The Broward, Miami Dade and Palm Beach County school districts are not following the science As I brought it to you. There's a much more complicated picture there. Now. About these lawsuits. Evan Brown, Fox News radio Joining us now. So, Evan, we have now not one but two high profile cases. One ruled on About school mass mandates with Leon County Circuit Court Judge John Cooper. A second one ruled on by U. S. District Court Judge Mark Walker both being appealed by the state to the U. S First District Court of Appeals in Atlanta. I kind of give us the lay of the land and what we can expect here. Well, certainly. Well, first of all, the one the rules by Judge Cooper. That's a state court, so it's being appealed actually, to the first District Court of Appeals in Florida. Uh and so that You know, these are these two cases are following different tracks. One of the state course one of the state courts, one of the federals, which is necessary because there you know, there are two different sets of laws that are going to be applied here. And I'm sure everyone involved wants resolution on both ends from both the state and federal it because, believe it or not, we still do actually have the separation of states and federal powers and You know that whole the whole constitutional thing that goes on there, So it's good to see this play out in both court systems, but at the same time, uh, you know, we have a governor who has made a statement who has said that That often on matters that have gone political. They often lose at the district court level, and then they win on appeal, because ultimately the governor is is acting within the confines of his office, or certainly using the powers of his office appropriately. And one thing you have to remember is that local judges in the state are elected. They are politicians and depending on where they're from their their political inclinations could be this way. Or that way. Whatever the case may be, Uh which is why we have appeals courts where I don't believe appeals courts are Are they elected in this state? I don't think so. Right? I think they're appointed. Um, so I believe that's correct. Yeah, And even if not, the Florida Supreme Court justices are appointed, not elected. So, uh, that's uh You know that that all these are going to sanctions balance on that? Yeah. Now That's a really good point. It's a really good distinctions. And obviously we'll wait and we'll watch and see how this plays that you referenced the Constitution. Is that still a thing? Uh oh. That's gonna if we still have a constitution. Yeah, we make jokes about it, but ultimately, yes, it is. It is a thing we have systems of that's good at play. That to ensure this and in case you're curious about this much of the federal both district and appellate bench, not to mention three Spots on the U. S. That kids are being forced to wear masks in school. Yeah in in floor. I mean definitely in palm beach. County and the tri county area. Really and in some other counties north as well and like no other. Not what do you mean. Yes the all they are. Absolutely what do you mean. Have you not seen the lawsuits. Have you not seen santa's coming out every day and the school board meetings people fighting like where have you been. This is happening. it's ridiculous we'll focus on palm beach and broward miami dade counties. He you know the big three down here. But it's eleven county. It's eleven school districts in the state that still 'cause it's gonna it's gonna the pendulum swing again back the other way they face losing funding. Keep going back to this. They're playing with fight. You're playing chicken with your district's funding at some point. Where do the voters parents. And all of these counties step back and go.
