What were rejected provisional ballots with several hundred valid votes, which means the entire vote count is now irreversibly corrupted and this past August, the judge ruled that Snipes systematically mishandled mail in absentee ballots, and in two thousand seventeen a judge also ruled that she illegally destroyed ballots from a primary following a primary race as the Debbie Wasserman Schultz case, and we have Broward County election results were posted online in two thousand sixteen before the polls closed and you go back to twenty twelve thousand uncounted absentee ballots. Mysteriously discuss. Covered in Broward County a week after the election. You can even go back to two thousand and four we're snipe simply just lost track of six thousand absentee ballots. How do you lose track of this? You know, this now how do you go from fifty seven thousand fifty seven thousand volt lead to where we are now around twelve thousand plus Jeb Bush who appointed Brenda Snipes says it's time for her to be removed from office Florida election, supervisor, you know, has this history. Oh, Broward County ballots were found in a Fort Lauderdale Renna car that was big news yesterday, and of course, Debbie Wasserman Schultz. So she was happy that those ballots were destroyed before the legal time that it was allowed to Waddell laws have been broken. We also have a case in Georgia gateway pundit reporting that in fact, eighty percent of new ballots that were discovered in the governor's race o of the five thousand five hundred sixty nine votes four thousand eight hundred and four. And what the legal remedy is what the crimes might be in this case now that it's an ongoing criminal investigation. Greg Jarrett, author of the number one bestseller the Russia hoax. And specifically if we now have this investigation ongoing, well, we know certain laws were violated, which I've been listening every day. Oh, they were Brenda Snipes is the Pitta me of grossing competence and recklessness. She managed to break just about every election law. You can think of she missed every statutory deadline. She was spanked by the judge for that. She mixed up. Valid ballots with invalid ones she suddenly magically discovered. Tens of thousands of ballots that inexplicably appeared out of nowhere. But here's the problem. Problem. Sean Florida laws you can break with impunity. He's election laws are for the most part civil violations. They have no teeth. Now, there are several election fraud statutes, three different Florida Department say so far they haven't seen fraud, but their investigation has been cursory at best. So as you point out, it is good that Pam Bondi. The attorney general has ordered a complete and thorough investigation to determine if crimes have been committed as Snipes capable of fraud. Absolutely several months ago judge determined she unlawfully destroyed ballot. That does not happen accidentally that is intentional and every election she's handled for the last sixteen years every one of them have been marred by her incompetence if not corruption David Joan your thoughts legally well legally. As a matter of policy in the whole situation is very very troubling these deadlines for certification or set for a reason, there's an important public interest in finality. It's true. Everybody in my deal world wants to see every eligible voters vote count. But there's a reason again that we set limits to this. These provisional ballots, for example in Georgia. They're twenty one thousand nine hundred provisional ballots ballots means people with this question about the eligibility. They voted in the wrong precinct or something like that. Judge in Georgia. Now has changed the certification deadline from this evening until Friday. I no one knows when it'd be able to count all those provisional ballots determine eligibility questions on all of them. But it's very very suspicious that this is coming up at the last minute in the Florida race, George Aretha was so hotly contested. And all of the question now is on one side of the ledger. Well, you know, the thing that we all have to look at here. There's sixty seven counties in Florida, Greg sixty five of the Florida counties all complied with the law, including every county in the panhandle of Florida that was absolutely ravaged by hurricane Michael just twenty seven days prior Broward, Palm Beach county. Well, they county officials continued to tally tens of thousands of votes that was in violation of state law and remember we've gone over all the different laws that are involved here. And you know within thirty minutes after the polls closed. The canvas the canvassing board and all of these counties Arte report early voting all tabulated voting by mail results to the department of state, thirty minutes. Well, that number changed six times and nearly eighty thousand plus votes added in the case of Broward County, fifteen thousand Palm Beach county, and we also know that well, the canvassing board expects every forty five minutes, they expect the vote count update until the results are completely reported that never happened we go. We will go a whole day, and we'd get a dump of tens of thousands of votes at three in the morning for crying out loud. I we are never going to get the truth of what this vote is. The question is is it going to be allowed to stand with the fact that sixty five counties easily complied with the law, but brenda's nights in Broward County and Susan butcher. In Palm Beach county could not suggests in in my judgment, more than incompetence that something is amiss here that may be fraud. What should happen here is that the judge in Broward County who determined that Snipes broke the law shoot hold her in contempt of court that would trigger a criminal penalty and not just a civil fine. Now hasn't happened. It should happen. David. How would it tell you in Broward County in particular? The reason the focus is on there. They'd had problem after problem is, you know, from gore Bush, but even in this most recent election, not just big racist. Standard election recently for a Broward County judge when everyone went to. Sleep that judge lost is the incumbent very controversial guys put in office by the union. But the next morning, they somehow found in their words seven hundred votes, and he won the election. You talk about the FOX guarding the henhouse. These are the local judges. Now, we're going to be called on about certification questions and things like that. There's something rot there. You see this goes back so many years, and you just it it it boggles the mind to know that with this history. I mean, we are talking really about just malfeasance on a massive level here. And we'll find out about the law. The why this person is still in that position is unbelievable to me. Let me switch topics to both of you. And I know there's been a firestorm over the fact that Matthew Whitaker has been tapped to at least temporarily fill the void with Jeff Sessions. Retiring or be at being asked to retire by the president and the media is going apoplectic, and Greg I went to you. I and I said, well, I'm I'm listening to all these so-called fake news, lawyers, and they're saying president didn't have the right to do this. And you sent me the federal of vacancies act five USC thirty three forty five. I'll let you explain it. It says the president can appoint a person holding a Senate confirmed office or and this is the important part, quote, an officer or employee of such executive agency who has served in a position in such an agency for not less than ninety days. So Whitaker easily meet that second legal standard. And so these legal commentators. I've been listening to on television. And some imprint are absolutely one hundred percent wrong. And I'll tell you. You why I know they're wrong. Spring court has issued a ruling on this subject in US versus eaten and it rejected the claim that only a principal officer confirmed by the Senate can temporarily fill the shoes of the head of a department. It said just the opposite. And then, of course, after that ruling vacancies reform act elaborated on it and laid out the two methods by which somebody can be selected language. You sent is clear. It is unambiguous and I'm thinking, right? These guys are supposed to be lawyers. And and yet they clearly don't know or care about what the actual law says David I would assume you probably agree with Greg on this. Yeah. That's sections thirty three forty five eighty three that is clear. Look, they're drawing. There is a conventional wisdom about this. You had to have been a person previously confirmed by the Senate, they draw on a dissenting opinion. Just wrote in the case was completely dicta in the case. But listen to this. There's a motion filed now by the Torney general of Maryland demanding the rod Rosenstein, actually, put in a position Whitaker be stripped of it. And he's relying on the success of succession statute for the Justice department. Just been overridden by an executive order and by this day can see reforms act which accord is also ruled is the later enacted statute, and therefore that controls, but can you imagine we've talked before about separation of powers concerns, and all that the attorney general of Maryland wants to be able to dictate the rod Rosenstein, and nobody else has the hypocrisy. Rod Rosenstein has been conflicted from the gecko recommending the firing of Komi signing the fourth Fiso warrant application. He would be a witness and yet he is in charge of Muller investigation. None of the people that are out there complaining about so-called conflicts because Matthew Whitaker apparently thought and rightly so in my opinion, strong opinion that in fact Muller has exceeded his statutory. Mandate by going way too far. I mean, look what the news is today. All right. So we expect drone Corsi controversial figure granted he also served his country. And he says he expects to be indicted over lying to the two investigators. And I want to ask you both about that..

But if it happened it would be unprecedented the governor's race while in a recount is very unlikely to change with a three thousand vote margin. To make sure every vote is counted and perhaps auditioning for his next act. I'm simply here to say that for the votes that had been cast. They ought to be county. So that's one seat that will be a democratic seat to after all, and that leaves us, of course with with the Georgia governor's race. Right. Yes. In the hands of Brian camp right now, it is outside of the margin necessary for an automatic recount, and Brian is moving forward with his transition plans. And it's really again, just shameful that you have the democrat candidate Abrahams who refuses to concede after you've got now here five days after the election. It was originally called shortly thereafter, the margin is outside of that window for a recount, but they're still doing everything they can just try to scrape and find votes that may that don't exist. It just shows much like what we saw back in two thousand sixteen as much as you have, you know, Debbie Wasserman Schultz out there who Rick day primary for Hillary Clinton when she was DNC chair to now she's claiming about, you know, the president not wanting votes counted and things like that. This is a this is a party rejected the twenty sixteen presidential election outcome, they want it just throw it sale with all the Russians fault. But now here they want to believe. That there's no corruption and shenanigans going on in in Florida, and in some cases, Georgia's well, do we have any idea when this vote count is going to be over in Florida? And I think Thursday is the official deadline, but haven't we already heard from Broward County that no it won't be ready by then. Yeah. Again, it's like every time there is a deadline set whether it was on election night, whether it's under court order, you have the Broward County executive that just keeps pushing it back saying, they don't they aren't gonna meet the deadline. I was very encouraged today. Judge in Florida ordered the Broward County sheriff's office to basically stationed deputies in the Broward County election areas that do not report to the supervisor. So that they report directly. Outside. So we have some sort of independent verification that there's no illegal activity or improper activity taking place because up until now the only people that were watching security where people who were reported directly to that election supervisor. And I think the history shows that we just can't trust that done fairly Mark laudner. You think that the state is going to have to take a look at it? What is the the federal role here? Obviously the president's very concerned, obviously, you are keeping an eye on this. I understand that there's an army of lawyers that are standing by. Florida election races, the the lawyer full employment act of twenty eight gene. But what's what's next? However, this turns out there are a lot of lawsuits that have been filed will there be efforts at prosecution of what would be the game plan here. Well, there could be and obviously if a judge decides that the supervisor defied a court order, they could hold them in contempt and and take punitive actions against the original question, and this has always been a delicate balancing, and I'll tell you most of my public career has been spent in state and local government prior to joining the president and the vice president in twenty sixteen elections are run by the states, and they are very protective of their state bunch in in running elections across the nation, and while the federal government, they always want money, and we do offer partnership on cybersecurity and other technical kind of security measures. The state are very are very vocal in they run their own elections. And they don't want the federal government to take them over. But I'll tell you we keep seeing, you know, issues like what we see coming up here in Florida, and Georgia and other places where you've seen pockets of problems.
