The US house of representatives is set to vote Tuesday on a democratic resolution to stop President Trump from using his emergency declaration to get border wall money NPR detro- reports after congress didn't give President Trump the funding. He wanted for a border wall. Trump declared a federal emergency in order to construct a wall with existing federal money. Congress had not appropriated for that purpose. Several lawsuits have been filed challenging the move. But house speaker Nancy Pelosi says it's important for congress to try and block to be delinquent. In our duties, if we did not, protect and defend the constitution, even from the president of the United States. The house is controlled by Democrats. So it's expected to pass the resolution when it votes Tuesday, the Republican controlled Senate within have to hold a vote on it in a matter of weeks. Several Republican senators have opposed Trump's decision. So there's a chance the resolution would go to Trump's desk if that happens. He'd be expected to sign. His first veto, Scott detro- NPR news, Washington. President Trump has nominated US ambassador to Canada Kelly night craft to become the American ambassador to the United Nations. A judge in Kansas has dismissed charges stemming from a ten year old boy's death on an amusement park. Waterslide nearly three years ago as Dan Margulis of member station. Casey. You are reports. The judge says the case was tainted by grand jury abuse. The judge ruled that improper evidence and testimony were presented to the grand jury requiring indictments dismissal Caleb. And of course who knows if the grinch is lurking in the shadows because new Nafta's still has to be ratified by each country here to look at all of this. Is Our national affairs panel. Katie Simpson is a senior reporter with CBC News. She's been covering the Nafta talks and now the deal and we eastern Mexico City. Heather Scoffield is an economics columnist for the Toronto Star. She's in our Ottawa Studio and Kelly cried. Herman is a Calgary based reporter for the Globe and Mail who covers business and politics and she joins us from there. Hello to you all morning heather. Let's let's start with you. What are the positives? You see for Canada in this new trade agreement. It's a big relief. I think to you Well from from the business community point of view to just have some stability into know that there is something finally written on paper that yes it still has to go through ratification but it looks like ah you know all this. Everything's lined up for that to finally happen so you know for the last three years business every time you want to go and make an investment and every time you want to think where you're going to put your next dollar you've been you've been Surrounded by this uncertainty not knowing what's Donald Trump going to do next asked what he's what's he going to demand for his own economy What are the rules of the game and so you have second thoughts about investing in Canada and so this gives some kind of certainty in a very the very uncertain world? I mean there's all sorts of other things out there for sure but but this is this is one big piece that that is finally settled. Katie you are in Mexico City. What was the mood like among Canadian eighteen delegates at the signing ceremony? Mexico's National Palace. I think there's a sense that this is actually now in the final stretch and they can finally finally proceed with the domestic ratification process. And they're relieved. Everyone thought that this was going to be over about a year ago when they signed off on this does aries the sidelines of the G. Twenty people knew would be difficult with the changing political dynamic in the United States however now there seems to be a bigger sense sense of relief but one thing that I want to point out. That was really strange inside. The Room is when the Americans got up to speak at yesterday signing ceremony it was. US Trade Representative Robert Bert Lighthizer who spoke on behalf of the American delegation. And he was. It almost became uncomfortable the way he was gushing about the American or about out the Mexicans and and how the president was a historic figure and and how they put the best person possible in in this position to negotiate gate. This and they didn't let politics get in the way and the key to that is the Americans were so pleased to get the concessions out of Mexico. Soco's that they were able to get that ball blight heiser was just. He couldn't contain himself at the ceremony. Yesterday okay well we know. Then it's going to be a a big selling point for trump in Washington them but tell us what's in this agreement that allows the Canadian government to frame this as a win win win Kristof religious said well Christopher your freely in the Canadian government is trying to take credit for some of the changes that were added to this agreement and When Nafta negotiations originally began back in two thousand seventeen the the conservatives that actually criticized the Liberals for trying to put some things in there that were to progressive particularly around the environment? Well what do you know two years later when it's time for the Democrats to have a say in all of this in the United States That the environment would be a big deal. So the the changes that have been added to this agreement relate to environmental environmental and labor provisions and making sure particularly in Mexico. The Mexican companies live up to the Labor standards and they've they've sort of changed the onus here that if a company is believed to have been violating the standards and not meeting the standards that have been set out by this agreement. It's up to the company to prove that es in violation of the or it's up to that they are following the rules that are in place it reverses the onus and so there's a big push to make sure that inspections can be done in Mexican facilities to make sure again. There are those standards and make sure that there is the right to collective bargaining in Mexico. Things like that so the major changes are really targeting. are really targeting Mexico but there is one change that really stands out for Canada and that has to do with pharmaceutical drugs. Dogs the new Nafta the the one that was negotiated in two thousand eighteen that all three countries signed off on had this provision that large pharmaceutical companies could develop and be protected texted from generic companies taking their science to make generic drugs for ten years in Canada. The current law or the current rules are eight years so this would give those big pharmaceutical companies two more years to make those big profits and it would mean that the higher drug prices could be charged for an additional two years. Well the Democrats got that entire provision stripped out so it will remain status quo in Canada Kelly. Credit and Calgary what is the view from there is Canada's seen to lost in it in any ground in this agreement. Well I you know I think in For all the reasons that Heather in Katie of laid out there is is a sense of relief that there is any stability and any solid agreement that can really be relied on as as as Canadian companies look for investment as they look for some kind of stability. I think they're this does not put an end to what might happen out of the US. The Donald Trump administration. This does not put an end to the uncertainties there. the ratification process for this will take place in the US. Maybe a day after the impeachment impeachment vote so there there's still a lot of uncertainty. I think what is really interesting to me. Is What is interesting to Albertson's in a lot of respect to is the messaging that came from Christie a freeland on this of course. She emphasized at a in Mexico City yesterday that that this will this new Nafta after deal will require a seventy percent North American aluminum component. Of course that is focused at Quebec Major aluminum producer deuce her and that that was important. Because right away you had Block leader Mr Blanchette saying that. This deal isn't good enough for Quebec so I think the messaging on this back to Canada was really interesting because we have a government. A minority government needs to rely on the other parties. The other parties are going to be looking at the de details details of this deal and and really they will have an actual say in this unlike If if this agreement had come to fruition before The October vote that led to a minority government so I think the messaging back to the Conservatives to the block to the. MVP is really interesting in this case. Heather we we are. There are growing concerns about the health of the Canadian. Economy is this deal is signed. What what did the latest job numbers tell us? Well we had We've had a really great year in terms of job creation until last month. Where where where the where we had a major setback And you know every economist will say okay. Let's let's look past. It's the number you have to. You have to look over over time and not get too carried away about one month But you know there is. There is certainly a lot of concern. I think that the global economy is slowing down And that growth levels in Canada are just not what what we what we've become used to. They're not what they used to be an in and going forward. We won't be seeing a lot of strong growth so You know there. There is a fear that this one month will be a sign of things to come or or that or that. You know we're just heading into a period of of of slow growth and weakness. Generally that even if people are getting jobs they're not getting there. There's just not a lot of momentum. I mentioned in the economy so that our standard of living over time is is eroding. We'll jobs are one thing. Heather what what are other indicators that suggest the country could be heading for recession in two thousand twenty. Well I don't think You know nobody's crying recession yet in a serious way But we do have quite a few challenges on on on the horizon that that that suggests some some times I think investment is one of the one of the things that Quite a few people who are concerned about we had some ups and downs For sure but Especially in the patch. I think Kelly Kelly knows a lot about that but That they in the third quarter. We had some really Concerning serving investment numbers and and you know with all the uncertainty that we see globally That that looks to be a sign of things to come and Kellyanne hustle prized where you by the national numbers given unemployment in Alberta. I was surprised to see such a dramatic turn in the national numbers of course A A low ebb. Economy is something that elbruz been dealing with the last five years and there are a lot of striking numbers in the the statistics. Canada job report for November. Of course it's just one month it's a snapshot but we saw you know not only the Drop in job numbers nationally but in Alberta we we saw another increase in the unemployment rate another eighteen thousand jobs lawson and really strikingly a really high jump in the unemployment rate among young young men Under age twenty five basically in one in five young men in Alberta under the age of twenty five is unemployed right now according to the November numbers. And you know if that's not a political issue I don't know what is when you have young men without work and what was really striking to me. This week is Federal Finance Minister Bill. More no saying he doesn't He doesn't worry too much about recession. And I worry about that personally because we have in Canada in the global economy seen years of growth and anytime That cyclical process reaches this point. I think you know policy-makers he makers need to be very worried about recession about A lot of a lot of possible headwinds. So I just you know and the concern from Alberta's Verte whether The federal liberals are taking those economic concerns seriously of course Katie during the election campaign the liberals promised to deliver on on both climate action action and economic growth and. I'm wondering how much of the agenda hinges on bringing foreign investment back all that is certainly something that has been a challenge for the liberal government when it was when it had its majority mandate I think one thing that we're going to see a now that this the big chunk of the Nafta negotiations is sort of put to bed and Christopher Freeland freeland. Can you know get back to Canada. Take on this new role that she can sort of focus less on that candidate. US relationship and now focus on making sure that the concerns of of the prairies and the concerns parts of Canada that you know ended up you know the Liberals didn't win any seats in Alberta Saskatchewan and a big concern about that is has the economic climate and that's a big part of what is going on with the political result. We saw the twenty a nineteen election so now the Christa Freeland has has finished dealing with this abroad Justin Trudeau can lean on her. And we know that she's already started sort of an impromptu listening tour speaking with premier speaking with other Leaders to try and find find out ways that they can hear the concerns of the people that lives in those in those parts of the country and a big concern. There is investment in the economic climate. Speaking of Premieres Kelli Kelli. The Jason Kennedy was in Ottawa. Yesterday I met with the Prime Minister. Was He hoping to win from his meeting with Justin Trudeau. You know. I think most of all he was hoping to win attention for The the economic issues and The political issues that he's bringing up at a time where there is national focus focused on Alberta and Saskatchewan issues because of the the election results because the liberals were completely shut out of Alberta and catch one. There is attention on this and and and you know while while the federal government sees this as a pressing issue rather than you know international trade disputes. I think Mister sure Kenny is going to work that for all it's worth and you know the the things that he's asking for The headline items. Of course our you know guaranteed timeline for the completion. The Transmission Trans Mountain pipeline expansion A lift on the cap on the Fiscal Stabilization Fund which Jason Kenney very very politically has called a rebate on equalization even though it's not And he he is looking for some kind of wiggle room from the the federal government on Algirdas issues given the economic circumstances given that Alberta's economy has diverged so much from the national economy in the last five years. He's he's looking for some kind of he's looking for some kind of reset in the relationship. As you know Kristie of freeland takes over the the interprovincial file and I think you know while he's not going to get any kind of result this week there is going. I mean to be a push from Alberta for some kind of movement from Ottawa in the weeks and months ahead and and that will be watched very closely. Okay how do you think anything resulted from from that meeting. Yesterday that would allow Canada to claim progress. If not victories will. He didn't leave with any money in his pocket but I don't think he came with that in mind. I think he very successfully frame the conversation around Albertus demands but he so so he's he said what the conversation will be about over the next few months it's and You know and set the stakes out very clearly to to the population of Alberta. But it's also interesting. He stood down Actually early on on his demand to change See Forty eight NC sixty nine which he calls the new pipeline bills No more pipeline bills Those are those are the the bills that were passed last Towards the end of the the last parliament that that changed the way that the government oversees and Approves Natural Resource Development So so Jason. Kenney has has conceded publicly that okay the federal government is not going to change those. And he's he's he's changed how he's framed that conversation around approval of of natural resource development. So that's pretty pretty important and also you know by by focusing on the fiscal stabilization aspect of of transfer payments he's moved away from that equalization conversation as well which was A. I mean that was just an a nonstarter for for everybody involved. So you know there's been a bit of give and take and I think he. He's he's trying to convey a sense that he's leaving Ottawa with a bit of a warm and fuzzy feeling about the future conversations with auto with with the federal government but there has been a lot of movement I think on both sides here so far. Katie I want to touch on another development yesterday. China hinted that the two Canadians who have been detained for a year. Michael Covert and Michael are detained in China. They could face trial. What could did this mean for the fate of them? Well it certainly. It's IT IT'S A. It's a significant development in this whole process. Remember these two men. These two Canadians have. I've been held in a detention centre with little information about what's going on no access to a lawyer and and really no certainty or no clarity about what's going on now there or a couple of scenarios here in some cases in China when things go to trial there have been situations where okay You know They can he moved through the legal process. And and and perhaps This China's justice system isn't like the Canadian justice system and things can sort of be dropped here and there as they go or or you. Can you can sort of look at it in another way. And that is another serious debt. Moving forward any sort of development involving the two michaels a massive concern for the government but China has made it abundantly clear. Nothing is going to change in the Canada China relationship. It is going to be difficult until the Canadians unless the Canadians released Mung Wong. Joe The wall way executive. She was arrested by Canadian. Authorities at the request of the Americans on an extradition request and and the Chinese have made aided directly abundantly clear until she is let go trying to pressure pressure pressure Ottawa. To make that happen The Canada China relationship is going to be difficult. Donald they of course in retaliation it's widely seen as retaliation. They arrested the two michaels Michael. Covert the former diplomat and Michael savage the former or he is an the An entrepreneur in China of course canola dispute China stopping purchasing large swath of Canadian canola and there was the the meat dispute and the only only reason that China had to relent on that is because China had a I believe it was a swine flu epidemic and they were running out of port and they just badly needed pork for the Chinese people for the Chinese people so they had to relent on not because anything's actually changed in the relationship but because they really had no choice so this situation is going to remain bad until there is some sort of development on the Mung Joe Front and Really Canada has dug in its ground saying we are a rule of law country. We are not going to just release this person because You are pressuring us. We're going to go through the legal channels. We are going to continue with this process. And so whatever is happening sitting over in China with the two michaels. It's always going to relate back to what's going on in Canada. We have about a minute left and that actually leads me into my next question. which is the government suffered? Its first defeat if you will yesterday. When the opposition parties passed a motion to set up a special committee to review all aspects of the candidate China relationship? What's at stake? There are two things going on there. One was minority government politics. I think the opposition parties You found something. They landed on something that they could agree on and wanted to flex their muscle and remind the government. Right away. That I in a nonthreatening way. And that you know this doesn't trigger an election or anything But by setting up this committee that they have the power to to do you know to to At least express themselves in this in this new configuration. But I think it's also reflective of the broader public that there's a restlessness in a great frustration in dealing with China. There's a you know a pressure to to find a solution and if there is no obvious solution it's so complicated But you know the Conservatives have been pushing for to be tougher on China The business community has been Over having meetings in in in China There's a restlessness of like. Please can we just be on this. Find a way to get out of this. So that we can increase our trade the trade the trade volumes back and forth forth with Canada and China or down quite a bit this year compared to last year. And I think you know where people are really starting to get You know they want to see some progress on that all right we will leave it there. The first new accusation against Donald Trump as president and the attorney for the newest accuser joins me lie. Then Elizabeth Warren changes the game. I believe there are signs of both on both sides. That are accurate the growing urgency for climate action on the left why this is an emergency in this country and all in starch right now. Good evening from New York. I'm Chris Hayes tonight, a staffer on the Trump twenty sixteen presidential campaign has come forward to become the sixteenth woman to accuse Donald Trump of unwanted sexual contact of Johnson was a Trump campaign staffer in Florida. That's her on the day of the alleged incident. She claims in a new lawsuit that then candidate Trump, quote, forcibly kissed her as he exited an RV August two thousand sixteen Johnson says she turned away from Trump as he tried to kiss on the lips and the ultimate kissed her on the side of her mouth. This is the first sexual misconduct accusation against the president since he became the president. It's the first alleging misconduct while he was a candidate is also the first accusation be made by a woman who worked on Trump's campaign Johnson who in addition to suing Trump is also soon the Trump campaign alleging she was underpaid because of a race and gender says the incident took place about six weeks before the release release. Of the access Hollywood tape in which Trump in the year, two thousand five can be heard boasting that he can do the very thing. He's been accused of doing. What a medically directed to beat a just missing them. It's like a magnet. I don't even away. And when you star they let you do it you can do anything. But if you want grabbed by the. Do anything Johnson did not speak out of the time that tape became public, but told the Washington Post she was stunned when the tape came out, quote, I felt sick to my stomach. That was what he did to me to women who say they were present for the allegis. Melania Trump chief of staff, Stephanie Grisham and former Florida attorney general Pam Bondi told him easy news that they did not see take place Bondi flat out called the allegations false. In addition, the director of Trump's Florida campaign. Karen, giorno told the post the allegation was ridiculous saying that did not happen. In a statement. Sarah Sanders, also rejected the allegation, quote, this acusations is absurd on its face. This never happened as directly contradicted by multiple highly credible. I would as counts Johnson's boyfriend mother and stepfather confirmed the posts that Johnson told them about the alleged kiss on the day took place Florida Turney till the posted Johnson at approached him about the alleged incident. Just two months later joining now Assan Zavarra, he's the attorney for. Alva- Johnson Gadhafi here. Getting Chris why filed this lawsuit now? So MS Johnson actually tried to come forward and was prepared to come forward shortly after the access Hollywood tape came out. It was at that moment that she was able to contextualized what happened to her. I think if I she was very confused. She knew it was inappropriate. But she didn't really know what it meant until Mr. Trump told her exactly what it meant he told her, and he told the rest of the country that this was a pattern. This was his modus operandi. This was part of his way of sexually assaulting women. And so once she saw that she left the campaign. She never came back. She hired an attorney she moved out of campaign housing. And she began the steps to bring a lawsuit. This two months after the incident when the tape comes out you're saying that is precipitating incident for her to break with the camp. That's right. The access Hollywood tape. I will say that she had very fun things to say not saying, this means that she's not telling the truth here. But I do want to put on the record that she did say fun things about. The president back in may twenty seventeen radio interview. Take a listen to what you had to say. He is more incredible in person Finn. I think than you would even think as you see on TV he's just the nicest guy, he really loves his country. He loves his family. He treats everyone as if they're part of his family is that reflect the way, she feels about the absoutely Chris keep in mind. So after she found the attorney thought she had found an attorney he declined to move forward with the case for business reasons, even though he believed in the merits of her claim and at that point shortly afterwards candidate, Trump became President Trump, and at that point she was terrified and she was very scared of coming forward and she decided not to come forward. And as a victim as many victims are terrified she was as well. And she decided to go along to get along to shut up to not talk about it and to move forward with her life, which at that point included her life as a campaign. Advocate. The allegations are that this was done in the public in public essentially, her boss, the boss of the campaign, just to of forcibly kissed her in the midst of what is a day of public campaign. Look that again, that's his MO. He did it to Cathy Heller mar-a-lago and nineteen Ninety-seven. He did it to a MS USA candidate on on camera. So yes, that's exactly what he did. And it's consistent with his behavior in the past. She she did she sign an NDA as a condition of employment in that campaign. She signed an NDA purportedly as a condition of employment and we intend to fight that NDA. We believe it's unconscionable and unenforceable why it's so overbroad foods, not just the president has entire family, his, grandchildren. They're really, yes. Stifles all kinds of speech. I mean, it's so brought up provide a copy for you if you'd like to see it, and you can see how he's tried to abuse it. I mean, he's tried to shut down people who are working in the White House. House. He's tried to shut down people who have made other complaints about him. And in the line of work that I'm involved in where I fight corporations every day, they try to shut people down and shut people up. That's what we do. We fight these sorts of abusive agreements. There's another aspect to lawsuit aside from this allegation of unwanted sexual contact by the president which has to do with the way that she was paid on the campaign. Tell me what is that part of loss. That's right. So they're two aspects to that she was paid less than comparable men who were working on the campaign, and she was paid less than comparable white people who are working on the campaign with respect to her gender claims. She's actually bringing that claim on behalf of all women who worked on the Trump campaign and just as an example, there was a kid at straight out of high school white kids straight out of high school teenager who was brought on the campaign as an intern. And after he graduated from high school was making more than she was. So this is a federal race and sex discrimination lawsuit claim in federal court. That's right. What is her thinking? About her role in that campaign. Now, what does she feel about being some small part of getting this president? And what does she think about now, this has been the most difficult thing for her? Feeling like she helped to legitimize this man and help him become the president of the United States after what happened in Charlottesville when she saw him talking about there being fine people on both sides after what happened at the Mexican border where he saw where she saw him separating children from their from their parents. And then when she saw him mocking the metoo movement, those things I think have made a big impact on her, and she's feels very responsible. And I think part of coming forward now is to try and redeem herself for what she feels guilty about which is her role and having Donald Trump elected president. Or sounds very who is the lawyer for Johnson who has filed suit in federal court over what she says unwanted sexual contact by the president of the United States while she worked on his campaign. The latest allegation against Donald Trump is a reminder of the enormous body of sexual misconduct allegations that exist against the man who is now the president of the United States when we entered the room. He. Grabbed each tightly hugged and kissed each one of us without asking permission. I feel the little this little grab it's like feeling a little cheek like a little cheek lift almost. And I stand up really tall. I'm shocked in a moment. And I look and I turn around and I look at him. And he doesn't look at me. He doesn't wanna make contact with me some hone other arm rest in in the sea disappeared, and it was a real shock. When all of a sudden, his hands were all over me, the person on my right who unbeknownst to me at that time was Donald Trump put their hand, my skirt. He did touch my vagina through my underwear absolutely p pushed me up against the wall and had his handle over me and try to get up my dress again. And I had a physically say, what are you doing stop? It. Donald Trump has. Missed all the women who accused everyone as liars and suggested some we're not attractive enough for him to assault. One came out recently where I was sitting alone in some club. I was sitting alone by MISA like this. And then I went wall. To somebody. Every woman lied when they came forward to hurt my campaign. Total fabrication all of these liars who will be sued after the election is over when you looked at that horrible woman last night. You said I don't think so I don't think whoever she is wherever she comes from. The stories are total fiction. I was sitting with him on an aeroplane. And he went after me on the plan. Yeah. I'm gonna go left. Believe me. She would not be my first choice that I can tell joining me now Christine agree or associate professor political science form university and Betsy Woodruff politics reporter for the Daily Beast, Christina. You know, what occurred to me as I read the story today that a in another context, it would be enormous world stopping news campaign staffer had said that getting off a bus Barack Obama had forced to sell a kiss on her in the middle of the two years, the ministration, I think we all agree that would be AB. It is not that kind of story, partly because I think there it is priced in an assumptions about how the president. Well, I mean, we've been dealing with these assaults by Donald Trump just as citizens alleged say, no when I say, I mean, just barrage double on the constant barrage of him and his British behavior. So yes, there are sixteen women who have allegedly accused of accused Trump of alleged assault. But there's so much more every day. It's a fire. You you've put this show together every single day. There's something new, and so this onslaught where we can't really focus on sort of one issue because each day something else happens. And so what really bothers me though, is that this is clearly a pattern for those of us who live in New York. We've known about this pattern for decades, actually. And he seems to be Teflon, Don, right? And we've seen what happened to Dr Blasi Ford where she is not back at work. She's using her private funds and savings to pie her own security. We know that the sport of Donald Trump are highly aggressive and some of them unstable as far as going after these women so for some of them, it's a safety issue. And he encourages that. I mean, we've seen this time and time again with the way he talks about his accusers. Betsy I it struck me the singular role that NDA's play and Trump world, which is followed him into the White House Clifford SIMS who. The book now engaged in a legal dispute with the White House over getting out of those NEA's, which the president unprecedented fashion has used to lock up almost everyone comes into contact. But that's right. This story is sort of the extension of two lifelong trends for Trump. The first of course, being allegations of sexual misconduct and assault and the second being efforts to sort of weaponize, the American legal system to force people not to be open about their encounters with him and about their work with him one thing Daily Beast reported a couple of days ago is the fact that the Trump administration has actually forced interns to sign the as and it hasn't let these interns, according to our reporting keep the copies of the as that they signed. In other words, if you're a young preps, a college student trying to get started in the White House trying to get your foot in the door, and politics, and you wanna work in this White House. The prospect of financial ruin will be hanging over your head because of these days now to be crystal clear, it is very much. Unclear whether or not these NDA's are legal, and whether they can actually be enforced in court. There's a very interesting argument that I it rights for these federal employees can't be enforced because the rather than the president being the person they're making the commitment to they'd be making the commitment to the United States as a country. Anyway, the legal side of this is really interesting, and if interned decides to try to get out of it NEA, it will it will be fascinating to watch. But this is just Trump's MO. This is how it works. You heard her turn from his Johnson say they think it's totally null and void. But there's another part of this. And I think we see. This amazing thing about the equilibriums approval rating. Right. Like, no, new facts change things that much in one direction or another. It's not like people can be converted to excellent. If you were with him when he came down, a gold escalator Mexicans are, rapists. Like, you're not moving now. But there's also there's a lesson almost for the rest of our politics about the value shamelessness, which is essentially Ralph north right now is still the governor of Virginia. Right. And there was this moment where when the face came out and people thought, well, obviously, gotta go and one of the things that I think Trump is shown for all kinds of political public figures. If you don't bow the shame and you just plunge ahead. Maybe you can just weather anything most dangerous man in the world has no shame. And that means he will not be moved by anything. Right. Not by embarrassment embarrassment to his family embarrassment to his wife because he has no shame. And for those of us who from New York. We know the interesting thing that Betsy talks about about these indie as that. We also know that Trump is weaponized legal system and sense of he says he's going to people, but he also always renege. On deals that he makes with other people and his Goto line is well suited me. Right. Yes. I know we've made agreement where I'm supposed to be fifty thousand dollars all the pay you twenty five thousand, but if he wants your other twenty thousand Sumi spend twenty thousand twenty five thousand there is there's no one probably in American public life as the tickets who's been as many lawsuits on both ends as Donald Trump, which is part of another part of his lifelong, ammo, right? There's no doubt and interesting factor in the American legal system is that this type of civil litigation your ability to be successful in. It is often contingent on how much money you have hiring lawyers to represent you for these civil suits some of which can drag on for years before resolution just costs a ton of money. And this is a tool that Trump doesn't Trump is not breaking new ground here in the way that he uses the legal system, although he certainly is quite innovative and enthusiastic about it. But the reality is that many Americans have trouble when they're when avid choice between do we stay quiet or do I go. To try to fight for the right to say what I believe is true. When people need to know. And that's part of the reason that Trump has been able to use this tool so well as that he's had the financial resources to essentially us law fair to go after his credit. I'm sort of processing the Eddie of inter White House insurance locked up behind NDA's, which is just utterly and say an idea Christina Grier. And Betsy Woodrow, thank you. Both Senator Elizabeth Warren. We'll be here live to discuss her announced today that she is swearing off big money fundraisers. That's a head. And my next guest says Robert Muller's latest Manafort filing, maybe an indication of bigger things to come. Marcy Wheeler will explain why right after this. After delay Friday night. Prosecutors working for Robert Muller finally filed a sentencing memo in one of two cases against the president's campaign manager, Paul Manafort, this was the one in Washington DC. That's where judge just ruled that Manafort violated his plea deal by lying to investigators and the sentencing memo, which is sealed on Saturday is more notable for what it leaves out than what it includes while previous filings by Muller's office have contained what appear pretty intentional hints. But the probes trajectory revealing for example that Roger stone's outreach to WikiLeaks. In two thousand sixteen quote was directed by high ranking individuals in the campaign the Manafort sentencing memo that we got on Saturday covers no new ground instead of shedding light on the central mystery of metaphors contacts with his Russian Ukrainian henchmen constant Kalinic during the campaign, which according prosecutors, quote, go very much the heart of the molestation the memo sticks with information already in the public record. It's skates over Matt affords lie. To investigators mainly dealing with his illegal lobbying work for Ukraine, though. We don't know what's hiding under roughly a full page of productions amid conflicting reports on the status investigation. It's hard to know how to interpret this latest public move by the special counsel no-one has been following this more closely than journalists. Marcy Wheeler who writes about the Mola probe on her blog empty wheeled on that going over every document with a fine tooth comb theory for why this latest memo holds its cards, so close to the vest. Namely that it shows Muller still has another hand left play. Marcy, I read what you've been writing about this. What is your sort of mean take away from the document that we got on Saturday? Well, molar has made accusations of lying against five of Trump's associates. George popadopoulos, Mike Flynn, the draft room Coursey plea, Roger stone, and Michael Cohen, and every single one of them is you know, it describes other roles on the campaign. It describes dates it quotes directly from emails and both in this in the sentencing hero, the memo that we got on month on sun Saturday, but also in all of the breach negotiation that breach discussions going back to months before that we got none of that. And so at the time when there's a big question about whether or not Muller's going to be able to report out what he discovered that's the first time. He's withholding those details. I don't really know what to make of it. But he hadn't opportunity on Saturday to show his hand. And he didn't show his hand. So for the first time he's not disclosing those because he's made. Picked up on affirmative decision about how many details to include seems making affirmative decisions to withhold things in this document and a few of the others that he has not made in the past. Right. And at the core of the breach discussion was this August, second twenty-six, teen meeting between Manafort and constant and clinic where Manafort dealt clinics seventy five pages of polling data and at the same time discussed a peace deal for Ukraine, which is which was obviously also a sanctions relief deal. And so we don't get any of those details. Those details came from Paul Manafort to some degree the judge. They don't come from Muller in this case. But but that, but that's the story. That's like the God of the question of whether or not Trump and his campaign. We're conspiring with the Russian, and you just mentioned seventy five pages someone casually, but I had not seen that number anywhere anywhere in the reporting, and you sort of go through the document, and you find that basically the footnote by one of metaphors own lawyers filings say how long the polling data is any seventy five pages in at least the. Attachment that they gave to the court is that right? Yeah. So it's included as a declaration to what the government presented back in January and manafort's lawyers. And they're very last memo, which is probably why no a notice this. They're like, here's the Email that Manafort sent to Rick gates saying print and print this out. So we know that that's big of it. And then it says here's the pages of the data that we're all discussing. It's it's actually seventy six pages I've been corrected on that. But it's it's at least seventy five pages long. So it's a chunk of polling date. It wasn't just, you know, top lines or something like that which which does seem material to this. Right. Because as you said this sort of question that that that hinted up by Muller's lawyers in the breach conversation about going to the heart of what are they doing in this cigar bar on this night meeting with this guy during the campaign printing polling data and giving to and the idea that manafort's only cop into the fact that will gave him was like a big. Gaffey chunk of whatever it was. And there I mean, his lawyers also say they kind of go back and forth on how they're explaining it. But they also say it was so complex and so focused that I don't understand it. And so the came case Amy Berman Jackson backs the point right? And so her discussions about why it was material are actually really interesting, but Muller isn't saying that Muller's been silent about what that August. Second twenty sixteen meeting is we know it's central to the investigation. He just isn't gonna tell what it means. And and there's the last question, I guess is what I mean there has been so much about when it's going to end their sources at news congressional sources and others who've said that it's wrapping up soon. Other organizations have reported the same the special counsel's office push back at no not next week. What would what do you make of all that? I have no idea. I mean that's an eye exam because that's how I feel too. Yeah. I mean, I have no idea. I mean, obviously investigative things we're waiting to come in the mystery appellants that is before the supreme court, and there's like three or four other pieces that we know have yet to come in. But yeah, I'm hearing like you are that we're really close. I just don't know whether that means a week from Monday or mid-march MARCY Wheeler. Thank you so much. Coming up. Elizabeth Warren just blew up her fundraising operation swearing off. Big ticket fundraising events and calls to wealthy donors in favor. The Wall Street Journal reports of pay what you can't events as a major departure from the usual presidential campaign here to talk about the decision and others in her campaign democratic Senator Elizabeth Warren Senator what what causes decision. What's what does it mean for you? So look we've got a problem in democracy right now. And that is that funny just has too much influence in Washington. And we have a chance right now in a democratic primary were in a primary. It's Democrats against Democrats to say, here's how we're gonna do this. We're going to build from the grassroots. We're actually going to build a foundation for the Democratic Party that is really about face to face person. A person neighbor to neighbor people who are engaged in this campaign, whether they can give. Fifty bucks or thousands of dollars. What we care about is that we have a whole movement of engaged people who are gonna help us get elected not just to the White House. But help us take congress. Help us take statehouses help us take the governor's mansions and help us have the momentum. We're going to need to make the changes once we're elected. This is about how we build real changes. So I'm excited about it. So here's my question. You've been you've been in politics for a little while you've just recently reelected and Senator wants term, right? So and during that time, you have done you've done call to the donors you've done big-ticket fundraisers. You put together pretty good work chest. I think about eleven million dollars that you had amassed. What does that say about what you were doing before? This is the right way to do it. Now why now and why not before? So look, I'm never actually been in of deeply competitive primary. I get it Republicans come to the table armed to the teeth. They've got all of their donors. Their wealthy wealthy donors. They've got their super PACS. They've got their dark money. They got everything going for. And I'm just going to be blunt. I do not believe in unilateral disarmament. We got to go into these fights. And we got to be to win supplies the primary like were you to get this? And. And we're anyone else get nomination like just raise all the money. You can however you can guess, but here's what I want you to see different about it. Chris think about the difference once down to the two candidates if the Democrats have spent the next year in a primary building this thing face to face person to person neighbor to neighbor across the country. Think of the kind of foundation that we have laid down. So that when we're really up against it in the general election, it's not just money to fund television ads. It's all the folks who will do the door knocking. It's all the folks will make the phone calls. It's all the folks who will reach out to their network because you know, how we're going to win in twenty twenty. It's going to be big. It's going to be people who voted for Donald Trump last time around. It's going to be people who haven't voted at all it's going to be people who see a vision and a way to make this democracy work. Not just for the rich and the powerful, but make this democracy work for everyone. Final question on this. And I want to ask you other questions about some stuff that is happening. The campaign of -posedly you question. I guess the question is how much is this an either or right, there are campaigns that are able to build both sort of that kind of grassroots fundraising machinery and also wealthy donors and also do big ticket fundraising. What does it mean for candidates? Time. What why why make this sort of decision? That's the real point the best estimates are that most candidates for office are spending about seventy percent of their time with millionaires and billionaires spending behind closed doors, fancy cocktail, receptions, and private dinners in mansions. Let me tell you what I'm gonna do. I'm gonna do call time tonight. You know what call timing? This is when you have stomach. I don't even have to do call. Well, am doing call time tonight and tomorrow night and the next night. But here's the deal. The people I'm calling to say thank you to. I'm gonna call not based on how much money they kicked in. I'm just going to pick these numbers up randomly, and I'm gonna call people and say, thank you very much for being part of this. Thank you for going to Elizabeth Warren dot com signing up whether you signed up for five bucks or twenty five bucks or fifty bucks. Thank you for volunteering because that's how we get a chance to build a democracy. You know, Chris, I'm only to come this way. Once a first time candidate for president. I want to run a campaign that's based on that's based on principles that's based on restoring democracy. And I think this is the way to do that join us to segue to that you have a very ambitious child can universal. Childcare proposal you. Campaign put out I think about a week ago if I'm not mistaken, and I want to ask this question. So there, so let's say you do the problem, which I think is obviously a problem that parents particularly women do not have access to childcare, it hurts female, labor force participation. It's an incredible financial burden two different ways. You can imagine about solving that problem. One is universal childcare that you stand up and sort of credit for the federal government, which is looks like what you're you're proposing. The other would be just like give people a tax credit, give them a childcare tax credit, and then they could go out there and to the marketplace and find it why did you choose your pack. So I choose it for a couple reasons the first one is it's the way to get real money into it for everyone. This is child care universal childcare, and I should say early learning. It's an investment from zero to five in our future. And so it's about child care for all our kids. But it's also about putting the money into early. Learn. Because we have learned that Nichols spent on two year olds and three or four years old. So they're ready to go to kindergarten and ready to learn pays off many many many times over through the years. So what this permits is to do is to have enough money enough resources and then go straight in to the communities and the providers. The nonprofits the towns and cities that want to do this and say here the standards, if you'll meet those standards will make sure there's money available. And by the way, will also make sure that the child care providers who are taking care of our most precious resource. Get paid like public schoolteachers will even put some money in to help them bring up the standards. So that happens so think of this Chris not just as could your kids get parked in front of a TV set, and at least be safe for a few hours. It's. Really about an investment in our children's. So they have the best possible start. This is how we build a real future in which not just the children of rich people. But the children of everyone get a real chance to build lives. That are good. They're too big domestic policy proposals. Your camping pan pain is unveiled you've got to Friday positions. But this and the wealth tax, and this is a question I've been asking every candidate, you, let's say you get elected, and let's say by some sort of political miracle, frankly that the Democrats have both the house and the Senate maybe even by a healthy margin in the Senate. What's your first big domestic legislation? You're the first big Bill. The president Warren moves anti corruption. The problem we've got in Washington right now is that money isn't influencing basically every decision that goes on. So whatever brings you to the table to say I care about what's happening in Washington. Whether it's climate change that's bearing down on us, whether or not it says student loan debt that you can't pay whether or not housing that's unaffordable whether or not it's child care, whether or not it's a criminal Justice system that works great for those who are running private prisons, but not for people whose lives are being. Strode whether it's prescription drugs. I guarantee you every one of those crosses through the intersection of the influence of money. And when you've got a government that's working great for the rich and the powerful and not working for anyone else. It's corruption and we need to call it out. So I put together a big Bill because it's a big problem. But it has the features we need to just be back some of the influence of money in lobbying as we know it force the United States Supreme court to have to follow basic ethics rules. Stop the revolving door between Wall Street and Washington. Oh, and here's one everybody who runs for federal office has to put their tax returns online. We've got to make this government work again for everyone. Because we gotta make this country work again for everyone, and it starts by reducing the influence of money and increasing the influence of the Boyce's of people all across this country. That's that's the kind of campaign that I believe in. This is my chance to get out there and fight for him. That's a straightforward answer. Admirably? So a second question I've been asking everyone. This is the the final one. I'll let you go. The filibuster. There's been Jay Inslee. Who's the governor Washington? He's not a US Senator. So the different perspective on this said today, he would he thinks she get rid of the filibuster. There's some back and forth among different people. Would you support ending the filibuster? In the near future. So I already have a record on this back when the Republicans were blocking everything that we were trying to do you remember back in twenty thirteen and twenty fourteen man, I was one of the points out there fighting to beat back the filibuster. And we did we shop the filibuster back a lot. You may remember they not only were blocking judges. They were blocking the head of the consumer financial protection bureau. So it couldn't take on its power blocking the NLRB. So workers wouldn't have a place to be able to go to have their complaints heard. When when their employers broke the law, and I was all for my view on. This is everything stays on the table. We can't live in world where the Republicans do what they want like they got rid of the filibuster for the supreme court. And then we turn around in his Democrats. Oh, we're gonna play by some set of rules that are long. Past. Now, my view is it all stays on the table, right? Senator Elizabeth Warren, Massachusetts, thank you very much. And I appreciate and respect both sides of the science. Or is it just another problem? So I think this green new deal debate is interesting because it's first of all let's just say that it's only happening in one part of American politics because there's a side that is doing things. What are the axes of debates that are happening here Heather, so I think. Everything changed when the latest UN climate report came out, my son was a month old when that came out, and I sat there and just had all the range of feelings when you realize this person you've just brought into the world is going to be inheriting if we do nothing and over the next twelve years, basically a nightmare. So, you know, I think most of the Democratic Party much of the mainstream has been working for a very long time for ten years for twenty years on a plan that frankly has just been surpassed there is now a new goal post. I wish that there weren't there is and so the green new deal the resolution the idea the vision that I will say is popular immensely popular, just in its raw form, the idea of using this crisis as an opportunity to rebuild the American dream and to channel that American ingenuity that I grew up thinking was our hallmark as this country that we were superman and that when a meteor was going to be coming towards the planet. Absolutely. This country would suit up and get to fighting that idea of the green new deal something that is aboriginal. But also absolutely the minimum that we need to do in order to stave off planetary disaster. That's where we need to be. And that's something that's popular with eighty percent of Americans, including the majority of Republicans. Where do you see this discussion sort of the axes of tension in the discussion near? So I think it's I agree with Heather that I think. IPCC report fundamentally change the calculus of this issue. But I I really think if you think about how we've made substantial social change in the last hundred years, it's both a mixture of widespread political movements that see deep urgency, and that is what is so important about the green new deal is that it's recognizing the cataclysmic affects of climate change. But I also think you need to at some point have a specific plan just like the actual new deal had, and that's the that's the energy behind the green new deal. It's that we are recognizing the scale of the problem. I do think this debate is between has unfortunately, become like a kind of effort of people talking pass each other. And what is the right solution? How do we actually get there? We have made progress for like varies of time. We were in the Paris deal. We did have the clean power plant. Those are being. Ng destroyed. It's not that they're neutral. It's not like the Republican ministration selling Donald Trump is neutral. Which is not like, it's just there's nothing happening over there. There is an assault on climate scientists on the F any effort in this country to deal with climate. And I think a lot of Democrats are caught between these two issues, which is they're defending against Trump right and trying to take on Trump, but also recognizing that it is a cataclysmic challenge. And we can't just have the solutions. We've had in the past two things happening, right? What one is about the sort of size of the scope of the green new deal division. Right. Which is not just a price on carbon. It's a bunch of stuff about transition economy Medicare for all of this. I want to put that aside. But the other thing to me is just a fight in the Democratic Party right now, and in this primary that will get sorted out about prioritization that to me is one of the key things that's happening. And I asked I just asked Elizabeth warning her answer. I asked us if every candidate. It's like what's the first Bill you move, the what's the big I invested priority. And I think what we're seeing right now is a fight in the party in partly being worked out in real time. Heather that like climate the answer to that. Should be the answer that question. I think the twin crises of our time our inequality in climate change and the answer to both is more democracy. So I actually agree with Senator warned that it's important to get the kind of climate Bill that this planet desperately needs. We need to make the people who are in office at that time in knock you lated from the fossil fuel money that's going to be waiting for them on the other side. So I see the theory of the case that you can't get the planet. We deserve that our children deserve without dealing with corruption. Do you do you see that ear that priority question because I watch I've watched I watched the eight primary and I watched health care. I mean through the process of that primary healthcare it became clear that whoever was gonna win that primary back in two thousand eight. Yeah, it was gonna be a healthcare Bill that was good like view the to deal with the stimulus because the economy fell apart. But like the first big thing, do you think we're watching this sort of prioritization battle play out now. Absolutely. I think that that is part of what it is. I hope that through this debate. We have not just a discussion of motive, and who cares most about this? But what actually also happened in the two thousand eight campaign? And I was I was on all sides of the debate. Was an actual discussion of how these plans would work. So as you remember there was detailed discussion back and forth between then-senator Bama, and then Senator Clinton about how you actually got a universal health care plan, and whether we'd have an individual mandate or not. And I when I think is so vital about this debate is that we have a sense of urgency about it. But it also believe that the next president has to have a specific plan. Not just a resolution resolution is really important, but a specific planted -til with the climate crisis. Because if we're just talking about what we like in what we care about and the priority, and you don't have specific goals specific legislation than that to will let a lot of people. The fuck this is a really important thing to respond to because they're absolutely needs to be next part of the new deal movement, which is legislation. But I think that. We can do that. And the first step to doing that is getting a sense of the Democratic Party on the Senate floor that we are all behind this vision. There are things that are happening all across the country at the state level that will be components of the green new deal. And it's not like, we don't have the answers. I mean have this weird. Can't do is right now in this country, even among Democrats, we built the Hoover dam we put the man on the moon. Right. Why can't we? As a final point. Let me just say I agree with that. He did put the man in the moon. And that's what I appreciate about the green new deal. But there was a plan to put the man on the moon. That's only point is living through the primary which saw about the mandate. Brock Obama was like no you can't have the mandate. And then won the nomination was like, okay, we have mandate.
