"Philadelphia Phillies slugger Bryce Harper is expected to return to the lineup on Tuesday, 160 days after undergoing Tommy John surgery on his right elbow. The two time national league MVP indicated on Instagram that an appointment with doctor Neal eletro on Monday went well and that he was cleared to return. The Phillies said when Harper had surgery on November 23rd that he was expected to return around the all star break in mid July. Philadelphia was set to begin a three game series against the Dodgers in Los Angeles on Monday. I'm geffen cool bar.

I know Drake Turner preferred silly to San Diego he's probably the one guy in the world, but Harper was a little hesitant at first, but he's the perfect guy because he's into it with a fans and all that. You know, Machado is a great guy, but he's a little cooler, you know? He's not going to revel with the fans and really get to be a Philly guy. So I mean, I think it's really ended up getting the right guy. I know there were people that front office who looked at the war and said Machado is the better all around player and I get that, but he was the guy for that team and he gives them an edge and with that lineup with Turner who again turned down San Diego, I have to keep saying that because I can't believe you turned down San Diego and go to Philadelphia. We have Fox Sports radio cavina in which footballs. We're going to talk about players that you hate it, now you're forced to like. There's a few stories in the world of sports. It's kind of hard. Is it a progression? Do you just make the decision because they're wearing your Jersey now? They represent your city. Is it that easy? How does it work for you? When a guy you typically hated is now on your team, what do you do? Because there's a story, there's a couple. There's a couple factors at play here. The NBA, a lot of moves, a lot of moves. And with Russell Westbrook, remember Aaron Rodgers woke up and he's like, wait a minute, where's Westbrook? Wait, what happened? Aaron, he's still in LA. Wait, what? I thought they got rid of him. No, on the clippers. They're still gonna suck. I know you were in a four day slumber. Russell Westbrook is now a clipper, right? Ben maller, monse Bologna, who does the updates. I know a lot of clippers fans here at Fox Sports radio are probably fighting themselves like, wait a minute, I just spent the last months of my life making fun of the Lakers and Russell Westbrook. Wait, and now he's on my team? Now I got a route for this guy. How do you spin and twist that? I'm not sure Ben maller had Westbrook in his ingredients for the Baba gauge. For the clippers bob I can use. I don't think so. He had Juicy Lucy. No Russell Westbrook. And Patrick Beverly, polarizing character, right? Anytime someone's polarizing, it is always that feeling of, I don't know if I could root for this guy. It's either the guy's flashy, he's outspoken, he's polarizing, or he's just really good and he destroys your team. That's why you hate a player. Right? I hate this guy's a blowhard. He's a cry, baby. All right, why did Matt fans hate Chipper Jones back in the day? 'cause he met. He owned them so much, he named his son, Shay. So yeah, so it's like, exactly. That's so great. That's like a mets fan. Now having to root for Chipper Jones. Patrick Beverly now finds himself as a Chicago bull. But he's trying to win over the fans because you know what he said? He said that his goal is to not only make the playoffs, but to knock the Lakers out because they play a few times down the street. Right, right. But now both fans are like, well, I like that. He's trying to win us over, but I hate it, Patrick Beverly. But when he's on your team. But when he's on your team, we name these guys yesterday on our show, but to reiterate, guys like Richard Sherman. I remember in the 90s as a niners fan, Deion Sanders hate him. Then he came to the niners for that championship run in 94 95. All of a sudden, I was like, prime time, baby. So you love a guy when he wins for you, but those same type of people, and they're not on your team. God, they're not likeable. Again, hated players that now you're forced to love, you end up loving, who comes to mind, how does it work for you? Does it take a minute? It's interesting. They have to win. It's interesting with pat bev because Chicago is on the outside looking in. Just outside of playoff reach as we speak. Same with the Lakers. So he left the team at the bubble. I don't know if you knew that. Yeah. He's on the outside. Outside. He's looking in. He's looking in. So, pat bev. What other guys come to mind? We were talking about Russell Westbrook. Guys that, again, it's always going to be outspoken, flashy guys, or again, a guy who owned your team. For sure, as a guy, like, I hate it, this guy. TO. Now I got a root for this guy. Tio ran to the 50 yard line and disrespected the Dallas Cowboys star. Like he was Rick James on a couch. F y'all couch. No. He put the ball down. The ultimate. And then he ends up playing for the cowboys and cowboy fans like, yeah, are we good? We're it's okay. Take a minute. And the only way to really make it work is to win, right? Yeah, winning tears off. Walk the talk. And then all of a sudden, everybody's on board and they're supporting you, even though they hated you. But it does take a minute. It takes some campaigning too. We often reference Bryce Harper when we talk about stuff like this. There's some campaigning involved in winning over the new fans. Bryce Harper was a genius. Yeah. Shout out to the late great. And by the way, papa, the genius. The shout out to Lenny pavlos, right, rest in peace. Why would anyone hate Bryce arbor? Because he's good, because he's arrogant. He plays with a sense. Or he looks a little out of the hair. It's the hair. He's handsome. He's got the beard. Could stubble. That's his guy. Good beard, yeah. Right? So he has to campaign and win over new fans. So when he went to Philadelphia, keep in mind, time flies. He's been on the Phillies for a minute now. He was on the Washington nationals. And when he was there, I'll tell you who hated him. Mets fans, Phillies fans, Marlins fans. I don't know if they exist, but Marlins fans. And everyone else in that division. Braves fans, because he dominated when he went to the Phillies as a free agent. You know what he did? He started taking pictures, hugging the Philly fanatic. He was wearing Philly phanatic socks. He was talking about how he loves the city of brotherly love and he's going to earn their love and he's eating cheesesteaks and yo, he dove headfirst in. He really did. Like when you think back and when you witnessed what he did, yeah, that was really smart because he won everybody over. Everybody hated on them. Everybody hated his pompadour and all this guy with the hair and the beard. Remember in his early days he would pull it down and he was some sort of warrior. Some sort of ultimate baseball warrior and he did a great job winning them over. We ask you Fox Sports radio nation. How do you do it and who comes to mind? Players you hated, why'd you hate them? And now you're forced to love them. I always hated in my number one answer. Again, I got number one answer on the board. Survey says, okay, Steve Harvey. For me, for me. Number one answer for me. I always hated guys. Like Paul O'Neill. He's my number one go to when I think of stuff like this. You know why? Because he was like a cry baby kind of guy. And he had like a Ronald McDonald Afro. And I'm like, this guy sucks. I hate Paul O'Neill. He's a cry, baby. Look at him crying. Set the Ronald McDonald. He went to the barber asked for the Ronald McDonald. Same like when Howie long goes to the barber and he goes, can I get the whole colgan? Yeah, not how a Terry Bradshaw. How he long just says military, please. No, how are you long asked for the Brian bosworth? Or did Brian bosworth as for the Howie long? No, but Paul O'Neill, he had a Ben savage haircut. I think Jimmy Johnson just wears a helmet. I don't think that's, I think it's a helmet. It's a hair helmet. Like those little people, like the little toys. It's a hair helmet. Pole O'Neal, why is he polarizing? I don't know. His crybaby attitude, the way he'd come back and beat up on a Gatorade cooler. He smashed a water cooler. He's swinging a bat, crying and fountain. Then when he came to the Yankees and he brought that fire and fury and that winning attitude and those expectations to the Yankees. And I saw him win and produce. And watched him every day. "All right, John, thanks so much. We appreciate that. Boy, what a week for technology earnings. And if you think about it since the great financial crisis, it just seems to me that technology has been the leader in this market. I wonder after this week's action, if that's still the case, let's talk to a couple of experts about that. Dan, I've seen your equity analyst at Wedbush securities, a Penn State alum is probably more to the point as a facial Ohio State this weekend. Plus mandeep Singh. Bloomberg intelligence. Join us here. We're going to round table at Katie to talk some big technology. Hey, Dan, I want to start with you. Again, I kind of feel like this market, the leadership has been technology, technology, technology. Is there any reason to think that after this week's earnings that may not be the case going forward? Well, it's a great question. Clearly, this was a horror week for big tech. Outside of the Apple. And obviously, you're seeing the stocks reflect that I think as we get through this rough patch, they continue to lead actually as we go on the other side is downturn. Look, no doubt. I mean, blooms come off to release your big tech and now it's a bifurcation. I mean, you have the Microsoft the apple versus disaster situations like meta and others. And not all are going to go up. And I think that's really what we're seeing here. But Dan, how much of a bright spot was Apple truly? Because I know that revenue profit, they both beat expectations. That was the headline, but they also warned of a holiday slowdown. You'd sales of iPhone services a little bit lighter than expected. The stock, I mean, definitely compared to its peers upright spot, but is it worth a 5% rally today? I think relative to seeing big tech, I'd call it a Bryce Harper type of quarter. And guidance because if you strip away currency, they beat and actually guide higher. And I think that's what the street when investors are greening, the underlying demand story still relatively tough on. Of course, we're on the edges demand issues, services as well. But I think that's really the headline here. And by the way, how is a higher state of 15 and a half point favorite over Penn State? I'm just looking at that right now. I'm going to take a look. I'm going to do some work on that later this year. Talk to us about the digital advertising space. I think I look at the numbers of Google, Facebook, again, I'm old school, so I'm going with those names. And even Amazon's advertising space, it is, it's been such a great secular growth story as all the advertising dollars come from some traditional media into digital. Any reason to think that that's not such a strong case anymore or was this just the weakness we saw in some of this digital ad spend numbers just to focus of hey it's a cyclical business? It is and I think to give you a data point, the vendors that actually outperformed in the digital ad space this quarter was Pinterest. It exceeded expectations, the arpu growth was positive. They didn't have as much of ad pricing headwinds as some of the other vendors that talked about. And look, this is a classic case of expectations coming down and then the company beating estimates. And so now that it's happened with alphabet and SnapChat, and look, this space is cyclical. It's going to come back. Maybe I think 2023 is priced in at this point of time. And as we go along, if it's not of a deep recession or anything like that, these companies will outperform their numbers going forward. Mandeep, it is so wild to hear you say that about Pinterest because speaking is the center of my own universe. I think about my average life. I never use Pinterest. I used it to help plan my wedding maybe 6 years ago at the fringes. It would have been a core use. No. No, I don't even know what it's used for. I mean, who's the average Pinterest user? How are they possibly crushing it? Yeah, so look, in terms of DAUs, Pinterest, like USD AU is around 23 million. Contrast that with SnapChat, 100 million U.S. DEA us and Facebook, Instagram is around 200 million. So clearly, they cater to a niche audience, but the thing is, one they have launched this new app called shuffles that seems that has seen some traction and also they operate across the funnel. Top of the funnel, lower funnel. So they have a lot of first party data to cater to the different types of ads. And with the management change, they had recently, they just seem to have gotten their act together now. Is it sustainable in terms of user growth? Probably not. I still think it's a niche social media app, but the fact that they're executing well in their core audience is a good sign for the rest of the social media space. Hey, Dan, you've been one of the leading technology bulls on Wall Street and you've been very right, how are you positioning in a sector now and maybe what are the names that you're going to be talking about over the next three to 6 months with your clients? Yes. I mean, we're hand holding through this downturn specifically navigating towards software, diverse security. I still think Microsoft here in large cap Salesforce.com. Cybersecurity resilient and then we're really seeing that memes like pow out or checkpoint tenable crowd strike Z scale or another. And I think apple and large caps are going to get more and more of those large cap dollars because cook's pilot in the plane. Zuckerberg, that was more of a Ted striker airplane moment in terms of that conference call. And I think that's what investors really gleaned from this week. You want to bet on the Dell in cook and not Zuckerberg betting on metaverse for 2030. All right, and then Dan, I just put in TW TR into my terminal and I got nothing back. It's gone. Elon owns it. So we're going to have to see how that we're going to see how that plays out, won't we? Official today must go into Twitter. And as I said, the easy part was buying Twitter from us. The hard part is going to be fixing it and that's really going to be front and center. So China has ended its streak of yuan fixings near 7.11 per U.S. dollar, but that doesn't mean it's not a much stronger than expected fix from what the market was expecting. The market estimate was 7 1962, the PBOC came in at 7 1230 per U.S. dollar, and we're trading back to the weak side of the range we've been in this morning to see an H is now right around 7 27 against the greenback and we'll be getting the onshore in about 12 minutes or so the last trade there was at 7 23 O 6. The boomer dollar spot is stronger this morning, normally that's bad for risk assets. But we are seeing some pretty sharp rallies across the region. The nikkei up 1.2% the ASX 200 in Sydney up about 1.8% strong rallies in Seoul as well. It costs me up about one and a third percent. We saw shares open higher in most of the markets and the U.S. futures as well are up about a third of the percent, trading in currencies is pretty choppy this morning again has swung between gains and losses. It appears that there was a second intervention from Japanese authorities in the second session and that's what we heard from the Nike this morning. Not long ago, the dollar yen figure was right up around one 49 and change, and we went all the way down to one 46 and changed, but it has weakened again at the moment all again, one 48 95. the legal side of the situation rejoined by Martin edel He is the chair of gulston and stores sports law practice and an adjunct instructor at Columbia law school Martin thank you so much for joining us Thank you for the opportunity of speaking with both of you Martin why would baseball order the teams to take down images of players during this Lockhart for instance Bryce Harper was the MVP of the national league as a big banner at Citizens Bank ballpark and they were ordered to take it down Basically eliminating all name image and likeness with ownership gain an advantage by keeping his image up on the ballpark To me that can cut both ways Mike By taking down the image they're preventing Bryce Harper from realizing any licensing fees or other types of revenues he may gain from promoting his name image or likeness But it also affects the team which is trying to do that and ostensibly has a deal with Bryce Harper to license his name image and likeness What I don't understand is the whole hang up about sponsorships I don't understand how that can be infected and how that is shut down So that's another great question Professional athletes have a limited life in the sand that they play They can excel for a period of time but eventually age creeps up And they're no longer as viable as stars or viable as professional athletes So they seek to monetize their right as early as they can for as much as they can And by telling sponsors hey we're not going to permit the licensing to go forward You're taking a deep cut into a player's ability to monetize his name image and likeness With the result that they're trying it's an economic tool to try to force the players to come back to the bargaining table on term favorable to the owners Martin the free agency I think is probably the number one sticking point here the 6 years or 5 should there be a work stoppage is there always a concession that time lost can be credited to a player for instance if he's hit 5 and a half years in and they don't start playing until August of next year That's going to be a subject of intense bargaining whether or not they should credit the player back You remember back to 2015 with Chris Bryant And of course the cubs did not let Bryant go to the major lease I think it was until the second month of the season and therefore they didn't under the existing rules The cubs did not have to credit Bryant with that particular year as being accredited towards the free agency time period Brian arbitrated that issue was lost So instead of being a 6 year term it became a 7 year term for Bryant And here too if the work stoppage well the lockout continues into the year and then there's no time made up and that's not the subject of bargaining that comes out favorable to the players The players may lose some players who would otherwise be eligible for the full year credit towards free agency may find that they're not getting that credit Baseball commissioner rob Manfred said that he believes that an off season lockouts the best mechanism to protect the 2022 season and they hope that the lockout will jump start the negotiations Do you agree with that Martin No A lockout is a very serious economic tactic It's perfectly permissible under the national labor relations act Just like a strike is perfectly permissible under the national labor relations act But you look at what happened they had a 7 minute session That didn't bode well for future discussions And the question really becomes how interested is each party in coming back to the table and on what terms Yeah I was supposed to be 9 hours and wound up being just 7 minutes Right Right So as you probably know pitchers and catchers are scheduled to report around February 15 and exhibition games are scheduled to commence February 26 Given the holiday schedule that's really just around the corner Will the party's come back to bargain in earnest Will they be able to complete what are going to be complex negotiations before that time is really up in the air Yes there is an advantage to starting during the off season That's probably one of the reasons that the collective bargaining agreement expired during the off season But there's no guarantee that they'll be able to complete these complex negotiations in two and a half months with all the holidays in play Martin the commissioner said on Thursday that in 1994 baseball made a mistake by starting the season without a collective bargaining agreement and he said we will not make that mistake again Does that sound like something that is very inflexible to you Yes There are other leagues which start the season when they think they've made sufficient progress on a new collective bargaining agreement that they think they're going to bring it across the finish line Taking a hard line position saying we're not going to reopen our doors And get rid of the lockout until we have a sign collective bargaining agreement sounds inflexible and I think is designed to send a very strong message to the players union that you better become more flexible on your demands What's different to me when you talk about the four major food groups in sports baseball football basketball hockey especially in the NBA Adam silver has what appears to be a great relationship with the union and the players on the other side of the coin rob Manfred has let's call it maybe a strained relationship with the union And I'll put it that way Is that a fair assessment and what can both sides do here to try to change that So from everything I've read in the press yes I think that's very fair assessment And remember that rob Manfred's background is that he came to Major League Baseball and he was a principal negotiator of prior collective bargaining agreements for Major League Baseball As commissioner now he represents 30 owners And he has to take into account not only what is in the best interest of the sport but also what the 30 owners want Historically that's to be protected somewhat from their own greed hence let's keep that fine mechanisms to reduce player salaries and player compensation because otherwise we're going to be bidding against each other in an endless war We so just before the lockout went to effect Corey Seager signed a contract with the rangers for $325 million over ten years That's a lot of money And left to their own devices owners might continue to bid up salaries Martin is chair of goldston and stores sports law practice looking through your lens here Where do you see the imbalance between both sides I think this really comes down to two issues One being the owners desire to avoid paying players tremendous amounts once they're past their prime as the owners would think And the players desire to make sure there's a path for younger players to get more of the pie and older players to receive their due even if their skills are somewhat somewhat So diminished over where they've been So how does that work Luxury tax If you have a luxury tax or a team three years running at team exceeds the luxury tax of $210 million it's going to be hit with penalties How is it going to it's going to want the flexibility to reduce payroll there In a means that preserves the competitiveness of the team while it eliminates the sanctions or penalties that exist That may hurt veterans more than younger players By contrast teams may decide that they also don't want veterans and are willing This is the tanking issue They may want to bring up newer players from the minor.

a deep cut into a player's ability to monetize his name image and likeness With the result that they're trying to economic tool to try to force the players to come back to the bargaining table on is each party in coming back to the table and on what terms Yeah I was supposed to be 9 hours and it wound up being just 7 minutes Right right So as you probably know pitchers and catchers are scheduled to report around February 15 and exhibition games are scheduled to commence February 26 Given the holiday schedule that's really just around the corner Will the party's comeback to bargain in earnest Will they be able to complete what are going to be complex negotiations before that time is really up in the air Yes there is an advantage to starting during the off season That's probably one of the reasons that the collective bargaining agreement expired during the off season But there's no guarantee that they'll be able to complete these complex negotiations in two and a half months with all the holidays in play Martin the commissioner said on Thursday that in 1994 baseball made a mistake by starting the season without a collective bargaining agreement and he said we will not
