"Lot of planning. Yeah. Well, I can understand why somebody wouldn't want to continue with the minimum payments and go with the lumps. I'm like you said the trust issue, I keep reading all these stories about, oh, the California teachers union invested in this and lost money, or the Illinois, let's just kick Illinois while they're down. The Illinois teaches union invested in this and lost a ton of money. If I'm in a teacher's union, I'm going to want to know what I'm investing in. It's the same thing that they just invested in lost a lot of money. I've taken my money and running. I can see that that being a huge issue. I wonder what percentage of people who are taking the lump sum because of lack of trust are in these pensions that are being talked about in the news about how they don't have any funding for they can't meet their future obligations for past three years or whatever it was you said earlier. Versus a regular company and they're like, oh, I don't know if they're going to be around. Yeah, I don't have any statistics off the top of my head, but practically speaking or logically speaking, I would say that assuming the employees paying attention to what's going on with the pension fund, they only typically start to do that later in their career. If they see that the pension fund is struggling, they're probably going to take the lumps on. The take up rates on just too high for me to believe otherwise that people aren't going to try and cash out of a system that they think is in financial peril. Now again, not every pension system offers a lump sum. It's not a requirement. So again, it depends on what pension plan you're in and what the rules are as to whether or not you would even be offered a lump sum..

They do a lot of early voting, and so many of the votes have been cast already. Uh, you know, in the polling has been all over the place, Al. I mean anywhere from him, losing to being up 10 points to being even. I would say it's probably about 50 50, and it just depends on who gets out to vote. But that's the way it always is with these kind of either recall or runoff type elections. Yeah, I do think that, um Larry L. A. Has a has a shot at it, but because some of the polls are within the margin of error, But But I will say that, um the liberals have sent out millions of mail in ballots. So how How is it that The teachers union has gotten so powerful. That's an excellent question. No, they have a whole lot of money that they can give to these candidates. That's where most of the money that Gavin Newsom has has come from that that's exactly right. And the whole bottom line. There is The teachers in California are basically mandated to be a part of the union as I as I remember, and that's a lot of those teachers don't want to be a part of the union, but they have no choice if they want to be employed there, so that money and I don't know what to do Czar, but they they're they're fairly significant part teacher. But and it's going for his his real life real like the California Teachers union, the national teachers unions have gotten involved, so we'll know tomorrow kind of how this goes, how I took a quick primer and how California recalls work. The first vote is whether you want to recall the governor and if that gets 50, plus one, uh then the governor's out, and then the second vote. It's not a second time but on the same ballot. Is all these 40 some people that are running and it is a plurality so they don't have to have a runoff. So whoever gets the most votes if they if the voters indeed decide to recall Gavin Newsom than that person becomes the governor. And this this kind of equating Larry Elder, who has been around long before Donald Trump was related to politics. Uh, just just kind of silly, and it shows how scared they are that they would go out that the president would go out and spending entire day. Traveling there and back. To, um, you know, campaign for Gavin Newsom. When he's really doing a terrible job. He's doing a horrible job, and they are concerned. Obviously, their internal polls are showing something that we're not seeing. But I do think it's a lot closer and for for Larry Elder to be on the street and eggs be throw out thrown at him, and they they're calling and the black face of white supremacy. I mean, that is so That number one assigned call for very interesting meant that you would mention the black face of white supremacy. Yesterday in Washington, D. C. There was an arrest of a man outside of the Democratic National Committee headquarters who was a white supremacist. He had white supremacist stickers and things. He was armed all the nine yards. Guess where he was from California. Maybe California cool and I'm not laughing about that. But what I'm saying is when you try to say, Oh, these people have that problem over there, and we don't have that problem over here. Extremists. Are a problem everywhere, Okay, But extremists, by definition are a small percentage of the people and my theory about that. And you can tell me if I'm crazy. With social Media 24 hour news. Inordinate ways to communicate, Okay. It used to be the community would say to somebody that was acting crazy. You're acting crazy. If you want to be a part of this community, you got to straighten up in tow the line. Still a few people wouldn't But most people would fall in line now with social media and all of that you can find 200 people that think your ideas are fine, no matter how crazy they are in the 24 hour news cycle the same way I mean, they're searching for things to do, say thanking. Of just fine people, and they're doing that. And that's uh they're always looking for the In my opinion, for the most part, the negative stuff. He's doing a lot more national than he is local. But he'll get here. So just hang on there. Um, it was about 1100 Respondents, um, mostly likely GOP voters. The response rate. Um was 1.44% the confidence factor, which is what you're always looking for is 95% confidence. Uh, it does have Herschel Walker at 75.7%. Gary Black is next at 6.3%. Let them Sadler, 2.7. Calvin King at 2.2 and undecided is in second place at 13.2. Unbelievable If you had all this together, plus the 13.2 Partial still got a commanding lead, but it's early. Yeah, early. He hasn't been questioning. Look, He knows what's comin. First of all, Let me just tell you something in the primary, No Democrats are going to spend money bashing Herschel Walker. San Francisco was the most beautiful city I thought in the country. Now. Most people don't even want to live there, let alone go there. And they're not the only ones. Inherited beautiful state doing beautiful things. If state they gave us, Reagan and Duke, Major and Wilson Three tremendous governors. Everybody used to say Go to California go to California. When I was a kid growing up in Philadelphia, that's what they would say. That's the land of opportunity. Not anymore. The question is whether or not there enough people in California To take matters into their own hands and control the outcome of the state or whether They've just bought off too many people. California's have an opportunity. And what I would encourage you to do if you live in California for haven't voted obviously vote. But be responsible for five or 10, other people. You've heard me say this before. It's up to you. It's not up to anybody else. It's going to be up to you. And we'll see what happens. And I want to salute Larry Elder. He's a gutsy man. He didn't have to put up with this stuff. Is enormously successful career But he said, if I don't step up and fight this who the hell is going to do it? "State Assemblyman Kevin Kiley has been serving California on the state level since 2016. In fact, in the 2020 election, he received more votes than any Republican in California history. And just as an aside from me, he's probably one of the most tech savvy candidates in the recall field on the frontlines fighting international intellectual property theft and pleased to be joined now by Assemblyman Kevin Kiley of the sixth District Assemblyman Kylie A Pleasure to speak with you. How are you this evening? I am doing very well. Thank you so much for the chance to be with you. Absolutely. Anyone who knows me knows that I'm big on education, Anyone who knows you Knows you started your professional career here in Los Angeles as a teacher, and your father was a physician. So let's get to it. What is likely going to happen in our schools because of this delta variant? And for better for worse with that answer, how would you handle it as governor? Well, I would learn from the experience of the last year and a half, which is that states that kept their schools open that actually, you know, tried to do what was right for kids did far better than California. Did. You know, By any measure, California had the worst school shutdown of any state in the country were we were literally 50th out of the 50 states. In getting our kids back to the classroom, and that wasn't because that was somehow the safety and do. The governor knew it. Wasn't he sent his own kids to in person private school? It was because the governor and the Legislature simply took their orders from the teachers unions that tried to shut down schools and continues to try to shut down schools for as long as possible. And so what I do is I would actually do what's right for kids. I would have them in school full time. Five days a week without any excuses for any district across the state, that is the right of students under our State constitution. Is to have access to a quality education, and we look at what's happened over the course of the whole last school year, the states that had their schools open for in person instruction. They did not do any worse as far as covid goes, But they avoided all of just the terrible, almost incalculable harm that we've done to our kids by keeping them out of school here. I think you might be psychic, because I think you know, my quick follow up question is going to be as a former teacher. You understand the teachers union equation in this better than most I suspect. But if you say as governor and you're saying right now I want all the schools open. But the teachers, unions and teachers, California teachers union and also California Federation of Teachers that they say no. How do you navigate that politically? Well, they can't say no, I mean that you know, that's the reason we have schools is for them to be open and for them to educate kids. What we need is politicians who are committed to doing that, who don't just do whatever the teachers union says. And so I will be very clear as governor that there is absolutely no excuse for any district not to offer every single family the opportunity for full time. Five days a week in person instruction, that is what they are owed. That's what they pay taxes for, and that's what needs to happen. Assemblyman and counselor. You won a major battle in California Superior Court against Governor Newsom with the court indicating that Newsom had in fact abused his emergency powers. Put another way. I'm not so sure that this recall effort takes hold without that court case. How do you view its significance now? On the other side? Yeah, I mean the principle that we were litigating That case is one that is just absolutely fundamental. It is the issue of our time. In the sense that Gavin Newsom viewed the state of emergency that he declared as transforming our entire system of government from a democracy from a representative government into an autocracy where all power is concentrated in his hands, And that's not an exaggeration. That's literally what he said in this court case. On several occasions. They said that they state of emergency centralizes the state's powers in the hands of the governor. And so we have been living without the representative form of government That is every American's birthright. And so What we said is no. That is not what an emergency does. We have an emergency services act that allows the governor to sort of operationalize the powers that are properly vested in the executive branch to respond to things like fires and earthquakes. And then fine investigations And, yes, pandemics. But that does not mean that he can exercise powers of the Legislature or that are not, you know, uh, part of You know the powers of government in the first place, And so we want to trial against Newsom on that basis for the court said that yes, he had, you know, abused his emergency powers. And I think that it did, uh, you know, in some sense helped to galvanize support for the recall, because, you know, it was just another example. I give kind of a forum for what everyone was feeling that the governor had just taken too much power into his own hands had violated the Constitution and was acting in a way that required A check, and if the courts weren't going to do that, then the people of California could do it on their own and take matters into their own hands. There's ideas, and then there's implementation, and I can ask other candidates this and they can answer in the abstract, but I think you can answer it on a reality level. I wonder about this relationship between the governor and the Legislature. I wonder if a Republican governor can work with this Super majority Democrat Legislature. You are there in the trenches, as they say. How is this relationship working these days? Just on a general level for the last year and a half. The Legislature has really been pathetic that the Legislature has sort of just, you know, And I mean the leadership who's calling the shots is just kind of surrendered to this idea of one person government and everything related to Covid has been controlled by the governor. And that's not the way it should work from the beginning. The Legislature should have been involved. There should have been hearings where the people of California would actually have a say in the way, you know our state responded, and I think We have done that we could have avoided He just serious errors that led us to have I believe the worst overall covid 19 outcomes of any state in the country. But you know when you look more generally at how would I as governor deal with the Legislature? Well, I'll say this. Yes, I've been in the Legislature for five years, and I've actually passed a number of bipartisan bills some of the most groundbreaking legislation to pass in recent years on topics like public safety, school choice, freedom of speech. Artificial intelligence. I actually the governor just signed one of my bills days ago, so I do know what it takes to get legislation through. But I also know just how fundamentally broken our state government is. How dysfunctional our legislatures how it's just made California's problems worse and worse, and worse, year and year after year and neglected to do the things government is supposed to do. And so I'd be in a position on day one to sort of issue an ultimatum to the Legislature to lay down the gauntlet and say, I want to see major legislation reform legislation. On the key challenges facing the state are failing public schools, rising crime rates, homelessness, the soaring cost of living, and I'd say Look, if you do not work with me to act on this call for fundamental change. The people of California have just given us then I'll take the issue to voters again. In 2022, you can face the same fate as Gavin Newsom the next year's election. Because they don't they don't have the resources to suck those things away. Why do we have a lot of different reasons. But but roughly half. We're gonna show up in record numbers that defend incumbent governor. That just doesn't happen. And so as of June 30th at midnight, the schools will not legally be allowed to say that distance learning is fine. You can't do it. You're not going to get your funding that way. This is setting up. The next big fight with the teachers unions because I'm sure incessantly Meyer cruises broadcast on YouTube tomorrow. She's going to be upset with the fact that the governor thinks that we're gonna be safe enough on June 30th to do away with distance learning, which means in the fall, they won't even be able to use that. You can just hear if you open up your door, because if the teachers unions don't have that tool in the toolbox to say they have permission from the state to allow distance learning, and so they can still do hybrid in the fall, or I mean right now, tell us do you think 8% of high school students are back? For advancing the recall because of some of things I've said about recalls in general in the past, and it's not because I think Governor Newsome deserves to stay in office. It has nothing to do with it. It's just because it's so much bigger. It is so much bigger than first of all. I don't think Gavin Newsom actually cares about the recall. Don't I know that's heresy for a lot of conservatives who think that everything he's doing is because of the pressure the recall. I really don't think he feels that pressure. I don't. I mean, after the recall qualifies, and I think you'll see some pivot it But people were going to recall him. People gonna sign those petitions. Whether or not he reopen schools reopens K through okay through three. Whatever the people signing those recall petitions didn't vote for him. Did not vote for him. So it's easy to get signatures from people who didn't want him to be governor in the first place. Have yet to find. Someone who voted for Newsom. And wants him recall today and replaced by a Republican. Haven't found that person. Yet. In California. Maybe there is one. Maybe there's 10. But you need like four million So The recalls a separate discussion. We could talk about that separately. My larger concern. Is where the governor's one man hey, could be overruled by you know by the Legislature. Republican or Democrat. The school's closed has to hurt all families. But yet in a Democrat controlled Sacramento, it doesn't seem to mind any of the elected lawmakers. It doesn't mean either. It doesn't bother them. Or it is true that the California Teachers union has such a grip on Sacramento. But the recall wouldn't matter anyway. Right, because they wouldn't they wouldn't allow Remember the people choose To effect change. It is true when you think about it, right? I mean, where is the Where is the the the statement from every member of the state Legislature in San Diego County. Well, this should be constant statements. Arguing with the governor. Angry with the governor. Angry with the teachers unions angry with every school district that is not yet open. Based on the science. Mean Republican and Democrat. You would think that they would all be screaming because they're representing families. And those families like the one you just heard from John in National City. He's got three boys in elementary school. I have three boys in elementary school. Well, they're registered in elementary school that are getting any elementary education because I'm not in school. Said vaccinations should be a prerequisite to resuming in person instruction, all teachers and he said, Look, if you're gonna talk like that the new mothers would just say that we're not reopening because you can't By the time you vaccinate every single teacher, there won't be enough of a school year left. So this back and forth is interesting to me because the presumption is well look, the teachers unions are the ones giving money to Democrats. Newsome is a huge Democrat, a huge recipient and has been of teacher you union PAC money all this time. So are they really picking on each other? Are they really going at it with each other? Or is he about to throw the teachers union onto the bus? And I scratched as a way to hold on. I'm you know. Is this. This? This is not play. And then 14% or in classrooms half the time, which is a joke. And then everybody else is at home. You and I both know that there's no learning going on. And they sing songs on the paint pictures and wait until the other half the class it was done teaching getting, you know, taught in by an actual teacher, Then they switch off. It's still not a full day. It's complete ridiculousness. So the union's know that they're not educating Children. The governor knows that Children are not getting educated, and certainly parents have known this since mid March. So what's changed, right? I got ahold of somebody in the governor's office, and they went into this notion that the governor wants it to be a sustainable opening. Louis. We want to do this right. We want to do it once and write the shutdowns and opening up and shut down of the restaurant industry and the other industries have been devastating. We don't wanna make them stay calm.
