but no judging by the judge or other Hey FBI Hey police officer him up every county police officer bring me your files and bring me the email bring me the cellphone or separately this to show inside these four corners of this war that what you say in this war is true that's not what happened at the probable cause stage so it's not up to the judge the judge pushes back but by the judges pushed back on the okay all the time there's a lot of give and take them back and forth before judge will make a final decision on on approving or disapproving the FISA warrant that's not the judge's job the judge's job to make sure there's legal and factual sufficiency as contained in the warrant application but if that national security division lawyers apartment justice at the FBI lawyers in the department in the FBI in eighty six thousand have to look in the file the actual Manila folder file to make sure the evidence is there that email the pictures SL found the warrant the mystery that the anything that's answerable that backs up each and every fact in these applications but we learned of a separate cases up to three four hundred alleged facts and then there along and so you got to have boxes and boxes of facts that back up each and every that evidence to back up each and every the fact the alleged application and if they follow the woods procedures were scrupulously accurate which is their internal standard you would never have appointed warrants on Carter page well and they were they were either scrupulously an accurate if I can turn that phrase around by accident by sloppiness or on purpose does it doesn't matter though does it calling I mean the fact is they did what they did I the question is when an FBI director or an FBI official or a deputy Attorney General signs those warrants and it's inaccurate there need to be criminal repercussions aren't there or otherwise otherwise there's no way to know what won't happen again well we've been a big proponent of heritage of answering a reform in other words reforming laws that Congress passes so that you know you're actually violated if you're being violated so if it's inadvertent mistake that's one thing in there may be consequences administrative but if it's an intentional act whether it's in a standard criminal court or at the course in the FISA court in the people should be held legally accountable in up to including criminally accountable work up stumbling stomping on somebody's constitutional rights is it fair because you're you're often bringing into this conversation I think it's it's it's it helps with the context here and help people sort of to put this on perspective you bring up the criminal courts are you bring up you know well local courts versus just this federal FISA court however when it comes to a FISA warrant and the power that comes along with that kind of warrant hi and the secret nature of the FISA court shouldn't this is the injured be that much higher because of that it it shouldn't be the same as a criminal court it should be a higher standard that they're meeting why because of the nature of it well when you appear before a judge in a criminal proceeding and you ask for one there's no other advocate there there's nobody else there you go to the judge in chambers as the representative government and you're asked to sign up on the market in the back and forth
