"When I had got to prison, I didn't get caught up in prison politics. I didn't do nothing. I stayed in law library. I stayed in my work and I stayed on the right path. My focus was to get out. And this had been in prison for about ten years, reading the Bible, taking classes, educating yourself, while outside prison. There was a fight for me. I'll try to watch my swearing. Thank you. I mean, I feel free to swear as much as you'd like. For truly, I mean, I called up Kate chatfield, a director at the justice collaborative. I've probably have a lot of unresolved anger issues and being in a courtroom is a good way to work those out. I mean, is a courtroom the right place to get out those issues. Absolutely. Yeah. How dare you charge my client? How did this is an outrage? Among the things that make Kate angry is the felony murder rule. It doesn't make sense. Murder is a homicide with malice. Somebody has to intend the murder. Now I'm being told about this rule where, okay, okay, wait, there's this huge, glaring, ginormous exception over here to murder. And that's the felony murder rule. And it sweeps up a lot of people year in year out. So it's just the exception that eats the rule. She heard about dozens of cases, like a nissos. One of the most striking ones to her was a group of teenagers, who decided one day to sneak into an old man's house and steal some stuff. One of the boys wandered by himself into the kitchen. He's 15 years old. He's looking through the drawers and he takes some chocolates. Meanwhile, two of his friends who were a little older than him were in another part of the house, and they encountered the owner who turned out to be at home. Seems like they got into some kind of fight. They all only resident he dies. Two older boys were charged with murder, but so was the 15 year old who was in the kitchen, stealing chocolates. They're saying, you have the intention to go and commit that burglary. So that's the underlying felony, which is a burglary. And they said, and it death occurred during that felony. So therefore, we're going to charge you with murder. I see. So with felony murder, there has to be some intent to do something else. That's criminal. Yes. Yes, exactly. And it's sort of like that intent stands in or like wells into this larger intent to kill. That's exactly right. The fact that you were engaged in a burglary and somebody died felony murder. The 15 year old in that case got 25 years to life. It's a barbaric rule. We have to have laws that connect our culpability with our intention. What did we intend to do? What did we actually do and what did we intend to have happen? This rule has been abolished and every other country that derives its law from the English common law. Even in England, it's no longer a rule in England where the last the last vestige of this barbaric rule. Kate helped do a survey of inmates in California, serving time for felony murder. They found that the rule was disproportionately affecting women and youth of color. And that 72% of women serving life sentences for felony murder had not actually killed anyone. Nearly two thirds of the time, the killer, the person who, quote unquote, pulled the trigger, was the woman's romantic partner. We undrafted a resolution by both houses of the legislature in California, the assembly in the Senate that sort of outlined what the felony murder rule was and why we need to change it. The bill would essentially gut the felony murder rule in California. It would make it so that you could only prosecute the person who did the killing themselves. Someone who was a major participant in the felony who had reckless indifference to human life, or someone who ate it in the killing, but that person would also need to have an intent to kill. And who was kind of against you. Oh, the California district attorney's association. This was their number one kill Bill. But after 6 months of debate, the bill passed in the state assembly by one vote. And what happened next was state assembly staffers, contacted California's prisons. And they said, please help Kate chatfield to go on a tour of prisons throughout California to educate people about the law and to see if they're eligible for re sentencing so they can petition the court to go back and get re sentenced. So I think we went to almost every prison in the state of California. One of the prisoners that Kate chopped field visited in prison was in a Jordan. The levy and law library to talk about all this new thing coming into effect. So I start reading on it. This law was retroactive. So anissa would be one of the people who would be eligible for release. So I was like, what? I couldn't believe it. I was really really leaving. It was like butterflies. Swarmed the whole prison. It was just like butterflies in the prison for a whole week. My room, I said, you leave it. You know, freedom is coming. You leave it. Advocates say the gutting of the felony murder rule in California could affect hundreds of prisoners. The rules also been gutted in Hawaii, Kentucky, Michigan, and Massachusetts. And there are movements brewing to reform the felony murder rules in Pennsylvania and Minnesota. But in the last few months, the rules been used in a way you might not expect..

Nothing i go out. I got a bit of variety. I do something else interesting. I am quite introverted. So i i tend to go to people's books i read a lot of sci-fi and speculative fiction I play video games or quite a lot. i've been playing a lot of slave spy during the pandemic which is a cg a card based game. I think hope to understand challenge as part of a bundle as part of a package. People don't do things sort of for one set of reasons for one thing beliefs. Come in bundles. Mean it makes no sense that for example something like gun rights and abortion should be yoked together because will why would someone predict that beliefs. Why would it be so predictive that someone believes wanted us. They believe in the other. There's you can only make sense of these. Things by looking at political tribes by looking at networks of influence by looking as opposed beliefs says really short term for lot of people have saying i am like these people are not like these people might not like you. I do write quite a bit about time and attention because i feel especially when i talk to younger. People and trump walkout. What's going on that unless you're able to pull its take a moment and observe yourself and gain some kind of equillibrium. None of the other good stuff can happen. I like about policing you. And i must give shoutout to robert poynton. Who's a friend in. A wonderful book called do polls have allowed to give shout outs. But very influential book on me because again. It's like having been the room saying it's okay to pools. You didn't have to stop you. Don't have to disconnect. That's not really possible for many of us. I think that's an impossible standard. It's okay to pause and take a moment galleria self and observe yourself and an off yourself. How you feel about your feelings are you. Think about. you'll thinking very liberating to give yourself permission to do these things and in the context of social media than because in this doom scrolling time. I guess it's it's funny with doom scouting. Because i feel like that is projecting so much it onto the future. It's like the opposite of being in the present moment not just constantly panicking about the past or the future and i think what was interesting about your book is this yes polls also identifying your own ignorance. Is this amazing tool for exploring your ignorance absolutely right but if you if you don't take an interest in your ignorance you can't learn stuff in a you need to take a really catholic interesting in what you know. That's gonna have to come out of his pocket now or some kind of a donated fund more so than ever because that was all election campaign money. Much of the security for him was provide while he's still got secret service protection, But you get the point. It's gonna be a lot higher to get the message out. But I said, I don't think Donald Trump is backing down at all. I don't need it. Let me go back to say before there was any Donald Trump and back in 2000 and 9 2010 when the tea party started It cost me probably 2 to $3000 to do that really implement, But I paid it gladly and 1800 people showed up. I'm willing to do that. I'm sure other people are but what I'm saying. What I'm trying to say is, people don't be discouraged and don't give up. The states have rights and the lines have become blurry. Right now we need to formulate and get back together and say This is what we can do. And this is what we should be doing. I'm just saying, I want people to stay engaged and get ready for my need them when we do and and you're absolutely speaking to what we can do, Yes. That's right. Okay. Don't soldiers don't go away. People don't give up. Just hold tight and see what comes out. But I will have to say that I am not going to Wait for the Republican Party or anybody that's in the so called authority or power position to tell us what we need to do well on most of them. But I support not one. I'm disgusted with every one of them. I'd haven't gotten to it yet. But a lot of the people that we thought were on our side are not even Christy Nome is going south. "You know, Election day we're months past it, but the fallout continues. Um, one of my reporters here, Tim, Alberta, who is a Michigan native lives there now and records from Michigan. He had this pretty big piece in our publication two weeks ago, that really focused in on how Michigan became the center of these unsubstantiated voter fraud, claims this speaker of the House of Michigan House of Representatives, the Chatfield told him I'm told my colleague Tim, Alberta, that the party his party made a mistake by not allowing for the pre processing of absentee votes, which resulted in the backlog and a lot of the controversy that surrounded this election. So popular after 2022 you intend you see a need to push for changes to election law so you can head off any of the sort of similar problems going into the next election cycle or 2024. What are your plans around that? Well, I do, and I was pushing for that, and the Legislature only agreed to one day. Really processing. We were seeking to have a lot more time. Florida I think has 40 days or something like that it you know it. Certainly in the midst of a pandemic this right to vote safely at home was so important and we had we were just were inundated with Mail in ballots and I'm hopeful that we're strengthening this muscle. People are getting more comfortable voting from home and that they will want to utilize that ability going forward and we need to prepare for it. So I certainly will be pushing for additional longer term, more thoughtful policies around making the easier and ensuring that people can have confidence and a Tally that comes in quicker any any specifics there that you were governors across the country. Do you think your fellow governors you said before you're in a chat, or sort of a text chain with other governors? This is something that you will talk about. As you come out of this pretty tumultuous period. You think we'll see any movement with other governors on this front? I think we will. You know this. This election really showed the people of our country how different the laws are in every different state. And perhaps there's an opportunity to really make more uniformity there and talk a lot to my friend Kate Brown, the governor of Oregon, who is the biggest champion of mail in balloting on We've been doing this for a long time. They've written the book on how to do it. We've got a phenomenal secretary of state here in Michigan who has been recommending changes that we should be making. I'm hopeful that as a nation we look to see how can we improve this so that every American have confidence in the outcome of our elections, doing that it's safe that every every Bella gets counted. So admit everything else. I sort of ticked off a couple of things at the top that you've had to deal with the one thing that I think is, you know, that beaver mist not to ask you about is the fact that the F that the federal government foiled a kidnapping attempt of you, Um which you know is just sort of this extraordinary thing. And I wondered since that news broke, you know, almost two months ago. Can you describe in detail that moment you first learned that there was a plot to kidnap you. What your immediate reaction and what went through your head at that point, And frankly, in the in the weeks and months sense, But I think you know early on in the pandemic when Detroit was heating up so fast, same time New York City New Orleans, Chicago. We were some of the first cities to really be feeling the brunt of covert. It became very clear that the federal government was not going to be able to help us meet our needs. In fact, I think the president said, I'm not the nation's shipping clerk. You better go find these things on your own, and we were going into a weekend where we didn't have enough masks for a single shift at our hospitals, much less the weekend. And so I was on national television. I said, there's no national strategy and I was, you know, lamenting that fact but also building a global procurement office in my state. That statement put me straight in the sights of Donald Trump, and once he started attacking me personally, the death threats started. We saw that continue all summer. I had to have a lot of hard conversations with my teenage daughters about what was being said, and the people on my front lawn with Um, automatic rifles and at our state capital. But it was mid summer where the state police told me about this plot and that the FBI was working. It was going to be bringing charges. And I think that you know, we've seen a lot of information come to light since then. I've not read every affidavit. I just can't. I just can't go there. I've never been worried about my safety, the state police and the FBI. Done a phenomenal job so that I can put all my focus into fighting covert, which is where my focus needs to be. But it really is a stunning thing when people like Dr Fauci or the secretary of state in Georgia or my Secretary's day here in Michigan are dealing with death threats, But this kidnapping on birder plot was, you know, it should have shaken every leader in this country to the core, because, as Americans we solve our differences at the ballot box, and then we move forward. We don't tolerate unlawful domestic terrorism and we need more people to call it out. What was that conversation with your daughter? But hadn't she was fun? Yes. So I've got two teenage daughters they are. You know, I've been very honest with them throughout. I had. I gave birth to 11 as a freshman in the Michigan Legislature. My first term I gave birth of the second, my second term in the Michigan Legislature. So They've grown up around politics. They we have a very candid conversation always. And so none of this was a surprise to them when the charges were announced, But I think the vitriol the depravity of it the locker up chance at Trump rallies. That was all pretty stunning, and it was hard, but I want my girls to see their mom. Fighting for what she believes into standing up for what she thinks the right thing is always and, um, you know, fighting back when we need to, And I think it's an unfortunate moment in our nation's history. But it's ah, learning moment for generations of Americans, and we need to call people to our higher angels and the promise of this great democracy. If conversations you've had with law enforcement in recent months, like how real is the threat of political violence right now? In Michigan and across the country. Well, you know, it's sad to say that when we have legislators who are simply show up to a hearing that they're required to attend where Rudy Giuliani comes to Michigan, all of a sudden they're being taunted and threatened just for showing up and doing their job that they're required to do. I mean, the fact that people are making this what used to be a horrible leap from political advocacy to domestic terrorism. Now what seems to be so seamless and short trip is very concerning and it should be concerning for everyone. It's not limited to one party or one person. This is about the rhetoric, the dialogue in our in our country and the kind of things that we're seeing now, you would expect to see from groups like Isis on They're playing out here in our country, and I think that's why it we can't get them to this and we can't Excuse it, And we certainly shouldn't be encouraging it, which is sadly what I think we've seen too many rallies this political year. So it's 50 years for a bit. Of course, you know where we wrapped up this election season. And you weren't you played a role in it sort of as a constant figure. One way in which the, uh Joe Biden considered you tol for his vice president. Um, can you take us a little bit behind the scenes there? How secretive. The plans were a Sephora's You being notified the flight to Delaware, where you were going. Tol beat him on all the substance. Well, that's one thing that you learned about Biden during that interview that you did not know going into it. California Votes To Keep Criminal Justice Changes

"Was a good day for criminal justice reformers. In California statewide voters resoundingly defeated a ballot measure that would have rolled back some reforms. And voted to give people on parole the right to vote in the Bay Area. Six police Accountability measures enjoyed strong support, and San Francisco's former district attorney, George Gascon, appears to be winning in his challenge to the more conservative sitting Los Angeles D A. But voters did reject an attempt to end money bail. Here to sort out what All this means is cake politics correspondent Marissa Lagos. Marissa, You have been covering criminal justice reform efforts in California for over a decade now, were you surprised by these results? You know, I wasn't surprised Hera. But I do think that it is a huge win for the reform side of things. I mean, we've heard for years ever since some of these changes started coming through both legislatively and at the ballot box. A lot of pushback from law enforcement and other folks who saw them is going to far and I think that voters weighing in s O decisively on both proposition 20 rejecting some of these rollbacks of reforms and also on some of these police oversight measures really does show a shift an opinion. I spoke to Kate Chatfield, she's policy director at the Justice Collaborative, which is a national pro reform group. She knows that proposition. 20 wasn't even close. Even though law enforcement worked really hard to make the case to voters standing is all the usual cards in the deck. You know the Willie Horton playbook, crime is increasing the fear based mailers in the voter saw through them. And Kate, of course, is referring to that. 1988 Presidential Willie Horton ad The really helped Republicans win and I think that you know, while the No 1 20 side spend a lot more money than the outside, and I think some folks see that is, you know, money talks. I do think that Given how much we've heard talked about these issues that voters it seems like they knew what they were weighing in on and just didn't want, Teo turn the tide back the other direction. Yeah, you know, proposition 25 that was aimed at Indian cash. Bail was pretty suddenly defeated. What happened there? Yeah, This is a really interesting one. I mean, I think there's a couple things happening. One is that you didn't have the same coalition on the left really backing this reform. There's a schism with a lot of people kind of on the more progressive wing of The Democratic Party. The bail industry also spent a lot of money on this, and I think that the combination of them targeting folks in places like Riverside County and more conservative counties with some of the doubt that was cast by progressives probably was the reason they were able to build this coalition against prop 25. But it does feel like if you look at the kind of universe of all these that that is a bit of an outlier. It was a very complicated questions, so that may have been part of it. So do you think these results could actually encourage state lawmakers to go even further in the future? I do. Although I don't expect to see any dramatic huge reforms come out of the Legislature. I think we'll see what we've seen in years past, which is piecemeal attempts to kind of dismantle some of the harsher sentencing laws. I do think from the outside that we're going to see more pressure from advocacy groups to push the Legislature further. It's worth noting that just before the election The Sisters of Polly class who was one of the crime victims who has really helped spur the three strikes movement in California, came out to say that they want to see reforms and that they are unhappy with the way three strikes when the way their sister's name was used. So lawmakers may not go as far as voters, but they're going to get some pressure. Well, thanks

So I woke up like right before the event and I sat down and I hadn't even made coffee and went heard the word home pot I was like I'm going to make some coffee. Hold on vk is reconnect. So how did everybody in the chatfield about the home pods in particular? That's something that I want to hear because we get back back in. Okay. what I what I was saying before before the disconnect wise I haven't had any coffee when the event I started and then when I heard the word Home Pod, I just got up and I was like I'm Gonna I'm GonNa make some coffee I'm not. A little bit of a breather. Yeah Yeah. So how did you feel about the homepage announcement? I'm surprised I'm actually I was surprised to see the smaller Unsettling. I guess it's a good thing that I guess people do like it for for Small Home Speaker for automation for using. You Know Siri integration it. It's nice. It's cute. It's. That's the best way to say, I haven't used home before my my my primary use of apple products for most part is just like iphone se the iphone eleven promos. An. An also use a MAC for my for my work. PC as well. So it's one of those things that I I use as far as ecosystem, but I've never gotten into the home pot but it's nice to see that there's more options and it sounds like it's supposed to actually be pack a lot of good sound especially in even though it's smaller. than the construction supposed to be really good I. Mean it's it looks cool. I was waiting for iphone so. I'm like, okay exactly I mean. It's cool that there's sort of a light on the top, and there's like haptic feedback and stuff like that. All of the all of the stuff they talk about when it comes to audio quality I mean that's obviously something you have to test for yourself. Because, we've used the minis of all Alexa like a lot already and all these claims of like heavy base and all that stuff never really does pan out. So Hard. So it's always been a challenge whenever you creating speaker system that works on individual pieces, right so you're trying to mimic give a good stereo, fool sound but most of these units are sold in single units and you really like to really get the full benefit of the the nest home audio. You really need to buy two of them which they do have a special four but. You really should buy to get that full audio experience. So E it's the same thing with the home pod I. It's they're sold as a single unit, but the experience truthful experience this still needs to be tested to see how you know when when they claim it's supposed to provide all of these things and when you get it in the hand so we'll have. A few people in the chatter saying they're disappointed that there was no spotify support I I, a part of me wonders if the main reason for that is because they obviously want you to be in their own ecosystem, apple music and all that stuff. Yeah I I. I'm I'm I'm sending a little bit of A. You know yeah. They want gear you primarily through their service. I assume at some point DEL allow some type of casting functionality. I don't I. Don't remember I. Don't remember even hearing anything about a Bluetooth functionality. So it's going to be where if 'cause if you connected the Bluetooth that circumvents the whole issue, right? To be paired directly with the phone, you tap it obviously, you get them to pair you connect to it. So maybe maybe spotify can add some casting functionalities. Love. Someone I actually know is in the Chris Markevic Yeah. He says apple want you in their walled garden and that's true for pretty much anything. I can attest to it that you can even see right now I'm using my iphone eleven pro I have the air pods in and I have my apple watch like the thing is I use these because in terms of like. Our workflow and stuff like that. Sometimes, it's just easier to go to these devices like like they say the apple ecosystem is pretty easy and it's also in some ways. It's more supported than other ecosystems but I will tell you and I'm still working on my review. I shall also high working on his review of the Apple Watch doing my review of the Apple Watch Se. It straight is the gateway drug. Trade of it's the gateway drug of the ecosystem is the lodge I, swear it's it's I if there's ever been a situation where I've always wanted to just try something on an eye on. It is the Apple Watch. Actual interest into into some of the new things they talked about with the iphones because that's also like there's deep change some stuff like they're trying to new different options and they're not just sticking to the incremental just see. Yeah, this is a faster slightly smaller. Slightly you know all of those things they're trying to push out some new stuff so. I like the Apple Watch I just I prefer watch that works on both systems.

So I'm hopeful I'm optimistic that Washington Democrats can come to the table and work with the president of the United States.
