the rules and policies that they're supposed to be following. Police believe Josh Powell was also responsible for his wife Susan's disappearance in 2009. Attorneys argued that state workers weren't trained for parental visits and domestic violence situations until jurors it was time to change course. And I think he took that very seriously that they're standing in a position where they could really make a difference in how often can you make history? Chuck Cox says he hopes to use the money to help other Children. However, the state could still appeal the verdict and says it's currently reviewing its options. Back to you, Joel. Thank you alive. Look AT T Mobile Park tonight. The Mariners home opener just wrapped up a little while ago, and it sure feels a bit different in Soto Street's and seats practically empty. Most Co Miller is live outside the park Tonight. Cold fans, businesses. Trying to make the most out of AA pretty unusual start to the season, aren't they? Jesse, This is a lot different. Admittedly, it is my first home opener. But people down here tell me with the Mariners win and the weather as nice at it. As it has been, Occidental would normally be packed this after party would still be going That is not the case tonight with the Corona virus pandemic still in full swing businesses in the shadow of the park are feeling the blow its opening Day Cove in 2020 style with no one cheering from inside T Mobile Park on this Mariners home opener. Alright it might not have been the best idea to have are three and six year old girls share a bedroom because it leads to random screams, followed by crying, and then somebody running down the hall. She took by doll. She threw my book, she tattled on me. That's my personal favorite. When my kids tattle on their siblings for tattling, but are fine. Folks in Washington are giving my kids a run for their money with. This child is shut down the government shutdown speaker of the house Nancy Pelosi tells President Trump to postpone his state of the union address because of security concerns. Trump in return, cancels, Pelosi's military, transport, Afghanistan in Brussels, literally while she's on the right of the airfield makes you wonder whether on the desk of the president of the United States. Does he have like Plato and juice boxes? Trump's trumpy. But Chuck Todd agreed with me this morning. The Nancy Pelosi's move was just as childish, I thought she she undermined her own physician a bit when she said it was for security reasons for the shutdown. There's nothing wrong with saying we're not going to have a state. You know, let's not do this until we open the government. Yeah. We're going to be all like that. Let's just talk about childish things here like golf carts that look like fifty seven chevies cool one was auctioned off at the Russo and Steele collector car auction yesterday for thirty grand. But because the auction benefited the family of fallen Salt River police officer Clayton towns in the person who won the auction donated it back and it was auctioned off a second. Time for another twenty eight grand a grand total of fifty eight thousand dollars for officer townsman family. Well, even when we're dealing with childish things here in Arizona. We do it in a much more adult fashion and with much more respect for those who serve us than just about anybody in Washington, be sure enjoying Jim Sharpe. And Jamie, west weekday mornings at five for Amazon is morning news here on KTAR news. And it is five eleven repeating our top story for you this afternoon. I had to go over to see for myself, his attorney and Bremner hadn't heard much from him for a while. It was the first time that they were like, okay, they were just great. Then her phone rang. I'll never forget this part. He said they're all gone, and we told them so for two boys. So young Charlie and Braden Powell's loss hit a lot of people, including curiously Hellawell Susan's close friend in Utah. I don't wanna be the one to tell you this. I do not want to tell you this. And I told her no, no Susan's work friends on solidified. This he had to her sister-in-law, Jennifer graves. It was such a such a weight such a horrible. Horrible thing. My mind couldn't even comprehend and even people who didn't know Susan it really devastated our whole community members of the Puyallup gem and mineral club had played with those boys. There was a stone that the boys were interested in. They wanted to do something special for their grandparents, Chuck and Judy Cox. I took it to a trophy shop and had a plaque put on it. "Also prohibited. Any new stories from going online and blocked Josh and his family from even talking about the contents of Susan's journals? Steve made an initial court appearance that day as well pleading not guilty to all fifteen counts. He end Josh talked through things over the phone has Steve's that in the Pierce county jail. One phone call. Thank were Josh actually says that MRs record line, you know, which it tells you when you make phone calls kinda put them in kind of which was we're Josh told Steve to be careful about what he said into sit tight because the family would get him a good lawyer. After the hearings. Susan sister, Denise spoke through tears begging. Josh and Steve to come clean. It's hard. And I just want this all to come to pose a mother she's alive wrenches. Let me know where she's at. So. Our family. I just want him to talk to the police. I want Josh talked to listen just if you're so innocent as you claim. Why are you talking and? I I know she didn't run away with somebody. That's just unbelievable that they're even continuing to say that those points. Chuck Cox told reporters that in spite of Steve's arrests they were no closer to knowing what it actually happened to Susan. We still don't know where she is. So we're still concerned about that. But we're also very concerned for the welfare of grandchildren of what's desk. Take care of them, or they we're doing everything legally that we can Josh still had some fight left in him that afternoon he headed to the Washington state children's administration office into coma for an F T DM or family team decision making meeting. It was his chance to explain where he wanted his sons to end up in the immediate future. Tears gathered in the corners of Josh's is as he said his boys needed to be protected from the Cox's their home was the last place. He wanted his sons to live. In paperwork filed along with that meeting. Josh listed, his religion as not Mormon that same afternoon social worker. Rocky Stevenson sat down with Josh for an interview they chatted about Josh's parenting style and how he disciplined the kids before getting to the matter of Steve's arrest. Josh said, he was only somewhat aware of the charges and that he hadn't watched the TV news coverage because he found it depressing. Stevenson told Josh police found voyeur videos and images showing prepubescent girls in the nude in Steve's bedroom. Josh said, he didn't know anything about that. And had never seen his dad recording kids. He did. Admit though, Steve was obsessed with Susan Josh that he'd erupted his dad after the search warrant rate in August, Steven come clean to a son about what he had written in his journals and apologized. Josh didn't let it go..

"Deputies took Steve to Pierce county's south hill. Precinct for questioning maranda sent him every Roman. He played the. I'm too stupid to understand what Miranda has. And I don't know if I need attorney. He just played games. Gary already had a pretty good idea of how Steve had made the images of the young neighbor girls. But asked him to explain it. We afford opportunity side of the story. Explain to us why hollows things in there. But he didn't wanna do that Ellis. Was there too and took the opportunity to press. The for information about Susan. He wanted to know about conversations Stephen Josh had in the wake of her disappearance. Even at the time didn't fill the you know, Steve was involved. An obviously my primary focuses Josh and trying to locate some sort of evidence to give direction as to where Susan was but Steve who for years. Ears had been unable to stop thinking writing or singing about Susan refused to say a word. Looking back. Now the night of Steve Powell's arrest seemed like a perfect opportunity for west valley city police to have also arrested. Josh. As you heard Gary Sanders describe it seemed as though Josh even expected. So why didn't they? Ellis told me they were very close. But there were still too many loose ends. Coming to the end. And you know, we're not at a point where we could screen charges quite yet. Because if they were to file them there was still quite a bit of work to do. So that in the event that you know, I'm up on the stand in defence during like wedding. You do this. Why didn't you do that? I wanna be able to answer removing the kids had taken them out of harm's way. And also put fresh pressure on Josh at left, Josh kinda vulnerable state. And it allowed us to kind of I guess press him a little bit more to see you know, if you disclose anything or revisit where he disposed Susan as the Pierce county sheriff's chief liaison on the Powell investigation. Gary Sanders had almost as much information about the cases anyone outside of the west valley city major crimes unit once Specht just. Evidence his story and just to tally circumstances led the spotlight right on one guy. Gary told me the the decision of whether or not to arrest. Josh that night was not his to make we respected that I understand you know, it's easy to Monday morning quarterback. But you had to think about, you know, their thought process and their prosecutor if they didn't wanna do nobody prosecution, but sometimes you just got to pull the trigger. Do it Susan's dad. Chuck Cox called his attorney and Bremner as soon as he found out about Steve's arrest. He's kept state by the rest. I kept thinking Josh because he was not on my radar. You know, it was like. Josh knows Steve both she and choke side as a major miss by the police. There was a no circumstantial evidence to say stuff happened right there that night in that place with without a body to say that he got rid of his wife, and I think they could have made that case. But the prosecuting attorney didn't wanna do it. But I do think with him in jail looking at that he would have without being able to talk to daddy or try and play some elaborate thing he would said, okay. I don't hear. I did this whatever he did. I think we would've known, but they didn't do it not arresting. Josh that night would come to have catastrophic consequences..

"And that the worst going on they explained to me how they're processing the scene, and it's it's very logical in this. What these to be done? So I have every confidence in what they're doing mid-september stretched on into late September. I don't know how long it will take. And I just feel it. This is a. Worthwhile investigation and a good place to be looking and I need to stay till we find out you know, what we found here. Finally, the excavation unearthed a number of small pieces of charred wood. Nobody no bones police removed those cinders when they did the dogs lost interest. Detective supposed someone might have burned bloody clothing or evidence on that. Would they sent the fragments in for forensic testing? But those tests came back negative. There was no DNA. We come across something that we think is going to be beneficial for the case, it's our big break. And at the end of the day ends up being nothing. Just another swift kick in the gut a kick in the gut not just for police, but for Susan's family to this day. Chuck Cox wonders what's make of it. I think something that Pitt had something to do with Susan. But I don't know what if if anything, you know, I maybe it's just me imagine while at Topaz mountain Chuck spotted a small rock among the excavated, debris. It looked different than the others. So he picked it up. Maybe he was there at one time or they had been there one time or something. I don't know. So I brought Chuck still has that stone today it sits on a small shelf in his home, flew home. With my suitcase. I felt like this one time I come down here and taking home something that might have something to do with Susan versus just. Yeah. We didn't find her go back home. So..

"Nine twenty nine eighty and Jess fable. Check your. There's one. One three. Honey layer. That's just a small piece of what the detectives had to review. Although it took months. New leads did arise out of that work. They found Steve Powell's digital journal where he referenced Josh. And Michael talking about a place called rattlesnake rock. I mentioned that back in episode seven detectives immediately went to work poring over maps and looking for any place with rattlesnake in the name at the start of October. They went out to examine mine shafts on the fringe of the west desert near a place called rattlesnake pass. But just like with every other search they came back empty-handed. A little less than a month after the launch of operation soon. Nami and shortly before that search around rattlesnake pass west valley police kicked off their biggest desert search of all at Topaz mountain. It was a reference I believe that we found in his writings referencing that area. And of course, police had Susan's pictures from the families may two thousand nine overnight or on the pony express trail and Charlie's comments from December eight of two thousand nine about his mom staying with the pretty crystals a possible reference to the Dugway geo beds or Topaz mountain. Are where what are? Owner the crystals crystals in crystals. Your mom state. Why the crystals are is that what you said. I mentioned this interview with Charlie in episode seven at the time. I didn't have access to it. That's obviously changed. So so mommy, stay cast. There is lower than crystals would. That was what? Little colorful yet here. Police had scoured the area multiple times before but on September twelve two thousand and eleven they came back in full force with aircraft ATV's and horseback riders also utilizing the assistance of some specialized dogs from the carbon county sheriff's office, and those are dogs that are specialized in searching for people the searchers quickly cleared the geo beds and moved down the eastern side of the Thomas range Lieutenant Bill Merritt met with reporters near Topaz mountain. Just doing a general search of this particular area, we are just following up on a couple things on our task list that need to be done and need to be completed. And we're at that point where we can actually get to it now. And we wanna make sure we take care of it before the weather turns bad. There was one other better reason. He didn't mention information overheard on the wiretap. The original plan was to wrap up the operation by September fifteenth ride as the wiretap from operations was expiring. There's a possibility that we might find something out here. Now, we're not coming out here with an absolute. Thing that we will. But we're just hoping we're we're fairly confident that there may be something value out here. We don't know for sure we may leave empty handed on September fourteenth, the dogs cut us in near road on the eastern flank of Topaz mountain several of them all gave the same indication at the same spot. A pile of rocks. It appeared to possibly be a grave site. We have confirmed with several of the dogs who have indicated, positively several times that it is human remains back in west valley detective scrambled to get a thirty day extension for the wiretap. From judge meantime, at Topaz mountain, they started to dig the work crept along with detective shoveling dirt into buckets for index specialists sifted each bucket of dirt through a mesh screen looking for any bone fragments tissue each night. An officer kept a solitary vigil over the site beneath a clear desert sky filled with stars. Chuck Cox bought a one way plane ticket from Seattle to Salt Lake City. Then drove the bumpy dirt road out to the site. I like to know the towel something. I haven't heard that yet. So they come called me or anything. It didn't take long for police to hedge their bets they soon downgraded their assessment to fifty fifty that they had found Susan's gravesite. The dogs though continued to indicate on the growing pit they are still indicating on human decomposition. But there been nothing that has been found far a reporter in Washington confronted. Josh with word that police had found human remains at Topaz mountain. He offered a simple, no comment. On the wiretap. He again seemed unconcerned. Police allowed Chuck Cox to see their work firsthand. I was able to see where they're excavating..

"Josh Powell loaded his sons, Charlie and Brayden into their car seats on Saturday, December nineteenth of two thousand and nine. He was leaving west valley City Utah for his dad's house on the outskirts of Puyallup, Washington, his wife Susan had been missing for twelve days. LS Maxwell west valley city's lead detective on the case was powerless to keep joshing Utah. It was frustrating at the most because. Is a crime ever investigating here. And. The individuals that were really focusing on is now leaving the state and going twelve hours away on Christmas Eve and Christmas day. Josh dropped the boys with Susan's parents each time. He refused to even set foot inside his in laws home Susan's, dad. Chuck Cox had suspected from the beginning. The Josh was responsible for his daughter's disappearance say for other than what did you do? You creep. You know, you'd better get her. You'd better find fighter shows where she is. Free her from wherever you have stashed or whatever he done between Christmas and New Year's west valley. Police learned about Joshua's request to withdraw Susan's retirement using the power of attorney. She had signed earlier that year. They couldn't stop the distribution. The paperwork was airtight. But the start of the new year Ellis learned Josh did not intend to come back. He was moving away from west valley permanently. It was surprising to us. But it wasn't. Remember police had been keeping close tabs on Josh's movements, including using a GPS tracker Rozan we're following him or doing everything that we can to see if we pick up on any cues, and he'll kind of. Screw up somewhere. He'll be like. Okay there. It is. Or you know and build a locator word of Josh's arrival spread quickly among the community. In Puyallup, didn't take long for Josh to kind of ruffled the waters up there. And you know, when people start learning that he was in the area and the kids were coming to church or whatnot. You know, it caused some concern and rightfully so because I think everybody wanted to see an end in this investigation. Probably want to see him sitting in jail. And then obviously Susan to be found..
