All of these women are in the media so this is very similar to the story that got jeered porter fired as the gm of the mets last week. The story from the athletic is very detailed. And i'll just read from part of the story. It says calloway aggressively pursued at least five women who work in sports media sending three of them inappropriate photographs and asking one of them to send nude photos in return. He sent them unsolicited electronic messages and regularly commented on their appearance in a manner that made them uncomfortable. In one instance thrust his crotch near the face of a reporter as she interviewed him in another. He told one of the women that if she got drunk with him. He chair information about the mets that one paragraph and i would encourage people who are interested in the story to go to the athletic and read it. If you hear that one paragraph you think well this guy. It's going to be like jared porter. He'll be fired today. Yeah he has not been fired today. And the reason for that is that in california and i don't know if this is different than in new york but in california you are entitled if you claim that you didn't do these things and he does claim that he didn't do it right then. You're entitled to an investigation before they can fire you so He since calloway has denied all wrongdoing that under california labor law. He's entitled to an investigation before he has terminated so the angels have suspended him so he ended up the team's not meeting right now anyway so we don't know when the baseball season's going though but mickey callaway is probably not going to be the pitching coach. The they're probably be some due process here and then they'll eventually fire him and the angels won't have a lot of time to go out and find a new pitching coach. We don't even know when the baseball season is going to start right. Baseball players union wants to start at the normal time. The owners want it to be pushed forward a month so spring training and march as opposed february players wanted to start in february on time. And there's a big disagreement go figure a big disagreement between the players and the owners in major league baseball right so we don't know when the baseball season going to start but back to this. Calloway story It is what i've learned. And what i learned in when we reported that cheered porter story is this is. This goes on with all sorts of female reporters in all sorts of sports. And i. there's no other way to handle this then to develop zero-tolerance people aren't getting it. I can't imagine ever sending a what was it. That porter sent forty one unanswered techs. And now this guy. Mickey callaway desert to five different female reporters. The these people are trying to do their jobs. What are what are you not getting here. I think anybody who did with jared porter did or what mickey calloway did meets professional help. They need it. Didn't need to go to a psychiatrist. And and so. You agree by the way this investigation. That means you're trying to dot. Every i and cross every t they wanna make sure they've got a rock solid case. Get all the evidence together all of it together and say here's the case why you're getting fired. He suspended he ultimately will be fired. There's no way am if this story is one hundred percent accurate. We have no reason to believe it. Isn't it seems very well sourced but i mean you're you are innocent until proven guilty in this world so he should have a chance now but wait. Wait what if you look at the story. And there's proof of the phone and it says in the story lays it all out like the in this story itself there's proof of screenshots of these text messages and appropriate text messages and they said that they saw the lincoln messages and they saw the emails. I mean just from our point of view without doing any type of investigation. Don't you think that that right. There is enough to be like okay. There's plenty of proof here to show that at least you know. But you've gotta your own investigation. You can't say all right. The athletic to the investigation. Let's run with this because right now. It's the athletic versus mickey callaway. Calloway's denying it didn't happen but can't the angels say we don't want somebody that's being accused of that by multiple people on our team whether it all you got gotta be careful if you fire somebody for 'cause they and somehow this is wrong but if it's just a moral thing it's a character clause like the you know like the whole thing he's going but he's going to be fired he's going to fire all they want is to say here's the case. So we learned that and then we learned this. Now, the this that we learned is interesting, and I had to kind of read it twice to understand it because Laws, Legal's legalities, legal laws, legal laws and business in things, which should not shock you. I don't know much about that's really not our forte on the coming and Bradley show. No, but we can read words which helps us And so here's what we know. Apparently, she's saying, Yeah, you took a bunch of my money or I should say you did a bunch of stuff on the down low that you weren't supposed to do. Labor code. Details. Just tell you what I just learned, like I didn't realize they had to be licensed. If there's a difference between an agent and a manager in agent has to actually have a license in California to do what they do, and it's a very specific thing that agents do not to be conflicted with the manager, which could be all sorts of things. So for staying so, basically, she's saying, like, um, Yeah, Here's the thing because you weren't licensed. You were violating California labor code. And because of that, um You didn't You made a bunch of money that you weren't supposed to make, and I would now like all that money back, Let's let me get you some details. Clarkson's filing with the California Labor Commission alleges the black stocks were not licensed to act as agents in California and hid that fact from her. "Services have had huge pandemic boosts not surprisingly there ready and waiting to ferry millions of holiday meals in particular. We're presuming that. The ceo of door dash is particularly thankful for the extra business today just last week. The silicon valley company filed to go public that filing has been met with as much skepticism as a novice cook eyeing his first turkey. Now let's be clear. Door dash is now the largest delivery service in the us by volume revenues grew exponentially after the first lock downs and they've continued to surge since january door dash has delivered more than five hundred. Forty million orders according to the company's sec filing that's about three times as many as the same period a year ago this year's orders brought in almost two billion dollars in sales again well over double the same time last year. Sales are likely to continue growing as long as the pandemic is with us. But here's where some of the skepticism comes in like many tech company door dashes focused on growth at the expense of prophets. The delivery business is a dogfight door dash up against ubereats grubhub postmates which ubereats bought in july and restaurants owned delivery services as a result. The company has only had a couple of profitable quarters since it was founded seven years ago. Yeah one of those quarters was this year in the second quarter door dashes turned a profit of twenty three million dollars but in the third quarter jordache once again lost money bat. Despite restaurant owners long complaints jordache takes as much as thirty percent commission from them. After winning a victory in the most expensive ballot measure ever to hit california along with other gig worker businesses like uber and instacart dash spent millions to win passage of proposition. Twenty two that proposition exempts some companies from a new california labor law that reclassifies gig workers as employees door dash has a million drivers call dashers across the country having furnished them with sick. Leave and unemployment benefits would have threatened the company's existence they say passage of prop. Twenty two may door dashes. Ipo prospects much brighter. Cnbc reported under prop twenty two door. Dash uber and others will have to provide some health care benefits to drivers along with minimum earnings guarantee over time those dashers face their own. Because there's not enough educators there coming out of the system already indoctrinated in part of the problem. These these teachers are have been indoctrinated. And they see what else you got absolute because that was the craziest thing about pocket and took her back to once you start something then they they have the the ability to go in and you got show them all your records and that means you got to pay somebody to prepare all these records show on and they can go down and keep checklist all these things. Because it's like the last three years of employees and Blah Blah Blah. We'll settle for ten five and they just go okay. Fine here yeah there's like a holdup. Yeah and the judges get involved because now they have a fiduciary duty to protect the clock. You know I call it a class but it's a pug a class. It's different from a a class class in a class action sure You know the the statue of limitations. One you're on first class. Actions are four so you times those damages potentially really times four because messy are sadly highly technical. Look this move on to By the way ten dozen dollars. It's not wrong so we'll we'll give you you know for one one in one What are these these two terms the same? The first term is regular rate of compensation versus regular rate of pay. I'll say it again okay. Regular uglier rate of compensation versus regular rate of pay. Only because I'm becoming cynical. I'm GonNa say the answer is no okay. Well see the answer probably was well actually a year. That is the exact answer but you know usually it starts depends right but you you know you know that you you know me. Better already You're one hundred percent correct. They sound the same. Yeah but they do sound exactly really if if if they pop quiz you would say that to say yeah come on. Yeah absolutely I you know. Regular rate of compensation is essentially essentially your wage that you're being paid And there's cases already were or these terms of endearment In the employment actually means something but just generally as far as what their meanings are regular rate of pay has a legal definition in the Labor Code The regular rate of pay goes towards calculating overtime versus versus regular rate of compensation goes towards compensating meal period premiums rest period premium. So Again this is ah compensation would be everything. That's in the package. Male breaks and stuff but the other one is overtime. Well Yeah I mean. The regular rate of compensation is more of a calculation to pay a meal period premium. So it's what's your hourly rate is The term regular rate of pay comes with a different bag of worms. Because it's not just your hourly rate There's different calculations that go into this but there's also bonuses you know if you give bonuses at the end of the year if you're a commission based employees those can also drive up. What's your regular rate of pay is because you have to calculate that when it's earned you know. Let's say there's there's class actions I wanna say it's Papa. John's was the case. But provided food to your employees you know the these are pitfalls potentially and you have employer trying to do the right thing. Yeah and yeah. It's not working out so well for them so in that situation does that increase one's rate of pay or compensation because they include the food that was given to them absolutely. So you have the tech the technology so you have the regular rate of compensation plus whatever else they got in the form of you know what's happening now. Paul is not gonNA provide me my standard pre show meal anymore. I know you clock in fingerprint. Your twin brother that came so Yeah No talk recommended bonuses because that was one thing that they brought up to that you decide at the end of the day holiday bonus her bonus because a safety bonus. You met a goal and yet that wasn't factored into your paychecks. Well it's a bonus. I didn't know what was going to give it to you. Well is it a bonus or should have been figuring as that make all the wage statements incorrect. Absolutely I'm you. Oh you hit on two issues one whether or not bonus matters is whether or not He knows discretionary. Tha- that's the term it could be non-discretionary or or discretionary. So that's that's the key analysis there and you hit on the wage stephen issue again. We always ended up back at the wage statement issue and that would be more of a derivative claim. I meaning meaning in the wage in our world. If you don't pay so one one dollar that she oh them again. The wage statements probably incorrect So you have a penalty there you the of a liquidated damages that they can tack on as well so again is one dollar that showed them but you know statements not because you didn't get paid or they're just because the statement was incorrect. Had The wrong address had rung employee number on it. Had A whole bunch of the statement was wrong. And there's a penalty for a big penalty. Yeah and you know no and again this goes back to my. Original thought is every year having attorney. Look these wage or even today these specialized. Hr you know third party managerial companies. Come in they know what they're doing they know to look for. I mean literally in Labor Co two to six it lists nine different items. That should be on your wages. Stephen so look whether or not you're coming to us do something about young. Give us some of the putsch spot to name all nine but give us some of the employee's name team and they're ide- yeah name last for the Social Security Address the employers true name. It's all about being transparent. A Lotta these factors one through nine. They WanNa make sure that the employees can look this wage statement Know who's paying them you know so so essentially know who they can potentially liable And know how much time they worked during that you know whether whether it was regular time overtime double time could be benefits. Do I have in my you know paid sick leave or other vacation policy And what was the rate of pay that those used and again you know this is regular rate of pay depending upon or is it regular rate of compensation. That's just you know get into those complicated issues are higher defining it but you really WanNa make sure that it's transparent transparent to the employees can look at this one piece of paper and know that they got paid a certain amount of money and it was a proper proper amount of money. I have one more question Bart an extra minute because I'm talking talking to mature but Let's say that you go to pick any payroll circus we can read off a ton of ADP or something. Am I correct. So just as way of proper introduction. your firm is Louis Brazil boy bisgaard and Smith so Happy to have you here. Tell us what employment law. Let's start there and then kind of work our way up. Yeah absolutely one. It's a lot of a lot of different subjects and I it's a business and it's the nuances within a business is dealing with. People is dealing with laws and is trying to conform the to to make sure that you're doing everything right. You know to the extent that you can And and that's the employment world that we live in two and in California's particularly Special within it especially the good word for it Especially Russia is complicated. The Lane sometimes you see them and then sometimes the pain isn't on the freeway and you're just trying to stay in the same lane. That's really what you're doing So with okay What are some of the hot topics these days? I know there's been some new laws and then there's been some Uh older laws that have been modified. So what what you've been working out lately. What should our listeners? Well you know. There's a lot a lot of different topics and the golden rule is every every new year. you should definitely meet with a consultant whether it's an attorney HR specialist someone who knows what they're doing To get you in the right the hands because come January first of every calendar year. Something's changed something you you thought you knew has now been changed. it could be arbitration Asian agreements policies. It can be the types of protected activity Or just managing your employees. How to do it do the? Laws differ based on the number of employees It it does different laws do apply But for the most part once you get over five you know really five fifty fifty And after fifty. It's pretty much the same okay. So was this the rule of thumb. Standard Five you still have rules and laws. Yeah you still do have to comply it. Everything's delicate everything's highly technical And here's this control Employers I you know in businesses takeoff and usually owners presidents vice presidents they control of you know the demand the supply and having a viable. Oh business the one thing. They cannot control our employees When they call in sick you know subjective feelings? Subjective factors that they can't control and and in California. You shouldn't give up on control you know. The employer should give control. Okay all right Is Is there anywhere you wanted to start i. I had one thing in particular when I kind of talked about it that that was kind of assumed. But if you want to start somewhere you go no you know. Look I I was. I'd like to start with. When do you get US involved in? I think that's an important question touched on in another podcast Get US involved as soon as as possible. Yeah I don't care whether or not your small business medium size business yeah fortune. One Hundred Company It's at the end of every year. It's kind of like an annual checkup up with the doctor physician. Yeah you want to at least set aside our couple hours whether it's an audit of your policies Let's talk about them. Yeah so An adage my wife uses because When it comes to us by organic food all this stuff goes honey? You WanNa. It's either by you know. Pay For an hour pay for later so pay for the expensive food now so you don't have the big medical bills later. Would that apply for you pay for a couple of hours now so you don't have a big blow up later. That is a spot on analogy to California California law and you know in the employment world Because it could be one simple policy it could be your wage statement that you're giving each and every one of your employees you're missing one one of the nine required items and if you fix it then you're limiting the liability thereafter so that statute of limitations every day that you keep going that's one less day that you're gonNA can have to send you and pay out all right. So do I have to go home and tell my wife that she's right. Well you know. Look I'm not gonNA tell anyone if you're all right so so you know. We love stories on the show and this is somewhat related to story. But we're in the holidays right. So what's Doosan dotes at holiday parties. He's yeah Well one have fun for me. I look that's the one you actually use the very technical term you said holiday parties I think that's one of the issues is you know when you have a themed Holiday towards Christmas Hanukkah You know kwanzaa whatever may be a holiday. Party is truly what it is. Okay So one your employment pro already using holiday terms But here's the issue have fun but within limits you know as everything you know. I'm an attorney but I also recognize that you're celebrating something. You're celebrating the end of the year and there's always limitations visions Let's stay away from theme parties You know we're celebrating a holiday. That's enough some of the pitfalls that we've seen in cases over the years Some people cowboy Indian themes can go wrong You know you something as simple as someone's favorite movie you know could be Greece and If you really think about things that were happening in a movie Danny Zuko was not always abiding by the rules that you know of engagement that we would like our employers to engage in and So so it's pretty easy to offend a for instance. You know you never know who's listening how they're gonNa take what's going on yeah But yeah there. There's lots of different different things so theme parties Stay away from those okay Obvious one is limiting drinking But again limits and you have have to balance who you know which are celebrating employees like to do When do you have the party is at night right? You're trying to limit factors Usually during the days a better option you know this day and age you have you know you can do a lot of these different courses. No you can do these game nights. It's you can do. You can get creative and you really trying to get creative to limit liability right. Stay away from drinking. How many people are not over the age of twenty one? Yeah How are the employees getting to and from Holiday Party and make sure you you provide them and writing sometimes uber or sometimes you can give a discount coupon? Whatever you're doing you're trying to show you're being conscious of the factors that that matter? You know being responsible responsible employee employer Towards your employees. Okay all right You know managers play crucial. I remember there's some of the the biggest offenders. How do you set aside enjoying the moment enjoying the holiday party?
