I saw many people actively using drugs or nodding off and seemingly people of all ages races genders people in wheelchairs I would say that it was quieter this week Then when. I visited the neighborhood earlier this month in the early morning hours. In the morning. When i was there for a story i saw many more people crowded in the streets laying in sidewalks people selling cigarettes especially menthol cigarettes. Which you can't legally buy massachusetts people selling drugs. There's a lot of trash human excrement It's not a pleasant place to be so remind us stab about the confluence That has come to mass and casts well. The areas described as sort of the epicenter of the opioid epidemic in massachusetts. There are several addiction. Treatment programs homeless shelters boston medical center in all of those services really are within blocks of each other so people come to the area for services and they have for a long time. But i think what's changed. Is that more people. Stay there Some human services providers in business leaders estimate there are several hundred people right now living on the streets of mass gas. "Rice was a democratic senator from the state of missouri. He served in the senate for twelve years from eighteen. Forty three to eighteen fifty five. He had a reputation for being extremely pro. Slavery he owned. Slaves supported all of the slave state issues in the run up to the civil war and when the war finally commenced he served in the confederate army as a brigadier general commanding missouri troops. So he's not the finest of people to sit in the upper chamber of congress. Quite frankly if it wasn't for the events that i'll be discussing this episode david. Rice atchison would probably be mostly forgotten to history i. I came across his name years ago and children's book of fun facts which said that he was the president of the united states for one day. This fact has been repeated on and off for over one hundred and fifty years in fact the words president of the united states for one day are on his tombstone in missouri as sort of a testament to his greatest achievement. So is this true. Was david rice. Atchison really the president of the united states for a single day to answer the question. We need to understand exactly what happened in the election of eighteen. Forty eight week party. Candidate zachary taylor comfortably. Defeated democrat lewis. Cass and free soil candidate. Martin van buren incoming president. James polka made a pledge to seek a single term in office and he honored that pledge by not. Running taylor was a career military man who had never expressed any political opinions prior to the election. And in fact he had never voted. He had a great deal of success as a general during the mexican american war which led to his popularity in calls for him to run for president. He wasn't fact recruited by both the whigs and the democrats. The two major political parties at the time to seek office prior to the passage of the twentieth amendment to the constitution the president and all members of congress would take office at noon on march fourth. So the argument is that because neither zachary taylor nor millard fillmore didn't take the oath of office on march fourth and waited until march fifth that they weren't president from noon on march fourth until noon on march fifth. That means that the next in line would have been the president pro. Temporary of the senate david rice. So is this true and does this argument. Hold water. The answer is pretty clear in the answer is no and there are a whole bunch of reasons. Why this is the case. I while the constitution does stipulate that the president and the vice president must take the oath of office it only says quote before he enters upon the execution of his office unquote. This is legal hair-splitting but it means before president can do anything presidential e- sign a law. Appoint officials signed a treaty etc. They must i take the oath of office however they can still be the president before taking the oath to illustrate the point. President kennedy was shot at twelve thirty pm on november. Twenty second nineteen sixty three. He was declared dead at one thirty three. Pm and lyndon johnson took the oath of office on air force one at two thirty eight pm. The moment president kennedy was dead. Or at least claire dead. Lyndon johnson became the president in the same way that someone becomes a king the moment the old king dead even if they haven't been coronated. The oath of office is just a way to legally unlock the powers of the presidency after becoming president. As i said this is legal hair-splitting and for all practical purposes it doesn't really matter but for the twenty four hour period before the oath of office zachary. Taylor was the president. If there was an emergency you could have quickly taken the oath of office in private and without a public ceremony and dealt with the crisis as president. The second argument as to why atkinson was never president is that he never took the oath of office. Either if taylor is in president. Because he didn't take the oath of office than atkinson also can't be president by the same logic. The third argument is that he officially wasn't the president pro. Tempore e of the senate. He was the president pro temporary during the previous session of congress. His term expired on march fourth at noon. Just like the presidential term. Did he needed to be reelected again. On march fifth which he was moreover. This wasn't the first time that this had happened in eighteen. Twenty one james monroe delay taking the oath by a day for the exact same reason yet known assumes that someone else was president for a day at johnson himself never claimed to be president at the time. No one seriously thought he was the president. And there's nothing in the congressional record to indicate that he was there are no constitutional scholars presidential historians or even atkinson's owned biographer. Who thinks that he was actually president at best. If you applied a very strict rule to the taking of the oath to become president then you could maybe say that there was a one day interregnum where there was no president but it doesn't follow that atkinson was president.

In eighteen eighteen forty seven the wilmot proviso had failed to pass the Senate but the measure still had life. There was a strong chance will not proviso or something like it would find. Its Way to the the desk of the next president. This possibility would cast a shadow of the election of eighteen. Forty eight and with the end of the war inside and with Alta California and New Mexico Texaco hanging in the balance many Americans demanded to know. Where does Zachary Taylor stand on the expansion of slavery In the summer of eighteen forty seven the editor of the Cincinnati signal sought. An answer to the question was tyler. The main issue on the table was whether or not to adopt the Wilmot Proviso Advisoe as part of the New York. State Platform New York. Democrats were split into two factions over the issue. The Barn Burners and hunters the barn burners largely argued in favor of the proviso to them. Slavery was a moral and political evil. And it was. New York's to limit its expansion. The hunters argue that POLKA party line. Slavery was a state right. The Proviso was nothing more than assault on President Polk in an attempt to stir up his unity among the democratic ranks at the eighteen. "They even inspire hope our goal is to connect with others in these toxic relationships to offer that hope and was supporters of our mission anyone willing to help get rid of use our culture we also talk with the experts in the field from the officers in the front lines of domestic abuse calls to the therapist and advocates helping survivors navigate this complicated road of recovery if you're in need of help please visit our website or call our twenty four seven hotline eight hundred eight two eight two zero up to three and at this is an emergency and you need help immediately please call nine one one welcome to I'm not in an abusive relationship with your host Claudia boss Dan Moyle here with I'm not in an abusive relationship and we are at the CASS area library for vigil tonight live here in Cass County will hear names of victims read in Memoriam where Stories domestic violence here in honor of domestic violence awareness month so as we are here our hope is that you it takes something from this that you are inspired that you find some hope maybe find some help as well gentlemen if you'd like to come in and gather around I think we're going to try to get started with our our event tonight my name is Rose Ludwig on the creative director for domestic and sexual abuse services and I want to welcome all of you tonight and thank you so much for being here and for helping us to remember people well who have individuals who have been victimized and have subsequently lost their lives due to violence at the hands of intimate partner I just a couple of things I wanted to point out just a couple of statistics almost one out of five or sixteen percent of murder victims in the US were killed line intimate partner women account for two out of three murder victims killed by intimate partners and nearly one in three female homicide victims that are reported to police are reported by police records are killed by an intimate partner so all the country focuses on death and injury from auto accidents health ailments it's in drug abuse a shocking number of deaths and injuries are result of domestic and inter intimate partner violence almost one third of all female homicide victims are killed intimate partner like I just said tens of thousands of women and men have died and hundreds of thousands have been injured at the hands of their abuser over the last few decades so would that set up WanNa thank you for coming and remembering the names of those who have who have lost their lives at the hands of intimate partners I do believe that it's a public health crisis domestic violence and I I'm glad that we still are observing domestic violence awareness want them bringing awareness to the to the subject to not being able to be afraid to talk about it to give voice to those who feel powerless who can't who can't you may not have the voice to to lend to talk telling their stories are sharing their being able to become survivor there's that they're no longer victimized but now they're survivors and unfortunately the names that we're gonna read tonight are just a small portion of those individuals that have lost their lives but I appreciate you coming out to honor though so I'm going to hand it over to the mistress of ceremonies and double get started thank you good evening my name is Deborah Hackworth than I am the director of advocacy services for domestic and sexual abuse services GonNa Start with the invocation by Pastorino from Faith Bible Church in Jones Michigan Hungry.
