Elon Musk Says Tesla Suing California County, Moving Headquarters Out Of State

"Week. California started phasing in the reopening of business including manufacturing so when that was announced Tesla CEO Elon. Musk sent out a memo to ten thousand employees at a factory in Alameda. County telling them to come into work the next day but just a few hours after that memo the local government in Alameda County said not so fast they were keeping tighter restrictions in place and Tesla's factory was not allowed to open yet in response. Tesla sued and Monday. Musk said they're opening their factory. Anyway here to tell us all about this lawsuit and what it could mean for businesses and governments across the US is our reporter. Tim Higgins Tim. Thank you so much for being here. Thank you all right. Let's start with Tesla. What is Tesla arguing in this suit? One of the things that you must angry about is that The California state government has to open up again including manufacturing and he's arguing that essentially that the local government has overstepped its authority by saying that. Tesla's factory cannot reopen that. The governor's office allowing for the state to reopen and that the US constitution allows for these sorts of things so really Arguments at the county. Government is overreaching and then he made a comparison to another facility. That is a nearby county. What's his argument? There Tesla has its has one assembly plant in the US but it has a number of facilities around California that help with the business. And there's a factory that is not that far from the assembly pant that has in a different county and the people there are not facing the same kind of shelter in place restrictions. Tassels reason the question of why are why isn't a uniform wise? They're pointing to figures. They say indicate that the rate of infection is very similar Why is one place stricter than the other so? Musk actually went a step further and reopened TUSLA yesterday. Right surprising a lot of people Monday. Tweeting out that He was opening the factory starting production that day in fact he said he's going to be on the assembly line and that if the police show up to arrest people he should be the one that's arrested so let's just back up a little bit. This sets tesla apart from many of its tag counterparts right. I mean facebook and others have announced that they're not bringing employees back to the office for months. Why is Elon? Musk and tesla wire. Wise Tusla's taking such a big stand here exactly facebook and Google and others. They can largely do their work at home on computers. Were Tesla makes cars. It needs an army of workers in the factory banging on metal to build these vehicles so they can sell them and without the Fremont Factory Online. It doesn't have anything to sell here in the US eventually. The cars that they made prior the shutdown. They're not gonNA have anything. So if Tesla is going to take advantage of any potential economic rebound that something might occur in the months to come as the country learns to live with the Corona virus. It needs cars. The shutdown came at a bad time for Tesla. It was just a ramping up. Production of its newest vehicle. The Model Y Compact Sport Utility vehicle is a vehicle that Elon. Musk has said could be. The company's top seller analysts expected to do very well. It's a good segment for this kind of vehicle and really there was a lot of enthusiasm among investors about the year ahead and so what the Krono virus has done is essentially. Put everything on ice and The problem for you on musk. Is that this. Factory has been sitting Essentially vacant for weeks. Now and he needs the lifeblood of the company to kick back on. I guess comparing to facebook isn't quite fair. I mean the better comparison might be to other. Automakers what are we seeing Michigan do for example and how our automakers they're responding. That's some of the frustration that musk has been. Venting is that Michigan announced last week and then that they were bringing manufacturing back online this week so Monday. As Yuan is sitting there unhappy that his factory is an open open. Places in Michigan could come back online and he knows his competitors have already announced. Gm for Chrysler others that they're kicking up production GM and Ford. They're a scheduled to start assembly vehicles again next Monday and here in California. That's that's not the case so elon. Musk has taken it another step further. He also has threatened to move production out of California altogether. He's saying maybe to Texas. What kind of impact could his departure have on? The state would smell something that can happen. Overnight it's not as simple as picking up his tools and going to Texas and starting to make cars and a new factory I. It's much more complicated. And it's something that probably would take years to do but the effect would be dramatic. Tessa wouldn't be the first car company to pull out of California Toyota. Its headquarters for the US. He's in essentially negotiating in public. He's trying to push put pressure on on the local government to allow him to open up. Yeah I mean it's it's a very public lobbying effort if you can call it that I think the interesting thing is. We'VE SEE BUSINESSES. Do this all the time time right to get tax incentives or or other deals but in this case it's public health interests that are at stake. How HAVE OFFICIALS IN ALAMEDA? County responded to this very open threat And is the pressure that he's putting on them seeming to impact their decisions to reopen at all whether the mayor of Fremont put out a statement saying that she supports Tesla and the Mayor of Palo Alto or the company's headquarters is located. Put out a statement over the weekend about their support for the company. It's a tough position for some of these elected officials They want to see the company. Back Open. They want to see businesses back. Open him yet. Some are also weighing the health ramifications. Several people have died in the county from Kovic Nineteen and they have reported More than two thousand cases of Govan Nineteen and so the concern among county leaders is that they're not sure if there's going to be a spike as they start to re phase in business activity and they'd like to see it play out a little bit longer and be prepared and the idea of ten thousand people coming into a facility is concerning and so they have been working with the company to make sure that the safety protocols in place and the Tesla has Publicized some of these. Things are what they're working on. And that's where the standoff here is. It's not when we're unique to test so there are lots of places and companies around the country who are frustrated and want to get back to the way things were and we've seen state by state by state Different ways of handling this. J.Crew Files For Bankruptcy. More Retailers Are Expected To Follow

"When J crew filed for bankruptcy yesterday it got a lot of attention in part. Because it's the first major retailer to fall prey to this pandemic. The company was forced to close five hundred stores and furlough all but two thousand of its thirteen thousand employees but this might not be the end. Other companies are very likely to go under in these times. And let's turn to David Wessel director of the Hutchins Center at Brookings Institution. David Hope you're well good morning so talk to me about J. crew going to bankruptcy court and what what exactly the company is going to be experiencing here well when a company files for protection of the Bankruptcy Court under chapter eleven of the law. It's allowed to not pay its debts. So it can continue to operate in business in the case of J. Crew which also owns a company called made. Well it worked out a deal with its creditors before it went to court. People who'd lent the company nearly two billion dollars essentially get control the company squeezing out to shareholders. Then it borrows more money about four hundred million dollars so we can keep going It's online businesses functioning. And it's planning to open. At least some of its stores. When the Corona virus receives the whole point of chapter eleven is to allow a debt laden company to reorganize and and stay in business. So is this an option that other retailers other companies are going to follow. We're GONNA see more. Companies seeking protection absolutely. American businesses borrowed a lot of money fifteen trillion dollars by one recent estimate when times were good. Many of them are going to have trouble keeping up the payment. It's hard to stay current on your debt when your revenues drive up. Gold's gym filed for bankruptcy this week already the Wall Street Journal says that both Neiman Marcus and JC. Penney have missed some interest payments. And they're talking to lenders about a bankruptcy filing hurts. The car rental company has hired advisors and in the oil and gas industry. Low Oil prices are pushing a lot of the little companies towards the bankruptcy court as well. David you've talked on a program about the hundreds of billions of dollars that Congress approve to try and help small businesses. Wasn't that supposed to try and avoid this. It was and all that aid is GONNA keep some companies out of bankruptcy. But it's not enough for all of them particularly that were already kind of over-borrowed before the corona virus hit and the problem here is this is going to overwhelm the bankruptcy courts. And that's going to have unfortunate side effects. Some companies are going to have trouble finding the money you need to borrow temporarily to keep going while you're in bankruptcy and history suggests when they're lots of business bankruptcies as I expect there will be. The courts tend to put their attention on reorganizing. The big ones and that means little people a little companies had filed for bankruptcy just end up liquidated they sell off their assets with the court supervision and essentially go out of business. What other options out there David to to try and save a company in these times? Well the best option. Of course we'll get the economy going when the virus receipt so they can start selling again. Joe Stiglitz Nobel laureate suggests a super chapter eleven kind of one size fits all plan. David scale a law professor at Paneth suggested that Congress legislate a moratorium on debt payments giving companies and even some families the immediate benefits of bankruptcy without having go through the court and Peter or Zag was the White House budget director in the Obama administration says that because bankruptcy can have such a big effect on suppliers. He suggests government lending to what he calls firms that are two connected to fail doing. Essentially what the government did for GM and Chrysler during the great recession? However, Renner has been in tonight's with Nissan for twenty years, and therefore shares of many parts platforms is fairly integrated with Nissan, now, the French states decided that it would not back this deal without the explicit approval and without the explicit support of Nissan and Nissan. And in the US, does it help rivals, like maybe Volkswagen, perhaps, I mean, it's very difficult to tell at this stage in the US, this would have meant said Nissan, getting together with Chrysler in a way, which which would obviously bought brands like ramen Jeep closer closer with the Nissan's. So that doesn't seem like it's going to happen now. I mean what it means I guess, for the car industry is, if you speak to end this most of them think that Fiat Chrysler needs a deal right now and because then they haven't invested enough in future technologies, I'm so we'll see who they end up with whether it's another French call maker of maybe Paju, or whether.

But we're starting off in Europe where the EU just wrapped up parliamentary elections in several countries, including Britain, Germany, Italy, and France, nationalist and populist parties have been on the rise. So I know the media loves it storylines, but this was billed as no less than the battle for the soul of Europe. Right. Those who who want this much closer union than nationalists, who wanna looser collection of independent states sticking with the story line idea who won, not the nationalists. Marinela pens party in France dwell, but across the EU and in the European parliament, these nationalist, anti EU parties are still in a minority. So maybe, we'll eventually have to go back to the people, but it remains a highly highly contentious issue in British politics. So I want to pivot a little bit. We've talked about tensions, of course within the EU. I wanna talk about economic tensions between the US and the European Union specifically. On auto tariffs, especially with a big proposed auto merger on the line today. The promise to reject the Trump administration push to limit imports of cars and parts from Europe. That's just happening today. What does that mean for the future of that trade relationship? Well, this is potentially a very serious escalation, EU Komai because exports run into the tens of billions of dollars. I mean it's actually in fact that with ten times European steel and aluminum exports to the US. So the e u is determined to stand up to President Trump's threats giving every impression today that the commission has not been in any way, weakened in its stones by the European election result, marketplace's Stephen beard. Again, you know, when trying to sell that's what real estate analysts and brokers are saying, and and probably because folks they're so focused on the buildings financial, performance and. Obviously they can ask for premium because you know, it's the Mona Lisa buildings. It's it's the Chrysler building. Right. But they're saying people are still going to look at the bottom line. This kind of strategy at a very, very big fun in a very big pile of money that's very hard to do. But for us to do this at this level, the main thing we do is try to make sure we understand the business while enough and then get a gigantic margin safety. So that even if you find that you didn't understand it well enough if you just got it right. That may be bigger in ten years. You're gonna come out fine and you're gonna get rich, and that's just because some of those are. Some of those picks that you made are going to be fabulous. They're gonna be fabulous. And I warn is said over and over again, you know, you should act as if you only gonna get twenty companies in your car life. And if that's all you bought, he, he, he would be willing to speculated four of them with turn out to be fabulous and make you rich. Right? So this ten cap method of using the value of business is very important. And yet it's very kind of subjective. So we've tried to turn something subjective in the something objective with a formula that you can use the book invested to come up with the owner it. So we're gonna do this. Now we're gonna dive into be up Chrysler a little bit and. Contrarian positions. This company was quite a contrarian position when Monet Chabrier started buying it, which is how many people even found out about it kind of in this like value investing community. And I don't think he talked about it for quite a while. And yet people didn't seem to think that it was going to shoot up the way it did, but he believed in the management as well and has held it for quite a few years. So his interviews said he still hasn't, and he still thinks it's good to go. Now that was before to mercury passed away, and things have changed a lot since then if yacht Chrysler, but we still want to get into it here because it's also it's. Kind of like a complicated company. I mean, I looked at it as I said with my tea and the financial statements are there. They're more complicated than other companies. I'll say that. Will they are in the companies comprise a number of other companies. Right. Yeah, it's kind of a conglomerate and that always makes things more difficult. So if you're just getting started as an investor, I would say starting with Christ who would be a great place to start right now. There's going to be in fact, honestly, at this point in this stock market ten years into the stock market, moving up from very low bottom.
