If you're one of the congratulations. You may have noticed though that the news really did not slow down this weekend. Like, not even for a second. Not even for a two day. Let alone a three day weekend. These absolutely terrifying and terrifyingly destructive. Fires have continued to ravage California. The death toll from those fires rose precipitously through the weekend. We're going to have more on that ongoing disaster and the president's ill considered response to it in just a few moments. But of course, the midterm elections despite having technically happened almost a week ago have continued happening not just through the weekend. But right up to this very moment. NBC news is calling democrat Kristen cinema the apparent winner in the Arizona Senate race. That's the seat currently held by retiring Republican Jeff flake, which may. This a democratic game the Republican candidate Martha mcsally conceited not long ago in a video tweeted out by her campaign there she is accompanied by her dog national Republicans, including the White House have reportedly been urging her not to concede and to join them in pushing conspiracy theories about the vote count in Arizona, but she has declined. Now, there's speculation that that could be because she expects to be appointed. Arizona's other Senator in the seat that John Kyle is holding only on a temporary basis following the death of John McCain. Let's begin the night in Florida. This was the scene over the weekend as captured by producer of this show outside the Broward County supervisor of elections office where votes are being counted in Florida Senate and governor's races as you could see the protests outside the elections office in Broward County, look a little more relaxed today almost more of a tailgating feel to them if your tailgating parties resembled Donald Trump rally beyond the parking lot the legal battle over. These Florida raises is really only getting started as of tonight in the Florida governor's race Republican Ron descent is remains the apparent winner. According to NBC news, but his lead over democrat. Andrew gillum has shrunk considerably since Tuesday night as more votes have been counted. In democrat stronghold like Broward County to Santa's is ahead of Guillem. Now by fewer than thirty four thousand votes out of over eight million cast that makes the margin less than half a. Percentage point which in Florida triggers, an automatic machine recount of the votes. So that's ongoing across the state as we speak though, it last check Broward County still had not started its recount and the deadline for counties to complete the recount is Thursday afternoon. The same goes for the Florida Senate race, but that raises much closer as you can see NBC news still has this race too close to call just twelve and a half thousand votes separate Republican governor, Rick Scott and the democratic Senator he's tried to unseat Bill. Nelson Scott's lead in this race has dwindled over the last weekend on Thursday at noon when the machine recount is over if it's over by then, and if the margin is still this close or closer, there will be a hand recount of all the votes. I spoke with NBC news national political correspondent Steve Kornacki earlier today, he told me the hand recount is where things may get really interesting. In the issue in Broward County, is you had this extraordinary number of what they call under votes votes that were cast votes that were cast for governor. And but we're not casper Senate there were about twenty six thousand ballots that left that Senate contest blank in the question is why in a county that Bill Nelson's getting seventy percent of the vote in the Nelson campaign since it's a machine issue. They were feeding him in the machines. And it was for some reason missing all these votes in the Senate. Well, if there's a manual recount, they will find that. And they will find tens of thousands of ballots with names checked off in the Senate race. They'll add them in potentially just looking at the way, the vote is going in this county, potentially. You could be talking about a net gain. They're like ten thousand votes for Bill Nelson, again, keep that margin in my. But the other possibility here is the ballot design we've been talking about this the Broward bail designed long column on the left here of instructions there's the US Senate race look the governor's race me. Whether we're more votes promise. Top of the center column wide spacing there say a lot easier to miss this. Then that in the US election assistance commission. They give advice to states and cities and how to run elections. They have a report that specifically vise never to do. What brower did they said when you have a column of instructions their studies found that when you put a race underneath a column of instructions they concluded voters were likely to miss race and not vote on it. So that's why that the ballot design issue loom so large if the Nelson campaign is right that twelve thousand could come awfully close to zero just because of this. But if not not sure where else now, so what happened? That was Steve Kornacki earlier today laying out where the Nelson campaign thinks it can find the votes to possibly win that race in Florida. It's possible. Nelson. Lost a lot of votes in a heavily democratic county because of how poorly designed that ballot is. But the Nelson campaigns attorney who's litigated a lot of recounts in his time says he's confident that when all of the votes are counted Nelson will be the winner while the vote counting continues. Meanwhile in Florida's courtrooms. There are a number of battles brewing. I'm not going to detail for you every single lawsuit. That's been filed this far in Florida. The show's homeland our long after all, but I am going to tell you that the Nelson campaign outside democratic groups are asking judges to make county elections officials county elections officials stopped tossing out mailed in ballots because the signature doesn't match the one on file they want officials to take a second look and reconsider those ballots. They want county officials to accept ballots that were mailed by. Election day, but didn't reach elections officials by the mandated deadline. Another lawsuit seeks to have Rick Scott as the governor of Florida recused himself from involvement with the recount process. And that is because it's one makes sense Rick Scott as his lead in the race has dwindled has not only accused the Broward County supervisor of elections of rampant fraud, he's not only alleged that quote, unethical liberals are trying to steal the election from him. He's also asked the state law enforcement agency, which he controls to investigate and potentially intervene in vote counting in Broward County. Yesterday. Rick Scott, secured emotionally filed a motion in court asking a judge to let his state law enforcement agency impound all the vote counting machines in Broward County as in take control of the voting equipment. Now, the Broward County elections department has had its share of problems. You will be hard pressed to find anyone who would disagree with that. In fact, after the supervisor of elections there got in trouble after the last election in two thousand and sixteen this governor Rick Scott said he was so concerned about Broward County, he would be sending his own state election monitors in there to keep an eye on things this year in two thousand eighteen and so after Rick Scott started saying that there was rampant fraud in Broward county's vote count this year reporters, including from this very program. Started reaching out to the Scott administration to ask. Whether those monitors had in fact, been sent to Broward County. Whether they had found anything suspicious. Guess what? Scotts election monitors have not seen anything to support. Rick Scott's claims of fraud, quote, our staff is he no evidence of criminal activity at this time, which is also what the state law enforcement enforcement agency said they told the governor they were unable to carry out the investigation into the vote count that he asked for because they couldn't find any allegations of fraud to investigate not evidence allegations. And so Rick Scott went to court today to try to get a judge to force law enforcement to intervene in the recount by impounding taking control of the voting machines. The judge rejected his motion because he said there was simply no evidence that it was warranted. Or someone who's county is evidence. Or irregularities at office. They should. Officer destroyed. The elections offices being beamed over the country. We need to be. We say these things these days. So emerging body to wait over and there's going to be. Litigating anybody wants to right? So Rick Scott has not had much luck thus far tried to intervene in the vote count. Though, he has been making almost daily appearances on Fox News to air his evidence free claims of voter fraud. It's a popular Saul. But here's something interesting to keep in mind about the continuing election fight in Florida. And it's this is something we have heard from among others. The Rachel Maddow show producers who were in Broward County on Friday and Saturday a lot of the national attention is on this Senate race between Rick Scott and Bill Nelson because that is the closest race. And it's being most vigorously fought in the courts, but on the ground in Florida, the strongest feeling among voters appears to be centered on the governor's race the protesters. Crowding the Broward County elections office were mostly to judge by their signs and their paraphernalia. Supporters of to Santa's Andrew gillum last night. And tonight, Andrew gillum. Is held events at black churches in Florida labeled as faith events to make every vote count. Here's another one scheduled for tomorrow, the speeches. He's been giving have not just been about his own election prospects, which remain distant even with the recount given the wider margin in the governor's race. But his speeches have been more broadly about voting rights about voter disenfranchisement about the integrity of elections, which may suggest that Andrew gillum like his fellow democratic gubernatorial candidate Stacey Abrams in Georgia might be focusing not only on his own contest. But on fixing the process for the next election. Joining us now is Patricia mosaic Miami bureau chief for the New York Times, Patricia. Thank you for being with us. My pleasure. All right. These lawsuits there are lots of them out there. They're hard to keep track of we haven't even listed them. Because there are so many going on are there any that to you look like they've got the most merit. Well, we should note that the governor won his two first motions against Broward in Palm Beach. They were not on fraud allegations, they were on access public records transparency issues. There is a federal lawsuit ending filed by Senator Nelson's campaign. That is challenging how Florida counties invalidate mail ballots and provisional ballots based on voter signatures. We're gonna have a hearing on that on Wednesday. And that's going to be interesting. If nothing else because this has been an issue in other states, and because what they claim is that the criteria for throwing out. Some of these ballots is so inconsistent that all of these ballots should count out where we're talking about thousands of ballots, but probably not enough to overturn any result except for maybe the agriculture Commissioner's race on their own. But it just wouldn't be a statewide implication as opposed to lawsuits in specific counties. Right. And the signature issue is more serious than it. Appears Sidney McCain has said that sometimes she signs her name, Cindy McCain. And sometimes it see McCain. And I might do Al evil she somewhere naval she so this issue of not exact matches being thrown out may have some merit. But you you bring up Broward County and Palm Beach county. What's the problem with Broward County? Marco Rubio has tweeted about it Jeb Bush got in on it. Everybody's been talking about what a mess Broward County is from the perspective of elections. And Steve Kornacki when he showed me that ballot today, I was thinking to myself, I might have missed that. I mean, it's a poorly designed ballot. Well, there are national guidelines for how to design ballots, and they specifically say that when you have vertical voter instructions as Broward, did you should not put a contest underneath the instructions because people might miss them having said that there is no standardized state ballot. And these are always the issues that we see when there is a disputed election that come up after the fact in Broward in particular, as you noted they've had a history of troubles and people took a while to really be openly critical of the elected supervisor elections. But you know, she's faced criticism even from within her own party at this point just because people are frustrated with the fact that for example, Miami Dade County next door, which is a bigger county was able to vote count more votes. More quickly. Patricia this is supposed to be done by noon. This first machine recount by noon on Thursday. We're already hearing there might be delays. What do you think happens? Do you think on Thursday at noon, the margin is that tight and it goes to Henry cow? Well, I think it's three pm. I think we can probably expect Henry counts in the Senate and agriculture commission races. But look if history has taught us anything it's that we're going to see more lawsuits, especially if counties are unable to complete their machine recounts. And then we're going to have to ask the same question about the hand recount whether they will be able to finish in time for their next deadline on Sunday three pm on Thursday. Thank you for for for noting. That is as the Miami bureau chief for. And the New York Times joining us now is berry Richard Gillam campaign counsel, Mr Richard, thanks for being with us tonight. Turf. What's going on with Andrew gillum? Does. He does he think that this recount will bring him closer. Or is he as I mentioned, maybe thinking about future elections. Well, he's hoping it will bring him closer. Obviously the legislature thought that when newer within the margin of a half a percent or less was a realistic chance it would become closer, especially when the votes being accounted as they come in late or an account. He that favorite hymn significantly. I think what his mind is on based upon the conversations I've had with him is the city to fix a system that leaves a lot of people without their votes being counted. And I think that's why you're seeing him making speeches along that line. I think that's significant to him you represented George Bush in the two thousand recount, how would you compare? What's happening now to what happened then? Here's how I would compare. It was a democrat representing the Republican candidate received hundreds of emails and mail letters phone calls homely, a small handful of them were nasty wife, and I had an anniversary in the middle of the litigation and Gore's legal team toasted us a national television. We had demonstrators for both parties in front of the capitol who would demonstrate all day and then party together that night. Can you imagine that happening today not at all that said, how do you see the next few days playing out? Thursday. We'll know what the machine recount results in so far as the Gillam team is concerned. We'll evaluate all of the evidence. That's come in will advise a mayor Gillam of what his legal rights are. And he'll make a decision. All right. And of course, that margin is bigger in the governor's race than it is in the senatorial race when you were representing George Bush in two thousand the margin was much much smaller. Are you given your experience? Do you think of margin of this point of thirty thousand plus votes is something that Andrew gillum can bridge. Well, it's certainly possible when it's out of eight and a half million votes. Whether or not that will happen again remains to be seen. I'm not pressuring. None of us can predict what the result can be high. Don't think by the way that there's any fraud here much less massive fraud. There generally is not fraud in American studies that have been very little fraud. So the question is whether there was enough error in the county, and we just don't know that that's an important distinction. This is these are voting practices. These are all sorts of things that we can fix. It's not not the same thing as fraud that the governor is alleging thank you very Richard with the Gillam campaign council. Thank you. I'm more news straight ahead. We'll be right back. Over the weekend. Leading Democrats continued to raise the alarm about the president's new acting attorney. General Matthew Whitaker comes to the job of chief law enforcement officer of the United States would they long record of criticizing the special counsel investigation saying there was no collusion. And the investigation ought to be starved of financial resources now would occur occurs. Taking the job of overseeing the investigation, and he's fighting back against accusations that he's going to try to rein in or undermine. The pro Bloomberg news reports the acting attorney general has told us OC it's that the Justice department under his new leadership will not cut the budget for Muller's investigation. Even though the only place that suggestion came from was him in this interview. He specifically put that idea out there as an option last year on TV available for everyone. To see this is not hard journalistic work for us hilson continues to face questions about whether his appointment to be the acting attorney general was constituted today. The city of San Francisco threatened court action over the appointment noting that the city currently has four cases proceeding against the department of Justice that name fired attorney general Jeff Sessions as the defendant. San Francisco city attorney is asking the Justice department to provide the legal justification behind elevating Whittaker to lead the Justice department. Rod Rosenstein would have been the natural choice, by the way. Otherwise, the city says it may be forced to ask a judge for legal rationale. Now, the Wall Street Journal reports late tonight that the Justice department is expected to publish a legal opinion, supporting Whitaker's appointment that legal opinion is expected to come as early as tomorrow. Meanwhile, reports that Whitaker will not recuse himself from overseeing the Muller investigation despite his well documented his. Of making statements questioning its legitimacy have Democrats pursuing new avenues of inquiry Whitaker has declared that he is quote committed to leading a fair department with the highest ethical standards. Democrats are not taking that face value today. It emerged the top democratic leaders, including one with whom I'm about to speak in both the house and the Senate have sent a letter to Li loft us. This is Lee Loftus. He's the top ethics official at the department of Justice demanding to know immediately. What if any advice he has given Whitaker regarding recusals, quote, we request that you immediately notify us in writing regarding whether you or any other ethics officials at the Justice department have advised Mr. Whittaker to recuse from supervision of the special counsel investigation and the basis for that recommendation. It continues we also request that you provide us all ethics guidance. The department has provided to Mr. Whittaker. To date. The letter was signed by seven top Democrats, including the incoming chair of the House Judiciary committee, New Jersey, New York, Democrat, Jerry Nadler empowered by the majority Democrats won last week congressman Nadler says he will summon Whittaker as the very first witness before his committee when Democrats take charge in January. Joining me now, congressman Jerry Nadler, the top democrat on the House Judiciary committee, congressman good to have you here. Thank you here. Here you got a response to your letter, delete lofta. No, we have not gotten a lot of yet. And I don't know when we'll get when I mean, it is clear I think that the very reason that he was appointed was to be a hatchet person on on the investigation. He ought to recuse himself because he is he's prejudged the issue. He said there was no Russian involvement has been very specific. You said there was no collusion this. He doesn't think this is a legitimate line of inquiry and had suggested on television in that CNN interview that you could starve them usually just a number of ways in which you could do that. But he's prejudged the issue, which means he shouldn't be there. But we know why he was appointed. Because the only reason that the president was very clear about this. The only beef had was the thirty general sessions was that he did not recuse himself. He did not act as a prisons personal defense attorney. So obviously when the appointed someone who appointed somebody expected not to recuse himself he has under normal ethical guidelines. He must recuse himself. And that's why we wrote this letter to the. The chief ethics person. But, you know, this is just another the obvious reason for this appointment was to crack down and control the investigation. This is part of a pattern of interference by the president. With the investigation of the president thinks he's above the law get away with it. And we're going to have to show he's not above the law, and we have to protect the our first priorities to protect the integrity of the investigation because we are dependent on investigation to protect the integrity of our elections from foreign to furans, so perhaps in response to the letter that you in seven other legislators sent or perhaps in response to our inquiries. The department of Justice has given us a statement tonight. And it says acting attorney general Matt Whitaker's fully committed to following all appropriate processes and procedures at the department of Justice, including consulting with senior ethics officials on his oversight responsibilities and matters that may warrant recusals, which is interesting it's different than a straight out denial that there's any issue. Well, I hope that's true. I have my reasons to doubt it, which I stated a moment ago, but we'll see and we'll be interested in seeing what the Justice department says given everything that's happened. And given how these ethics departments tend to be weakened under this administration. Do you any faith that Matthew Whitaker will a meet with these ethics officials and be that they'll tell them anything, that's useful. And see that he might listen. I'm very skeptical of all of that. Because the of the obvious reason he is only useful to the president. Insofar as it doesn't recuse because he doesn't recuse himself and access closely investigation. That's why he was appointed. It's part of the pattern of interference by the president. With the with the investigation with the investigation through normal presses affecting of having an acting attorney general would have been to go to the deputy general, and I rose to the solicitor general both of them have been confirmed by the Senate to their positions. But instead they went out of the normal line to take this guy who's got no apparent qualifications. Lots of conflicts of interest. And again, the reasons transparent. Okay. So you're going to get in and you're going to take over as chairman of the house sharee committee, and you are going to invite or subpoena met winner. I invite him if he'd declines the invitation, then we'll think he'll respect that subpoena. Well, I would hope so I would hope that he will respect that's not fight it the could delay somewhat. But ultimately, he has to respect the SABENA. Alright house has to enforce it subpoenas. What do you wanna ask him? Well, we'll ask the obvious questions. Given your stated views, given the fact that you said that the that you prejudge the issue. There was no investigate. There was no Russian interference with the election, which is ridiculous. How can you supervise the investigation and more to the point? What will you do will you when if and when Mullah gives gives a report will you make that report public will you give because he put it in a drawer, you could put in a drawer. Will you make that report available to congress will you? Veto hotel Muller. He cannot go down any particular investigation line. We'll you say he cannon indict any particular person, or do you think that he should be given the freedom to take the investigation where it leads as he has had that freedom under Rosas signs supervision. And as any investigation should congressman Nadler good to see you. Thank you, sir. Congressman Jerry Nadler is the incoming chairman of the House Judiciary committee still ahead tonight. We've got the latest on the surprisingly longlist of races that have not yet been called after last week's midterm elections. As I said earlier, I hope you're having a good Veterans Day weekend yesterday, a number of senior administration officials, including the VA Secretary Robert Wilkie and the Defense Secretary James Mattis honored our nation's veterans at Arlington National Cemetery. President Trump was not in attendance. He was in France this weekend with other world leaders to Mark the one hundred year anniversary of the end of World War One on Saturday. President Trump was scheduled to hold an event at a cemetery east of Paris in which number of American soldiers are buried, but he didn't show he cancelled apparently due to rain all the other world leaders managed to attend their events that day, but rain stopped the president of the United States of America who instead decided to hold up at the residents of the US ambassador to France for the afternoon since returning to the United States last night, the president has held no public events here at home to Mark Veterans Day. These are unusual moves for the president who tends to take every opportunity. He can. Into publicly tout his support for veterans, even as he has taken numerous steps to undermine the government agency in charge of helping veterans the veterans administration's the BA today, we're seeing just how much those efforts to minimize the VA have worked last year. The president signed the law intended to expand GI Bill benefits to more veterans. It was supposed to help more veterans cover their education and housing costs. But since signing that Bill the VA has struggled to keep up with the backlog created by that GI Bill today. More than eighty two thousand veterans in school have yet to receive their GI Bill payments from the VA in large part due to IT glitches at the VA causing payments to veterans to either be delayed or just never delivered veterans have been waiting on those payments now face taking on loans and credit card debts getting kicked out of school or even fiction from their housing as they wait for the VA to figure out these IT glitches. VA spokesperson tells NBC news that efforts to find a solution to the issue are quote ongoing. Thous veteran's affairs committee will in the meantime, schedule a hearing on the matter scheduled for Wednesday, which is weeks left to go in the semester. Happy Veterans Day weekend. Over Georgia Democrat Stacey Abrams is still battling her Republican opponent. Brian Kemp right now, she's trailing by about fifty eight thousand votes with ballots still left to be counted Abrahams hopes she can close the gap just enough to push Kemp's lead below fifty percent. That would force a race the race into a runoff because that's how it works in Georgia. You have to get fifty percent or more to win. I talked to the campaign manager for Stacey Abrams today. She. Says her team has to find twenty thousand votes to make that runoff happen. There's focused on a yet as yet uncounted profession provisional and absentee ballots as well as early votes that have yet to be reported the Abrahams campaign has filed a lawsuit to make sure every vote in Georgia gets counted. Why do you have to file a lawsuit for that? Shouldn't every vote counted? All right. It's not just marquee races. That remain outstanding. By the way, results are still trickling in in some pivotal house races voters in New Jersey's third congressional district. Still do not know who their Representative will be in January Republican Congressman Tom McArthur is trying to cling to his seat there. But democratic challenger Andrew Kim is currently ahead by more than a point three and a half thousand votes ballots are still being counted in Utah tonight, where tens of thousands of votes have yet to be tallied in the fourth congressional district. If Republican incumbent Mia love loses the race that would give Democrats another pickup five. Thousand votes, separating the two by NBC's count. Democrats have gained thirty one seats. So far the last votes to be counted will likely be in California where vote tallying is notoriously slow, but there's one candidate in California who did not wait for an official call to declare victory. This was the headline over the Sacramento. Bee on Saturday Harley Ruta declares victory over thirty year. Congressman Dana Rohrabacher now Republican congressman Dana Rohrabacher has represented this solid red district in Orange County, California for fifteen terms in the entire existence of this congressional district voters have never elected a democrat. Dana Rohrabacher is so Russia friendly, he's frequently referred to as Ladimir Putin's favourite congressman. But now it looks like Mr Putin may need to find himself a new favorite on capitol. Capitol hill. Dana Rohrabacher is trailing Harley Rueda by more than nine thousand votes. I should tell you NBC news has. Not officially called this race in favor of Harley wrote up, but the Associated Press has declared Mr. Rudo the winner and Mr. Rueda declared victory this weekend. He's a first time candidate he's new to the Democratic Party for years. He was a registered Republican. Now, he is the newest political newcomer to wrestle a solid red seat into democratic hands. Joining me now Harley Rueda who has declared victory against Dana Rohrabacher in California's forty ninth congressional district. Mr. Rueda, thank you for being here. Thanks for having me under normal circumstances. I've congratulate someone who's won a seat. We haven't determined that. You've won that that how did you determine part of? It is looking at what votes are left to be counted. And for us those word the mail-in ballots that had been received three days prior to election day, those that were dropped off on election day, those that are received three days after election day and provisional ballots in based on the trend lines. We had seen those were all going to be headed our direction. Democrats had. Flanked is district on as one of their targets early on. There was a huge push to flip this seat. Why do you think you were the candidate to unseat a fifteen term congressman someone who's been in congress for thirty years? Yes, thirty years, and it really just started after the women's March and me like many people around the country holding their hand up and saying we need the change that we want to see. So we've had a grassroots support since day one by the time we got to election day, we had five thousand volunteers supporting our campaign. And I think most people are between the twenty yard lines in America, they believe in socially, progressive ideas. But they want fiscal responsibility. They want moderates, and that's why we won this election. All right. So I want to ask you about congressman Rohrabacher who's known for his affection towards Ladimir Putin. I he was one of the only people I'm trying to just get a count in my head who voted against the Magnitsky act, for instance, when you talk to voters in your district does the support. For Russia or the investigation into Russia's interference into the elections are the are those issues for your your constituents depended on who you talk to and where they were on our on the political spectrum. But when you brought it down to okay, what's all of his trips to Russia, all his hard work on Russia doing to create jobs here. How's it helping your family? How's it helping your community? How's it helping your schools? How's it helping your kids when you put it in that in those types of terms most people quickly concluded? Yeah. Why is he spending so much time on Russia? What's the number one priority for you? When you take office. How are you going to reconcile the goals? You've got with a Republican controlled Senate. I think this is the best opportunity we have to really work on bipartisan legislation, and I think one of the first areas we have to focus on his infrastructure. We spent about two and a half percent of our GDP on infrastructure. That's about half of what the European Union spends about a third of what China's spends we see it all. All around us great opportunity for bipartisan support, and I'm hoping those on both sides of the aisle will work to achieve that outcome. You would think so the president has hosted several infrastructure weeks in the last two years, but they haven't amounted to a hill of beans. Yeah. I think it's been about fifty infrastructure weeks at a row, but yes, it's time to make it a reality Harley route to tell me about the fact that you were a Republican. Yeah. I was a Republican I left in hundred ninety seven and prior to that time, it was common for Republicans to believe in environmental stewardship to believe in women's rights to believe in voting rights to believe in civil rights to believe in reducing the budget, and since then in especially now, most of those issues have been placed on a back burner at best. And I think that's why we're seeing such a move at least in my district of moderate Republicans to support our campaign Harley route a former Republican now, California Democrat, and according to the Associated Press, a congressman elect thank you for your time tonight, sir. Thank you. All right up next to report from the California fires with a guest who really knows how these things work. We'll be right back. It started as a small brush fire a little after two pm in Griffith park. California the blaze quickly spread through the park trails where thousands of men were out clearing, the brush and maintaining the roads. The men didn't have access to water. So they tried to fight the fire with their shovels and within fifteen minutes the smoke was halfway up. The canyon the fire took the lives of twenty nine people. That was Tober third nineteen thirty three it was the deadliest fire in California until paradise in this past hour. We learned that the death toll in and around the California town of paradise is now forty two making the campfire the deadliest in California state history right now, there are three huge fires raging across California. The campfire the Wolsey fire and the hill. Fire statewide, forty four people have died hundreds of thousands of been forced to evacuate eight thousand firefighters have been dispatched across the. State risking their lives battling these wind driven wildfires. Which is what makes what happened this weekend? Particularly troubling the president took to quitter Twitter claiming that California's forest mismanagement is to blame for the fires and threatening to withhold federal funds from the state in response. The president of California professional firefighters issued a scathing statement calling the president's tweet, quote, ill-informed, ill-timed and demeaning hill. So pointed out that the president did not have his facts straight quote. Nearly sixty percent of California's forests are under federal management another one third under private control. It's the federal government that has chosen to divert resources away from forest management, not California. He went on quote, natural disasters are not red or blue they destroy regardless of party right now. Families are in mourning thousands of lost homes. A quarter million Americans have been forced to flee at this desperate time. We would encourage the president to offer support in word and deed. Instead of recrimination and blame. Joining me. Now, the guy who authored that statement Brian rice, president of the California professional firefighters, Mr. rice, we appreciate your time tonight. And we thank you and your members in all first responders and firefighters medical professionals for doing what they are doing to keep Americans safe right now. What's the latest? Thank you. You know, the news on the fire front up in paradise and then in Wolseley to their it's looking better ago backup to paradise as far as the weather is beginning to cooperate now. Personnel and equipment on scene down at the Wolseley fire. A lot of the area is down. But the winds are still up and that on either of these when the winds come up that could change everything in a heartbeat. I know earlier the couple of hours ago the campfire seem to have been about twenty five percent contain the Wolsey fire about twenty percent. What are these numbers mean in real life? What what what is supposed to make people feel safe? What degree of containment? I think in California when you start to see the containment begin to approach fifty fifty percent. And there's a good weather outlook. You can begin to have a little bit of a sigh of relief talk to me in simple terms about what the president said. And what it really means. There are a lot of people have pushed back saying, regardless of whether it was ill-timed in ill-conceived. It just not actually correct what the president has said about California. And why there are fire wire they are these these massive wildfires there. I'll absolutely stand by by what my statement said and. The the force system in the United States. And certainly California's part of that is very complex in its complex between state and federal government in the case of the campfire, the campfire started in federal f r a federal responsibility area, the federal government had responsibility for that land. The gave the fire suppression peace over the state and Cal fire, but the overall management of that they retain which includes vegetation management. The statement or the initial tweet to say that there is no reason for these fires who've taken place there's several reasons in the top three or absolutely weather driven that we can't have an effect on. There's no there's no doubt that force management can be better. Across this nation in our national forest lands. But, but but to say, there's no reason that it it doesn't make any sense. We have red flag conditions. They're still here. And everybody needs. If you're a citizen you need to be on your guard. We're in the setup to your of a drought live and dead fuel moisture's an all-time low. We're still have low humidities, and we still have a wind and those things in and of themselves that you cannot control the best maintained forest when you have fifty sixty and seventy mile an hour. Winds pushing a fire you're in trouble like hurricane type wins the president maybe in response to what you said or otherwise did tweet out a more traditional response. He also tweeted out that he'd signed an expedited request for a major disaster declaration for California. What do firefighters need to fight? These fires. Does this help? You win. The president says this. Yes, I do think. The president completed his mission in that certainly we'll a nod and an appreciation of thanks it. And that's good. But when you lead men and women on the fire lines or any situation with that. Their morale is incredibly important and the the initial tweet did nothing to help the morale. I think and I hope that there's a boost that the firefighters on the line. No, not only their local and state officials have their back. But also their federal government has their back. I don't I don't make it a habit to speak on behalf of our viewers. But I think it's fair to say tonight the country has your back the country's behind you the country's very grateful for the work that you do firefighters run toward a fire while the rest of us run away from it. Ep. 848 Are They Stealing the Election?

Well, it's one of those weeks again, Dan, where do we start? Well, we had a great week last week with the exception of Friday. And listen folks, my show is for you outside of my God in my family. You matter to be more than anything. So I always appreciate you being here. And there were eye because I'm always open with you. There's no fourth wall here ever. I try leave my Email by personally mail out on my website for you to correspond with the show. You very upset about Friday. And I totally understand. Let me just explain to you. What happened a lot of people at an unusual, man. You know, we always get two or three people who would prefer. We talked about some other thing when this topic, but the emails usually very nice, I be almost never thankfully get complaints on the show, which makes me very happy. But Friday a lot of people were upset. We did not address the Florida. What was going on in Florida there? The it's not even I'm not even want to call it the recount show. It's not a recount, I refused to call it that it's the reassessment because they want to reassess the election. It's not stop calling. It the recount they are not even counting in my opinion of legitimate votes anymore because no one can answer a question until they answer the question about what's going on. I'll get to this. Then we'll call it a recount, but I just want to explain you. What happened without wasting your time? I had a marathon day on Friday. I had to go up and do the fire to fly out. Do the five tape gut failed show on the five do Tucker. Wake up the next morning, do FOX and friends and then fly back. Now having said that this is not a PD story. And I love you guys. And ladies, but I don't take days off. I may next year. But I've never in three years missed the show ever any weekday holidays. Nothing. We do two hundred sixty shows a year. I feel of the situation I've been doing a lot of homework on it over the weekend because I felt so bad about letting down on Friday with it. Let's point out a couple of things first. Let's get to the facts. Okay. There are I live in Florida. I know the system well Iran here for office. I have voted now four times in Florida there. The problems in Florida are not Florida problems. I want to be crystal clear on this. They are Broward County, which is a democrat county. And a Broward in Palm Beach county. They're both democrat county Broward, highly democrat, Palm Beach county leans, democrat, it pretty much never countywide goes Republican, but Broward in Palm Beach county of the sixty seven counties in Florida, the two big democrat counties. Two of the biggest I should say are the ones having problems. It is not a Florida problem. It is a Palm Beach Broward problem. This has been a problem over and over and over again, the Brenda Snipes and a Palm Beach county board of elections down there. They have had issues as you know, from the two thousand recount and others Dave had significant problems. Now, I want to give you the good news. I because I don't want to bury the lead. Here's the good news. I'm folks I've been down here. I got back on Saturday. I have been shaking the trees for everything on this. Here's what I'm getting on the ground. So you can partially smile, but I'm gonna leave you with the bad news last unlike other times because I want to keep you frosty. I don't want anybody sleeping on this. The good news is this Rick. Scott who's the governor is a ninja when it comes to this stuff. I'm not kidding, folks. Don't let Rick Scott's gentlemanly calm. I mean, we've all seen him interviewed on FOX. He's very he certainly not as passionate as I am about stuff. But Rick Scott wins Rick's. Oh, he only wins by some he wins. Rick Scott has not lost the race in Florida. He's one for governor both times both times up sets p ran this time in an upset and won this race this race. I'm telling you is over. Okay. Now, the Democrats are going to pull every single thing out of their hats to try to take this thing back. Rick Scott is not having now when I say not having it. I don't just mean he's sitting out there saying you go to do with your we're gonna take I mean, Scott and the Republicans down in Florida learned a lot from two thousand they have lawyers on this. This is what I'm hearing that already to go ninja style on this thing. They are not messing around. They're not screwing. Around. They're not like two thousand where it took days to get the Bush team down there and fix things up and get people on the ground ready to fight this. The Scott team is ready. They Orrock enrolling they have lawyers. Who know exactly what they're doing? I'm telling you. This guy is a bulldog do not mess with the guy. He gets it. He understands they're trying to steal this thing. And he has a strong strong legal team. Not only that folks. Remember, this is a PR fight to now the Democrats line going forward, which is absurd by the way. And you may see him surgeries it's going to be every vote should count. No, no. No, no, no, no, no every vote shouldn't count Joe every legal vote should count. Bingo, every vote should count. Hey, joe. My, you know, my daughter's like she's fourteen as about as you get is about you want to vote in this election, dad. I can't I'm not no it doesn't matter. The Democrats said every vote should count, you know, Isabelle's vote doesn't count. She can't vote. She's fourteen nonsense. Votes can't count. Oh, why are you bringing that up? Dan. I'll because if you read the court transcript on Luke Rosiak Twitter feed, he did a great job Luke Rosiak from the daily caller. There are attorneys for both Gillam the gubernatorial candidate on the damn side and Nelson the Senate candidate running against God who actually made the case, ladies and gentlemen, in a court transcript, you can read it yourself that a non-citizen votes should been should have been counted treat the transcript. Even the state deport of elections head in Palm Beach county butcher was like now, we're going to disqualify and the lawyers are like we object. It was a non-citizen vote that happened. Now, Marc Elias who is the democrat lawyer for this. Oh, yeah. The same lawyer who is paid by Perkins Kui and the Clinton team to hire fusion GPS, Jen up negative information on Trump crazy how this guy keeps appeared right? Yep. He tried to clean this mess up. He said, these were your junior lawyers. So just to be clear, Joe we're talking about because I don't want the audience, I want you to have all the facts here. Three of the audience on Butman. Yes, sir. Lawyers claimed that a non citizen vote should count. That is. Absolutely. It gets black and white s- against the law Kuku now a lot. It was not Elias Elias who's running the recount operation for the Dem's. Again, the same lawyer the Perkins coup guy hired fusion GPS for Hillary Clinton. Trump. You keeps reappearing in the suspect elections, by the way. Not mean to imply that Trump's win with suspect. I mean suspect because of what the Hillary did not because what Trump did Mark Elias said, well, these were just junior lawyers. They weren't authorized to do that, folks. They did it. It's on the court transcript arguing that a non citizen vote should count. It's there. So a couple of takeaways I'm gonna leave this bullet points for you number one. Scott's team is ready for a battle. And they are not. Screwing around just going to say something else. Understood. You got it. Understood understood daddy. Oh, they are not screwing around they are in this to win it. This is not like two thousand Mona took a few days for us to shake off the cobwebs. They are ready to rock and roll number two. There are sixty seven counties only two problems number three democrat, lawyers and a court transcript argued for a non citizen to be able to vote that happened that is indisputable. Number four, Brenda Snipes, Jesse waters on the five call. They're sneaky Snipes on Friday. When I was there. Brenda Snipes who runs the board of elections at Broward County. We're all these problems are starting to materialize. In addition pomp, each Brenda Snipes can't even tell you what the vote total is, ladies and gentlemen. Why is that the most critical piece of information here? Because ballots have to be in a had to be legal votes. Had to be counted by seven PM on Tuesday, a lot of those early votes and the ones that were in. They had to be announced a half an hour after closing the fact that they can't tell you the total is obvious. It says what? Ladies and gentlemen, they can add votes now by van votes. Let me be clear I'm not suggesting it conspiracy to fill out new balance. I can only I'm not going to tell you what I can't prove. Listen anything can happen. I'm gonna tell you what I think is happening. I don't think they're filling out new ballots. Here's what the problem is folks by not counting giving you a total vote number. A cat. Other words, the ceiling. This is how many votes received one hundred. They can get votes in the mail that weren't properly postmarked weren't sign. They were just frankly invalid they were non-citizens those votes, which would have been immediately discounted by. Now, if you can't give a ceiling on the number can be added to the total later folks, you have to vote by certain time on election day with your with your vote by mail, which is significant Florida a lot of people vote by mail. I did you have to vote by a certain day. Ladies and gentlemen, what I'm getting at by not giving a vote total is she somehow suggesting that not only early voting a big thing in Florida, Joe. But late voting is cool to vote up to two months later Scots in office at a Senate Joe Armacost moves down to Florida. He's filling out a ballot. He got in the mail. Hey, we could still fold right? Brennan tonight said it's okay. This is the Democrats line of attack every vote should count. No every vote shouldn't count every legal vote should count. Your vote has to be in the mail or you have to show up at the polls by seven PM on election day. It's as simple as that. It's not hard. I was going to the polls the vote and Ninette was with me. She said I really wish I could vote in Florida. And guess what you can you tell them that move on down. Move apparently vote maybe up till next. I don't know how long the polls are going to stay open stand. Obviously Joe's kidding. He's not recommending. It's a joke. But still is the Cuban is every joke. Right. That's funny. Joe has an air of reality to bet. Yeah. If this is the case are making the connection, right? Why the total vote count matters. Yeah. Yet, she gives a total vote count. And it's and it certified one hundred votes. They can't add more that hundred votes. She has if she needed fifty one votes for the Democrats win. She's got find them in that one hundred in that pool of one hundred votes. You get it works. Yep. Check xactly. But when she doesn't put it this is the genius of not announcing, and I say genius in it in a nefarious way. But this is the genius of not announcing a total vote count. All of a sudden, you know, here's the vote. There's vote. Here's the vote to Dr Pepper song. Right. We found a vote here. We found about their look to her balance in the closet. There were ballots in the car there were balancing. A bathroom. Some guy goes into bathroom. He needed a little pep though. He's look they're balanced behind the poll, this balance here all of a sudden how many ballots this twenty-five or how many were democrat fifteen. Let's take those ballots. This is the whole point of putting a hard cap on. When you're supposed to vote when you're supposed to vote the timelines up, and how many votes are outstanding. She doesn't want to do it. Now, you may say, okay. Well, what's going on? How are we going to fix this, Dan? Okay. Let me give you some more stuff. I want to throw out there. And what this is by the way, I'm going to tell you what this is really about. I haven't even gotten to that yet. This is not just about Scott. And the Santa's my opinion those races are over Scott's team is not going to take this lying down. I think the Santa's is ahead by a healthy enough margin that even calculating an if fraud were to occur. I think I think the Santa's in a healthy enough lead. I'm not telling anybody not be anxious about it. Don't get me wrong. I'm just giving you an opinion. This is about something else in my opinion. But I wanna get to that in a second. I still got a couple more things on this couple more points here late Tuesday night. Scotts electoral win, which it was was projected to be around fifty seven thousand votes that's election night by once they morning. Wow. Lee drops thirty eight thousand by Wednesday evenings about thirty thousand by Thursday's about Twenty-one thousand by Thursday evening. It's about fifteen thousand crazy crazy how that happens. It's only the Republicans vote count keeps going down, right? Here's Rica's PETA Joe on election night Broward County, where we're Brenda Snipes is in charge over there. On election night. She said, oh, there are six hundred thirty four thousand votes cast notice how the total vote tally. She never sticks a hard ceiling on it Mesa. She just did. Okay. She said six hundred thirty four on election I off but that changed show at one AM Thursday. We'll there were six hundred ninety five thousand seven hundred on. Two thirty pm Thursday. It was up to seven hundred seven thousand by Thursday evening. It was seven hundred twelve thousand where the hell are they find these new votes? Oh, there's a truck in fact with both where did that come from again that suggested people in the back of the truck filling out votes, but ladies and gentlemen, coming from the state of Maryland where I was involved in an election with some suspicious activity in Frederick city where people who were who claimed on their jury duty form they were not citizens somehow managed to vote. Let me tell you some where there's smoke. There's fire in a lot of these cases Joe remember the Ellen Sauerbrey race. Do celebrate wins the race for governors Republican in Maryland, all of a sudden Baltimore City, what a twenty seven thousand votes show. How did that happen? That's why you put a cap on and on election night all vote shouldn't count legal votes should count. Bingo. Now, don't give Susan book or a pass in Palm Beach county either. They're still finding votes as well Palm Beach is a huge County Down here. They haven't followed. Here's Florida law. It just so you understand too because I didn't want to waste your time. They did not have all this on Friday. So again, forgive me. But here we go Florida law requires that vote by mail and absentee ballots are accounted for within thirty minutes of polls closing Palm Beach county failed to update the department of state. They hadn't done it by ten by by Wednesday morning at ten nine thousand nine AM. This is a total violation of the law. Snipe has a history of this destroying ballots in two thousand sixteen allegations apprentice Snipes doing that by the way, some of the people folks who are upset with Brenda Snipes are not just Republicans. There's a democrat Tim Canova ran against Debbie Wasserman Schultz. He I think he's an independent now. But he's not a Republican. He's been leading the charge on us. We have that video. I can't verify it. I'm just saying it's. Out of Canova with ballots being loaded into trucks. Now to leave off this segment of the action items is I'm going to anybody can complain about it. You're getting a lot of that. Here's what has to happen. And here's what this is really about. I use what has to happen. It was a big deal down here in Florida who had he's in that race on election night. Matt Caldwell who was the Republican running who is a staunch defender of your second amendment rights for agriculture Commissioner, he was up by forty thousand votes. All of a sudden new Broward County ballot. Started appearing now called wells down by almost five thousand votes. Chia added that happen. Crazy. He's a ballot. There's a ballot. He used the ballot two ballots everywhere. Balanced dare balance balance balance everywhere, it's not the two races. They're trying to keep that the focus on and believe me, they'll take the don't mistake. What I'm saying? They'll take gubernatorial and a Senate if they could steal, but they understand the likelihood is Neil. But the likelihood of stealing the agr- ace right now looks very good. Now. He's always sure to personally distance themselves from Winokur, she what he said on the south grounds she but he said, right? They asked him about Whitaker. He says, I don't know. I don't know. Yes. He said he's got a good reputation. But I don't know. And then again, which was why Trump's not dumb don't telling you don't downplay this case, not stupid. He said that for a reason. And then he follows it up in a tweet where he says, no social contact. That's in his tweet Nova's. I have not socially been a friend. I don't know this guy. What I'm suggesting to you folks, is that Whitaker may be involved in a very legitimate very serious investigation ongoing since gosh last November between Dan Coats, and the department of Justice and the director of national intelligence, Dan Coats, and the department of Justice to weed out a bunch of leakers who have been working within the government to destroy the reputation of Donald Trump and everyone else. Whitaker may have had a role in leaving those investigative breadcrumbs. Here's the Warner text. Oh, here's the wolf thing. Oh, here's the date. Bingo. It makes total sense. Now, it makes sense that Trump would distance himself personally because I agree with this. Trump likely has not been briefed on this. You may say how the hell's that, Dan? How is Donald Trump the president United States not briefed on this -nificant investigation? Wait, wait. Wait. Because of these significant overlap between this and the nonsensical collusion narrative. It's likely that people injustice are probably trying to keep trumpet arm's distance. So he has not a but actual deniability. I nothing to do which he didn't you get what I'm saying. They probably didn't Dax why this constant effort to say, I don't know Whitaker. I've had no social contact. In other words, he hasn't briefed me on any of this stuff. He's been doing it on his own. It's portion of a legitimate leak investigation into the government. Joe is this makes sense because this is critical because you have folks, you know, I wake up every morning, and I'm I'm like obsessed with why why why why are liberals doing what they're doing? Why are they doing what to do is always a reason liberals aren't stupid don't ever think that that's why try to dissuade people from joking about the Hillary thing? Yeah. I just don't it's not funny. These people are for real if Hillary is thinking about running she's doing it 'cause she has evidence. She could win if liberals are going after Whitaker with fangs like, they're doing a constitutional Whitaker gut on me recused. It's for a reason the reason is he is probably need deep in this leak investigation, which is going to expose Democrats senators and others as having been involved in potentially felony leaks to disparage the Trump team is it makes sense. Now is that that I tied that up? I'm sorry. I had to take that slow. But you have to understand that Whitaker has been leading us down the golden brick road to win actual wizard of Oz. Not the fake one and the wizard of Oz. Is there are potentially democrat elected politicians, and liberal bureaucrats who are need deep in a felony criminal leaks scandal that Whitaker knows about. That's why they're losing their minds. Think about all those appearances of all those pieces of information, they appear seemingly randomly. Out of nowhere. Oh, look at these texts about a March seventeenth appearance on the Skift by water. What what what does that? And he's and he's texting guy working for a Russian lobbyist. Why why did you ever think? Why? Then all of a sudden, oh wolf it. Just appears this guy got arrested. And we find out that the document that he was likely in possession of. Was released with the stamp of March seventeen the same day. The democrat Senator was going into the skiff who else did he tell about that FIS application? Crazy, folks. All right. Well, those people in California, and God bless you. I had a house burned down in one tall Long Island. I lived with my aunt it is the most horrifying experience of your life. You have. I know the Democrats object to saying we'll pray for you. I frankly, don't give a damn what they say about that. I will be praying for you. Because the power of prayer matters. It's not gonna fix a rebuild your house. But hopefully, you can have the strength by house burned down. Actually, I live with my aunt it was but everything I had burned with it. And I just want you to understand from someone who's been through this. I didn't even own much back. Then I was about I don't know nineteen or twenty when it happened. But you don't even know what you lost yet because the scar of it goes on for a very long time. There were it was about a year later. I remember saying to myself. Hey, you know, I need that. What was that? I needed to lock it that someone had given me, and it was like a little picture in there. I was so deeply moved by it just this is such a wonderful amazing country. And I just if we could all collectively say a prayer for the people in California. It's what they've lost everything and have someone who's been through it. You don't even it's horrible. It is it is a scar. That keeps on opening.
